PORTARIA Nº 516, DE 9 DE DEZEMBRO DE 1997
O MINISTRO DE ESTADO DA AGRICULTURA, PECUÁRIA E ABASTECIMENTO, no uso da atribuição que lhe confere o Art. 87, Parágrafo Único, inciso II, da Constituição da República, tendo em vista o disposto no Art. 71 do Regulamento do Serviço de Defesa Sanitária Animal, aprovado pelo Decreto nº 24.548, de 3 de julho de 1934, considerando a decisão da 65ª Assembléia Geral do Comitê Internacional do Escritório Internacional de Epizootias - OIE que alterou o capítulo 3.2.13 - Encefalopatia Espongiforme Bovina, do Código Zoossanitário Internacional, resolve:
Art. 1º Declarar o Brasil livre de encefalopatia espongiforme bovina, de acordo com o que estabelece o artigo 3.2.13.2 do Código Zoossanitário Internacional.
Art. 2º Incluir a encefalopatia espongiforme bovina e a paraplexia enzoótica dos ovinos (scrapie) na relação de doenças passíveis de aplicação de medidas de defesa sanitária animal constante do artigo 61 do Regulamento do Serviço de Defesa Sanitária Animal, aprovado pelo Decreto nº 24.548, de 3 de julho de 1934.
Parágrafo único - A encefalopatia espongiforme bovina e a paraplexia enzoótica dos ovinos (scrapie) são doenças de notificação obrigatória e suas ocorrências ou suspeições devem ser imediatamente informadas à autoridade de defesa sanitária animal da jurisdição.
Art.3º Determinar a aplicação a partir de 1º de janeiro de 1998 das recomendações para prevenção da encefalopatia espongiforme bovina e outras encefalopatias espongiformes transmissíveis dos animais, constantes do artigo 3.2.13.1 do Código Zoossanitário Internacional, especialmente:
a) a identificação dos perigos potenciais de introdução da doença mediante análise de risco que inclua a importação de animais vivos e produtos e sub-produtos de origem animal;

THE STATE MINISTER OF AGRICULTURE, LIVESTOCK AND FOOD SUPPLY, under the authority conferred on him by Article 87, Sole Paragraph, item II, of the Constitution, pursuant to the provisions set forth in Article 71 of the Regulation of the Animal Health Inspection Service, approved by Decree No. 24.548, of July 3, 1934, considering the decision of the 65th General Meeting of the International Committee of the International Office of Epizootics – OIE, which altered chapter 3.2.13 – Bovine Spongiform Encephalopathy, of the International Animal Health Code, determines:
Art. 1 To declare Brazil free from bovine spongiform encephalopathy, pursuant to the provisions of article 3.2.13.2 of the International Animal Health Code.

Sole Paragraph – Bovine spongiform encephalopathy and scrapie are reportable diseases and the occurrences or risks thereof shall be immediately relayed to the animal health inspection authority of the jurisdiction.
Art 3 As of January 1, 1998, to determine the application of the recommendations for preventing bovine spongiform encephalopathy and other transmissible spongiform encephalopathy in animals, pursuant to article 3.2.13.1 of the International Animal Health Code, particularly:
a) the identification via risk analysis of the potential dangers posed by the insurge of the disease, including the import of livestock and animal products and by-products.

Source text - English NOTICE, CONSENT AND ACKNOWLEDGMENT
RELATING TO THE RAIL SERVICES AGREEMENT
To:
XYZ SA (the “Counterparty”)
From: ABC SA (the “Company”)
(the Company and [.] collectively, the “Borrowers”)
[.] (acting in its capacity as agent for the lenders, the “Security Agent”),
each a “Party” to this notice, consent and acknowledgment (this “Notice”).
Reference is made to the Rail Services Agreement dated [•], (as so amended, supplemented, transferred and novated from time to time, the “Contract”), between the Counterparty and the Company. Terms capitalised and not defined herein bear the meaning given to them in the Contract as in effect on the date hereof. A reference in this Notice to a clause is a reference to a clause of the Contract.
In the event of any conflict between any provisions of this Notice and any provisions of the Contract, the provisions of this Notice shall prevail.
Pursuant to clause [25] of the Contract, you have agreed that the Company may, as security in favour of any bank or financial institution or a trustee or agent on behalf of such bank or financial institution or group of banks and/or financial institutions, (a) assign all its rights under the Contract, and (b) enter into an agreement with such banks or financial institutions agreeing to such assignment.
We hereby give you notice that pursuant to[ a Convention de Nantissement de Fonds de Commerce and a private conditional assignment each of which are dated on or about the date of this Notice and made between the Borrowers, the Project Lenders (as defined below) and the Security Agent (together, the “Assignment”)], the Company has assigned its rights under the Contract by way of security to certain banks and financial institutions and their agents (the “Project Lenders”) (whether through the Security Agent or otherwise) in order to secure the Borrowers’ obligations under the Common Terms Agreement dated 22 August 2007, among, inter alia, the Borrowers, the Security Agent and the Project Lenders (the “Common Terms Agreement”) and each of the Loan Agreements (as defined in the Common Terms Agreement) dated 22 August 2007, to which the Project Lenders and the Borrowers are party, and certain associated Finance Documents (as such term is defined in the Common Terms Agreement).
Pursuant to clause [25] of the Contract, the Company hereby requests that, by your execution of the enclosed counterpart of this Notice you confirm and agree as follows:
1. ASSIGNMENT AND ACCOUNT DETAILS
1.1 You consent to the assignment to the Project Lenders (whether through the Security Agent or otherwise), by way of security as set out in the Assignment of all the Company’s rights, title, benefit and interest in and under the Contract (the “Assigned Rights”) and you acknowledge receipt of notice of such assignment given by this Notice provided that such assignment shall not be enforced until the Security Agent delivers to you (with a copy to the Company) a written notice (an “Enforcement Notice”) that the security created by such assignment has become enforceable.

É feita referência ao Contrato de Prestação de Serviços Ferroviários, datado de [•], (tal como periodicamente aditado, complementado, transferido e novado, o "Contrato"), entre a Parte Interessada e a Sociedade. Os termos em maiúscula e aqueles não definidos neste instrumento terão o significado que lhes foi atribuído no Contrato, em vigor na data deste. Vimos por este meio comunicar-lhe que, nos termos da [Convention de Nantissement de Fonds de Commerce e da cessão fiduciária particular, cada uma datada em ou próximo à data do presente instrumento e celebrada entre os Mutuários, os Credores do Projeto (conforme definição abaixo) e o Agente de Garantia (conjuntamente, a "Cessão")], a Sociedade cedeu os seus direitos nos termos do Contrato a título de garantia a certos bancos e instituições financeiras e seus agentes fiduciários (os "Credores do Projeto") (seja mediante o Agente de Garantia ou de outra forma), a fim de garantir as obrigações dos Mutuários no âmbito do Contrato de Termos Comuns de 22 de agosto de 2007, entre, dentre outros, os Mutuários, o Agente de Garantia e os Credores do Projeto (o "Contrato de Termos Comuns") e cada um dos Contratos de Mútuo (conforme definido no Contrato de Termos Comuns), datado de 22 de agosto de 2007, dos quais os Credores do Projeto e os Mutuários são Parte, e alguns Documentos Financeiros relevantes (conforme definição no Contrato de Termos Comuns).

1.1 A Parte Interessada autoriza a cessão aos Credores do Projeto (seja mediante Agente de Garantia ou de outra forma), a título de garantia, tal como estabelecido na Cessão, de todos os direitos de propriedade da Sociedade nos termos do Contrato (os "Direitos Cedidos ") e dá conhecimento ao recebimento da notificação de tal cessão dada pelo presente instrumento, desde que tal cessão não seja executada até que o Agente de Garantia lhe ofereça (com cópia à Sociedade) notificação por escrito (uma" Notificação de Execução") de que a garantia criada por tal cessão tenha se tornado exequível.
