Przy dokonywaniu zakupów towarów i usług ze ¶rodków bezzwrotnej pomocy zagranicznej przysługuj± pewne ułatwienia podatkowe w obszarze podatku od towarów i usług (VAT). Na podstawie odpowiednich aktów prawnych zarówno beneficjenci programów pomocowych jak również jednostki wdrażaj±ce poszczególne programy mog± korzystać ze zwrotu podatku VAT lub zastosowania 0% stawki VAT.
Ponadto przy sprowadzaniu towarów z zagranicy tym samym instytucjom należy się zastosowanie zwolnienia z cła, a przy tym z podatku importowego oraz VAT-u.
W dalszej czę¶ci kolejno zostan± opisane podstawy prawne, uprawniaj±ce do korzystania z ułatwień, jak również procedury rejestracji umów na usługi oraz wydawania za¶wiadczeń do urzędów skarbowych i celnych. Rozporz±dzenie Ministra Finansów z dnia 22 marca 2002 r. (Dz.U. Nr 27 poz. 268) Rozdz. 8 stwierdza:
"za ¶rodki finansowe z pomocy zagranicznej uważa się, z uwzględnieniem ust. 4 i 5, bezzwrotne ¶rodki przekazane polskim podmiotom przez rz±dy państw obcych lub organizacje międzynarodowe udzielaj±ce pomocy na podstawie:
1) umów zawartych z Rz±dem Rzeczypospolitej Polskiej,
2) jednostronnych deklaracji rz±dów i organizacji międzynarodowych udzielaj±cych pomocy"

Certain tax facilitations concerning the Value Added Tax (VAT) apply to purchases of goods and services financed using non-returnable foreign aid resources. Based on the appropriate legal acts, both beneficiaries of aid programs and program implementation units may file for VAT tax return or apply the 0% VAT rate.
Moreover, when importing goods from abroad, the same institutions are entitled to exemption from duty, import tax as well as the VAT.
In the further part of this document, the respective legal foundations authorizing the use of tax facilitations will be described, as well as procedures of registering contracts of service and issuing certificates for fiscal and customs offices. Ordinance of the Finance Minister of March 22, 2002 (Dz.U. No. 27, item 268) Ch. 8 states:
"In view of points 4 and 5, financial resources from foreign aid are defined as non-returnable resources granted to Polish entities by governments of foreign states or international organizations providing help on the basis of:
1) Contracts concluded with the Government of the Republic of Poland,
2) Unilateral declarations of governments and international organizations providing aid” |
