Source text - Portuguese A análise das alegações citadas anteriormente leva as seguintes considerações:
I. A Requerente tem razão quanto as alegações apresentadas nos itens 3 e 6, quando questiona o documento D2 como anterioridade da matéria em exame, pois sua publicação ocorreu um dia depois do depósito da prioridade, e tal documento foi desconsiderado no presente exame;
II. Embora a Requerente tenha alegado que nenhuma das referências menciona um problema que se relaciona com a resistência ao destacamento, da forma como foi reivindicado, a matéria em exame não se distingue do Estado da Técnica citado (D1, D3 e D4), pois todos os documentos citados possuem de forma isolada e combinada as características construtivas essenciais reivindicadas no presente pedido, ou seja, três camadas, sendo uma porosa, outra não porosa, e uma terceira obtida por fusão das demais e com espessura compatível com a reivindicada no presente pedido;
III. A Requerente falha também com respeito as alegações 4, 5 e 7 para rebater os argumentos técnicos apresentados no parecer anterior, pois a análise de um pedido de patente realizada pelo INPI brasileiro é, e deve continuar sendo, isenta e pautada apenas pelo mérito técnico da matéria reivindicada frente ao Estado da Técnica pertinente. A independência do exame nacional está respaldada pela Convenção da União de Paris, da qual o Brasil é signatário, a qual no “Art. 4 bis define que: “As patentes requeridas nos diferentes países da União por nacionais de países da União serão independentes das patentes obtidas para a mesma invenção nos outros países, membros ou não da União.”
Translation - English The analysis of the allegations above mentioned leads to the following considerations:
I. The Applicant is right about the allegations made in paragraphs 3 and 6, when she questions document D2 as prior to the subject matter in question, since its publication came a day after deposit of priority, and this document has been disregarded in the current examination;
II. Although the Claimant alleged that none of the references mentions a problem that relates to the resistance to detachment, as it was claimed, the subject matter in question is indistinguishable from the State of the Art quoted (D1, D3 and D4), for all cited documents have isolated and combined essential constructional features claimed in the present application, namely, three layers, one being porous, another non-porous, and a third obtained by melting the others and with thickness compatible with the one claimed in the present application;
III. The Applicant also failed in regard to the claims 4, 5 and 7 to contest the technical arguments presented in the previous opinion, as the examination of a patent application held by the Brazilian INPI is, and must remain, free and guided only by the technical merits of the subject matter claimed against the relevant State of the Art. The independence of the national survey is supported by the Paris Union, of which Brazil is a signatory, which in “Article 4bis states that: “Patents applied for in the various countries of the Union by nationals of countries of the Union shall be independent of patents obtained for the same invention in other countries, whether members of the Union or not.”
