Is there a particular legal framework for non-depositary institutions (different from that applicable to deposit-taking banks)?
Please differentiate between mortgage or housing credit institutions, consumer credit institutions and lease finance institutions.
Non-depository financial institutions (NDIs), such as mortgage finance companies, are primarily regulated under state law.
In New York, these institutions are regulated by the State of New York Banking Department (the NY Banking Department).
The Superintendent of Banks for the State of New York, through the NY Banking Department, issues licenses and monitors capital adequacy (we refer to the Superintendent and the NY Banking Department interchangeably in this memo).
Yet, NDIs may be periodically investigated by federal institutions such as the Department of Housing and Urban Development (HUD), Department of Justice (DOJ), and the Federal Trade Commission (FTC).
This type of federal oversight is often related to investigations of unfair lending practices.
Housing credit institutions, consumer credit institutions and lease finance institutions are subsets of a broader category of NDIs called finance companies, which are generally regulated in the same manner.
