Source text - Indonesian a. bahwa dalam rangka menciptakan sistem perbankan yang sehat, melindungi kepentingan stakeholders dan
meningkatkan kepatuhan terhadap peraturan perundang-undangan yang berlaku, diperlukan pelaksanaan good corporate governance di industri perbankan;
b. bahwa untuk mewujudkan good corporate governance
tersebut, industri perbankan perlu dimiliki dan dikelola oleh pihak–pihak yang senantiasa memenuhi persyaratan kemampuan dan kepatutan;
c. bahwa sejalan dengan perkembangan industri perbankan yang dinamis diperlukan penyempurnaan mekanisme uji kemampuan dan kepatutan terhadap calon pemilik dan calon pengelola bank maupun dalam melakukan penilaian kembali atas kemampuan dan kepatutan terhadap pemilik dan pengelola yang telah ada;
d. bahwa agar industri perbankan dimiliki dan dikelola oleh
pihak-pihak yang senantiasa memiliki kemampuan dan
kepatutan diperlukan pengenaan sanksi yang lebih
memberikan efek jera terhadap pemilik dan pengelola yang
tidak memenuhi persyaratan;
e. bahwa berdasarkan pertimbangan sebagaimana dimaksud pada huruf a, huruf b, huruf c, dan huruf d di atas, dipandang perlu untuk menyempurnakan ketentuan tentang Penilaian Kemampuan dan Kepatutan (Fit And Proper Test) dalam suatu Peraturan Bank Indonesia;
Translation - English a. whereas in order of designation for a healthy banking system, to protect the interest of the stakeholders and increasing the obeisance to the legislation in force, the implementation of good corporate governance in the banking industry is required;
b. whereas to manifest the mentioned good corporate governance, the banking industry should be owned and managed by parties who always fulfill the fit and proper requirements;
c. whereas in line with the dynamic development of the banking industry, the perfection of fit and proper test mechanism to prospective bank owners and prospective bank managers as well as in doing revaluation on the fit and proper to the owners and managers of existing;
d. whereas in order that the banking industry is owned and managed by parties who always acquire the fit and proper imposition of sanctions that provide a further deterrent effect to owners and managers who do not qualify the requirements is needed;
e. whereas according to the consideration as referred to in letter a, letter b, letter c, and letter d above, deemed necessary to perfect the regulation concerning Fit And Proper Test in Bank Indonesia Regulation;
