Source text - Russian В Российской Федерации проживает около 250 тысяч представителей коренных малочисленных народов Севера, Сибири и Дальнего Востока (далее – коренные народы), представляющих 47 этносов, различных по образу жизни, культуре, языку. Права коренных народов закреплены в Конституции Российской Федерации: статья 69 гарантирует соблюдение прав коренных малочисленных народов в соответствии с общепризнанными принципами и нормами международного права и международными договорами.
Основой жизни для большинства коренных народов является тесная постоянная связь с природой как необходимое условие для ведения традиционной хозяйственной деятельности, сохранения культуры, традиций и языка. Следствием низкого уровня законодательной защищенности прав на земли, природные ресурсы стало формирование социально-экономического кризиса и духовной фрустрации у коренных народов.
В настоящее время коренные народы представляют собой одну из наиболее маргинализированных и социально незащищенных категорий российского общества. Крайне низкий уровень социально-экономической обеспеченности выражается в низких демографических показателях по сравнению с общероссийскими: низкая продолжительность жизни, высокий уровень младенческой смертности, высокий уровень суицидов, социальных болезней.
В решении обозначенных проблем задействованы различные субъекты российского общества. Во-первых, активная деятельность проводится со стороны общественного сектора. За последние годы значительно выросло количество общественных формирований коренных народов (общины, союзы, общественные организации), реализующих деятельность в различных сферах – правовой, культурной, образовательной и т.п. Во-вторых, органы власти реализуют меры государственной поддержки коренных народов. Министерством регионального развития, являющимся федеральным уполномоченным органом по реализации национальной политики в России, проводятся социально-значимые мероприятия, реализуются меры финансовой поддержки коренных народов. На наш взгляд, верным является подход, выбранный Министерством для определения круга лиц из числа коренных народов, имеющих право на государственные преференции. Меры государственной поддержки должны предоставляться не только представителям коренных народов на основании этнической принадлежности, но, в первую очередь, на основании ведения традиционного образа жизни и занятия традиционными видами хозяйственной деятельности. Таким образом, планируется переход от этнического фактора как определяющего к хозяйственно-экономическому. Данный подход поддержан многими экспертами и реализуется на практике в некоторых регионах России.
Самым значимым изъяном государственной политики в отношении коренных народов является крайне слабое и не эффективное законодательное закрепление прав коренных народов на земли и доступ к природным ресурсам (объектам животного мира, водным биоресурсам). Приведу лишь один из многих примеров, характеризующих правовую несостоятельность регулирования доступа коренных народв к природным ресурсам.
C января 2007 года вступил в силу Лесной Кодекс Российской Федерации. Лесопользование коренных малочисленных народов в данном кодексе не урегулировано. Лесной кодекс не предоставляет коренным народам возможности закрепления за ними лесных земель. Вместо этого создается правовая база для получения территорий проживания коренных народов в собственность или аренду практически любым физическим или юридическим лицом, в числе которых могут быть иностранные граждане, лица без гражданства, иностранные компании. Ни Лесным кодексом, ни другим законодательством на собственников и арендаторов лесных участков не возлагается обязанность по обеспечению прав коренных народов на свободное и бесплатное лесопользование.
Министерством регионального развития, Советом Федерации Федерального собрания проводится работа по внесению законодательных предложений и изменений в целях обеспечения права доступа коренных народов к земле и природным ресурсам, однако, проводимая работа движется крайне медленно. Более эффективно и динамично законодательство по коренным народам развивается в регионах России. В республиках Ямал, Якутия, Хабаровском, Красноярском краях наработана правовая база, содействующая защите прав коренных народов на землюи природные ресурсы.
Таким образом, анализируя реализацию социальных и экономических прав коренных малочисленных народов Севера, Сибири и Дальнего Востока, можно сделать вывод о предпринимаемых Российской Федерацией мерах по реализации статей Международного пакта об экономических, социальных и культурных правах. Одновременно, существует объемный пласт проблем, требующих законодательного регулирования в направлении защиты прав коренных народов на земли и природные ресурсы.
Translation - English Approximately 250,000 members of Indigenous small-numbered peoples of the North, Siberia and the Far East (i.e., Indigenous Peoples), comprising 47 ethnicities with different cultures, languages and ways of life, live in the Russian Federation. The rights of Indigenous Peoples are guaranteed in the Constitution of the Russian Federation; Article 69 guarantees the observation of the rights of Indigenous small-numbered peoples in accordance with universally recognized principles and norms of international law and international treaties.
Daily life for the majority of Indigenous Peoples involves a close permanent relationship with nature that is an essential condition for conducting traditional economic activity and the conservation of their cultures, traditions and languages. The low level of legislative protection of the rights to land and natural resources has resulted in the creation of a socio-economic crisis and internal frustration among the Indigenous Peoples.
Currently, Indigenous Peoples are one of the most marginalized and socially unprotected groups in Russian society. Demographic indicators show an extremely low level of socio-economic security compared with that of ethnic Russians: low life expectancy and high rates of infant mortality, suicide and communicable disease.
Various members of Russian society were involved in finding solutions to the pressing problems. Firstly, active work has been performed by the public sector. In recent years, the number of public Indigenous organizations (communities, unions, public organizations) has significantly increased; these organizations carry out work is various spheres- law, culture, education, etc. Secondly, government bodies have implemented measures for governmental support of Indigenous Peoples. The Ministry of Regional Development, the federally recognized body that implements national policy in Russia, has implemented socially significant measures of financial support for Indigenous Peoples. In our opinion, this approach, chosen by the Ministry to define the range of people among the Indigenous Peoples who have the right to government preference, is correct. Measures of government support must be provided to members of Indigenous Peoples not only based on ethnicity, but primarily based on conducting their lives in their traditional manner and engaging in traditional economic activities. Thus, the Ministry is planning a transition from ethnic factors to economic factors in their definition. This approach was supported by many experts and implemented by several territories in Russia.
The most significant flaw in government policy regarding Indigenous Peoples is the extremely weak and ineffective legislation on the rights of Indigenous Peoples to land and access to natural resources (animals and water resources). I will give only one of many examples that demonstrated the legal failure of regulating the access of Indigenous Peoples to natural resources.
In January 2007, the Code of Forests of the Russian Federation (Лесной Кодекс Российской Федерации) came into force. In this code, forest usage of the Indigenous small-numbered peoples was not normalized. The Code of Forests does not give Indigenous Peoples the opportunity to consolidate their forest lands. Instead, it creates a legal base for taking territories owned or leased by Indigenous Peoples for any physical or legal reason, including for those who may be foreign citizens, people without citizenship, or foreign companies. Neither the Code of Forests nor any other legislation on owners or lessees of forested land places the responsibility of securing the rights of Indigenous Peoples on free forest use.
The Ministry of Regional Development and the Federation Council of the Federal Assembly is carrying out work on the submission of legislative proposals and changes on the securing the right of Indigenous Peoples to the access to land and natural resources; however, this process is moving extremely slowly. More effective and dynamic legislation on Indigenous Peoples has been developed by Russian territories. In Yamalia, Yakutia, Khabarovsk and Krasnoyarsk, a legal base facilitating the protection of the rights of Indigenous Peoples to land and natural resources was gained.
Thus, in analyzing the implementation of social and economic rights of the Indigenous small-numbered peoples of the North, Siberia, and the Far East, we may come to a conclusion on the measures taken by the Russian Federation in the implementation of the articles of the International Covenant on Economic, Social and Cultural Rights. At the same time, a great number of problems exists that demand legislative regulation for the protection of the rights of Indigenous Peoples to land and natural resources.
