Source text - Korean INCOTERMS는 국제상품 매매 계약에서 통상적으로 이용되고 있는 계약 정형 요건이다. 운송 수단의 주선과 비용, 인도, 위험의 부담과 기타 책임에 있어서 매도인과 매수인 각각의 역할을 정의하고 있다. 1936년 ICC에 의해서 INCOTERMS의 첫판이 나온 이래 거듭 개정되어 현재 INCOTERMS 2010이 사용되고 있다. 비록 INCOTERMS는 계약 규범이 아니나 계약에 적시되어 그 내용이 계약 참조사항이 되어 계약에 편입된다.
INCOTERMS 2010은 해상매매계약에서 위험이전이나 비용의 분기점으로서 선반의 난간을 기준으로 한 점에 대한 문제 발생, 물류터미널에서의 화물취급 비용 부담자에 대한 논란, 전자무역거래가 활발해짐에 따른 발전에 대한 대응의 필요성 증가, 9.11 테러 이후 수출입화물의 안전에 대한 관심증가 등 국제 무역환경의 변화를 반영하여 INCOTERMS2000을 개정한 것으로 2011년부터 시행한다.
INCOTERMS 2010의 주요 특징은 다음과 같다. 첫째, 해상운송 물품의 인도 장소(위험이전과 비용부담 등) 기준을 기존 선박의 난간에서 본선적재로 변경하였다. FOB, CFR, CIF조건에서는 매도인이 선박 내로 계약물품을 반입, 인도해야 하나 오늘날 컨테이너 운송이 보편화되어 계약 물품을 선박에 반입하기 전에 운송인에게 인도하는 관행과 FOB조건은 매도인이 적출항에 도착한 선박에 계약물품을 반입해야 하지만 실무상으로는 선박이 도착하기 전에 Cargo Terminal에 계약물품을 반입시키고 그 이후는 물품에 대한 아무런 통제권이나 권리를 행사할 수 없는 것이 현실에 비추어 과거 본선의 난간을 기준으로 하여 위험과 비용의 분기점을 정하는 것은 현실적으로 매우 불합리하였다. 따라서 컨테이너 운송에서와 같이 본선 적재 인도 방식을 현실적으로 적용하기 어려운 경우에는 FOB, CFR, CIF보다는 FCA, CPT, CIP를 사용하도록 권고하였다. 둘째, 당사자 간의 합의 또는 관습적인 경우에 전자 통신수단을 종이서류와 같은 서면 통신과 동일한 효력을 부여하였다. 셋째, 매매 당사자 사이에 보안과 관련된 의무와 터미널사용료를 명확히 할당하였다.
Translation - English INCOTERMS is a set of pre-defined commercial terms widely used in international commercial transactions. The terms define each roles of the seller and the buyer on arrangements and costs of transportation, delivery, liability for risks and other responsibilities. First published in 1936, it has been periodically updated; the latest version - INCOTERMS 2010. Though not a contract standard, one can incorporate the INCOTERMS 2010 rules into their contract as reference by making it clear in the contract.
INCOTERMS 2010, a revise of INCOTERMS 2000, reflects the changes in modern international transaction environment and is affective of 2011. INCOTERM 2010 addresses the issue of mentioning the ship’s rail as the point at which risk passes and costs are transferred, controversies on which party is liable for costs of handling freight at distribution terminals, rising necessities to react to the developments due to active electronic transaction, and escalating concerns on trade freight safety after the 911 terror attack.
The main features of the INCOTERMS 2010 rules are as follows; first, the point of delivery has changed to “on board” the vessel from the ship’s rail regarding transfer of risk and costs of sea and inland waterway transport goods.
When FOB, CFR, CIF are used, the seller should bring and deliver the contracted goods into the vessel. However, the rules mentioning the ship’s rail as the point at which risk and costs are transferred is unreasonable due to current realities of transaction for the following reasons; containers are generally used for freight transportation nowadays, goods are conventionally delivered to the carrier before brought into the vessel, under FOB the seller should bring the goods into the vessel at the shipment port in principle, but in practical business the goods are brought into the Cargo Terminal before the vessel arrives at the port of shipment and from then on the seller holds no rights or control over the goods.
Therefore, when it is practically difficult to use “on board” vessel as point of delivery in such cases of container transportation, it is recommended to use FCA, CPT, and CIP than FOB, CFR, CIF.
Second, electronic means of communication is given the same effects as paper communication, as long as the parties agree or where customary. Third, security-related obligations and terminal handling charges are clearly allocated among each parties of the contract.

Source text - English What follows are three distinct parts that can be read either independently or as a connected whole. Part 1 is about the purpose and importance of having principles in general, having nothing to do with mine. Part 2 explains my most fundamental life principles that apply to everything I do. Part 3 explains my management principles as they are being lived out at Bridgewater. Since my management principles are simply my most fundamental life principles applied to management, reading Part 2 will help you to better understand Part 3, but it’s not required—you can go directly to Part 3 to see what my management principles are and how Bridgewater has been run. One day I’d like to write a Part 4 on my investment principles. If you are looking to get the most bang for your buck (i.e., understanding for the effort), I suggest that you read Parts 1 and 2, and the beginning of Part 3 (through the Summary and Table of Principles) which will give you nearly the whole picture. It’s only about 55 pages of a normal size book.
Above all else, I want you to think for yourself—to decide 1) what you want, 2) what is true, and 3) what to do about it. I want you to do that in a clear-headed, thoughtful way, so that you get what you want. I wrote this book to help you do that. I am going to ask only two things of you—1) that you be open-minded and 2) that you honestly answer some questions about what you want, what is true, and what you want to do about it. If you do these things, I believe that you will get a lot out of this book. If you can’t do these things, you should reflect on why that is, because you probably have discovered one of your greatest impediments to getting what you want out of life.
Translation - Korean 이 책을 구성하고 있는 세 개의 장(Part)은 각각 독립적으로 읽거나, 혹은 전체적으로 연결해 읽으며 활용할 수 있다. 제 1장에서는 보편적 원칙의 목적과 그 중요성에 관한 내용을 서술하였다. 제 2장에서는 나의 모든 활동에 적용되는 나 자신의 기본적 원칙들을 서술하였으며 제 3장에서는 브리지워터社에 실질적으로 살아 숨쉬고 있는 경영원칙을 서술하였다. 내 기본적 원칙을 경영에 접목시킨 것이 경영원칙이기 때문에 제 2장을 먼저 읽는 것이 제 3장을 조금 더 수월하게 이해하는데 도움이 되겠지만 순차적으로 읽는 것이 필수는 아니며, 바로 제 3장을 통해 경영원칙과 브리지워터社의 운영 방식을 알아볼 수 있다. 향후 투자원칙에 대한 제 4장을 집필할 기회가 내게 주어지길 바라고 있다. 이 책을 통해 투자효과를 극대화할 방법을 찾고 있다면 (즉, 노력에 대한 이해) 보통 크기의 책자 55쪽 분량 정도인, 제 1장과 제 2장, 그리고 제 3장의 첫 부분 (원칙에 대한 요약문과 도표 활용)을 참고하여 전모(全貌)를 파악할 수 있을 것이다.
