EKSPLORASI MENJADI IZIN USAHA PERTAMBANGAN (IUP) OPERASI PRODUKSI KEPADA PT. BUMI ENERGY KALTIM
BUPATI PENAJAM PASER UTARA
Membaca : Surat Direktur Utama PT. Bumi Energy Kaltim Nomor 25/BEK/IX/2009 perihal Permohonan Peningkatan Kuasa Pertambangan Eksplorasi.
Menimbang : Bahwa berdasarkan hasil evaluasi kegiatan Kuasa Pertambangan Eksplorasi PT. Bumi Energy Kaltim telah memenuhi syarat untuk diberikan persetujuan peningkatan Kuasa Pertambangan menjadi IUP Operasi Produksi.
Mengingat :
1. Undang-Undang Nomor 23 Tahun 1997 tentang Pengelolaan Lingkungan Hidup (Lembaran Negara Republik Indonesia Nomor : 68 Tahun 1997, Tambahan Lembaran Negara Republik Indonesia Nomor : 3699);
2. Undang-Undang Nomor 7 Tahun 2003 tentang pembentukan Kabupaten Penajam Paser Utara di Propinsi Kalimantan Timur (Lembaran Negara Republik Indonesia Tahun 1999 Nomor 72, Tambahan Lembaran Negara Nomor 4182);
3. Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintah Daerah (Lembaran Negara Tahun 2004 Nomor 125, Tambahan Lembaran Negara Nomor : 4437) sebagaimana telah diubah dengan Undang-Undang Nomor 8 Tahun 2005 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 3 Tahun 2005 tentang Perubahan atas Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintah Daerah menjadi Undang-Undang (Lembaran Negara Tahun 2005 Nomor 108, Tambahan Lembaran Negara Nomor 4548);
4. Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal (Lembaran Negara Tahun 2004 Nomor 67, Tambahan Lembaran Negara Nomor 4724);

11. Peraturan Daerah Kabupaten Penajam Paser Utara Nomor : 10 Tahun 2004 tentang Penerimaan Sumbangan Pihak Ketiga kepada Kabupaten Penajam Paser Utara (Lembaran Daerah Kabupaten Penajam Paser Utara Tahun 2005);
12. Surat Keputusan Bupati Penajam Paser Utara Nomor : 545/09-EKSPLORASI/EKONOMI/XII/2008 tanggal 5 Desember 2008 tentang Surat Izin Usaha Pertambangan Batubara Eksplorasi.
MEMUTUSKAN
Menetapkan : Keputusan Bupati Penajam Paser Utara tentang Persetujuan Peningkatan Kuasa Pertambangan Eksplorasi menjadi Izin Usaha Pertambangan (IUP) Operasi Produksi kepada PT. Bumi Energy Kaltim.
KESATU : Memberikan Izin Usaha Pertambangan Operasi Produksi kepada:

KEDUA : Pemegang IUP Operasi Produksi mempunyai hak untuk melakukan kegiatan konstruksi, produksi, pengangkutan dan penjualan serta pengolahan dan pemurnian dalam WIUP untuk jangka waktu 3 (tiga) tahun terhitung mulai tanggal ditetapkannya keputusan ini dan dapat diperpanjang 2 (dua) kali masing-masing 2 (dua) tahun;
KETIGA : IUP Operasi Produksi ini dilarang dipindahtangankan kepada pihak lain tanpa persetujuan Bupati.
KEEMPAT : PT. Bumi Energy Kaltim sebagai pemegang IUP Operasi Produksi dalam melaksanakan kegiatannya mempunyai hak dan kewajiban sebagaimana tercantum dalam lampiran III Keputusan ini;
KELIMA : Selambat-lambatnya 60 (enam puluh) hari kerja setelah diterbitkannya Keputusan ini pemegang IUP Operasi Produksi sudah harus menyampaikan Rencana Kerja dan Anggaran Biaya (RKAB) kepada Bupati untuk mendapat persetujuan;
KEENAM : Terhitung sejak 90 (sembilan puluh) hari kerja sejak persetujuan Rencana Kerja dan Anggaran Biaya sebagaimana dimaksud dalam diktum Kelima Pemegang IUP Operasi Produksi sudah harus memulai aktifitas dilapangan.
KETUJUH : Tanpa mengurangi ketentuan peraturan perundang-undangan maka IUP Operasi Produksi ini dapat diberhentikan sementara, dicabut, atau dibatalkan, apabila pemegang IUP Operasi Produksi tidak memenuhi kewajiban dan larangan sebagaimana dimaksud dalam diktum Ketiga, Keempat, dan Kelima dalam Keputusan ini.
KEDELAPAN : Keputusan Bupati Penajam Paser Utara ini mulai berlaku pada tanggal ditetapkan dengan ketentuan akan diperbaiki apabila dikemudian hari ternyata terdapat kekeliruan dalam penetapannya.

THE APPROVAL OF THE CONVERSION OF MINING EXPLORATION RIGHTS TO MINING PRODUCTION OPERATIONS BUSINESS LICENSE (IUP) TO PT. BUMI ENERGY KALTIM
THE REGENT OF PENAJAMAN PASER UTARA
Recite : The Letter from the Chief of PT. Bumi Energy Kaltim Number 25/BEK/IX/2009 concerning the Request for the Conversion of Mining Exploration Rights.
Considering : That according to the results of operations evaluation, PT. Bumi Energy Kaltim Mining Exploration Rights has fulfilled the requirements to be given an approval for a conversion from Mining Rights to Mining Production Operations Business License (IUP).
In view of :

To stipulate : Decree of the Regent of Penajam Paser Utara concerning the Approval of the Conversion of Mining Exploration Rights to Mining Production Operations Business License (IUP) to PT. Bumi Energy Kaltim

SECOND : The holder of a Mining Production Operations Business License (IUP) has the right to perform operations in constructions, productions, transportations, and sales as well as processing and refinement in the WIUP for a time period of 3 (Three) years starting from the date on which this decree is stipulated, and an extension is allowed 2 (Two) times of which a 2 (Year) period is given on each;
THIRD : It is prohibited to transfer this Mining Production Operations Business License (IUP) to another party without the approval of the Regent.
FOURTH : In performing their activities, PT. Bumi Energy Kaltim as a holder of a Mining Production Operations Business License (IUP) has rights and responsibilities as listed in appendix III of this decree;
FIFTH : Holder of this Mining Production Operations Business License (IUP) must submit their Work and Budget Plan (RKAB) to the Regent for an approval, by the latest within 60 (Sixty) working days after the issuance of this decree;
SIXTH : Mining Production Operations Business License holders must already start their field operations in 90 (Ninety) working days since the approval of the Work and Budget Plan as mentioned in the Fifth dictum.
SEVENTH : Without decreasing the provisions of the legislation, this Mining Production Operations Business License could be temporarily discontinued, revoked, or cancelled, if the holder of this Mining Production Operations Business License (IUP) does not comply with their responsibilities and prohibitions as mentioned in the Third, Fourth, and Fifth dictum of this decree.
EIGHTH : This decree of the Regent of Penajam Paser Utara shall come into force from the date on which it is stipulated with a condition that it could be amended in the future if there have been some mistakes in its stipulation.
