The couple doesn't show any preference regarding sex, skin colour or somatic traits differing from the European one's, and regarding nationality.
The couple has had the opportunity to deepen the problems regarding international adoption through friends of theirs who have adopted two Indian children and they would like to follow this line.
They state they have good knowledge of Indian culture, that they have been in India many times and will be happy to keep alive the child's links to his/her original culture.
Accomodation situation.
The couple lives in a high-class apartment in the residential area called Albaro. The apartment is owned by a cousin of the lady, let in use (they pay a symbolic rent of 400.000 italian liras per month) sine die.
The wife has received a proposal from her parents to go and live with them. They live in a villa which is owned by themselves, easy to section into two different parts, very spacious and situated in the park of Villa Carrara. Mr Corsi, however, prefers to mantain more independence.
Their apartment has a roomy entrance-living area, a studio, two large rooms and a bathroom.
The house is furnished with antique furniture heired from the lady's grand mother and it is well cared of and comfortable.
The couple has already thought about the new place for the incoming child which is quite appropriate.
Psychological profile
Mr Corsi seems an individual with good intelligence, with a tendency to be introverted and to defend his inner spaces.
Facing changes he seems to offer an initial resistance which permits himself a very accurate estimation of the problems.
When he is ready to manage a project he takes the burden with responsability and commitment.
For example, he recalls his first reservations about welcoming into his house the injured kitten that his wife wanted so much, and now it has become a pleasant and affectionate presence he takes care of.
Mr Corsi appears in contact with his emotional world and able to manage his emotions, though he needs a process of initial confidence. He also seems capable of perceiving the other's sentiments and to take his part of the burden.
Mrs Traversa seems an intelligent and creative individual still bearing the marks of a childhood slightly lacking of the affective attention she needed.
She seems to have the tendency to compensate her fragilities with friend relationships and a social commitment and she seems to have good empathic abilities.
Mrs Traversa seems to be prone to show very directly and loyally her emotions and to have a trustful but not ingenuous expectation with respect to the neighbour.
Within the relationship of the couple she constantly plays a propositive role and expresses her emotions which her husband checks and contains letting her, however, the necessary room for personal inclinations.
The couple, mostly as far as important decisions are concerned, seem to be able to openly face each other and to reach truly shared choices. The result is a sufficiently armonic couple relationship, permeable to changes and able to satisfy the important needs of both.
As a consequence of all this, the couple Corsi-Traversa seems suitable to play the delicate role of adoptive parents.

Object: report concerning the request for foster-care for international adoption presented by the married couple Corsi-Traversa.
With reference to the request of the above mentioned Court, dated 8th of September 2000, Reg. N.372/S/R.D, received at our office on the 19th of September 2000, the operators who have followed this case, social worker and psychologist, have completed the valuation procedure for the qualification of the couple for the adoption of a child. This has involved for the social worker: 2 individual interviews and one with the couple and for the psychologist: two individual interviews and one with the couple.
Moreover the two operators together have interviewed the couple and have visited the house.
The valuation has shown that the above mentioned couple seems suitable to play the delicate role of adoptive parents.
Information on the husband.
Mr Antonio Corsi was born in La Spezia on the19th of February 1957, he has a high school degree and is employed at the Ansaldo Trasporti, working from 8am to 4.30pm.
His mother Maria Luisa Alonge is a housekeeper.
His father Adolfo, deceased, was an employee.
He has a sister who's two years younger, she's married and has a seventeen years old daughter.
Mr Corsi spent his childhood, till he was eleven, in La Spezia, his parent's hometown.
He recalls this period as a peaceful one, within a united family expanded to gran parents, uncles and aunts, and moments of socialization in open spaces.
He has a nostalgic attachment to a more human way of life, far from the frantic needs of nowaday's society.
He recalls a good confidential relationship with his father, even though he was often away for work, and a deeper relationship with his mother, characterized, unfortunately, by a suffocating hyperprotection.
He thinks that in his role as a father he undoubtedly would tend to avoid such conditioning attitudes and would prefer encouraging autonomy and self-management.
Mr Corsi still today has the same friends he had in his childhood even tough, due to a different way of life, he meets them sporadically.
He tells us about a substantially positive scholastic period even though, in the beginning, he needed a period to accustom to the environment.
He describes himself as a 'little rascal', not used to accept the rules and always with a poor behaviour estimation from his teachers.
Mr Corsi has different interests originating from his artistic attitudes which he didn't develop through his studies also because they had a secondary importance for his parents.
In fact, he tells about his uncle who is a good painter but never turned it into a profession.
As far as the affective sphere is concerned, he asserts he has never had, before meeting his wife, important relationships, exept for one which lasted one year and ended because he didn't feel like turning the relationship into something more serious.
Information about the wife.
Mrs Vittoria Traversa was born in Genoa on the 30th of July, 1960, she has an artistic high school degree and works in a studio for accounting advices as a freelancer.
Her mother, Elisabetta Carrara, is a housewife.
Her father Franco, now retired, was an architectural engeneer and owned a building society.
The lady has four younger sisters:
Agnese, one year younger, is married and has two daughters;
Francesca, two years younger, is married and has two sons;
Giovanna, four years younger, is widow and has three sons;
Laura, six years younger, is married and has no sons.
The lady recalls her childhood within a large family, open to parents and several friends, a lot of noise and difficulty to have a private space.
She describes her mother as a very willing and concrete person, though not very affective.
She recalls that her way to show affection was through objects: a bar of chocolate inside the back-pack was her way of showing affection when she left for a scout-camp.
Her father was very busy working and was less present in the family, even though he represented a solid reference point and was able to manage impartially his numerous daughters.
The lady mantains that her parents have been substantially good parents and that they have given all they could, to take into account the context.
She describes her scholastic career as brilliant and the relationship between her and her teachers or persons of the same age as excellent.
She positively recalls her entrance into the boy-scout group, to which she is still, even though partially, linked.
The lady is largely accustomed to have a relationship with children and she loves very much social relations.
From an affective point of view sha has had, before marriage, a very important story which lasted six years and her partner interrupted.
Information about the couple
Husband and wife have met when they were very young, through a sister of hers, but their relationship started later on.
They seem very united and based on solid values they both share.
Their character aspects, apparently diverging, seem to find a mutual compensation.
The wife is very extroverted, she continuously proposes activities projected towards the exterior and changes inside the unit; the husband, more introverted and retired into himself, is capable of deepening and carefully thinking the problems, he has the role of filtering and checking his wife's stimulations.
The result seems to make possible choices which are shared and responsibly developped by both.
The married couple has a very good relation with their original families and solid friendship relations.
Reason for the adoption.
The reason for the adoption is a consequence of an ascertained infertility of the wife.
In fact, the lady has had three extrauterine pregnancies which have led the doctors to remove the only functioning tube for health reasons. Consequently she has undergone two attempts for assisted insemination which have failed.
The lady still shows pain while recalling these events and has the tendency to feel guilty for not giving her husband a natural paternity.
It seems, however, that she has already largely processed these losses and the decision to adopt a child doesn't seem a compensation but the result of a deep process within the couple.
Mr Corsi has shown a great sensibility in managing his wife's emotions and a real anxiety about the consequences, both from the organic point of view and from the mental one, deriving from the attempts of assisted insemination, refusing more operations even if they have the right to a third chance.
The child that the couple images at a fantastic level is a very small and healthy baby, to be followed through his evolution stages and to whom they could transmit all their affective, cultural and ethical heritage.
The lady is also willing to adopt two brothers, while the husband, in a more realistic way and with his habit to deepen the problems, states that in his mind there is room for just one child at the time and that he needs to know him/her very well, to test himself as a father and to find the right way to interact with him/her.

Having read the acts concerning the declaration of qualification presented on the 4th of August, 2000 through which the couple CORSI Antonio, born in La Spezia on the19th of February, 1957 and TRAVERSA Vittoria born in Genoa on the 30th of July, 1960, both living in Genoa, Via Livorno n.8/6, ask to be declared qualified for international adoption;
having heard the couple and seen the opinion of the Public Prosecutor for Minors;
having estimated the more articulated examination made by the proper Territorial Services;
considering that, from the documents and investigation in the deeds, the result is that the petitioning married couple has been united by marriage for more than three years and that not even a separation of fact exists between them;
having observed that, as far as the requisite regarding the difference of age between the adopting couple and the adoptee is concerned, it has to be in accordance with the laws in force at the moment the foster-care occurs;
considering that, as far as the requisite of qualification which is substancially the ability to adopt, the Council points out the following:
The couple expresses harmonious personality characteristics and an appropriate maturity;
both of them have a good health;
the couple lives an open and mainly complementary couple relationship, with an accomodating division of the duties;
the couple is part of a comfortable and quiet social context, essentially pivoting on the family;

he economic and accomodation situation of the couple is sufficient for the needs of a minor;
the couple expresses a multiple motivation for the adoption, shared by both and free from elements of compensating nature;
and that, as far as the characteristics of the minor the couple plans to adopt:
we believe that the minor's age could be the one prescribed by the law in force, without any particular indication or restriction as for his characteristics;
we believe that the minor should be in good psycho-physical condition;
and in the end that, as for the meeting between the couple and the minor is concerned, it shall occur according to the method and the timing decided by the authorized body along with the foreign authority.

Through the Centro Aiuti per l'Etiopia we have come into knowledge of a country we regret to know so little about, nevertheless we have liked immediatly the way it is committed and does its best to help its weaker people, and the attention it has towards their needs.

AND ITS EFFECTS ON CONCESSIONAIRES
GENERAL
The combined legislative framework composed of Law n∞ 30 of 27th February 1998 (establishment of the Italian International Register ) and Law n 856 of 5th December 1986 ( shipboard concessions ) amended and supplemented by Law n∞ 488 of 23td December 1999, has introduced a series of benefits for shipowners whose ships are listed in the International Register and for legal entitles contracted by the shipowner to perform commercial activities which are complementary to, ancillary to or in any way related to the principal activity on board cruise ships.
These benefits enable businesses to operate on the international market with vessels flying the Italian flag under conditions which are substantially equivalent to those of the main countries active in the cruise sector.
The most significant benefits are described below.
REDUCTION IN IRPEG . ( Company Tax )
The taxable income is equal to 20% of total income, which is equivalent to the application of a tax rate of 7.2 % ( 36 x 0.2 ) . ( See Enclosure A, Art.4 )

OPERATING CONDITIONS FOR CONCESSIONAIRES/CONTRACTORS______________
First of all, it is necessary to point out that ships listed in the International Register flying the Italian flag are considered to all intents and purposes to be part of ìItalian territoryî.
Consequently, concessionaires conducting any commercial activities which are ìcomplementary to, ancillary to or in any way related to the principal activity on board such cruise shipsî must have a permanent establishment in Italy.
Business relations between the concessionaires/contractors and the shipowner ( FESTIVAL CROCIERE SPA ) are to be regulated by a contract as per the provisions of Art. 17 of Law n∞ 856 of 5th December 1986, which states that . (ÖÖ)
The Minister of Transport and Shipping, as a departure from Article 316 and subsequent Articles of the Italian Maritime Law, may authorise the cruise owner of ships to entrust to domestic or foreign entitles which have an agent or representative in Italy, the performance of cabin services, galley services or general services as well as of any other commercial activity which is complementary to, ancillary to or in any way related to the principal activity on board.
These services are performed by the concessionaires using their own management and organisation and the personnel involved are not considered to be members of the crew although they are subject to the authority of the commanding officers on board as per Article 321 of the Italian Maritime Law.

3b) The services and activities as per paragraphs 1 and 2 above are subject to the provisions of
Articles 3 and 6 of Law n∞30 of 27th February 1998.
The amendments introduced by Budget Law n∞ 488 ( point 1 and 3 b ) of 23rd December 1999 have significantly expanded the possibilities for Italian shipowners wishing to outsource any complementary commercial activity. Such outsourcing will be regulated by specific agreements and it is widely held that, in practice, the existing contracts may be subject to some amendments in form only.
2. ISSUES RELATED TO VAT AND INDIRECT TAXATION
The listing of ships in the Italian International Register entails a series of fulfilments in relation to the application of VAT and other indirect taxes.
Besides the ordinary accounting required for the identification of the activity performed in Italy and the determination of the taxable amount, a specific accounting is required for VAT purposes.
Most sales of goods or services have to be witnesses by specific pre-numbered fiscal receipts whosy amounts have to be recapped daily in a pre-stamped register, other activities are subject to the issuance of an invoice and other minor activities just a recap of the daily amount cashed.

As is appears from the table, the higher tax burden deriving from the application of VAT will need to be examined for each activity in order to determine the portion of the additional burden that could be absorbed by passengers as well as the allocation of the remaining portion between the shipowner and the concessionaire/contractor,
Foreign entities operating in Italy through a permanent establishment are subject to Italian taxation on income produced in the Italian territory ( doing business in Italy ).
A permanent establishment is intended to mean ì permanent business premises from which the enterprise conducts all or part of its activity ì.
The business relations between the concessionaires/contractors and the shipowner meet both of these conditions, given that :
the activities of the concessionaires and contractors are performed on the ship, which is considered to be part of Italian territory as already mentioned ;
the activities of the concessionaires and contractors are performed by means of permanent establishment, i.e. there is a permanent site ( premises, material, facilities ) which is suitable for long-term use and is utilised to conduct business activity.
The permanent establishment is required to be set up in accordance with Italian law and in particular with administrative and taxation regulations.

GENERALE
La struttura legislativa congiunta composta dalla legge n. 30 del 27 febbraio 1998 (costituzione del Registro Internazionale Italiano) e dalla legge n 856 del 5 dicembre 1986 (concessioni di bordo) rettificata e integrata dalla legge n. 488 del 23 dicembre 1999, ha introdotto una serie di benefici in favore degli armatori le cui navi sono elencate nel Registro Internazionale e a favore di coloro che sono stati designati legalmente mediante contratto dall'armatore per svolgere attività commerciali che siano complementari, subordinate o in ogni modo in relazione con l'attività principale a bordo delle navi da crociera.
Questi benefici permettono di operare transazioni sul mercato internazionale con le imbarcazioni battenti bandiera italiana sotto le condizioni che siano sostanzialmente equivalenti a quelle dei principali paesi attivi nel settore delle crociere.
I principali benefici sono descritti qui di seguito.
RIDUZIONE IRPEG
Il reddito tassabile equivale al 20% del reddito totale, che è equivalente all'applicazione di un tasso del 7.2% (36x0,2). (Vedere allegato A, Art.4)
ESENZIONE IRAP
IMPIEGO DI PERSONALE EXTRACOMUNITARIO
E' possibile assumere personale non appartenente ai paesi dell'Unione Europea o che non risieda nell'Unione Europea, rinunciando ai requisiti della legislazione italiana sul lavoro. L'armatore ed altri concessionari a bordo hanno diritto ad un credito di tassa sull'IRPEG (Imposta sul Reddito delle Persone Giuridiche) equivalente all'IRPEF trattenuta sul reddito pagato agli impiegati e ai lavoratori autonomi. Questo credito di tassa è esentasse (vedere allegato A, art.4)
CONDIZIONI OPERATIVE PER I CONCESSIONARI/CONTRAENTI
Prima di tutto è necessario far presente che le navi elencate nel Registro Internazionale battenti bandiera italiana vengono considerate a tutti gli effetti e scopi come parte del territorio italiano.
Di conseguenza i concessionari che conducono una qualsiasi attività commerciale che sia complementare, subordinata o in ogni caso in relazione all'attività principale a bordo di detta nave da crociera, devono avere sede permanente in Italia.
1. CONDIZIONI CONTRATTUALI
Le relazioni d'affari tra i concessionari/contraenti e l'armatore (FESTIVAL CROCIERE SPA) devono essere regolate da un contratto come previsto dall'art.17 della Legge n.856 del 5 dicembre 1986 che dichiara ciò.
Il Ministero dei Trasporti e della Navigazione, secondo l'aricolo 316 e susseguenti della Legge Marittima sulla Navigazione, può autorizzare l'armatore di navi da crociera ad affidare ad entità locali o straniere, che abbiano un agente o un rappresentante in Italia, l'esecuzione dei servizi di cabina, dei servizi di cucina di bordo o servizi generici come pure ogni altra attività commerciale che sia complementare, subordinata o in ogni caso in relazione all'attività principale di bordo.
Questi servizi vengono forniti dai concessionari utilizzando la propria gestione e organizzazione e il personale coinvolto non è considerato come parte dell'equipaggio sebbene sia soggetto all'autorità degli ufficiali di comando di bordo come dettato nell'articolo 321 del Codice di Navigazione italiano.
3b) I servizi e le attività descritti nel paragrafo 1 e 2 sopra menzionati sono soggetti alle direttive degli art. 3 e 6 Legge n.30 del 27 febbraio 1998.
Gli emendamenti introdotti dalla legge Budget n.488 (punti 1 e 3b) del 23 dicembre 1999 hanno ampliato significativamente le possibilità per gli armatori italiani che volessero appaltare qualsiasi tipo di attività commerciale complementare. Tale appalto sarà regolato da accordi speciali e si ritiene largamente che, in pratica, i contratti esistenti possano essere soggetti ad alcune rettifiche solamente formali.
2. QUESTIONI RIGUARDANTI L'IVA E LE IMPOSTE INDIRETTE
La registrazione delle navi nel Registro Internazionale Italiano comporta una serie di adempimenti in relazione all'applicazione dell'IVA ed altre imposte indirette.
Oltre alla contabilità ordinaria richiesta per l'identificazione dell'attività svolta in Italia e la determinazione dell'ammontare tassabile, viene richiesta una contabilità specifica per l'IVA.
La maggior parte delle vendite di merce o servizi deve essere provata mediante specifiche ricevute fiscali prenumerate il cui ammontare deve essere ricapitolato giornalmente in un registro prebollato, altre attività sono soggette all'emissione di una fattura e altre attività minori necessitano solo di una ricapitolazione giornaliera dell'importo incassato.

Come appare dalla tabella, l'onere più alto d'imposta derivante dall'applicazione dell'IVA dovrà essere esaminato per ogni attività per poter determinare la porzione di onere addizionale che può essere assorbito dai passeggeri come pure la distribuzione della porzione rimanente tra l'armatore ed il concessionario/contraente.
STRUTTURA PERMANENTE
Le entità straniere che operano in Italia attraverso una struttura permanente sono soggette alla tassazione italiana sul reddito prodotto nel territorio italiano (operando affari in Italia).
Per struttura permanente si intende i locali di attività permanenti dai quali l'impresa conduce tutta o parte della sua attività.
Il rapporto di affari tra i concessionari/contraenti e l'armatore rispettano entrambe le condizioni poichè:
le attività dei concessionari e contraenti si svolgono sulla nave, che è considerata parte del territorio italiano come già menzionato;
le attività dei concessionari e contraenti sono svolte per mezzo di strutture permanenti, cioè vi è un sito permanente (locali, materiale, attrezzature) che è adeguato all'uso a lungo termine e viene utilizzato per condurre l'attività.
La struttura permanente deve essere allestita secondo la legge italiana e in particolare secondo i regolamenti amministrativi e di tassazione.

PRINCIPIO:
L'esterasi di colesterolo catalizza l'idrolisi degli esteri del colesterolo in colesterolo libero e acidi grassi. Il colesterolo libero viene poi ossidato in 4-colestene-3-one e in perossido di idrogeno in presenza di ossidasi del colesterolo. Il fenolo e la 4-amminoantipirina si combinano quindi con il perossido di idrogeno in presenza di perossidasi per produrre chinoneimina rossa. L'intensità del colore così prodotto è direttmente proporzionale alla concentrazione totale del campione.

Il campione con una concentrazione di colesterolo > 20,8 mmoli/l deve essere diluito in rapporto 1:3 con soluzione fi¬siologica (risultato x 3).
I valori dell'emoglobina fino a 2 g/l, della bilirubina fino a 85 µmoli/l, dei trigliceridi fino a 11 mmoli/l e delle proteine fino a 100 g/l non interferiscono nel test.
La concentrazione di acido ascorbico ≥50 mg/l, di metildopa ≥50 mgl, di 4-metilamminoantipirina ≥120 mg/l diminuisce i risultati.
La soluzione pronta all'uso non deve venire a contatto con pelle o mucose (i reagenti contengono fenolo).
La creatinchinasi (CK) catalizza la fosforilazione di ADP in presenza di fosfato creatina per formare ATP e creatina. L'enzima ausiliario esochinasi (HK) catalizza la fosforilazione di glucosio per mezzo della formazione di ATP per produrre ADP e glucosio-6-fosfato (G-6P).
Il glucosio-6-fosfato viene ossidato in gluconato-6-fosfato con la contemporanea produzione di NADPH. Il tasso di formazione di NADPH, misurato a 340 nm, è direttamente proporzionale all'attività di CK nel campione di siero.

PREPARAZIONE DEI REAGENTI:

Ricostituire una fiala di reagente 2 con 2,5 ml di soluzione tampone (reagente 1). Il reagente ricostituito è stabile per 5 giorni se conservato da 2 oC a 8 oC.
3. Siero di controllo
Aprire una fiala di siero di controllo molto cautamente, evitando perdita di materiale, e ricostituire in 2 ml esatti di H2O. Chiudere con cautela la fiala, lasciarla riposare per 15 minuti, sciogliere il contenuto completamente roteando dolcemente la fiala. CK-MB è stabile nel siero per 5 giorni se conservato da 2 oC a 8 oC, o 2 giorni a 25 oC e 4 settimane a -20oC.
PROCEDIMENTO:
Prima di completare all'attività di CK-MB nel siero è necessario misurare l'attività totale di CK usando il metodo CK-NAC.

LINEARITA': L'anticorpo inibisce fino a 2000 U/l di CK-MM.
NOTE:
La soluzione 1 (soluzione tampone/glucosio) contiene azoturo di sodio come conservante. Evitare ingestione o contatto con pelle e mu¬cose.
I sieri emolitici non vanno usati per determinare l'attività di CK e CK-MB.
Misurando a 334 nm o 340 nm si ottiene una grande precisione.
Anche la variazione in assorbanza al minuto (ΔA/min.) può essere misurata e viene utilizzato quindi il mezzo di 5 misurazioni per il calcolo (risultato x 5) oppure le 5 misurazioni dovrebbero essere usate nel calcolo. I fattori usati diventeranno quindi:

Esiste un sistema di compensazione di assenze che utilizza lo straordinario autorizzato in ordine decrescente di percentuale con l’eccezione del festivo che dovrà essere scalato per ultimo. Dovrà essere retribuita SOLO la maggiorazione delle ore straordinarie utilizzate per la compensazione.
Priorità nell’utilizzo delle causali di straordinario per compensazione:
1. Straordinario notturno/domenicale (50%)
2. Straordinario feriale oltre le 8 hh settimanali (20%)
3. Straordinario feriale entro le 8 hh settimanali (15%)
4. Straordinario in festività (130%)
Durata dell’orario di lavoro
a) dipendenti full-time direttivi (Dirigenti/Quadri/1° livello)
Non sono soggetti a limitazioni dell’orario di lavoro
b) dipendenti full-time non direttivi (Livelli dal 2° al 7°)
40 ore settimanali con riduzione dell’orario a 38 ore medie ferma restando la decorrenza del lavoro straordinario dopo la 40^ ora.
c) dipendenti part-time :
- 16 ore settimanali, ridotte ad 8 ore per specifici casi (vedi part-time)
- 64 ore mensili
- 532 ore annue
- 8 ore settimanali per la giornata del Sabato nel caso di studenti e/o lavoratori occupati part-time a tempo indeterminato presso altro datore di lavoro (art. 42 nuovo CCNL)

E’ possibile incrementare temporaneamente l’orario di lavoro part-time per le seguenti causali:
• incremento e concentrazione del flusso di visitatori e/o delle vendite in negozio (aumento scontrino medio) durante il c.d. periodo natalizio (dicembre), durante il periodo in cui si manifestano gli effetti della distribuzione del Catalogo Generale (settembre e ottobre), e durante il periodo dei saldi (come da delibere delle P.A. competenti)
• partecipazione a Riunioni Organizzative (svolte in orari in cui non è prevista la presenza del lavoratore part-time), ad attività di formazione ed addestramento (considerata la differenza rispetto alla normale attività lavorativa di questi strumenti d’accrescimento della professionalità)
• attività necessarie all’avviamento di nuovi negozi - build-up (nei 2 mesi precedenti e nei 6 mesi successivi all’apertura ufficiale del negozio: inaugurazione/apertura al pubblico) e al rifacimento Ambienti ed al “Cambio Prezzi”.
Nel caso di assunzione a tempo indeterminato a 20 ore settimanali, priorità di passaggio a 20 ore settimanali per i part-time 16 ore
Nel caso di assunzione a tempo determinato a 20 ore settimanali, la priorità di incremento temporaneo a 20 ore settimanali per i part-time 16 ore.
A condizione che:
- ci sia parità di funzione, compiti e mansione
- il lavoratore sia disponibile a modificare i propri turni di lavoro in base alle esigenze aziendali
- si applichino i criteri oggettivi di priorità: anzianità della richiesta scritta e, a parità, anzianità di servizio e carichi familiari.
La durata media dell’orario di lavoro non può in ogni caso superare, per ogni periodo di 7 giorni, le 48 ore (comprese le ore di lavoro straordinario) con riferimento ad un periodo non superiore a 4 mesi.

Rinuncia da parte del lavoratore alle clausole flessibili ed elastiche
Il lavoratore part-time può rinunciare alle predette clausole nei seguenti casi:
- esigenze di tutela della salute
- comprovata instaurazione di altra attività
- esigenze personali
in questo caso non sarà più possibile variare né incrementare la collocazione temporale della prestazione concordata in fase di assunzione
Turni di lavoro
La durata giornaliera dell’orario di lavoro può essere fissata in turni di 8/6/5/4 ore; è possibile prevedere turni di lavoro, in regime di orario ordinario, che eccedano le 8 ore nel rispetto delle norme sulle pause e sui riposi.
La distribuzione settimanale dell’orario può essere ripartita sino ad un massimo di sei giorni settimanali, nel rispetto delle norme sul riposo settimanale.
Riposi giornalieri
I riposi giornalieri non possono essere inferiori alle UNDICI ORE CONSECUTIVE

Dal 2° al 6 livello tutte le entrate e le uscite devono essere timbrate .
I 1 livelli , Quadri e Dirigenti , timbreranno solo l’entrata principale in Azienda . Nel caso di lavoro festivo o notturno sono previste quattro timbrature in quanto su queste ore è prevista la corresponsione di una maggiorazione.
Ogni dipendente part time ha un suo specifico orario di lavoro. Spesso, con l’accordo del dipendente, viene cambiato il singolo turno di lavoro. Il cambiamento deve essere certificato da un giustificativo firmato dal dipendente.
L’intervallo mensa non è retribuito.
Riduzione orario di lavoro
Per effetto della Riduzione dell’orario di lavoro (38 hh settimanali per i dipendenti del Terziario) , I dipendenti full time che non sono di livello Quadro e 1° svolgono hanno un orario di 40 ore settimanali (il lavoro straordinario si considera dopo la 40^ ora di lavoro). Tuttavia la pianificazione dei turni dovrà prevedere un orario medio di 38 ore in quanto viene smaltito in modo pianificato il monte ore di permessi annui. Le 38 ore settimanali possono essere distribuite in vario modo: 2 ore fisse settimanali, 4 ore a settimane alterne (una settimana a 40 ore e quella successiva a 36) oppure 8 ore ogni quattro settimane (tre settimane a 40 ore e una settimana a 32 ore).
Per la collocazione della riduzione di orario ci sono regole diverse in ogni store che derivano da diversi accordi sindacali o da differenti esigenze nei diversi reparti.
Se la riduzione non viene effettuata (es. un dipendente che dovrebbe lavorare 38 ore ne lavora 42) le ore fino alla 40^ non sono da considerare straordinarie ma ore ordinarie sulle quali spetta la maggiorazione del 15%.
Quindi si avrà la seguente contabilizzazione della prestazione:
38 ore di lavoro ordinario
2 ore di lavoro ordinario maggiorato del 15%
2 ore di lavoro straordinario maggiorato del 15% (solo questa voce rientra nel monte ore straordinario)
Lavoro notturno
Costituisce lavoro notturno ogni prestazione lavorativa svolta nel “periodo notturno”, individuato come quello di almeno 7 ore consecutive comprendenti l’intervallo tra mezzanotte e le cinque del mattino
E’ vietato adibire a lavoro notturno dalle ore 24 alle ore 6 per le donne nel periodo che va dal momento dell’accertamento dello stato di gravidanza fino al compimento di un anno del bambino.
Giorni previdenza dirigenti
Per il personale avente qualifica dirigente, vengono contabilizzati 30 gg di presenza teorici. Se il dipendente è stato assunto o è cessato nel mese di elaborazione, vengono sottratti i giorni non lavorati .
Integrazione festività
Trattamento valido nei giorni da lunedì a sabato se la festività cade in un periodo di assenza dal lavoro per maternità obbligatoria, malattia o infortunio.
Il lavoratore ha diritto ad un’indennità integrativa di quella a carico dell’INPS e dell’INAIL , da corrispondersi a carico del datore di lavoro, in modo da raggiungere complessivamente il 100% della retribuzione di fatto.

Al dipendente deve essere trasmesso il dato delle ferie maturate considerando la spettanza per l’intero anno in relazione alla % part-time contrattualmente prevista. Per il calcolo deve essere tenuto presente se il dipendente è presente o se è assente se questa assenza fa maturare o meno il diritto alla maturazione delle ferie sino alla scadenza del periodo previsto di assenza.
Ogni mese va ricalcolata la spettanza nel caso il dipendente abbia subito una variazione di %pt.
Se un lavoratore viene assunto dal giorno 1 al giorno 15 del mese ha diritto al rateo di ferie per quel mese , se assunto dopo non ha diritto.
Se un lavoratore cessa dal giorno 1 al 14 del mese non ha diritto al rateo di ferie per quel mese, se cessa dopo ha diritto.
Per i lavoratori in MATERNITA’ FACOLTATIVA, ASPETTATIVA NON RETRIBUITA SERVIZIO MILITARE , il diritto di spettanza del rateo ferie segue la stessa logica del dipendente assunto o cessato nel mese.

I lavoratori hanno l’obbligo di rispettare l’orario di lavoro, non sono ammessi ritardi rispetto all'inizio dell'orario di lavoro né uscite anticipate rispetto al termine del lavoro.
Nei confronti dei ritardatari e dei dipendenti che anticipano l'uscita sarà operata un trattenuta in busta paga di un importo pari alla mancata prestazione; i minuti di mancata prestazione verranno sommati nel mese ed arrotondati al quarto d'ora superiore.
Il ritardo non potrà essere recuperato in uscita, salvo espressa autorizzazione preventiva del responsabile.
Il ritardo entro i 15’ dal termine della fascia di flessibilità va giustificato automaticamente con una causale di “RITARDO LIEVE”. Il ritardo entro i 30’ dovrà essere giustificato automaticamente con una causale di “RITARDO GRAVE”. Decorso tale termine scatterà la gestione standard delle assenze. Inizialmente prevedere di NON effettuare alcuna trattenuta in caso di ritardi.
Arrotondamenti presenze/assenze
Le causali di assenza dovranno sempre essere arrotondate ai 30’.
Dovrà essere arrotondata la durata della causale e non i suoi estremi.
Congedo matrimoniale
Prevedere l’emissione di una segnalazione di errore nel caso di superamento dei 15 gg di calendario per congedo matrimoniale.
Ore lavorate
Per ore lavorate intendiamo il totale delle ore come da timbratura ore di missione non timbrate .
E’ necessario poter gestire queste ore su più cdc del negozio di appartenenza del dipendente o , se il dipendente presta ore ad altri negozi , anche su cdc di negozi diversi.
Queste ore devono comparire sui report di seguito elencati e devono essere progressivate per anno fiscale (il nostro anno fiscale va da settembre ad agosto).
Il cdc può essere individuato dal file delle timbrature in base al terminale orologio dal quale proviene la timbratura.
(Avremo un terminale orologio in ogni reparto del negozio????).

Ogni reparto (o CDC) può suddividersi in più aree (sottocdc).
E’ necessario poter disporre di questo dato nell’anagrafica.
Translation - English Overtime work with retrieval
There is a counterbalancing system for absences which exploits the authorized overtime work in a decreasing percentage order with the exception of festivity work which will have to be deducted in the end. ONLY the increase in overtime work hours used for counterbalance will have to be paid.
Priority in the use of overtime work for counterbalancing:
1. Night/Sunday overtime work (50%)
2. Overtime working days exceeding 8 hrs per week (20%)
3. Overtime working days within 8 hrs per week (15%)
4. Festivity overtime work (130%)
Working time length
a) executive full-time employees (Managers/Executives/1st Level)
They are not subject to limits in their working timetable
b) non executive full-time employees (from 2nd to 7th level)
40 hours per week with a reduction in the working time to 38 average hours being established that overtime work starts after the 40th hour
c) part-time employees
64 hours per month
532 hours per year
8 hours per week for Saturdays in case of students and/or part-time workers employed with a non temporary contract by another employer (art. n.42 new CCNL- National Workers Contract)
8 hours per week for days different from Saturdays, when agreed among the Business Administration representatives, OO.SS (Trade Union Organizations) and RSA/RSU for every single store.
It is possible to temporarily increase the part-time working hours for the following causes
• increase and concentration in the visitors flow and/or in the store sales (average voucher increase) during the so called Christmas time (December), during the period in which the effects of the distribution of the General Catalogue occur (September and October), and during sales period (as per resolutions decided by the qualified Public Authorities)
• participation in Organization Meetings (during hours where the attendance of the part-time worker is not provided for), in training activities
(considering the difference of these increasing professionalism instruments in comparison with the regular working activity)
• activities necessary to the starting-up of new stores – build-up (during the two following months and the 6 months before the official opening of the store: opening event, opening to the visitors), to the restyling of areas…………and to “Prices Updating”.
In case of non temporary employement with 20 hours weekly, the priority to switch to 20 hours per week for 16 hours part-time workers.

Provided that:
- there is equality in function, duties and tasks
- the worker is ready to modify his or her working shifts according to the business needs
- priority objective criteria are enforced: age of written application and, if equal, seniority and family dependants.
The average length of working time cannot in any case exceed, for every 7 days period, 48 hours (hours of overtime work included) in reference to a period not exceeding 4 months.
Flexible and elastic clauses for part-time employees
Flexible clauses
They allow to shift the time of the work to be done, upon a two working days notice – the worker has the right to an increased pay per hour.
Elastic clauses
They allow an increasing variation of the work done, upon a two working days notice – the worker has the right to an increased pay per hour.
Increases in pay regarding flexible and elastic clauses
PER HOUR
1,5% of the regular pay given for only ordinary hours of variation in working timetable 35% for ordinary hours worked in application to elastic clauses
FORFAIT
As an alternative to the increased pay per hour, an annual forfait indemnity among worker and employer may be agreed, and it has to be not less than 120 Euro pretax, to be paid by monthly shares.In such case the increase will be 35% instead of 36,5%
Renunciation by the worker to flexible and elastic clauses
Part-time workers may renounce to the above mentioned clauses in the following cases:
- health problems
- prooved establishment of another activity
- private needs
in such case the variation or increase in working time agreed during the engagement phase will not be possible any more
Working shifts
The daily length of working time can be fixed in 8/6/5/4 hours shifts; it is possible to provide for working shifts, under an ordinary working time regime, that exceed 8 hours, respecting rules on breaks and days off.
The weekly distribution of working time can be divided up to a maximum of six days per week, respecting rules on week rest.
Daily rests
Daily rests cannot be less than ELEVEN CONSECUTIVE HOURS
(EVERY 24 HOURS)
Weekly day off
- Cannot be given up
- Interval: every seven days = no more than six consecutive working days
- Length: 24 consecutive hours from midnight to midnight to be cumulated with the 11 hours of daily rest.
- Sundays coinciding with festivities: right to the payement of an additional day
- Weekly day off coinciding with festivities: in case of work done the hours worked must be considered as overtime or extra work.
Breaks
- They are settled through an agreement with the responsible person
- They cannot be extended without a reason
- They can’t be derogated
LENGTH OF TIME:
• IKEA acknowledges 15 paid minutes included in the working hours which absorb the 10 minutes break provided by law for people working more than 6 hours per day
• Usually 60 minutes per day for full-time employees included the days of ROL
• Usually 30 minutes per day for part-time employees working up to 6hrs per day
Flexible working timetable
For employees of Property, ServiceOffice and for some store tasks the flexibility for entering time and lunch break is possible.

Starting from the 2nd level all ins and outs must be punched.
1st levels, Executives and Managers will only punch their main entrance into the firm. In case of holiday or nighttime work four punches are necessary as a higher payement is calculated on these hours.
Every part-time worker has his own specific working timetable. Often, in agreement with the employee, the single working shift is changed. This change must be certified by a voucher signed by the employee.
Lunch break is not paid.
Reduction in working hours
As an effect due to the Reduction in working hours (38hrs per week for Tertiary employees), full-time employees who do not pertain to 1st level and Executive, have a timetable of 40 hours per week (overtime work is considered after the 40th worked hour). Anyhow, planning of shifts will have to provide an average working time of 38 hours as the cumulated hours of annual leaves are discharged in a planned way. The 38 hours per week can be distributed in different ways: 2 fixed hours per week, 4 hours in alternate weeks (one week at 40 hours and the next one at 36) or 8 hours every four weeks (three weeks at 40 hours and one at 32).
To arrange the reduction in working time there are different rules for every store deriving from different union agreements or from different needs in the various departments.
If the reduction is not respected (for ex an employee who should work for 38 hours effectively works for 42) the hours worked up to the 40th are not to be considered overtime work but ordinary hours on which an increased pay of 15% is due.
So there will be the following calculation of the work done:
38 hours of ordinary work
2 hours of ordinary work increased by 15%
2 hours of overtime work increased by 15% (only this item is included in the cumulated overtime work hours)
Nighttime work
It is nighttime work any work done during the “nighttime period”, determined as the period of at least 7 consecutive hours including the interval between midnight and five a.m.
It is forbidden to assign to nighttime work from 24 to 6 to whomen during the period going from the moment of the statement of pregnancy to when the baby will be one year old.
Previdence days for managers
For employees at managerial level, 30 days of theoretic attendance are calculated. If the manager has been employed or has left in the month of processing, the days he has not worked are deducted.
Festivity supplement
This supplement is valid for the days from Monday to Saturday if the festivity falls in a period of absence from work for compulsory maternity, desease or accident.
The worker has the right to a compensation which integrates the one charged to INPS (National Institute for Social Pensions) and INAIL (National Institute for Insurance on Work Accidents), to be paid by the employer, so to reach totally 100% of the real pay.
Holidays
Holidays due to employees and executives 176hrs per year proportioned to the % of part-time
Holidays due to managers 232hrs per year
Period of maturation: Genuary-December
The data about matured holidays have to be transmitted to the employee, taking into account what is due for the whole year in relation to the part-time % provided by contract. To make the calculation it is necessary to consider wether the employee is at work and if he is absent it has to be considered wether this absence causes or not the right to mature holidays up to the expiration of the provided period of absence
Every month, , in case the employee has undergone a variation in part-time%, the due amount has to be calculated.
Should a worker be employed from the 1st to the 15th day of the month, he has the right to the share of holidays for that month, if employed afterwards he has no such right.
Should a worker stop working from the 1st to the 14th day of the month, he has no right to the share of holidays for that month; stopping afterwards he does have the right.
The right to mature the share of holidays for OPTIONAL MATERNITY, NOT PAID LEAVE OF ABSENCE, MILITARY SERVICE employees, follows the same logic of the worker who has been employed or has stopped working in the month.

In the method of unloading holidays it is necessary to first act on the previous year residual holidays and then on those of the present year.
Holidays are:
- compulsory
- may be enjoyed in any period of the year, service needs permitting.
- are planned in a department holiday chart
- are temporarily stopped by certified disease according to what prescribed by the laws in force
- are extended in case of festivity
The period of compulsory holidays has to be enjoyed
- for two weeks minimum, in the year of maturation, if required by the employee, and they must be consecutive weeks.
- for the remaining two weeks , within the 18 months following the year of maturation.
Paid Leaves
Leaves due to full-time employees: 32hrs per year
Leaves due to employees, pt, executives and 1st level 104hrs per year reproportioned to the part time %

Delays
Workers have the duty to comply with the working timetable, delays and early exiting with respect to the starting and ending working times are not accepted
With regard to late-comers and employees who get out early a deduction from their pay will be made equal to the amount of non-activity; the minutes of non-activity in the month will be added up and rounded off to the higher quarter of an hour.
The delay cannot be retrieved by exiting later, except in case of explicit anticipated authorization by a responsible.
The delay within 15’ from the end of the flexibility time must be automatically justified with the motivation “LIGHT DELAY”.The delay within 30’ must be automatically justified with the motivation “SERIOUS DELAY”. After such limit the standard absence management will become effective. At the beginning provide NOT to make any deduction in case of delay.
Attendances/absences rounding offs
Causes of absence must always be rounded off to 30’.
It will be necessary to round off the length of motivation and not its details.
Marriage leave
Provide for an error warning in case of exceeding the 15 calendar days for marriage leave.
Hours worked
Worked hours are meant to be the total amount of hours resulting from punching not punched assignment hours.
It is necessary to be able to manage these hours on the various cdc of the store where the employee works for or even on cdc of different stores, if the employee lends hours of work to other stores.
These hours must appear on the report listed below and must be in progressive fiscal year order (our fiscal year goes from September to August).
The cdc can be spotted by the punching file according to the clock terminal from which the punching derives.
(We will have a clock terminal in every compartment of the store????).
Subcdc
Every compartment (or CDC) may be divided into more areas (subcdc).
It is necessary to have this data included into the private record.

Sarà necessario definire i dati che devono essere contenuti nell’anagrafica e come questa si deve interfacciare con gli altri sistemi esistenti.
Attualmente disponiamo di un sistema informativo per la selezione (Brassering). Sarebbe opportuno acquisire i dati già disponibili in questo sistema.
I dati anagrafici dovranno poter generare il contratto di lavoro (collegamento con sistema Editor) ed essere importati nel sistema CDS (banca dati globale Ikea mondo).
Il sistema dovrà gestire la tenuta dello scadenziario collegato alle presenze (es. periodo di prova calcolato in base al livello contrattuale ed alle giornate lavorate – limite massimo di giornate di assenza per malattia ed infortunio – scadenza del contratto di lavoro – rispetto delle ore di formazione per i contratti per i quali ne è previsto l’obbligo ecc.); se lo scadenziario non è gestito direttamente dal sistema si dovrà prevedere la trasmissione dei dati ad un diverso programma.
Per i giustificativi di assenza, oltre ai dati inseriti dai DH/GL/CW si dovrà prevedere il collegamento con il sistema Travel .
I dati relativi alle ore lavorate ed alla composizione dell’organico, assenteismo ecc. dovranno essere acquisiti direttamente dal controlling per l’emissione del report P

SYSTEMS TO BE INTERFACED WITH THE ATTENDANCE RECORDER
It will be necessary to fix the data which have to be enclosed in the private record and how this has to be interfaced to the other existing systems.
Currently we have an informative system for selection (Brassering). It would be convenient to acquire the existing data from this system
Private data will have to be able to generate the working contract (link to the system Editor) and to be imported in the system CDS (global data bank Ikea worldwide)
The system will have to manage the due register linked to the attendance recorder (for example: probation period calculated on the basis of the contract level and the days worked – maximum limit of days of absence due to accident or disease – working contract expiration – observance of training hours for contracts which provide for compulsory training, etc). If the due register isn’t directly managed by the system it will be necessary to provide the data transmission to a different program.
As far as the absence documents are concerned, besides the data fed by DH/GL/CW, it will be necessary to provide the link to the system Travel
