Article 2: Pénalités pour retard de la mise en service industriel
53.1 Si la Date de Mise en Service Industriel d’un Groupe (turbine à
combustion) de la Centrale n’est pas intervenue dans les délais visés
aux paragraphes 11.3.3 i) et 11.3.3 ii) de l’Article 11 ci-dessus, tel que
ces délais auraient pu être reportés par écrit par les Parties,
STARENERGIE payera à l’Autorité Concédante, une pénalité pour
retard de mise en service de la turbine à combustion concernée,
PRMSCi, calculée sur la base d’un montant égal à trente millions [
30 000 000…] de francs CFA par Jour de retard.
53.2 Si la Date de Mise en Service Industriel du Groupe turbine à vapeur de
la Centrale n’est pas intervenue dans le délai visé à l’Article 11.3.3 iii) de
la Convention ENERGIE 73, telle que ce délai aurait pu être reporté par
écrit par les Parties, STARENERGIE payera à l’Autorité Concédante,
une pénalité pour retard de mise en service de la turbine à vapeur,
PRMSV, calculée sur la base d’un montant égal à quarante millions [
40 000 000…] de francs CFA par Jour de retard.

PENALTIES FOR DELAYS IN THE PROVISION OF INDUSTRIAL SERVICES
53.1If the industrial commissioning of one of the Plant’s Groups (combustion turbine ) is delayed, thereby exceeding the time frames stipulated in paragraphs 11.33.3.j and 11.3.3.ii of article 11 above and delays are reported in writing by the Parties, STARENERGYwill compensate the Licensing Authority for the delay in putting the turbine into use. PICDi (Penalty for industrial commissioning delay).
The PICDi will be calculated on the basis of 30 million (30,000,000) CFA Francs per day (of delay).
53.2If the date of industrial commissioning of the steam turbine has exceeded the delay allowed in Article 11.3.3.iii of the CONVENTION ENERGY 73 and the delay has been reported in writing by the PARTIES, STARENERGIE will compensate the Licensing Authority with a penalty for the delay in industrial commissioning of the steam turbine (PDICST Penalty for the Delay in Industrial Commissioning of Steam Turbine). The latter will be calculated at forty million CFA Francs per day.
