वकील ने जिरह करते हुए दलील दी कि इस मामले में केवल कुछेक लोगों को ही आरोपी बनाया गया है किसी फर्म को आरोपी नहीं बनाया गया है। इस बारे में सामान्यकत: पाया जाता है कि फर्म को नाम से आरोपी नहीं बनाया जाता है बल्कि उसके मुख्यइ कार्यकारी निदेशक तथा साझेदार आदि को आरोपी बनाया जाता है। अत: इस स्ततर पर यह तर्क भी स्वीिकार्य नहीं है।
सीबीई के विशेष लोक अभियोजक ने आरोपियों के वकीलों की उपर्युक्तर दलीलों को खारिज करते हुए कहा कि न्याईयालय को जांच के दौरान जुटाए गए साक्ष्योंर से केवल यह देखना है कि क्याह साक्ष्यह आरोपित व्य क्तिसयों पर मुकदमा चलाने के लिहाज से पर्याप्त हैं या नहीं। इस स्तंर पर न तो साक्ष्यों की गुणवत्ता माइने रखती है और न ही यह देखना होता है कि आरोपित व्यकक्तिनयों को अपराधी सिद्ध करने के लिए साक्ष्यी पर्याप्तह हैं या नहीं। उन्होंतने अनुरोध किया कि गवाहों के बयानों, रिपोर्टों तथा आरोप-पत्र के साथ संलग्न दस्ता्वेजों के आधार पर आरोपित व्यनक्तितयों के खिलाफ आरोप तैयार किए जाएं।
मैंने दोनों पक्षों के तर्क सुने हैं और दस्ताोवेजों तथा फाइलों का गहन अवलोकन किया है।
गवाह श्री ओप्रकाश दधीप, संयुक्ता आयुक्तत, सीमाशुल्क के बयान से प्रथमदृष्ट।या स्पतष्टा होता है कि सीमाशुल्को विभाग के हितों के मद्दे नजर संबंधित फर्मों के शिपिंग बिलों के जरिए निर्यात किए जाने वाले डिब्बों में रखे माल की नियमों के मुताबिक जांच करना तथा डिब्बों की कीमत का सही-सही मूल्यांनकन करना आरोपित दिनेश बांगड़ का दायित्वि था। बयान से प्रथमदृष्टिया स्प ष्टह होता है कि आरापी दिनेश बांगड़ ने जानबूझकर डिब्बोंद की जांच नहीं की और डिब्बोंा में रखे फटे-पुराने कपड़ों को स्वीीकार करके निर्यात के लिए आगे कर दिया। इसी प्रकार, अपराध संहिता की धारा 161 के तहत दर्ज गवाह ओमप्रकाश छाबड़ा के बयान से प्रथम-दृष्ट या प्रतीत होता है कि वह आरोपित सीमाशुल्के निरीक्षक डाली गिल और सीमाशुल्कश मूल्यांयकक के हस्ता‍क्षरों को पहचानता है जिन्होंोने निर्यात के लिए लाए गए विवादास्प द डिब्बोंल को स्वीशकार करके आगे बढ़ाया था एवं शिपिंग बिलों में माल की मनमाफिक कीमत दर्ज की थी। उन्होंोने उसकी कीमत का सत्याोपन नहीं किया हालांकि मूल्यांथकन समिति को कई डिब्बोंम में बहुत ही कम कीमत का घटिया माल मिला था जिसे निर्यात के स्वींकार नहीं किया जाना चाहिए था। आरोपी के वकील की यह दलील इस स्त र पर स्वीथकार नहीं की जा सकती कि यह साफ नहीं है कि किस डिब्बेक की कौन-सी रिपोर्ट कौन-से अरोपी ने दी थी और किस डिब्बें की रिपोर्ट डाली गिल द्वारा दी गई थी। न्याडयालय को अपराध सिद्धि की संभावना नहीं तलाशनी है क्योंेकि इस स्ततर पर मामले में यह विचार किया जाना है कि क्याि अपराधियों के खिलाफ प्रथमदृष्टाया आरोप तय किए जा सकते हैं या नहीं। भारत संघ बनाम प्रफुल्ला सामल (1997, क्रिमिनल लॉ रिपोर्ट, सुप्रीम कोर्ट, पृष्ठभ-462) मामले में उच्चदत्त न्या।यालय ने यह व्य वस्थाे दी है कि आरोप तय करने के स्त र पर अरोपी की अपराधी सिद्धि की संभावना पर विचार नहीं किया जाएगा बल्कि इस बात पर विचार किया जाएगा कि आरोपी के खिलाफ आरोप तय करने के लिए प्रथमदृष्टगया साक्ष्यइ मौजूद हैं या नहीं।
इसी प्रकार, गवाह राजपाल सिंह के बयान से प्रथमदृष्ट या प्रतीत होता है कि मामले में संलिप्त् फर्मों को ड्यूटी ड्रा बैक का किया गया भुगतान नियम विरूद्ध था क्यों कि घटिया माल के निर्यात की वजह से विभाग को कोई विदेशी मुद्रा प्राप्तक नहीं हुई। अत: वकील की यह दलील भी स्वी कार्य नहीं है कि विभाग को माल के अंकित मूल्यर के अनुपात में विदेशी मुद्रा प्राप्त हुई थी।

Translation - English
It was argued by the advocate that only few persons have been named as accused while no firm have been made accused in this case. In this regard, it is generally found that firm is not made accused by name but its Chief Executive Director and partner etc are made accused. Hence this is also not found tenable at this stage.
The Special Public Prosecutor of CBI while opposing the above-mentioned pleas of the advocates for the accused submitted that the court is only to see from the evidences collected during the investigation as to whether the evidences are sufficient or not to try the accused persons. At this stage, neither quality of evidences matters nor it is to be viewed as to whether evidences are sufficient to convict the accused persons or not. He has prayed for framing of charges against the accused persons on the basis of statements of witnesses, reports and documents enclosed with the charge-sheet.
I have heard the arguments of both the parties and intensively perused the documents and files.
It appears prima facie from the statement of witness Sh. Omprakash Dadhip, Joint Commissioner, Custom that keeping in mind the interest of the Custom Department, it was the duty of the accused Dinesh Bangar, Custom Appraiser to check as per rules the goods contained in the containers to be exported through shipping bills of the concerned firms and to make right evaluation of the price of the consignments. It appears prima facie from the statement that the accused Dinesh Kumar Bangar knowingly didn’t check the consignments and after accepting torn and old clothes kept in the containers, forwarded the same for export. Similarly, it prima facie appears from the statement of witness Om Prakash Chabra u/s 161 of Cr.PC that he is familiar with the signatures of the accused Daly Gill, Custom Inspector and Dinesh Bangar, Custom Appraiser, who processed and accepted the disputed containers for export and shown inflated value of goods in the shipping bills. They didn’t verify its value, though the valuation committee had found many containers with substandard goods of extremely low value, which should not have been accepted for export. The argument of the advocate for the accused can’t be accepted at this stage that it was not clear as to which report of which container was given by a particular accused and report of which container was given by the accused Dally Gill. It will be clear during trial only. The court is not to see the possibility of conviction because at the stage of charges, the case is to be considered prima facie as to whether charges can be framed against the accused or not. The Hon’ble Supreme Court has given a ruling in the case of Union of India versus Prafulla Samal (1997, Criminal Law Report, Supreme Court, page-462) that at the stage of charge, the possibility of conviction of the accused will not be considered rather it will be considered as to whether there exists or not prima facie evidences against the accused for framing of charges.
Similarly, it prima facie, appears from the statement of the witness Rajpal Singh that the payment of Duty Draw Back made to the firms involved in the case was against the rule as the department did not get any foreign exchange on account of export of substandard goods. Hence, the argument of the advocate is also not tenable that the department had received foreign exchange in proportion to the stated price of the goods.
