Source text - English Parties Residing in the Same State
Each state provides the appropriate venue which can make custody and visitation determinations in a case where all of the parties reside in the same state.
Where a divorce is pending, the appropriate venue for making a custody or visitation decision involving the grandparents and grandchildren is almost always the court hearing the divorce proceedings.
Some states require visitation petitions to be filed with another domestic relations suit.
Some states also permit visitation requests after a domestic relations order has been rendered or as an original proceeding.
Parties Residing in Different States
If a child's parents and/or grandparents live in different states, one of several laws will determine the appropriate court to hear a custody or visitation case.
If a valid custody or visitation decree has been entered in one state, the XXX requires that another state must enforce and must not modify the decree.
Another state may modify the decree only if the original state no longer has jurisdiction over the case or has declined jurisdiction to modify the custody or visitation decree.
Congress amended this statute in 1998 to include a grandparent in the definition of "contestant."
If no state has made a valid custody determination, the provisions of theXXX, as adopted by each state, will apply.

Ogni Stato stabilisce il foro competente a deliberare in materia di affidamento e diritto di visita in una causa in cui le parti risiedono nello stesso Stato.
In caso di divorzio pendente, il foro competente a pronunciarsi in materia di affidamento o diritto di visita con il coinvolgimento di nonni e nipoti è quasi sempre il tribunale che ha in esame la causa di divorzio.
Taluni Stati prescrivono che le istanze per il diritto di visita vengano presentate congiuntamente a un’altra azione legale riguardante il diritto di famiglia.
Alcuni Stati ammettono istanze per il diritto di visita anche successivamente all’emissione di un’ordinanza inerente il diritto di famiglia, o come nuovo procedimento.
Parti residenti in Stati diversi
Qualora i genitori e/o i nonni del minore vivano in Stati diversi, una delle numerose leggi stabilirà il tribunale competente a esaminare una causa di affidamento o diritto di visita.
Se uno Stato ha adottato un decreto valido in materia di affidamento o diritto di visita, il XXX prescrive che un altro Stato applichi il decreto medesimo senza modificarlo.
Un altro Stato può modificare il decreto solo se lo Stato emanante non ha più giurisdizione sul caso, o ha rinunciato alla giurisdizione relativa alla modifica di tale decreto relativo all’affidamento o al diritto di visita.
Il Congresso ha modificato lo statuto nel 1998 al fine di includere i nonni nella definizione di “concorrente”.
Se nessuno Stato ha preso una decisione valida in materia di affidamento, si applicheranno le disposizioni dello XXX, come adottate da ciascuno Stato.
