תיקון ס' 58 לחוק ביטוח בריאות ממלכתי קובע כי ישראלי השוהה בחו"ל שנתיים ומעלה, ומוכר כתושב ישראל ואינו משלם דמי ביטוח בריאות למוסד לביטוח לאומי בישראל או מפגר בתשלומיו יותר מ-12 חודשים, יהיה חייב בתקופת המתנה, (חודשיים בגין כל שנת היעדרות מישראל) כדי לקבל לשירותים רפואיים בעת חזרתו לישראל לשהות קבע. כמו כן, ישראלי השוהה בחו"ל, שאינו מוכר כתושב ישראל (גם אם שילם דמי ביטוח לאומי!) לא יהיה זכאי לשירותים רפואיים בעת חזרתו לישראל לשהות קבע כל תקופת ההמתנה הקבועה בחוק.
תקופת ההמתנה המינימאלית הינה 4 חודשים והמקסימאלית עומדת על 24 חודשים .
לידיעתך, שנת היעדרות מישראל נחשבת שנה שבמהלכה ישראלי שהה 182 יום לפחות, גם אם לא ברציפות, מחוץ לישראל.

For anyone planning to return to Israel in the near future, or to stay for an extended period, it is important to be aware of your medical rights.
Amendment S. 58 to the State Health Insurance Act states that an Israeli who has been abroad for two years or more, and is recognized as a resident of Israel and who has not paid dues to the National Insurance Agency in Israel or is behind in his payments for more than 12 months will be obligated to wait for a waiting period (two months for each month of absence from Israel) in order to received medical services upon his return to Israel as a permanent resident. Also an Israeli who remains abroad and is not recognized as a resident of Israel (even if he paid his dues to the National Health Agency!) is not eligible to receive medical services at the time of his return to Israel as a permanent resident for the period stated in the Act.
The minimal waiting period is 4 months up to a maximum of 24 months.
For your information each year of absence from Israel is considered, according to Israeli law, to be at least 182 days whether or not the absence, outside of Israel, was consecutive.
