I am translating a judicial document issued by a court from Hong Kog
In the High Court of the Hong Kong Special Administrative Region Court of First Instance Criminal Case No. xxxx HKSAR v. xxxxx *****CHARGE COMMITTED FOR SENTENCE***** Statement of Offence Traffiking in a dangerous drug..... Particulars of Offence
Cuando hablo de sentencia (en español) me refiero a la resolución judicial, que puede ser absolutoria o condenatoria. Y cuando hablo de condena, hago referencia a la invidualización de la pena.
Entonces este documento viene entre la condena y la sentencia, ¿no? ¿O es posterior a la sentencia?
Parece que:
A) Se declara culpable y es condenado por el delito X B) El fiscal manda este documento "Charge Committed for Sentence" al órgano sentenciador C) El órgano sentenciador pone la sentencia
Sí, Alvaro, me parece que encaja. There is a document that reads: Mr. xxxx on March 13 de xxxxx was convicted upon his guilty plea of the following charge: drug trafficking before xxxx, a magistrate sitting at xxxx Magistracy and was committed to the Court of First Instance.
Later, on March 24 the document named "Charge Commited for Sentence" is issued. This document describes: Statement of offence: drug trafficking .... (it mentions the Drugs Ordinance that has been violated) Below, the document describe the Particulars of the offence: this part describes how the person was found with drugs... Another document describes that in May the person was sentenced by the High Court to serve a period of xxxx year's imprinsonment.
Xd. Podría ser, sí. Pero es que no lo tengo nada claro. A lo mejor es un documento posterior que el fiscal envía al órgano sentenciador, o sea, al Court of First Instance. Esto es, tras declararse culpable, el magistrado envía el asunto al Court of First Instance para que ponga la sentencia y el fiscal presenta ante ese órgano un pliego de cargos o acusación. Si 678 está traduciendo todo el procedimiento, podrá ver como encaja todo esto.
(2) If the accused then pleads guilty the magistrate, before he accepts the plea shall-
(a) where the accused pleads guilty in proceedings under section 80C, require the prosecutor to outline to the accused, to the satisfaction of the magistrate, the alleged facts upon which the charge is based; (b) explain to the accused the offence with which he is charged and the ingredients which at law constitute such offence; and (c) record any statement made by the accused in pleading guilty to the charge and that the offence and the ingredients which at law constitute the offence were explained to the accused, and, if the magistrate is satisfied that the plea is made voluntarily and with an understanding of the nature of the charge, he shall commit the accused for sentence.
El acusado se declara culpable y entonces el juez requiere al fiscal una especie de pliego de cargos o resumen de la acusación. El fiscal la presenta y entonces el asunto queda visto para sentencia sin más trámite. Sentencia que no sé quien pone.
*Es lo único que se me ocurre. Llevo un rato mirándome el proceso penal en Hong Kong y esto es lo que podría tener sentido.
No estoy segura si es una sentencia. El nombre del documento es Charge Committed for Sentence. Luego establece la ley que tipifica el delito (en este caso tráfico de drogas) y luego describe cómo y donde sucedió el delito.

Coincido con Alvaro: si es una sentencia (condenatoria), "delito juzgado" me parece una muy buena opción.
