Source text - English The situation in Kosovo, and the shared determination of NATO and
Russia to ensure the full implementation of UN Security Council Resolution
1244, remained high on the agenda of the Permanent Joint Council. It issued
firm warnings against acts of provocation or other attempts to undermine the
peace process in the region and took note of ever more converging views on
the situation in the Balkans.
At the PJC Ministerial meeting in December 2000, NATO and Russia reaffirmed
their commitment to build, within the framework of the PJC, a strong,
stable and equal partnership in the interest of security and stability in the Euro-
Atlantic area. Ministers exchanged letters on the establishment of a NATO
Information Office in Moscow. They also approved an ambitious Work
Programme for 2001, which included promising new items, such as cooperation
in the field of search and rescue at sea and defence reform. Defence
Ministers also agreed to begin consultations on the opening of a NATO Military
Liaison Mission in Moscow.
Against the background of enhanced dialogue and improved cooperation,
NATO Secretary General Lord Robertson again visited Moscow on
19-21 February 2001. The Secretary General of NATO and the Russian leadership
took positive stock of what had been achieved over the previous year
and discussed how the potential of the Founding Act could be tapped more
effectively. During this visit, the NATO Secretary General officially inaugurated
the NATO Information Office in Moscow, which is expected to contribute significantly
to public understanding of NATO and of the evolving relations between
NATO and Russia.
Future prospects
Cooperation in SFOR and KFOR are striking examples of how NATO and
Russia can indeed interact successfully to achieve common goals. They have
indicated that they will continue to work together closely on the ground, both in
Bosnia and Herzegovina and in Kosovo.
They also face numerous common security challenges in other areas.
Working together to address these challenges is in the interest of both sides
and contributes to the further strengthening of the basis of mutual trust which
is essential for peace and stability in the Euro-Atlantic area5.

NATO’S PARTNERSHIP WITH UKRAINE
A visit to Ukraine by the North Atlantic Council in March 2000 injected new
momentum into the Distinctive Partnership between NATO and Ukraine established
in Madrid in July 1997.
The meeting in Kyiv of the NATO-Ukraine Commission - the first time this
body, which directs the Partnership, had met in Ukraine - was an occasion for
the 19 NATO allies and Ukraine to review the full range of their cooperation. It
was hailed as a significant step for bringing Ukraine closer to the Euro-Atlantic
community of nations.
The signing of the Charter on a Distinctive Partnership in Madrid in 1997
shifted cooperation between NATO and Ukraine on to a new plane and gave
formal recognition to the importance of an independent, stable and democratic
Ukraine to Europe as a whole.
The Charter is in line with Ukraine’s declared strategy of increasing its
integration in European and transatlantic structures. It is the basis on which
NATO and Ukraine agree to consult in the context of Euro-Atlantic security and
stability and in areas such as conflict prevention, crisis management, peace
support and humanitarian operations.
Seminars, joint working group meetings and other cooperative programmes
have focused on areas such as defence reform and the reshaping of
the defence establishment, civil-military relations, budgeting and resource
planning. Seminars on retraining retiring Ukrainian military personnel and on
military downsizing and conversion have also been held.
Joint work in civil emergency planning and disaster preparedness is also
a major area of cooperation with direct practical benefits for Ukraine. A
Memorandum of Understanding on civil emergency planning was concluded in
December 1997, providing for cooperation in this field. A disaster relief exercise
was subsequently scheduled for September 2000, in the Transcarpathia region
of Ukraine, to test humanitarian assistance procedures in the event of further
flooding.

Вони зазначили, що продовжуватимуть співпрацю по питаннях Боснії та Герцеговини та Косово. Вони також розглянули числені виклики загальній безпеці в інших сферах. Співпраця задля вирішення цих викликів є в інтересах обох сторін, що сприяє подальшому зміцненню спільної довіри та є важливим для миру та стабільності в Євро - Атлантичному регіоні.

Це є базою по якій НАТО та Україна погодилися консультуватися в контексті євротлантичної безпеки та стабільності, а власне попередження конфліктів, порядку дій в разі непередбачених обставин та гуманітарних операцій.
Семінари, тематичні робочі групи та інші спільні програми сфокусувалися на таких питаннях, як оборонна реформа та відновлення оборонної основи, цивільно – військових відносин, плануванні ресурсів та бюджету. Також провели семінари з перепідготовки українського військового персоналу на пенсії та скорочення реструктуризації.
Спільна робота щодо попередження назвичайних громадянських ситуацій та катастроф є також важливим питанням співпраці з безпосереднімі практичними перевагами для України. Договір про взаєморозуміння щодо попередження назвичайних громадянських ситуацій було укладено в грудні 1997 р., забезпечуючи співпрацю в цій області. Згодом було заплановано на вересень 2000 р. захід по запобіганню катастрофи в Закарпатській області, щоб перевірити методи гуманітарної допомоги у разі подальшої повені.

A. The Existence of War sui generis
The first question which must be answered is whether a situation
of “war” actually exists in the relationship between the United States
and its allies (“Allies”), and al Qaeda.
Because of the constant reference to the “War on Terror,” many
have been led to believe that there is a war of traditional character
going on and that the law of war apply in all their details to the conflict.
145 As for the terrorists, it is patently obvious that they do not
fulfill the criteria of distinction to receive protection under the law of
war, that is to say, they do not abide by the obligation to wear a uniform
and carry their arms openly.146 Still, the United States Supreme
Court found that detainees are protected by the Geneva Conventions,
147 which form an important part of the law of war. It is worth
analyzing whether this conclusion is based on logical and factual arguments
or on misunderstanding of international law.
The present situation with regard to al Qaeda terrorists involves
more than “uneasy peace.” There are armed surreptitious attacks by
the terrorists, nearly always directed against civilians148 in flagrant violation
of the law of war.149 There have been responses by the Allies to
root out terrorist training camps150 and to capture members of the terrorist
organization.151 The enhanced level of intensity due to terrorist
surprise attacks152 certainly would seem to amount to armed conflict,
albeit of a different nature than traditional wars. The situation with
regard to terrorists, their past actions, and their threats about future
action would authorize the war powers of the Executive. It may be

suggested that the War on Terror is a “war sui generis” and that powers
corresponding to such a “war” are authorized under the
Constitution.
The Red Cross suggests that there is no “war” and that we should
instead speak of a “fight against terrorism.”153 In that case, if there is
no “war” and no “armed conflict,” why did the Red Cross demand to
be allowed to inspect conditions in Guantanamo?154 The Red Cross
suggests further that terrorists cannot be a “party” to an armed conflict
as “terrorism” itself is a “phenomenon” rather than the activities
of a party.155 This ignores political and military realities.
In December 2006, the Foreign Office of the United Kingdom
issued instructions to British diplomats to refrain from using the expression
“War on Terror” to avoid reinforcing and giving succor to the
terrorists’ view of the conflict by using language which, taken out of
context, could be counterproductive.156 But states may be wrong
when they assume that such retraction will pacify the terrorists. Furthermore,
changing the terminology will not alter the existence of an
armed conflict. Indeed, the expression did not originate from the terrorists
but from a statement by the President of the United States.
The absurd position of international lawyers not to accept nonstate
subjects of international law157 may have contributed to the conceptual
confusion that war cannot exist between states and a non-state
international terrorist organization.
It has long been established in international practice that there
might well be a war between a state and a non-state enemy: this is
even the traditional situation in civil war as well as in a number of
recent secession and liberation wars.158 It is also well accepted in case
law that an “enemy” may exist before full scale war commences.159

What might have changed in the present situation is that the new
type of war is not fought between lawful “combatants,” because such
individuals will only appear on the side of the Allies; on the side of al
Qaeda, the participants cannot be lawful “combatants” in the traditional
sense as they do not wear uniforms and do not distinguish
themselves from the civilian population.160 Therefore, a new definition
of war may be required.161 The correct position is possibly that
the present situation does amount to “war,” but to “war” of a new and
different kind.
Some—especially those who deny that groups and movements
are subjects of international law—say that it is not possible to declare
“war” on a terrorist movement.162 The reply to this must be that international
law is a flexible system; it is a system of law which exists to
protect the interests of states and their citizens and, if no applicable
rule exists, one will emerge to cater to a specific need. This phenomenon
is coupled with the assumption that international society has a
“hypothetical goal” consisting of a duty of survival.163 Rules to protect
this goal must be inferred or assumed in the interpretation and
further development of international law.164
An analysis of the situations in Iraq and Afghanistan leads to the
conclusion that we are facing a new international type of armed conflict,
certainly amounting to “war” but in a lopsided situation. On one
side, we have the United States and its allies—all properly constituted
states—and on the other side, as the “enemy,” a number of highly
organized but dissipated non-state groups of terrorists. These terrorists
are not motivated by any ambition other than hatred of states
with Western, especially Christian, traditions.165 They do not seek
their own state166 like the liberation movements of the 1960s, they do
not seek to show the futility of any state structures like the anarchists
of the 1970s, and they do not seek financial reward like some of the
hijackers of the 1980s. As Justice Thomas stated in his dissenting
opinion in Hamdan v. Rumsfeld:
We are not engaged in a traditional battle with a nationstate,
but with a worldwide, hydra-headed enemy, who lurks

in the shadows conspiring to reproduce the atrocities of September
11, 2001, and who has boasted of sending suicide
bombers into civilian gatherings, has proudly distributed
videotapes of beheadings of civilian workers, and has tortured
and dismembered captured American soldiers.167
The armed activity in Afghanistan, in terms of the law of war and
of international law, was initially an “invasion,” or an “intervention”168
directed at the Taliban-led government. But since the Taliban lost
control of the government of Afghanistan, this operation is now much
on par with the action in Iraq as an intervention with the goal of tracking
down the training camps and leaders of the terrorists. The action
in Iraq was also initially an invasion to remove a dictator similar to the
operations which removed Pol Pot in Cambodia and Generalissimo Idi
Amin in Uganda. In Iraq, however, internal structures crumbled rapidly
and Shi’ite, Sunni, and Kurdish factions melted into a strife of
considerable proportion. In Iraq, as in Afghanistan, we are not facing
a war in the traditional sense; the terrorists are directing a great deal
of effort to oust the intervening forces rather than to gain terrain from
competing factions.
With the United States and its allies overlooking the importance
of devising an exit strategy, both in Afghanistan and in Iraq, the
armed conflicts have been prolonged with a tragic loss of life on all
sides. It certainly has become more acceptable in common words to
speak about “The War.” Yet, from a strictly legal point of view, this is
indeed a war of a new type. In Iraq, there is an interventionary force
seeking to establish internal order,169 while at the same time that force
is capturing those who are considered to be possible terrorists.170 Similar
efforts are being pursued in Afghanistan to apprehend terrorists
and members of al Qaeda. Al Qaeda and other like-minded terrorists
have responded globally to this Allied action.
We therefore face, with the genocidal terrorist attacks and armed
responses in the form of self-defense and preemptive military action,
not a traditional war but a war sui generis.

Питання на яке спочатку треба дати відповідь – чи насправді існує стан війни між Сполученими Штатами, їх союзниками та Аль Каїдою? Через постійні згадки «війни проти терору» багато людей були введені в оману, нібито відбувається звичайна війна до якої застосовуються усі закони та звичаї війни. Щодо терористів досить очевидно, що вони не мають зовнішніх ознак, щоб отримати захист військового законодавства, тобто вони не зв’язані обов'язком одягати уніформу та носити відкрито зброю. Але Верховний Суд Сполучених Штатів визнав, що полонені є під захистом Женевської Конвенції, яка складає важливу частину військового законодавства. Варто проаналізувати чи це рішення базується на логічних та фактичних аргументах чи на нерозумінні військового законодавства. Теперішня ситуація стосовно терористів Аль Каїди є дещо іншою ніж «тимчасовий мир». Відбуваються таємні озброєні напади терористів практично щоразу проти цивільного населення, що є грубим порушенням військового законодавства. Союзники завдають удару у відповідь, щоб викорінити тренувальні табори терористів та полонити членів терористичних організацій. Збільшення рівня інтенсивності через блискавичні атаки терористів майже прирівнюється до збройного конфлікту, хоча й іншого характеру ніж звичайна війна. Червоний Хрест далі зауважує, що терористи не можуть бути «стороною» у збройному конфлікті, бо «тероризм» є більше «феноменом», ніж діяльністю збройної сторони. Це є ігнорування політичних та військових реальностей. В грудні, 2006 р. Міністерство Міжнародних Відносин Великобританії надало інструкціі своїм дипломатам утриматися від вислову «Війна проти терору», аби уникнути надання підтримки поглядам терористів щодо конфлікту, використовуючи мову яка поза контекстом може виявитися контрпродуктивною. Але Штати можуть помилятися, вважаючи що така відмова заспокоїть терористів. Більше того, зміна термінів не змінить існування збройного конфлікту. Насправді цей вислів належить не терористам, а Президентові Сполучених Штатів. Абсурдна позиція міжнародних юристів, що не визнаває недержавні суб’єкти міжнародного законодавства, можливо завдячує хибній думці, що війна не може існувати між державами та недержавними міжнародними терористичними організаціями. Вже давно доведено міжнародною практикою, що може існувати війна між державою та недержавним ворогом, у таких стандартних випадках як громадянська війна та, наприклад, нещодавніх сецессіях та визвольних війн. Отож, можливо нам потрібне нове визначення війни. Можливо вірною позицією є те, що теперішня ситуація прирівнюється до «війни», але до «війни» нового та іншого виду. Дехто, особливо ті, хто заперечують що угрупування та рухи підлягають міжнародному законодавству, кажуть що неможливо проголосити «війну» терористичному угруповуванню. Відповіддю на це повинно бути те, що міжнародне право є гнучкою системою, це є юридична система, що існує задля забезпечення інтересів держав та їх громадян, і якщо не існує потрібної норми, її потрібно створити, щоб відповісти на потребу. Цей феномен поєднюється з презумпцією, що міжнародне суспільство має «гипотетичну мету», що складається з обов’язку виживання. Норми, що захищатимуть цю мету, повинні закладатися та матися на увазі при тлумаченні та подальшому розвитку міжнародного права. Військова кампанія в Афганістані, згідно визначенню військового та міжнародного законодавства була спочатку «вторгненням» або «інтервенцією» направленою на талібський уряд. Але оскільки Талібан втратив контроль над афганським урядом, ця операція зараз прирівнюється до дій в Іраці, як інтервенція з метою пошуку тренувальних таборів та чільників терористів. Дії в Іраці були початково вторгненням задля усунення диктатора, подібно до операцій у Пол Поті в Камбоджі та проти генерала Іді Аміна в Уганді. Проте в Іраці внутрішні структури швидко зникли й шиїтські, сунітські та курдські угрупування були втягнуті у досить значну війну. В Іраці та Афганістані ми зустрічаємося не з війною у звичному нам сенсі; терористи спрямовують значні зусилля більше на витіснення військ інтервентів, ніж на захоплення землі конкуруючих угруповувань. Через нерозуміння важливості стратегії виводу військ Сполученими Штатами та союзниками в Афганістані та Іраці, збройні конфлікти були продовжені з значними втратами з обох боків. Дійсно, стало більш прийнятно говорити в загальному про «Війну». Але, строго кажучи, ми справді повинні говорити про війну нового виду. В Іраці знаходиться війська інтервентів, що намагаються встановити порядок в країні, полонячи тих, кого розгялдають, як можливих терористів.
Подібні дії відбуваються в Афганістані, щоб полонити терористів та членів Аль Каїди. Аль Каїда та інші терористи однодумці відповили на кампанію союзників глобально. Отож, ми маємо справу з геноцидом та атаками терористів й формою самозахисту та запобіжних військових дій, не з традиційною війною, а війною sui generis.

I have graduated from Lviv State Medical Colledge, however I had never sensed that medicine is the field where I would like to succeed.
I was always interested in literature, philosophy and languages, so I decided to enroll to Saint James Bible Colledge, based in Kiev, Ukraine. I have graduated in 2001 with the diploma of theologian. And since that time I was working for an international mission organisation Every Nation Ministries. Localy I was pastoring a church in Lviv.
In 2006, I continued my theological education at ENLI and Asian Baptist Seminary, based in Manila, Philippines. I have graduated as MA in christian leadership
Regarding my secular education, while studing and working, I enrolled to Ivan Franco National University of Lviv to the department of foreign languages. I have graduated as MA in English and Spanish language and liturature.
I am an experienced interpreter and profound translator. I have been interpreting for 10 years now and translating for individuals and companies. My favorite fields for translation and interpreting are: medicine, linguistics, philosophy, history, social scinces, theology, psychology, economics etc. I am interested as well in exact sciences like mathematics, physics, engineering, construction etc.
