3. The Properties are divided by a retaining wall ("Retaining Wall") which belongs to Schaeffler's Property.
4. The Retaining Wall is currently damaged. In order to prevent further damage to one of the Properties Ms.### intends to reinforce the Retaining Wall by sprayed concrete. A description of the works to be carried out is attached to this agreement as Annex 1 ("Reinforcing Work"). The Reinforcing Work shall be carried out by the company #### on ####'s Property.
5. Ms. #### intends to restore any damage caused in the yard of the ####'s Property in the course of the Reinforcing Work ("Restoring Work", together with the Reinforcing Work the "Work").
