Excellencies, ladies and gentlemen,
Being a representative of the National Human Rights Institution of Germany I would like to say a few words about the Institution. The German Institute for Human Rights was founded in 2001 following an unanimous decision of the German Bundestag. It is publicly financed and politically independent. Its role is that of a critical observer of the human rights situation in Germany. As such we are engaged in an ongoing critical dialogue with the government.
In the following speech, I will outline some aspects related to the right to education, which the German Institute for Human Rights considers to be of essential importance. In this context, I will particularly highlight the right of free access to education and the right to education as an empowerment right. After that, I will describe the educational situation of unaccompanied refugee children and undocumented children in Germany in the context of the right of free access to education.
“Everyone has the right to education.” That’s what is stated in the United Nations’ Universal Declaration of Human Rights of 1948. In this declaration, the right to education was laid down for the first time in an international human rights document. In so doing, the declaration clearly states that the right to education as a universal human right shall be guaranteed to every person on an equal basis, that is, without discrimination. The declaration thereby marks an historical transition from the understanding of education as a privilege for a few to a fundamental right for all. Consequently, the prohibition of discrimination as a structural principle of all human rights also applies to the right to education. Accordingly, the right to education was linked to the principle of non-discrimination in all subsequent binding human rights conventions.
The right to education has been specified on the United Nations level in Article 13 of the International Covenant on Economic, Social and Cultural Rights (ICESCR) of 1966 and in Articles 28 and 29 of the Convention on the Rights of the Child (CRC) of 1989. Furthermore, the International Convention on the Elimination of All Forms of Racial Discrimination of 1965 and the Convention on the Elimination of All Forms of Discrimination Against Women of 1979 contain provisions on the right to education. On the European level, it is particularly worth mentioning the European Convention on Human Rights, to which an additional protocol exists, guaranteeing the right to education.
