TENTANG
PIHAK PELAPOR DALAM PENCEGAHAN DAN PEMBERANTASAN TINDAK
PIDANA PENCUCIAN UANG

DENGAN RAHMAT TUHAN YANG MAHA ESA

PRESIDEN REPUBLIK INDONESIA,

Menimbang :
bahwa untuk melaksanakan ketentuan Pasal 17 ayat (2) Undang-Undang Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang, perlu menetapkan Peraturan Pemerintah tentang Pihak Pelapor dalam Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang;

Mengingat :
1. Pasal 5 ayat (2) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945;
2. Undang-Undang Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang (Lembaran Negara Republik Indonesia Tahun 2010 Nomor 122, Tambahan Lembaran Negara Republik Indonesia Nomor 5164);

MEMUTUSKAN:

Menetapkan : PERATURAN PEMERINTAH TENTANG PIHAK PELAPOR DALAM PENCEGAHAN DAN PEMBERANTASAN TINDAK PI DANA PENCUCIAN UANG.

Pasal 1
Dalam Peraturan Pemerintah ini yang dimaksud dengan:
1. Pusat Pelaporan dan Analisis Transaksi Keuangan yang selanjutnya disingkat PPATK adalah lembaga independen yang dibentuk dalam rangka mencegah dan memberantas tindak pidana pencucian uang.
2. Setiap Orang adalah orang perseorangan atau korporasi.
3. Pihak Pelapor adalah Setiap Orang yang menurut peraturan perundang-undangan yang mengatur mengenai pencegahan dan pemberantasan tindak pidana pencucian uang wajib menyampaikan laporan kepada PPATK.
4. Pengguna Jasa adalah pihak yang menggunakan jasa Pihak Pelapor.
5. Transaksi adalah seluruh kegiatan yang menimbulkan hak danjatau kewajiban atau menyebabkan timbulnya hubungan hukum antara dua pihak atau lebih.
6. Transaksi Keuangan adalah Transaksi untuk melakukan atau menerima penempatan, penyetoran, penarikan, pemindahbukuan, pentransferan, pembayaran, hibah, sumbangan, penitipan, dan/atau penukaran atas sejumlah uang atau tindakan dan/atau kegiatan lain yang berhubungan dengan uang.
7. Harta Kekayaan adalah semua benda bergerak atau benda tidak bergerak, baik yang berwujud maupun yang tidak berwujud, yang diperoleh baik secara langsung maupun tidak langsung.
8. Transaksi Keuangan Mencurigakan adalah:
a. Transaksi Keuangan yang menyimpang dari profil, karakteristik, atau kebiasaan pola Transaksi dari Pengguna Jasa yang bersangkutan;
b. Transaksi Keuangan oleh Pengguna Jasa yang patut diduga dilakukan dengan tujuan untuk menghindari pelaporan Transaksi yang bersangkutan yang wajib dilakukan oleh Pihak Pelapor sesuai dengan ketentuan peraturan perundang-undangan yang mengatur mengenai pencegahan dan pemberantasan tindak pidana pencucian uang;
c. Transaksi Keuangan yang dilakukan atau batal dilakukan dengan menggunakan Harta Kekayaan yang diduga berasal dari hasil tindak pidana; atau
d. Transaksi Keuangan yang diminta oleh PPATK untuk dilaporkan oleh Pihak Pelapor karena melibatkan Harta Kekayaan yang diduga berasal dari hasil tindak pidana.
9. Lembaga Pengawas dan Pengatur adalah lembaga yang memiliki kewenangan pengawasan, pengaturan, dan/ atau pengenaan sanksi terhadap Pihak Pelapor.
10. Undang-Undang adalah Undang-Undang Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang.

Pasal 2
(1) Pihak Pelapor meliputi:
a. penyedia jasa keuangan:
1. bank;
2. perusahaan pembiayaan;
3. perusahaan asuransi dan perusahaan pialang asuransi;
4. dana pensiun lembaga keuangan;
5. perusahaan efek;
6. manajer investasi;
7. kustodian;
8. wali amanat;
9. perposan sebagai penyedia jasa giro;
10. pedagang valuta asing;
11. penyelenggara alat pembayaran menggunakan kartu;
12. penyelenggara e-money dan/ atau e-uiallet;
13. koperasi yang melakukan kegiatan simpan pinjam;
14. pegadaian;
15. perusahaan yang bergerak di bidang perdagangan berjangka komoditi; atau
16. penyelenggara kegiatan usaha pengiriman uang.
b. penyedia barang dan/ atau jasa lain:
1. perusahaan properti/ agen properti;
2. pedagang kendaraan bermotor;
3. pedagang permata dan perhiasarr/Iogam mulia;
4. pedagang barang seni dan antik; atau
5. balai lelang.
(2) Pihak Pelapor penyedia jasa keuangan selain sebagaimana dimaksud pada ayat (1) huruf a mencakup juga:
a. perusahaan modal ventura;
b. perusahaan pembiayaan infrastruktur;
c. lembaga keuangan mikro; dan
d. lembaga pembiayaan ekspor.

Pasal 3
Pihak Pelapor selain sebagaimana dimaksud dalam Pasal 2 mencakup juga:
a. advokat;
b. notaris;
c. pejabat pembuat akta tanah;
d. akuntan;
e. akuntan publik; dan
f. perencana keuangan.

Pasal 4
Pihak Pelapor sebagaimana dimaksud dalam Pasal 2 dan Pasal 3 wajib menerapkan prinsip mengenali Pengguna Jasa.

REPORTING PARTY IN COUNTERMEASURE AND ERADICATION OF THE CRIMINAL ACT OF MONEY LAUNDERING

WITH THE BLESSING OF GOD THE ALMIGHTY

THE PRESIDENT OF THE REPUBLIC OF INDONESIA,

Considering :
whereas in order to implement the provision of Article 17 sub-article (2) of Law Number 8 of 2010 concerning Countermeasure and Eradication of the Criminal Act of Money Laundering, it is necessary to stipulate Government Regulation concerning the Reporting Party in Countermeasure and Eradication of the Criminal Act of Money Laundering;

In view of :
1. Article 5 sub-article (2) of the 1945 Constitution of the State of the Republic of Indonesia;
2. Law Number 8 of 2010 concerning Countermeasure and Eradication of the Criminal Act of Money Laundering (State Gazette of the Republic of Indonesia Year 2010 Number 122, Supplement to State Gazette of the Republic of Indonesia Number 5164);

RESOLVES:

To stipulate : GOVERNMENT REGULATION CONCERNING THE REPORTING PARTY IN COUNTERMEASURE AND ERADICATION OF THE CRIMINAL ACT OF MONEY LAUNDERING.

Article 1
In this Government Regulation, the meaning of:
1. The Financial Transactions Reporting and Analysis Center, hereinafter abbreviated to PPATK, shall be the independent institution established to prevent and eradicate the criminal act of money laundering.
2. Any Person shall be an individual or a corporation.
3. Reporting Party shall be Any Person whom the laws and regulations governing the countermeasure and eradication of the criminal act of money laundering consider obligated to submit report to the PPATK.
4. User shall be the party who uses the service of the Reporting Party.
5. Transaction shall be all activities which give rise to rights and/or obligation or which result in legal relation between two parties or more.
6. Financial Transaction shall be a Transaction to perform or receive placement, deposit, withdrawal, mutation, transfer, payment, grants, donation, custody, and/or exchange of a sum of money or an action and/or other activities related with money.
7. Assets shall be all movable objects or immovable objects, whether tangible or intangible, which are acquired directly or indirectly.
8. Suspicious Financial Transaction shall be:
a. Financial Transaction which diverges from the relevant User’s normal profile, characteristic, or pattern of Transaction;
b. Financial Transaction made by a User which is reasonably suspected as has been made to avoid reporting the relevant Transaction, which is mandatory for the Reporting Party in accordance with the provision of the laws and regulations governing the countermeasure and eradication of the criminal act of money laundering;
c. Financial Transaction which is made or cancelled, which uses Assets which are allegedly constitute the proceeds of a criminal act; or
d. Financial Transaction in which PPATK requires the Reporting Party to submit the report thereon, since it involves Assets which are allegedly constitute the proceeds of a criminal act.
9. The Supervisory and Regulatory Agency shall be the agency authorized to supervise, regulate, and/or impose sanctions on the Reporting Party.
10. The Law shall be Law Number 8 of 2010 concerning Countermeasure and Eradication of The Criminal Act of Money Laundering.

Article 2
(1) Reporting Party shall include:
a. financial services provider:
1. bank;
2. finance company;
3. insurance company and insurance broker company;
4. financial institution pension fund;
5. securities company;
6. investment manager;
7. custodian;
8. trustee;
9. postal service as current account service provider;
10. trader of foreign currency;
11. card-based payment device service provider;
12. e-money and/or e-wallet service provider;
13. saving and loan cooperative;
14. pawn shop;
15. company engaging in the field of commodity futures trading; or
16. remittance service provider.
b. provider of other goods and/or services:
1. property company/ property agent;
2. motor vehicle dealers;
3. gems and jewelry/precious metal dealers;
4. antique and artistic stuff dealers; or
5. auction house.
(2) Reporting Party of financial services provider, in addition to those intended in sub-article (1) letter a, shall also include:
a. venture capital company;
b. infrastructure finance company;
c. microfinance company; and
d. export finance company.

Article 3
Reporting Party, in addition to those intended in Article 2, shall also include:
a. advocate;
b. notary;
c. conveyancer;
d. accountant;
e. public accountant; and
f. financial planner.

Article 4
Reporting Party as intended in Articles 2 and 3 shall be obligated to implement the principles of Know the User.

1.2 Interpretation

In this deed:

(a) Any Guarantor, the First Creditor, the Facility Agent, any Transaction Party or any other person is construed so as to include its successors in title, permitted assigns and permitted transferees and, in the case of the First Creditor, any person for the time being appointed as “Security Agent” or “Security Agents” in accordance with the First Creditor Documents.

(b) A document in agreed form is a document which is previously agreed in writing by or on behalf of the Debtor and the Facility Agent.

(c) Assets includes present and future properties, revenues and rights of every description.

(d) Any agreement or instrument is a reference to that agreement or instrument as amended or novated (however fundamentally).

(e) A regulation includes any regulation, rule, official directive, request or guideline (whether or not having the force of law) of any governmental, intergovernmental or supranational body, agency, department or regulatory, self-regulatory or other authority or organisation and if not having the force of law, with which responsible entities in the position of the relevant party would normally comply.

(f) A provision of law or a regulation is a reference to that provision as amended or re-enacted.

(g) Unless a contrary indication appears, a time of day is a reference to Sydney time.

(h) Section, clause and Schedule headings are for ease of reference only.

(i) Unless a contrary indication appears, a term used in any other First Creditor Document or in any notice given under or in connection with any First Creditor Document has the same meaning in that First Creditor Document or notice as in this deed.

(j) An Event of Default (as defined in a First Creditor Document or the Second Facility Agreement, as the case may be) subsists until the First Creditor has been notified that it has been waived or remedied in accordance with the terms of the First Creditor Document or the Second Facility Agreement under which it occurred.

Dalam akta ini:

(a) Setiap Pemberi Garansi, Kreditur Pertama, Agen Fasilitas, setiap Pihak Transaksi, atau setiap orang lainnya ditafsirkan sebagai termasuk para penerusnya dalam hak milik, para penerima pengalihan yang diizinkan serta para penerima transfer yang diizinkan dan, dalam hal Kreditur Pertama, setiap orang yang untuk saat ini ditunjuk sebagai "Agen Jaminan" atau "Para Agen Jaminan" sesuai dengan Dokumen Kreditur Pertama.

(b) Dokumen dalam bentuk yang disepakati merupakan dokumen yang telah disepakati sebelumnya secara tertulis oleh atau atas nama Debitur dan Agen Fasilitas.

(c) Aset termasuk properti, pendapatan, dan hak dengan uraian apa pun, yang ada pada saat ini dan di kemudian hari.

(d) Setiap perjanjian atau instrumen merupakan acuan kepada perjanjian atau instrumen tersebut sebagaimana yang diubah atau dinovasi (secara mendasar dengan cara apa pun).

(e) Peraturan termasuk setiap peraturan, aturan, kebijakan resmi, permohonan atau petunjuk (baik yang memiliki atau pun tidak memiliki kekuatan hukum) dari setiap badan, instansi, departemen pemerintah, antarpemerintah, atau supranasional, atau otoritas atau organisasi pengaturan, yang mengatur diri sendiri, atau otoritas atau organisasi lainnya, dan apabila tidak memiliki kekuatan hukum, yang biasanya dipatuhi oleh para entitas yang bertanggung jawab yang berada dalam posisi pihak yang terkait.

(f) Suatu ketentuan undang-undang atau peraturan merupakan acuan kepada ketentuan tersebut sebagaimana yang diubah atau diberlakukan kembali.

(g) Kecuali apabila terdapat indikasi yang bertentangan, suatu waktu pada suatu hari merupakan acuan kepada waktu Sydney.

(h) Judul Pasal, klausul, dan Lampiran hanya untuk kemudahan pengacuan.

(i) Kecuali apabila terdapat indikasi yang bertentangan, suatu istilah yang digunakan dalam setiap Dokumen Kreditur Pertama lainnya atau dalam setiap pemberitahuan yang disampaikan berdasarkan atau sehubungan dengan Dokumen Kreditur Pertama memiliki arti yang sama dalam Dokumen Kreditur Pertama atau pemberitahuan tersebut sebagaimana dalam akta ini.

(j) Peristiwa Wanprestasi (sebagaimana yang didefinisikan dalam Dokumen Kreditur Pertama atau Perjanjian Fasilitas Kedua, sesuai dengan keadaan) terus berlangsung hingga Kreditur Pertama diberitahukan bahwa Peristiwa Wanprestasi tersebut telah dikesampingkan atau diperbaiki sesuai dengan ketentuan Dokumen Kreditur Pertama atau Perjanjian Fasilitas Kedua berdasarkan mana hal tersebut terjadi.

I am a full time freelance translator currently living in Jakarta, Indonesia. I am a graduate in Public Relations and used to work as a Public Relations officer in a Bank. At one point, however, I had to resign to help my mother's business due to her health condition. Following my resignation, I was requested by my (then) manager to keep providing them with translation services for press releases and articles as a freelance translator.

This is the beginning of my pursuit of career as a translator. I took translation courses, both general and legal, and studied in the University of New South Wales where I was conferred a Master's Degree in Interpreting and Translation Studies.
