A travers leur action, l'usage qu'ils font du veto — les États-Unis n'ont pas hésité à l'utiliser pour empêcher de faire appliquer la décision de la Cour internationale de justice prise contre eux dans l'affaire ouverte par le Nicaragua —, les trémolos pacifistes sur fond de vente d'armes (notamment lors du conflit Iran-Irak), les arguties formalistes des exégèses, le Conseil de sécurité s'est taillé une puissance arbitraire.
Un bras de fer feutré s'engage peu à peu avec la Cour internationale de justice, seule instance à même de dénoncer, avec l'autorité nécessaire, les violations du droit maquillées en impuissance et d'affirmer que le Conseil de sécurité n'est pas un législateur et qu'il reste soumis à la légalité internationale.
Ce que nous pouvons faire, insiste Olivier Russbach, c'est « utiliser les moyens de droit interne pour faire dire le droit international ». Seul l'individu, regroupé en associations avec ses semblables, totalement concerné par toutes les atteintes à l'humanité, peut relever le défi. Translation - English Those responsible for the constant and sometimes gross breaches of existing laws are designated in this work as, essentially, the permanent members of the Security Council – in particular the United States, the United Kingdom and France. Through their actions, such as their use of the veto (which the United States did not hesitate to use in order to prevent the International Court of Justice from implementing the decision it had made against them in the case brought by Nicaragua), their claims of pacifism contrasted with their background in selling arms (notably during the Iran-Iraq conflict), and their formalistic quibbling over the drafting of texts, the Security Council has created for itself an arbitrary power.
The Council is also gradually engaging in a covert battle of wills with the International Court of Justice, which is the only institution with the necessary authority to denounce breaches of law masquerading as weakness, and to assert that the Council is not a legislator and that it therefore remains subject to international law.
What we can do, insists Olivier Russbach, is “utilise the means of national law to help shape international law.” Russbach himself sets an example with his direct experience, notably as the head of the association ‘Droit Contre Raison d’Etat’ (Law Versus Raison d’État*) which is active in cases involving the sale of arms. Only the individual, working together in organisations with like-minded people, and focussing totally on all threats to humanity, can take up the challenge. To fully assume individual responsibility and using the courts to ensure that national law delivers international protection of individuals - such is the novelty, but also the difficulty, of the task at hand. By asking ordinary citizens to implement democratic control of international decision, the author is calling out to all those with the desire to understand and to act.

Die in der Charta der Vereinten Nationen festgelegten Grundsätze wirken in zwei Richtungen. Auf der einen Seite bestimmen und begrenzen sie die Tätigkeit der Organisation und ihrer Organe. Auf der anderen Seite verpflichten sie die Mitglieder der Vereinten Nationen zu einem bestimmten Verhalten
2. Anerkennung individueller und kollektiver Selbstverteidigung als Grundrecht.
Die Sicherung des Friedens wird keineswegs als ein Monopol der Vereinten Nationen betrachtet. Ihre Schöpfer haben die Grenzen der Macht der Weltorganisation sehr wohl gesehen. Den einzelnen Staaten wird nicht nur das Recht zuerkannt, sich selbst allein oder im Kollektiv sofort gegen einen Angriff zu verteidigen (Art. 51), sondern es wird ihnen ausdrücklich gestattet, sich im Interesse der Bewahrung von Frieden und Sicherheit mit anderen Ländern zusammenzutun (Art. 52). – Solche Vorkehrung müssen jedoch mit den Zielen und Grundsätzen der Vereinten Nationen im Einklang stehen.
In der Praxis beziehen sich infolgedessen alle gegenwärtig bestehenden Regionalpakte auf die Charta der Vereinten Nationen und bekennen sich zu ihren Zielen.
3. Keine Eingriffe in innerstaatliche Angelegenheiten
Art. 2 Abs. 7 der Charta der Vereinten Nationen bestimmt, dass die Vereinten Nationen nicht berechtigt sind, in Angelegenheiten einzugreifen, die ihrem Wesen nach zu den innerstaatlichen Hoheitsaufgaben eines Staates gehören oder das Mitglied nötigen würden, sich in solchen Angelegenheiten einer Regelung im Sinne der Charta zu unterwerfen.
Diese Bestimmung verurteilt die Vereinten Nationen zur Untätigkeit insbesondere bei Verletzung der Menschenrechte in einzelnen Staaten. Die Vereinten Nationen, die die Menschen- und Freiheitsrechte fördern wollen und in einer „Allgemeinen Erklärung der Menschenrechte“ (10.12.48) ihre Vorstellung von diesen Grundrechten dargelegt haben, sind nicht in der Lage ihre Gewährleistung zu sichern, es sei denn, die Verletzung der Menschenrechte führte zur Bedrohung des Friedens. Aber selbst hier können sich die angeklagten Regierungen auf ihre Souveränität berufen, wie es z.B. im Falle der ungarischen Revolution von 1956 sowie während des Krieges in Algerien geschehen ist.
Die UN können die Menschenrechte einzelner Bürger nicht gegen ihre Regierungen verteidigen. Hinzu kommt, dass eine Reihe von Mitgliedern, insbesondere die totalitären Staaten, diese Menschenrechte permanent missachtet. Durch die Anwesenheit dieser Staaten in der Organisation wird die Ernsthaftigkeit der Zielsetzung der UN hinsichtlich der Menschenrechte fraglich, die Vertrauenswürdigkeit der UN beeinträchtigt.

The principles set down in the Charter of the United Nations have two functions. On the one hand they define and delimit the activity of the organisation and its subsidiary institutions; on the other, they commit the United Nations Member States to a specific type of conduct
2. Acknowledgement of the Fundamental Right to Individual and Collective Self-Defence
The United Nations is by no means considered to have a monopoly on maintaining peace. The organisation’s founders were clearly aware of the limits of its power. The member states are not only accorded the right of immediate individual or collective self-defence against an attack (art. 51), they are also expressly permitted to work together with other nations in the interests of maintaining peace and security (art. 52). Such arrangements must, however, be in keeping with the purposes and principles of the United Nations.
Consequently, all current regional agreements refer in practice to the UN Charter and declare their support for its objectives.
3. Non- Intervention in Domestic Matters
Article 2 paragraph 7 of the UN Charter states that the United Nations is not authorised to intervene in matters which, by their very nature, fall under the jurisdiction of a particular state, or in those which would require the Member State to submit in such matters to a settlement under the Charter.
This regulation condemns the United Nations to inaction, particularly where human rights violations in individual states are concerned. The United Nations seeks to promote freedom and human rights, and has even set forth its ideas regarding these fundamental rights in a ‘Universal Declaration of Human Rights’ (10/12/48); yet it is in no position to guarantee them, unless the human rights violation in question becomes a possible threat to peace. However, even in this situation the accused governments can still invoke their sovereignty, as in the case of the Hungarian Revolution of 1956 and the Algerian War of Independence.
The UN cannot defend the human rights of individual citizens against their own governments. These rights are, moreover, constantly being flouted by a number of Member States – the totalitarian states in particular. The presence of such countries within the organisation casts doubt upon the sincerity of the UN’s objectives regarding human rights and, in turn, upon its trustworthiness.
Expertise
