Source text - English 2. Anti-Trust Law – What does that mean?
The regulations of the Anti-Trust Law shall guarantee the macroeconomic advantage of the competition – therefore, the possibility for customers to independently choose goods, quality improvements and fair prices.
Hence it restricts anticompetitive agreements and concerned practices by competitors as well as abuse of a dominant market position. The goal is to protect both free competition and consumers.
Cartels and market abuse restrict the free competition and, therefore, the possibilities of individual consumers (private persons and companies).
Furthermore, public authorities receive additional resources and extensive rights in order to guarantee compliant behaviour and adherence to Anti-Trust Law. The so-called “leniency program” is an example for that. The “principal witness” (=the first company which does a self-deunification and provides all evidences) is been released from a cartel fine.
Translation - Croatian 2. Kartelno pravo – Što se pod tim podrazumijeva?
Odredbama kartelnog prava osigurava se makroekonomska prednost tržišnog natjecanja – odnosno kupcima se daje mogućnost neovisnog odabira proizvoda, poboljšanja u kvaliteti i fer cijena.
Na taj se način zakonom ograničavaju sporazumi koji narušavaju tržišno natjecanje i usklađena djelovanja tržišnih sudionika kao i zlouporaba vladajućeg položaja na tržištu. Cilj je pritom s jedne strane zaštita slobodnog tržišnog natjecanja, a s druge strane zaštita potrošača.
Karteli i zlouporaba tržišta ograničavaju slobodnu konkurenciju, a time i mogućnosti samih potrošača (fizičke osobe i pravne osobe).
Nadalje, nadležnim se institucijama javne uprave osiguravaju dodatna sredstva kao i veća prava kako bi se osiguralo da djelovanje tržišnih sudionika bude u skladu s odredbama kartelnog prava. Primjer za to je takozvani “leniency program”, odnosno program zviždača. “Ključni svjedok” (= poduzetnik koji prvi prestane s kartelnim aktivnostima i podnese relevantne dokaze) oslobađa se kazne predviđene prema kartelnim propisima.
