ç) Tür¬ki¬ye Bi¬lim¬sel ve Tek¬no¬lo¬jik Araş¬tır¬ma Ku¬ru¬mu, ener¬ji ve¬rim¬li¬li¬ği¬nin ar¬tı¬rıl¬ma¬sı ile ye¬ni ve ye¬ni¬le¬ne¬bi¬lir ener¬ji kay¬nak¬la¬rın¬dan ya¬rar¬la¬nıl¬ma¬sı¬na yö¬ne¬lik araş¬tır¬ma ve ge¬liş¬tir¬me pro¬je¬le¬ri¬ni ön¬ce¬lik¬le des¬tek¬ler; bu pro¬je¬le¬rin yön¬len¬di¬ril¬me¬sin¬de ve de¬ğer¬len¬di¬ril¬me¬sin¬de Genel Mü¬dür¬lü¬ğün gö¬rü¬şü¬nü alır.

MAD¬DE 9- (1) Ener¬ji ve¬rim¬li¬li¬ği¬nin ar¬tı¬rıl¬ma¬sı ama¬cıy¬la aşa¬ğı¬da¬ki uy¬gu¬la¬ma¬lar gerçekleş¬ti¬ri¬lir:
a) En¬düs¬tri¬yel iş¬let¬me¬le¬rin mev¬cut sis¬tem¬le¬rin¬de ener¬ji ve¬rim¬li¬li¬ği¬nin ar¬tı¬rıl¬ma¬sı¬na yö¬ne¬lik ola¬rak ha¬zır¬la¬nan, Ku¬rul ta¬ra¬fın¬dan onay¬la¬nan ve as¬garî ya¬tı¬rım bü¬yük¬lük¬le¬ri Ba¬kan¬lar Ku¬ru¬lu ta¬ra¬fın¬dan be¬lir¬le¬nen mik¬ta¬rın üze¬rin¬de olan pro¬je¬ler ile kul¬lan¬dık¬la¬rı ya¬kıt tür¬le¬ri ve teknoloji¬le¬ri¬ne bağ¬lı ola¬rak Ba¬kan¬lık ta¬ra¬fın¬dan yü¬rür¬lü¬ğe ko¬nu¬la¬cak yö¬net¬me¬lik¬te ta¬nım¬la¬nan yıl¬lık or¬ta¬la¬ma ve¬rim de¬ğer¬le¬ri¬ni sağ¬la¬yan ko¬je¬ne¬ras¬yon ya¬tı¬rım¬la¬rı, Ha¬zi¬ne Müs¬te¬şar¬lı¬ğın¬ca ya¬tı¬rım teş¬vik¬le¬rin¬den ya¬rar¬lan¬dı¬rı¬lır.
MAD¬DE 17- 10/5/2005 tarihli ve 5346 sayılı Yenilenebilir Enerji Kaynaklarının Elektrik Enerjisi Üretimi Amaçlı Kullanımına İlişkin Kanunun 6 ncı maddesi aşağıdaki şekilde değiştirilmiştir.
“MADDE 6- Bu Kanun kapsamındaki yenilenebilir enerji kaynaklarından elektrik enerjisi üretim ve ticaretinde, lisans sahibi tüzel kişiler aşağıdaki uygulama esaslarına tâbidirler:
a) Perakende satış lisansı sahibi tüzel kişiler, bu Kanun kapsamındaki yenilenebilir enerji kaynaklarından elektrik enerjisi üreten YEK Belgeli tesislerin işletmede on yılını tamamlamamış olanlarından, bu maddede belirlenen esaslara göre elektrik enerjisi satın alırlar.
b) Bu Kanun kapsamındaki uygulamalardan yararlanabilecek YEK Belgeli elektrik enerjisi miktarına ilişkin bilgiler her yıl EPDK tarafından yayınlanır. Perakende satış lisansı sahibi tüzel kişilerin her biri, bir önceki takvim yılında sattıkları elektrik enerjisi miktarının ülkede sattıkları toplam elektrik enerjisi miktarına oranı kadar, YEK Belgeli elektrik enerjisinden satın alırlar.
c) Bu Kanun kapsamında satın alınacak elektrik enerjisi için uygulanacak fiyat; her yıl için, EPDK’nın belirlediği bir önceki yıla ait Türkiye ortalama elektrik toptan satış fiyatıdır. Ancak uygulanacak bu fiyat 5 Euro Cent/kWh karşılığı Türk Lirasından az, 5,5 Euro Cent /kWh karşılığı Türk Lirasından fazla olamaz. Ancak 5,5 Euro Cent /kWh sınırının üzerinde serbest piyasada satış imkânı bulan yenilenebilir enerji kaynaklarına dayalı lisans sahibi tüzel kişiler bu imkândan yararlanırlar.
Bu madde kapsamındaki uygulamalar 31/12/2011 tarihinden önce işletmeye giren tesisleri kapsar. Ancak Bakanlar Kurulu uygulamanın sona ereceği tarihi, 31/12/2009 tarihine kadar Resmî Gazetede yayımlanmak şartıyla en fazla 2 yıl süreyle uzatabilir.”

Chapter 4 Support and Other Practices
Support
Article 8 – The support of the implementation of the practice of Energy Efficiency, the practice of decreasing energy intensity and practices related to R&C projects are provided through the following methods and principles:
a) The projects for the implementation of energy efficiency are supported in accordance with the following principles:
1) Projects offered by industrial enterprises to the General Directorate (EIE) amounting up to 500 000 Turkish Lira and with repayment period of up to five years, up to 20% of the value of implemented projects will be supported if they are approved by the General Directorate and considered appropriate by the Committee ( Coordination Committee for Energy Efficiency).
2) The legal entities that support projects which increase energy efficiency, shall apply these projects in practice within two years. If they exceed this period or apply practices different than those in the projects, they are not supported. The implementation reports containing information and outlooks before and after the execution are sent to the General Directorate. The General Directorate executes on-the-spot control of the results of the application.
3) The methods and principles related to the support of the implementation of projects increasing energy efficiency will be coordinated with the Regulation that will be enforced by the Ministry (the Ministry of Energy and Natural Resources).
b) The following practices aimed at decreasing energy intensity will be executed:
1) Any industrial enterprise which takes an engagement to decrease its energy intensity by at least 10% within three years, makes a voluntary agreement with the General Directorate and fulfills the agreement, the industrial enterprise related to legal or physical entity, having in mind its payment ability and on condition that it does not exceed 100 000 Turkish Lira, will get 20 % compensation for the energy expenses related to the year of signing making the contract.
2) If legal or physical entities from industrial enterprises that fulfill their engagement within point1) of this paragraph increase their energy intensity in the following years, they cannot make an agreement with the General Directorate for a second time.
3) Legal or physical entities in industrial enterprises that make voluntary agreements and consume electric energy, cannot include in the energy intensity calculation the energy which is diverted into electric energy and heat through modern techniques for waste burning, the energy defined in article a) of the first paragraph of Article 9 and produced in co-generation facilities in the country or from sources such as hydro, water, geothermal, solar or biomass.
4) The changes in energy intensity of industrial enterprises which have more than one physical or legal entity in their structure and do not make a voluntary agreement are investigated by the General Directorate.
5) The eligibilities/characteristics s that will be sought in the industrial enterprise where a voluntary agreement will be made and the other principles that have to take place in the voluntary agreements, including the methods for calculating energy intensity and the coercive circumstances, will be defined by the Ministry with the Regulation that is to be enforced.
c) The support of projects implementing energy efficiency and the intention of applying the reduction of energy intensity will be included as the necessary allowances in the budget of the General Directorate. The allowances aimed and used for this support, the supported projects, the voluntary agreements, the industrial enterprises that decrease or increase energy intensity and education and awareness activities will be published on the website of the General Directorate.
d) The Turkish Institute for Scientific and Technological Research shall support with priority the R&D projects aimed at the utilization of increasing energy efficiency and new and renewable energy sources; in the monitoring and assessment of these projects is considered the opinion of the General Directorate.
Other Practices
Article 9 – (1) – The following practices shall be implemented with the aim of increasing energy efficiency:
a) The projects prepared to increase energy efficiency in the existing systems of industrial enterprises which are approved by the Committee and where the minimum investment costs exceed the extent defined by the Council of Ministers and the cogeneration investments which provide the annual average productive value described in a Regulation that is to be enforced by the Ministry and related to the type of fuel used and the technology are to benefit from the incentives of the Turkish Treasury.
Article 17 – Article 6 of Law No 5346 – the Law on the Utilization of Electric Energy Produced from Renewable Energy Sources adopted on 10/5/2005 was changed in the following way:
Article 6- in the production and trade of electric energy from Renewable Energy Sources within the range of this Law, legal entities- holders of licenses are subject to the following principles of implementation:
a) Legal entities holders of retail licenses and in the less than 10 years in operation of YEK-certified facilities producing electric energy from renewable energy sources, purchase electric energy in accordance with the principles defined in this article
b) The information about the quantity of YEK-certified electric energy that is to benefit from the practices within this Law will be announced by EPDK each year. Each of the legal entities holders of retail licenses can purchase YEK-certified energy up to the ratio between the quantity of electric energy that they have sold in the previous calendar year and the total electric energy they have sold in the country.
c) The price to be applied for the purchase of electric energy within this Law - it is the average for Turkey wholesale price for electricity applied to the previous year and defined by EPDK However, the price to be applied could not be less than the Turkish Lira equivalent of 5 Euro cent/kWh and more than the Turkish Lira equivalent of 5.5 Euro cent/kWh. If the legal entities holders of retail licenses based on renewable energy sources find a sale opportunity on the free market and the price is above the 5.5. Euro cent/kWh limit they can take advantage of that opportunity.
The practices in this article concern the facilities that will become operational before December 31, 2011. However the Council of Ministers can extend the date of expiration of the practice from December 31, 2011 by up to 2 years on condition that it is published in the Official Gazette.
