Source text - English The delivery of the Equipment includes its packaging, which must be in accordance with the nature of the Equipment and the requirements of truck transport. The Seller is responsible for the completeness of delivery of the loaded Equipment, for sub-deliveries until unpacked at the installation site, provided the packaging is not damaged.
3. No later than ten days before the date of shipment of the Equipment, the following documents will be delivered to the Buyer in the English language:
a) all technical documentation necessary for standard operation of the Equipment in printed and electronic form including at least:
- Equipment operating instructions, commissioning instructions and maintenance instructions;
- Passport certificate of the oven and burners;
- Schematic line arrangement, drawings of the corresponding design;
- Wiring diagrams incl. general wiring and connection of the console
- Certificate of completeness and quality of the product;
- Technical documentation in English and covering the Equipment specifically delivered. If the technical documentation proves to be incomplete during the acceptance of the technical documentation, the Seller undertakes to supply the missing parts of the documentation at the Buyer's first request at its costs in the shortest possible time.
4. The Seller hereby undertakes:
a) to deliver to the Buyer the Equipment according to the subject of the Contract determined in terms of quantity and type,
b) to transfer ownership right and liability for damage to the Buyer under the terms and conditions set forth in this Contract.
Translation - Polish Dostawa Urządzenia obejmuje jego opakowanie, które musi być zgodne z charakterem Urządzenia i wymogami transportu samochodowego. Sprzedawca jest odpowiedzialny za kompletność dostawy załadowanego Urządzenia, za poddostawy do momentu rozpakowania w miejscu instalacji, pod warunkiem, że opakowanie nie jest uszkodzone.
3. Nie później niż dziesięć dni przed datą wysyłki Urządzenia, następujące dokumenty zostaną dostarczone do Kupującego w języku angielskim:
b) wszelka dokumentacja techniczna, niezbędna do standardowego działania Urządzenia, w formie drukowanej i elektronicznej, w tym co najmniej:
- Instrukcje obsługi sprzętu, instrukcje uruchomienia i konserwacji;
- Paszport techniczny piekarnika i palników;
- Schematyczny układ linii, rysunki odpowiedniego projektu;
- Schematy połączeń wraz z ogólnym okablowaniem i podłączeniem konsoli
- Świadectwo kompletności i jakości produktu;
- Dokumentacja techniczna w języku angielskim, obejmująca dostarczony sprzęt. Jeżeli dokumentacja techniczna okaże się niekompletna w trakcie odbioru dokumentacji technicznej, Sprzedawca zobowiązuje się dostarczyć brakujące części dokumentacji na pierwsze żądanie Kupującego na swój koszt w możliwie najkrótszym czasie.
4. Sprzedawca niniejszym zobowiązuje się:
c) dostarczenia Kupującemu Urządzeń zgodnie z przedmiotem Umowy określonym ilościowo i rodzajowo,
przeniesienia prawa własności i odpowiedzialności za szkody na Kupującego na warunkach określonych w niniejszej Umowie.

1) niezaciągania nowych kredytów lub zobowiązań o charakterze kredytowym (w tym: pożyczki faktoring, leasing, dyskonta weksli) lub zwiększania kwoty już zaciągniętych kredytów i zobowiązań o charakterze kredytowym w innych bankach lub instytucjach finansowych, nieudzielania gwarancji ani poręczeń za zobowiązania innych podmiotów powyżej kwoty 3 000 000 PLN (słownie: trzy miliony złotych 00/100) bez pisemnej zgody Banku. Nie dotyczy już zawartych umów i ich przedłużania na następne okresy do wysokości limitów zadłużenia na dzień podpisania aneksu

1 The Factor undertakes to
1) No new loans or credit commitments (including factoring, leasing or discounting of bills of exchange) or increase in the amount of loans or credit commitments already contracted by other banks or financial institutions, no guarantees or sureties for liabilities of other entities exceeding PLN 3,000,000 (say: three million zloty) without the Bank's written consent. It does not apply to concluded agreements and their extension for further periods up to the debt limits as at the date of signing the annex.
