DPR Tolak Pelonggaran Remisi bagi Koruptor

TEMPO.CO , Jakarta: Rencana revisi aturan yang memperketat pemberian remisi dan pembebasan bersyarat bagi terpidana korupsi tak mendapat dukungan dari banyak pihak. Peraturan Pemerintah Nomor 99 Tahun 2012 yang mengubah Peraturan Pemerintah Nomor 32 Tahun 1999 tentang Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyarakatan diminta terus dijalankan secara konsisten.

Anggota Fraksi Partai Persatuan Pembangunan Arsul Sani menyatakan aturan tersebut jangan diubah dulu karena baru saja disahkan. “Aturan itu mengakomodasi upaya pemberantasan korupsi dan mendapat dukungan dari masyarakat,” kata Arsul saat dihubungi pada Ahad, 15 Maret 2015.

Mengacu pada peraturan itu, narapidana kasus korupsi, narkotika dan terorisme tidak berhak mendapatkan remisi atau pengetatan dalam pemberian remisi. Untuk mendapat remisi, setidaknya ada dua syarat yang harus dipenuhi. Pertama, narapidana kasus korupsi harus bersedia menjadi justice collaborator yang bekerja sama untuk mengungkap pelaku utama atau perkara maupun pelaku korupsi yang lainnya. Kedua, narapidana kasus korupsi harus membayar pidana uang pengganti dan denda yang dijatuhkan kepadanya.

Menteri Hukum dan HAM Yasonna H. Laoly menggulirkan wacana untuk merevisi syarat pemberian remisi dalam beleid tersebut karena bertentangan dengan Undang-undang Nomor 12 Tahun 1995 Tentang Pemasyarakatan. Aturan itu menyatakan setiap narapidana berhak atas remisi dan pembebasan bersyarat.

Menurut Arsul, tidak ada hal kontradiktif antara peraturan dan undang-undang tersebut. Dalam Pasal 12 ayat 2 Undang-undang Pemasyarakatan, kata Arsul, jelas disebutkan bahwa pemerintah memiliki peluang untuk menetapkan syarat yang berbeda dalam memberikan remisi. "Kejahatan luar biasa harus mendapat perlakuan luar biasa, seperti korupsi," kata dia.

House Rejects Plan to Relax Remissions to Corruptors

TEMPO.CO , Jakarta: The plan to revise a regulation limiting remission and parole to corruption convicts sparks opposition among public. The government has been urged to consistently enforce Government Regulation Number 32/1999 on the rights of prisoners.

Arsul Sani, a member of the United Development Party (PPP) Faction at the House of Representatives, suggested that the regulation should not be amended yet since it has just been passed.

“The regulation accommodates corruption eradication efforts, and public supports it,” Arsul told Tempo on Sunday, March 15, 2015.

Based on the regulation, inmates convicted on corruption, drugs and terrorism charges are not entitled to remissions or being limited in pursuing their rights of remission. To gain a remission, a convict must be willing to cooperate in exposing the brain of a graft case and pay the fine and compensation charged by the court.

Earlier, Justice and Human Rights Minister Yasonna H. Laoly initiated a plan to revise the requirements for remissions since they contravene the provisions in Law Number 12/1995 on penitentiaries. The regulation states that all inmates are entitled to remissions and paroles.

Arsul argued that there were no contradictions found in the two regulations. Article 12 paragraph 2 of the law on penitentiaries states that the government has the authority to apply different requirements in giving remissions.

“An extraordinary crime, such corruption, must be treated extraordinarily,” Arsul said.
