Source text - Russian Это определение отражает европейский подход к арбитрабильности в противоположность американскому, который включает в нее установление двух обстоятельств: (1) наличие, действительность и исполнимость арбитражного соглашения и (2) отсутствие законодательного запрета на рассмотрение определенной категории споров в арбитраже за счет отнесения ее к исключительной компетенции государственных судов.
При этом ответ на вопрос о сущности арбитрабильности зачастую дается в зависимости от того, какой концепции природы самого арбитража придерживается тот или иной исследователь.
Так, классическая договорная теория арбитража исходила из того, что компетенция арбитров разрешать спор носит договорный характер и основывается на соглашении сторон передать разрешение спора на рассмотрение арбитража. Соответственно, поскольку арбитры не выполняют никаких публичных функций,
а являются агентами сторон, которые уполномочили их на вынесение решения, а само это решение основывается на автономии воли сторон и добровольности передачи возникающих между ними споров в арбитраж, то оно (это решение) и, как следствие, компетенция арбитража не могут быть подвержены никаким законодательным ограничениям и вообще никакому
вмешательству со стороны государства (за исключением действия оговорки о публичном порядке и связанных с ней норм об арбитрабильности споров) .
Translation - English This definition reflects the European approach to arbitrability, as opposed to the American one which considers it necessary to ascertain two circumstances: (1) presence, validity and enforceability of an arbitration agreement and (2) absence of a statute prohibiting arbitration of certain types of disputes by referring them to the exclusive competence of state courts.
However, the arbitrability is often defined in several ways, depending on which conceptual theory of arbitration the scholar adheres to.
Thus, the classical contractual theory suggests that an arbitrator’s authority to resolve a dispute has a consensual nature and is based on an agreement by the parties to submit a particular dispute to arbitration. Therefore, since arbitrators do not perform any public functions but are the agents designated by the parties to make an award, and since such an award depends on the parties’ will autonomy and voluntary agreement to submit the dispute to arbitration, it (the award) is not subject to any legal restraints or any intervention on the part of the state (except those under the ordre public clause and the related criteria for arbitrability of disputes).

Source text - Russian Согласовано, что независимо от других условий, исключений, положений и требований полиса или оговорок к нему период страхового покрытия должен быть продлен, чтобы включить испытания или тестовые нагрузки, но не более четырех недель от даты начала испытания.
Если, однако, часть производства или одной или нескольких машин проверены и / или пущены или приняты в эксплуатацию, страховое покрытие для этой отдельной части производства или машины, и любая ответственность, вытекающая из этого, прекращается, в то время как страховое покрытие продолжается для остающихся частей, к которым вышеупомянутое не применяется.
Далее согласовано, что для машин и установок, проходящих испытание, соответствующие исключения полиса не применяются и должно применяться следующее исключение:
- «утрата или повреждение из-за ошибок проектирования, дефектов материалов или исполнения, иные, чем дефекты монтажа;».
В случае подержанных предметов, страхование по этой оговорке должно, однако, прекратиться немедленно с начала испытания.
Translation - English It is agreed and understood that, notwithstanding the terms, exclusions, provisions and requirements contained in the Policy or endorsed thereon, this insurance shall be extended to include a test operation or a test loading but not beyond four weeks from the date of commencement of the test.
If, however, a part of production of one (or several) machine(s) is (are) tested and/or put into operation, the coverage for that particular part of the plant or machine(s) and any liability resulting therefrom shall cease whereas the coverage shall continue for the remaining parts to which the above does not apply.
It is further agreed and understood that, for the machinery and plants undergoing a test relevant exclusions of the Policy shall be inapplicable and the following exclusion shall apply instead:
- “loss or damage due to faulty design, defective material or bad workmanship other than faults in erection”.
In case of used items, the insurance hereunder shall, however, cease immediately on the commencement of the test.
