Source text - French Monsieur le Premier Ministre Chef du Gouvernement, Chers Collègues, L’Accord de Paris sur les changements climatiques a été adopté par consensus, le 12 décembre 2015, lors de la vingt et unième session de la Conférence des Parties à la Convention-Cadre des Nations Unies sur les changements climatiques (COP 21), tenue à Paris du 30 novembre au 13 décembre 2015, au cours de laquelle le Président de la République, S.E. Paul BIYA, a personnellement pris part. Il concrétise une longue suite de négociations internationales, entamées à Bali en 2007 (COP 13), en passant par Copenhague en 2009 (COP 15) et Durban en 2011 (COP 17), au cours desquelles les différents gouvernements ont convenu d’adopter un nouvel accord, universel et juridiquement contraignant, appelé à remplacer le Protocole de Kyoto, qui prend fin en 2020. Les enjeux qui ont prévalu à l’adoption de l’Accord de Paris sur le climat tournaient autour dela négociation d’un Accord universel, conformément au mandat de Durban, qui établit des règles et des mécanismes capables de relever progressivement l’ambition pour respecter la limite des 2°C ; la présentation des Contributions Prévues Déterminées au niveau National, afin de créer un effet d’entraînement et de démontrer que tous les États avancent, en fonction de leurs réalités nationales, dans la même direction ; et le volet financier, qui doit permettre de soutenir les pays en développement et de financer la transition vers des économies bas-carbone et résilientes, avant et après 2020. Au terme des négociations, les Etats sont donc parvenus à un consensus selon lequel : il faut limiter l’élévation de la température moyenne de la planète nettement en dessous de 2 °C par rapport aux niveaux préindustriels ; chaque Etat est tenu d’établir, communiquer et actualiser sa Contribution Prévue Déterminée au niveau National; et enfin, les pays développés Parties fournissent des ressources financières technologiques et techniques aux pays en développement, afin de les aider à mieux renforcer leurs capacités d’adaptation, d’atténuation et de résilience aux changements climatiques. Le texte a été ouvert à la signature des différents gouvernements, à l’occasion d’une cérémonie de haut niveau, organisée au siège des Nations Unies à New York, le 22 avril 2016. Le présent exposé, qui rend compte des « aspects juridiques et diplomatiques relatifs à l’entrée en vigueur de l’Accord de Paris sur les changements climatiques », est articulé autour de deux points principaux, à savoir les conditions d’entrée en vigueur de l’Accord, d’une part, et les implications juridiques et diplomatiques de son entrée en vigueur, d’autre part. Sur le premier point, à savoir les conditions d’entrée en vigueur de l’Accord de Paris, celles-ci sont formulées à l’article 21, paragraphe 1 du texte, aux termes duquel « le présent Accord entre en vigueur le trentième jour qui suit la date du dépôt de leurs instruments de ratification, d’acceptation, d’approbation ou d’adhésion par au moins 55 Parties à la Convention qui représentent au total au moins un pourcentage estimé à 55% du total des émissions mondiales de gaz à effet de serre ». L’on déduit aisément, de la lecture de ce paragraphe que, dans un souci d’efficacité, l’entrée en vigueur de l’Accord de Paris est doublement conditionnée aux plans quantitatif et qualitatif. Au plan quantitatif, il s’agit pour l’Accord d’être ratifié par au moins 55 des 197 parties à la Convention-Cadre des Nations Unies sur les changements climatiques. Toutefois, tout instrument déposé par une Organisation d’Intégration Economique Régionale (OIER) n’est pas compté en sus de ceux qui sont déposés par ses États membres. Au plan qualitatif, les Etats ayant ratifié l’Accord doivent faire partie des grands pollueurs de la planète, représentant au moins 55% des émissions mondiales de gaz à effet de serre. En d’autres termes, si cet Accord venait à être ratifié uniquement par des Etats peu émetteurs de gaz à effet de serre, des pays en développement notamment, il ne saurait entrer en vigueur, quand bien même le quota des 55 ratifications aurait été atteint. C’est pourquoi, aussi bien pour son entrée en vigueur que pour son efficacité, la participation des grands pays émetteurs de gaz à effet de serre comme les Etats-Unis d’Amérique, la Chine, la Russie, l’Inde, le Brésil, ainsi que les pays de l’Union Européenne, est fondamentale. Notons à ce sujet que jusqu’au 03 novembre 2016, 193 Etat Parties à la Convention-Cadre des Nations Unies sur les Changements Climatiques avaient signé l’Accord de Paris, et 110 d’entre-eux l’avaient ratifié au 4 novembre 2016. Le 21 septembre 2016 lors du de la réunion de Haut niveau, relative à l’entrée en vigueur de la l’Accord de Paris, convoquée par le Secrétaire Général des Nations Unies, Ban Ki Moon, en marge de la 71ème session de l’Assemblée Générale des Nations Unies, l’Accord de Paris a atteint son premier objectif à savoir : 55 pays représentant seulement 40% des émissions mondiales de gaz à effet de serre. Alors que l’entrée en vigueur est en principe prévue en 2020, ledit Accord connait une entrée en vigueur en force, le 04 novembre 2016 lors de la Cop22 à Marrakech, atteignant ainsi le second objectif, soit plus de 55% des émissions mondiales de gaz à effet de serre. S’agissant du Cameroun en particulier, sur les Très Hautes Instructions du Chef de l’Etat, S.E. Paul BIYA, j’ai moi-même procédé à la signature de l’Accord de Paris, le 22 avril 2016 et, après habilitation parlementaire par la loi n°2016/008 du 12 juillet 2016 autorisant le Président de la République à ratifier l’Accord de Paris sur le climat, et le décret N°2016/320 du 12 juillet 2016 portant ratification dudit Accord, notre pays a déposé ses instruments de ratification au Secrétariat Général des Nations Unies le 29 juillet 2016, devenant à cette date, le 21e Etat Partie. Monsieur le Premier Ministre, Chef du Gouvernement, Chers collègues, L’intervalle de temps, entre l’entrée en vigueur du texte et son application effective, serait l’occasion pour toutes les parties concernées d’ouvrir des concertations visant à faciliter la mise en œuvre prochaine des obligations auxquelles elles ont souscrit. La COP 21, à cet effet, a d’ailleurs créé un Groupe de travail spécial de l’Accord de Paris, aux fins, d’une part, de préparer l’entrée en vigueur du texte et, d’autre part, de convoquer la première session de la Conférence des Parties siégeant comme Réunion des Parties à l’Accord de Paris (cf. COP 21, décision 1/CP.21, paragraphe 8). Sur le second point de mon propos, relatif aux implications juridiques et diplomatiques de l’entrée en vigueur de l’Accord de Paris, permettez-moi tout d’abord de rappeler que ce texte, au même titre que la Convention-Cadre des Nations Unies sur les Changements Climatiques et le Protocole de Kyoto, selon ce qui ressort de son préambule et repris en son article 4. paragraphe 3, est placé sous l’empire du principe de responsabilités communes mais différenciées et des capacités respectives, eu égard aux différentes situations nationales. Ce qui emporte un certain nombre d’effets, à savoir que les attentes, droits et obligations de toutes les parties contractantes, développées et en développement, ne seront pas les mêmes au moment de l’application du texte. A ce titre, pour les pays en développement au registre desquels se situe bien évidemment le Cameroun, l’Accord de Paris prévoit : • Un appui financier, provenant des pays développés, ainsi que des institutions et organismes spécialisés des Nations Unies, pour la mise en œuvre de leurs obligations conventionnelles, étant entendu qu’un appui renforcé leur permettra de prendre des mesures plus ambitieuses. Certes, le montant de cet appui financier n’est pas déterminé à l’avance. Mais il convient de préciser sur ce point, que les ressources dont il s’agit devront être plus importantes que celles qui leur ont jusque-là été versées, prévisibles, additionnelles (c’est-à-dire qu’elles s’ajoutent et ne se substituent pas à l’aide publique au développement), et tenir compte des stratégies impulsées par les pays eux-mêmes en fonction de leurs priorités et besoins nationaux. Je souligne toutefois, peut-être pour le regretter aussi, que le montant de 100 milliards de dollars US par an d’ici à 2020, prévu au titre du Fonds Vert pour le Climat, n’est pas consigné dans le texte même de l’Accord de Paris, mais plutôt dans une décision annexe de la COP 21, ce qui pourrait constituer un obstacle à la libération desdites ressources en temps opportun. • En dehors de l’appui financier, l’Accord de Paris met également en place différents mécanismes de concertation pour la mise au point et le transfert des technologies, ainsi que le renforcement des capacités, en faveur des pays en développement. Sur un tout autre plan, dans le registre des obligations découlant de l’Accord de Paris, les pays en développement s’engagent à : • Communiquer, tous les cinq ans, sous réserve d’une modification ultérieure de cette périodicité, leur Contribution Prévue Déterminée au niveau National (CPDN) au titre de la réalisation des objectifs de l’Accord. Par ce document, il s’agit, pour chaque pays, d’informer le reste de la communauté internationale sur ses engagements en matière de réduction de ses émissions de gaz à effet de serre. A titre de rappel, notre pays a déjà formulé et déposé sa CPDN initiale. Dans ce document, le Gouvernement camerounais indique sa disponibilité à réduire ses émissions de gaz à effet de serre à hauteur de 32% par rapport à un scénario de référence pour l’année cible (2035). Cet engagement, bien évidemment, est conditionné au soutien de la communauté internationale sous forme de financement, d’actions de renforcement des capacités et de transfert des technologies. • Une fois l’Accord en vigueur, notre pays devra en outre produire un rapport national d’inventaire aussi bien de ses émissions anthropiques de gaz à effet de serre que d’absorption desdits gaz ; élaborer une stratégie à long terme de développement à faible émission de gaz à effet de serre ; communiquer sur les mesures qu’il prend en faveur de la conservation de ses forêts ; élaborer et mettre en œuvre des mesures d’adaptation aux changements climatiques ; prendre des mesures en faveur de l’éducation, la formation, la sensibilisation, la participation du public et l’accès des populations à l’information dans le domaine des changements climatiques. Bien évidemment, certaines de ces mesures ont déjà été entreprises, il s’agira juste pour notre pays de les poursuivre et, si besoin, de les renforcer. Tout comme le Protocole de Kyoto, aucune réserve ne peut-être faite au présent Accord. À l'expiration d'un délai de trois ans à compter de la date d'entrée en vigueur dudit Accord à l'égard d'une Partie, celle-ci peut, à tout moment, le dénoncer par notification écrite adressée au Dépositaire. Cette dénonciation prend effet à l'expiration d'un délai d'un an à compter de la date à laquelle le Dépositaire en reçoit notification, ou à toute date ultérieure pouvant être spécifiée dans ladite notification. Toute Partie qui aura dénoncé la Convention sera réputée avoir dénoncé également le présent Accord. Par ailleurs, Monsieur le Premier Ministre, Chef du Gouvernement, Chers Collègues, l’Accord de Paris fait de la coopération internationale, aux niveaux bilatéral et multilatéral, un des leviers majeurs de l’efficacité de la lutte mondiale contre les changements climatiques. C’est dans ce registre que l’action diplomatique est davantage interpellée et, à ce titre, pourrait être la plus déterminante pour permettre à notre pays non seulement de capitaliser les attentes légitimes que suscite ledit Accord auprès des populations camerounaises, mais également de mettre en œuvre, sans grande difficulté, les engagements auxquels il a souscrit. Pour nous, une telle action n’est conditionnée ni par l’entrée en vigueur du texte ni par son application, si tant est que les effets des changements climatiques n’attendront pas 2020 pour se manifester. C’est pourquoi, bien avant l’entrée en vigueur prochaine de ce texte, la diplomatie climatique du Cameroun devra être poursuivie, et même renforcée, à différents niveaux : • D’abord auprès de nos partenaires sous-régionaux (Commission du Bassin du Congo et de la Commission du Bassin du Lac Tchad) et régionaux (Union Africaine), dans l’optique de consolider et soutenir des positions africaines communes lors des rencontres internationales. N’oublions pas que, lors de la COP 21, le Chef de l’Etat, dans son discours, a insisté sur la nécessité de sauver le lac Tchad, ainsi que les forêts du Bassin du Congo. • Ensuite, notre diplomatie climatique devra se poursuivre auprès de nos partenaires bilatéraux et multilatéraux, nouveaux et traditionnels, je pense notamment à la France qui, à l’occasion de la COP 21, a fait preuve d’un leadership exceptionnel en faveur de l’adoption de l’Accord de Paris, s’illustrant au passage par denombreuses initiatives en faveur des pays africains : promesse de 2 milliards d’euros pour le financement des énergies renouvelables en Afrique sur la période 2016-2020 ; triplement de ses engagements bilatéraux en Afrique, pour atteindre 1 milliard d’euros par an en 2020, en matière de lutte contre la désertification et l’adaptation aux changements climatiques ; aide prioritaire pour les projets en faveur de la Grande Muraille Verte, de la préservation du lac Tchad et du fleuve Niger. • Toujours aux niveaux bilatéral et multilatéral, l’issue de la COP21 offre de nombreuses opportunités relative à la mobilisation des ressources financières, techniques et technologiques en vue de l’atteinte des objectifs fixés par les Parties dans leurs contributions déterminées au niveau national, ce qui nécessite un réel partenariat mondial renforcé et transparent. L’Etat ne pouvant pas tout seul mobiliser les ressources financières nécessaires à la réalisation des objectifs contenues dans sa Contribution déterminée au niveau national, un recours au financement extérieur serait justifié. Pour cela, il serait souhaitable qu’une stratégie de recherche, négociation et mobilisation des ressources financières, en vue de la mise en application effective des projets y afférents, soit élaborée par le MINREX et le MINEPDED. D’ailleurs, le Plan d’Action d’Addis-Abeba sur le financement du développement, met la lutte contre les changements climatiques au centre de ses priorités, en prévoyant la mise en place d’une Aide Publique au Développement pour le climat, distincte de l’Aide Publique au Développement classique. Une telle innovation montre la détermination de la Communauté internationale, à œuvrer à la mobilisation des ressources financières et technologiques pour le climat ; il ne reste plus qu’au pays en développement comme le nôtre, d’élaborer des cadres et stratégies afin de bénéficier de ces nouvelles opportunités de financement contre les changements climatiques. • Une action diplomatique prioritaire serait enfin nécessaire dans le cadre de la gouvernance climatique mondiale, afin que notre pays puisse mieux défendre ses intérêts au sein des différents mécanismes institués dans l’optique de la mise en œuvre de l’Accord de Paris. En effet, ce texte n’a pas réglé tous les points de désaccord entre les différents négociateurs, de sorte que les règles des divers mécanismes institués par l’Accord seront, pour la plupart, définies en 2020, lors de la première Conférence des Parties, siégeant comme Réunion des Parties audit Accord. Il s’agit précisément du mécanisme devant contribuer à l’atténuation des émissions de gaz à effet de serre et promouvoir le développement durable (article 6), des modalités de reconnaissance des efforts d’adaptation des pays en développement (article 7), du cadre de transparence destiné à renforcer la confiance mutuelle et la mise en œuvre efficace de l’Accord de Paris (article 13), ainsi que du mécanisme pour la facilitation, la mise en œuvre et la promotion du respect des dispositions de l’Accord (article 15). • La ratification par la Chine et les Etats-Unis, les plus gros pollueurs de la planète, qui totalisent à eux-seuls 38% des émissions mondiales des gaz à effet de serre, pourrait engendrer un effet d’entrainement, motivant le reste des Etats signataires n’ayant pas encore ratifié l’Accord de Paris, à le faire. De même, cela donnera de grands espoirs pour le respect des engagements et la mobilisation des ressources. • En Afrique en général, le Cameroun est le 2ème pays à avoir ratifié l’Accord de Paris sur le climat, et le 1er en Afrique Centrale et dans les Bassins du Lac Tchad et du Congo. De ce seul fait,notre pays pourrait jouer le rôle de leader dans la région, et à travers son empreinte diplomatique amener ses pays frères et voisins à le faire dans les jours à venir. Ainsi, afin de susciter des pays amis, des actions en faveur de la ratification du présent Accord, mon Département ministériel a par notes verbales et correspondances séparées, notifié toutes les missions diplomatiques étrangères au Cameroun et toutes ses représentations diplomatiques à l’étranger, de la ratification par notre pays de l’Accord de Paris sur le climat, le 29 juillet 2016. Par cet acte, le Cameroun marque son engagement et se pose comme un modèle à la lutte contre les changements climatiques. Voilà, Monsieur le Premier Ministre, Chef du Gouvernement, Chers collègues, les développements que suscitent auprès de mon Département ministériel, les aspects juridiques et diplomatiques relatifs à l’entrée en vigueur de l’Accord de Paris sur les changements climatiques. Je vous remercie pour votre attention./-	Translation - English Mr Prime Minister, Head of Government, Dear colleagues, The Paris Agreement on Climate Change was adopted by consensus on December 12, 2015 during the twenty-first session of the Conference of the Parties to the United Nations Framework Convention on Climate Change (COP 21), held in Paris from 13 November to 13 December 2015, at which the President of the Republic, H.E. Paul BIYA personally participated. The Agreement consolidates a long period of international negotiations launched in Bali in 2007 (COP 13) through Copenhagen in 2009 (COP 15) and Durban in 2011 (COP 17), at which various governments agreed to adopt a new universal and legally binding agreement to replace the Kyoto Protocol that ends in 2020 . The stakes which prevailed in the adoption of the Paris agreement on Climate were about the negotiation of a universal agreement according to the Durban mandate that sets up the rules and mechanisms able to gradually hold the increase in the global average temperature to well below 2°C ; the presentation of nationally determined contributions to bring about a knock-on-effect and to demonstrate the evolution of all states in the same direction, depending on their national contexts; and financial matters that will support developing countries and finance the transition towards economy-wide emission reduction before and after 2020 . At the end of the negotiations, states agreed on a consensus that: parties shall hold the increase in the global average temperature to well below 2°C above pre-industrial levels and pursuing efforts to limit the temperature increase above pre-industrial levels; each state shall prepare, communicate and maintain successive nationally determined contributions, and finally developed country parties should continue taking the lead by undertaking economy-wide absolute emission reduction targets, enhancing mitigation efforts of developing countries and encouraging them to move over time towards economy-wide emission reduction or limitation targets. The text was open for signature by various governments during a high-standard ceremony held at the United Nations Headquarters in New York, on April 22, 2016. The hereby presentation, which reports on “Legal and Diplomatic Aspects concerning the entry into force of the Paris Agreement On Climate Change”, is built around two main points, namely the conditions for entry into force of the agreement, on the one hand and legal and diplomatic implications for its entry into force, on the other hand. Concerning the first point, namely the conditions for entry into force of the Paris Agreement, they are set out in Article 21, paragraph 1, after which “this Agreement shall enter into force on the thirtieth day after the date on which at least 55 Parties to the Convention accounting in total for at least an estimated 55 per cent of the total global greenhouse gas emissions have deposited their instruments of ratification, acceptance, approval or accession.” It can be clearly inferred, from the reading of this paragraph that, in order to be effective, the entry into force of the Paris Agreement is twice conditioned in both quantitative and qualitative terms. In terms of quantity, the agreement shall be ratified by at least 55 of the 197 parties to the United Nations Framework Convention on Climate Change. However, any instrument deposited by a Regional Economic Integration Organization (REIO) is not part of the above deposited by those member states. In terms of quality, the states ratifying the Agreement shall be part of the biggest polluters on the planet, representing at least 55% of total greenhouse gas emissions. In other words, if this agreement is only ratified by states that generate low levels of greenhouse gas, especially developing countries, it would not enter into force even if the quota of 55 ratifications would have been achieved. That is why, both for its entry into force and for its efficiency, the participation of big polluters of greenhouse gas like United States, China, Russia, India, Brazil, as well as European Union countries, is vital. Note that up to November 03, 2016, 193 state parties to the United Nations Framework Convention on Climate Change signed the Paris Agreement and 110 of them had ratified it on November 04, 2016. On September 21, 2016 during the high-level meeting on the entry into force of the Paris Agreement, convened by the Secretary-General of the United Nations, Ban Ki Moon, on the sidelines of the 71st session of the United Nations General Assembly, the Paris Agreement achieved its first objective, namely 55 states representing only 40% of global greenhouse gas emissions. Although the Agreement was expected to be in effect in 2020, its entry into force was already effective on November 04 2016 during the COP 22 in Marrakech, thereby achieving the second objective, which was more than 55% of worldwide greenhouse gas emissions. With regard to Cameroon in particular, on the Very High Instructions of the Head of State, H.E. Paul BIYA, I personally signed the Paris Agreement on April 22, 2016 and, after the parliamentary authorization by law N° 2016/008 of 12 July 2016 authorizing the President of the Republic to ratify the Paris Climate Agreement, and Decree N° 2016/320 of 12 July 2016 ratifying this Agreement, our country deposited its ratification instruments at the United Nations General Secretariat on July 29, 2016, becoming the 21st State Party on that date. Mr Prime Minister, Head of Government, Dear colleagues, The interval between the entry into force of the text and its effective implementation would be an opportunity for all the parties concerned to open consultations in order to facilitate the forthcoming implementation of the obligations to which they have subscribed. To this end, COP 21 established a Special Task Force of the Paris Agreement, with a view to preparing for the entry into force of the text on the one hand and, on the other hand, convening the first session of the Conference of the Parties serving as the meeting of the Parties to the Paris Agreement (see COP 21, decision 1 / CP.21, paragraph 8). As concerns my second point on the legal and diplomatic implications of the entry into force of the Paris Agreement, let me first of all recall that this text, in the same way as the United Nations Framework Convention on Climate Change and the Kyoto Protocol, as reflected in its preamble and reflected in its Article 4 paragraph 3, is placed under the principle of common but differentiated responsibilities and respective capacities, regarding the various national contexts. This brings a number of effects, namely the fact that the expectations, rights and obligations of all developed and developing contracting parties will not be the same at the time of implementation. As such, for developing countries in which Cameroon is obviously located, the Paris Agreement provides: - Financial support from developed countries, as well as United Nations specialized agencies and institutions, for the implementation of their treaty obligations, given that an enhanced support will enable them to take more ambitious action. Of course, the amount of this financial support is not determined in advance. On this point, however, it should be pointed out that the resources in question must be larger than those which have hitherto been paid, foreseeable, additional (that is added to and Do not replace official development assistance), and take into account country-driven strategies based on national priorities and needs. I would point out, however, and perhaps also to regret it, that the amount of US $ 100 billion per year by 2020, under the Green Climate Fund, is not reflected in the text itself. But rather in a subsidiary decision of COP 21, which could constitute an obstacle to the release of these resources in due course. - Apart from financial support, the Paris Agreement also sets up various consultation mechanisms for the development and transfer of technology, as well as capacity building for developing countries. On an entirely different level, regarding obligations under the Paris Agreement, developing countries undertake to: • Submit, at five-year intervals, subject to a subsequent modification of this periodicity, their Contribution Planned Determined at the National Level (CPDN) in pursuit of the objectives of the Agreement. The purpose of this document is for each country to inform the rest of the international community about its commitments to reduce its greenhouse gas emissions. As a reminder, our country has already formulated and deposited its initial CPDN. In this document, the Government of Cameroon indicates its readiness to reduce its greenhouse gas emissions by 32% compared to a reference scenario for the target year (2035). This commitment, of course, is conditional on the support of the international community in the form of financing, capacity-building and technology transfer. • Once the Agreement is in force, our country will also have to produce a national inventory report of both its anthropogenic greenhouse gas emissions and the absorption of these gases; develop a long-term development strategy for low-green house effect gases; communicate on measures it is taking to conserve its forests; develop and implement climate change adaptation measures; take action in support of education, training, awareness-raising, public participation and access to information in the area of climate change. Obviously, some of these measures have already been taken, the task of our country will be to undertake them and, if necessary, to strengthen them. Like the Kyoto Protocol, no reservations can be made to this Agreement. On the expiry of a period of three years from the date of entry into force of this Agreement in respect of a Party, it may at any time denounce it by giving written notification to the depositary. Such denunciation shall take effect on the expiry of a period of one year from the date on which the depositary receives notification, thereof or such later date as may be specified in such notification. Any Party which will denounce the Convention shall be deemed to have denounced this Agreement as well. In addition, Mr Prime Minister, Head of Government, Dear Colleagues, the Paris Agreement makes bilateral and multilateral international cooperation a major leverage in the effectiveness of the global fight against climate change. In this context, diplomatic action is more concerned and, as such, could be the most decisive factor in enabling our country not only to capitalize on the legitimate expectations arising from the Agreement among Cameroonian populations, but also to implement without great difficulty, the commitments to which it has subscribed. For us, such an action is not conditioned by the entry into force of the text or by its implementation, if the effects of climate change will not wait until 2020 to come forward. This is why, long before the forthcoming into force of this text, Cameroon's climate diplomacy shall be continued and even strengthened at different levels: • First with our sub-regional partners (Congo Basin Commission and Lake Chad Basin Commission) and regional ones (African Union), with a view to consolidating and supporting common African positions at international meetings. Let us not forget that at the COP 21 the Head of State in his speech insisted on the need to save Lake Chad and the forests of the Congo Basin. • Secondly, our climate diplomacy shall be continued with our new and traditional bilateral and multilateral partners, notably France, which on COP 21 demonstrated exceptional leadership in favour of the adoption of the Paris Agreement, and also illustrated by numerous initiatives in favour of African countries: promise of 2 billion euros for the financing of renewable energies in Africa over the period 2016-2020; Tripling of its bilateral commitments in Africa to reach 1 billion euros per year in 2020 in the fight against desertification and adaptation to climate change; Priority aid for projects in favour of the Great Green Wall, the preservation of Lake Chad and the Niger River. • Also at bilateral and multilateral levels, the outcome of COP21 offers many opportunities for the mobilization of financial, technical and technological resources to achieve the objectives set by the Parties in their determined contributions at the national level, which requires a strong and transparent global partnership. Since the State cannot by itself mobilize the financial resources necessary to achieve the objectives contained in its contribution determined at national level, proceeding with external financing would be justified. To this end, it would be desirable for a strategy for research, negotiation and mobilization of financial resources, with a view to the effective implementation of the related projects, to be developed by MINREX and MINEPDED. • Moreover, the Addis Ababa Plan of Action on Financing for Development puts the fight against climate change at the center of its priorities by providing for the setting up of official development assistance for Climate, Distinct from a traditional Official Development Assistance. Such an innovation shows the determination of the international community to work towards the mobilization of financial and technological resources for climate; It is now up to the developing country like ours to develop frameworks and strategies to take advantage of these new opportunities to finance climate change. • Lastly, priority diplomatic action would be necessary in the context of global climate governance, so that our country could better defend its interests within the various mechanisms established in view of the implementation of the Paris Agreement. Indeed, the text did not resolve all the points of disagreement between the various negotiators, so that the rules of the various mechanisms established by the Agreement will for the most part be defined in 2020 at the first Conference of the Parties, Serving as the meeting of the Parties to the said Agreement. It is precisely the mechanism to contribute to the mitigation of greenhouse gas emissions and the promotion of sustainable development (Article 6), the modalities for recognizing the adaptation efforts of developing countries (Article 7), the Transparency framework to enhance mutual trust and effective implementation of the Paris Agreement (Article 13), as well as the mechanism for facilitation, implementation and promotion of compliance to the provisions of the Agreement (Article 15). • Ratification by China and the United States, the world's biggest polluters, which together account for 38% of the world's greenhouse gas emissions, could give rise to a knock-on-effect, motivating the remaining signatory states that have not yet ratified the Paris Agreement to do so. Similarly, it will give great hopes for meeting commitments and mobilizing resources. • In Africa in general, Cameroon is the second country to have ratified the Paris Climate Agreement and the first in Central Africa and the Lake Chad and Congo basins. From this fact alone, our country could play the leading role in the region, and through its diplomatic initiatives, bring its neighbouring and fraternal countries and to do so in the days to come. Thus, in order to encourage friendly countries, actions in favour of the ratification of this Agreement, my Ministerial Department has by verbal notes and separate correspondences, notified all foreign diplomatic missions to Cameroon and all its diplomatic representations abroad, The ratification by our country of the Paris Agreement on Climate, on July 29, 2016. Through this act, Cameroon marks its commitment and poses as a model to the fight against climate change. Source text - French Monsieur le Président, Permettez-moi tout d’abord d’exprimer à chacun des panélistes les remerciements du Cameroun en même temps que ses félicitations pour leurs brillants exposés qui nous rappellent à tous, encore une fois que le droit au développement est un droit de l’homme qui mérite les mêmes attentions et la même considération que tous les autres. Monsieur le Président, L’adoption il y’a trente ans de la déclaration des Nations Unies sur le droit au développement a marqué un tournant historique dans la perception de droits de l’homme d’une part et du développement d’autre part. Désormais en effet, il ne s’agit plus de deux réalités mais de deux processus imbriqués l’un dans l’autre et se renforçant mutuellement. Le droit au développement devient ainsi, aux termes de la Déclaration y relative, « est un droit inaliénable de l'Homme en vertu duquel toute personne humaine et tous les peuples ont le droit de participer et de contribuer à un développement économique, social, culturel et politique dans lequel tous les droits de l'Homme et toutes les libertés fondamentales puissent être pleinement réalisés». Cette Déclaration nous exhorte à adopter des politiques rationnelles favorisant une croissance équitable des populations. Ainsi, pour l’accélération de la croissance au Cameroun, le Gouvernement a adopté un Plan d’urgence national dont la mise en œuvre permettra à court terme de trouver le sentier de l’émergence. Il s’agit d’identifier des actions qui contribuent à lever, dans un bref délais, les goulots d’étranglements observés et à renforcer l’efficacité des autres mesures de politique économique en cours de mise en œuvre. Plus spécifiquement, le plan d’urgence national vise le relèvement à court terme du taux de croissance de l’économie au-dessus de 6 % à travers notamment l’amélioration du taux d’exécution du Budget d’Investissement Public, l’amélioration de la proportion des projets matures inscrits dans le budget et l’accélération du processus de signature et de mise en vigueur des accords de prêts ou de dons ; l’accroissement de l’offre d’emplois décents en faveur des jeunes. Monsieur le Président, Pour mon pays le droit au développement est un droit de l’individu et un droit collectif. En tant que droit collectif, c’est un droit des nations les plus pauvres à un développement qui favoriserait la prise de mesures à l’interne, en vue du bien-être économique et social des populations et leur participation en tant que acteur du développement. En tant que droit individuel, c’est un droit qui fait obligation de garantir à chaque personne des conditions nécessaires au bien-être. S’il est vrai que c’est aux Etats qu’il incombe au premier chef de créer les conditions favorables au développement des peuples et des individus, cette responsabilité est, en matière de mise en œuvre du droit au développement, adéquatement répartie, dans la déclaration sur le droit au développement, entre les systèmes nationaux et internationaux. La Déclaration sur le droit au développement consacre la nécessité d’instaurer un nouvel ordre économique international, de promouvoir l’égalité des chances comme prérogatives aussi bien de l’individu que des nations. Ainsi, en complément des efforts que les pays en développement accomplissent, une assistance internationale efficace est essentielle pour donner à ces pays les moyens de soutenir un développement global. Il ne vous aura certainement pas échappé, Monsieur le Président que cette année nous célébrons en même temps que le trentième anniversaire de la Déclaration des Nations Unies sur le Droit au Développement, le cinquantenaire du Pacte International sur les Droits Civils et Politiques et du Pacte International sur les Droits Economiques, Sociaux et Culturels. Il ne saurait donc y avoir d’occasion plus propice à la réaffirmation de l’indivisibilité et de la complémentarité de tous les droits de l’homme, y compris le droit au développement. Puisse la célébration conjointe de ces anniversaires permettre à la communauté internationale d’amorcer dans les faits, le dialogue souhaité entre les droits civils et politiques d’une part, et les droits économiques, sociaux et culturels, y compris le droit au développement d’autre part. Puisse la célébration du trentième anniversaire de la Déclaration sur le droit au développement, permettre le renforcement de l’élan suscité par l’adoption des Objectifs de Développement Durable et fédérer toutes les énergies pour que personne, aucun pays, aucun individu ne soit laissé à la traîne du développement. Je vous remercie./-	Translation - English Mr President, First of all, I would like to express to each panelist the thanks of Cameroon as well as its congratulations for their brilliant presentations which remind us all, once again that the right to development is a human right which deserves the same attention and consideration as all the others. Mr President, The thirty-year history of the United Nations Declaration on the Right to Development was a historic turning point in perceptions of human rights, on the one hand and of development, on the other hand. Henceforth, it is no longer a matter of two realities but of two closely interlinked processes becoming mutually reinforcing. The right to development thus becomes, under that Declaration, "an inalienable human right by virtue of which every human person and all peoples are entitled to participate in, contribute to, and enjoy economic, social, cultural and political development in which all human rights and fundamental freedoms can be fully realized”. This Declaration urges us to adopt rational policies promoting equitable growth of populations. So, to speed up the growth in Cameroon, the Government has adopted a National Emergency Plan, the implementation of which will contribute in the short term to find the emergence path. The aim is to identify actions that help to remove, within a short period, the bottlenecks observed and to improve the effectiveness of the other economic policy measures under development. More specifically, the national emergency plan targets the short-term increase of the economic growth rate above 6%, in particular by improving the execution rate of the Public Investment Budget and the share of mature projects included in the budget, by accelerating the signature process and enforcement of loan or grant agreements, and increasing decent jobs opportunities for young people. Mr President, For my country, the right to development is both an individual’s right and a collective right. As a collective right, it is the right of the poorest nations to a development which would foster internal measures to be taken, with a view to the economic and social well-being of the populations and their participation as development actors. As an individual’s right, it is a right that guarantees the necessary conditions for well-being to every individual. While it is true that the responsibility lies primarily with states for creating conditions conducive to the development of peoples and individuals, the responsibility for the implementation of the right to development is properly divided among national and international systems in the Declaration on the Right to Development,. The Declaration on the Right to Development devotes the need to establish a new international economic order, to promote equal opportunities as the prerogatives of both individuals and nations. Thus, in addition to the efforts of developing countries, effective international assistance is vital to give these countries the means and facilities to foster their comprehensive development. It has not escaped your notice, Mr. President, that this year we are celebrating at the same time the 30th anniversary of the United Nations Declaration on the Right to Development, the fiftieth anniversary of the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights. There could therefore be no better opportunity to reaffirm the indivisibility and complementarity of all human rights, including the right to development May the joint celebration of these anniversaries enable the international community to initiate the desired dialogue between civil and political rights, on the one hand and economic, social and cultural rights, including the right to development, on the other hand. May the celebration of the thirtieth anniversary of the Declaration on the Right to Development, strengthen the momentum generated by the adoption of the Sustainable Development Goals and pool all energies so that no one, no country, no individual is left behind in development. Au terme de l’article premier de ladite Déclaration, le droit au développement est un droit inaliénable de l'homme en vertu duquel toute personne humaine, et tous les peuples ont le droit de participer et de contribuer à un développement économique, social, culturel et politique dans lequel tous les droits de l'homme et toutes les libertés fondamentales sont pleinement réalisés. Le droit au développement est un droit inaliénable, un droit fondamental qui représente un moyen de faire progresser la promotion et la protection de l’exercice effectif par chacun, de tous les droits de l’homme. Il repose sur un certain nombre d’éléments constitutifs, notamment :  un développement centré sur l’être humain ;  une pleine réalisation de tous les droits de l’homme et toutes les libertés fondamentales ;  la participation active, libre et utile de tout un chacun au développement. II- Mise en œuvre du droit au développement Les Etats sont les principaux acteurs dans la mise en œuvre de la Déclaration sur le droit au développement. Cela se justifie non seulement parce que ce sont les principaux sujets du droit international, mais également parce qu’ils représentent leur peuple, disposent de la légitimité d’édicter des lois et de prendre des mesures adéquates en matière de développement. De plus, la Déclaration donne expressément aux Etats la responsabilité première de la création des conditions nationales et internationales favorables à la réalisation du droit au développement. En parallèle, elle fait des êtres humains et des peuples non seulement le sujet de ce droit mais les acteurs centraux, en insistant sur leur participation. Afin de permettre l’atteinte des objectifs du droit au développement, la Déclaration met l’accent sur la coopération internationale et le devoir des Etats de prendre, séparément et/ou conjointement, des mesures pour formuler des politiques internationales de développement en vue de faciliter la pleine réalisation du droit au développement. Elle exige également des Etats, une action soutenue pour un développement rapide des pays en développement et une assistance internationale efficace pour ces pays, de même que l’élimination des obstacles à la mise en œuvre de ce droit. Le droit au développement devrait ainsi tenir compte des réalités sociopolitiques, économiques et culturelles de chaque pays pour une meilleure réalisation. III- Obstacles à la réalisation du droit au développement Les principaux obstacles à la réalisation du droit au développement sont : le non-respect du droit des peuples à l’autodétermination, les politiques macroéconomiques au niveau international et le manque de coordination au sein du système des Nations Unies. De manière générale, peuvent également être ajoutés les obstacles ci-après :  Les conflits armés (internes et internationaux) et l’armement ;  La dette extérieure et les programmes d’ajustement structurel imposés par les institutions financières internationales ;  L’échange inégal et le commerce inéquitable ;  Les politiques économiques favorisant la mainmise des sociétés transnationales dans tous les domaines ;  La distribution inéquitable des richesses ;  La fuite des capitaux et l’évasion fiscale ;  La mainmise privée sur les richesses naturelles et les gaspillages effrénés ;  Les violations des droits humains en général, économiques, sociaux et culturels en particulier  Le manque de la coopération internationale ;  Le manque de participation populaire ;  La corruption… IV- La mise en œuvre au Cameroun du droit au développement Le Cameroun fait partie des Etats ayant ratifié la Déclaration des Nations Unies sur le droit au développement. Tous les Etats africains ont ratifié cette déclaration ainsi que les 193 Etats membres des Nations Unies. Le Cameroun a pris de nombreuses mesures et a élaboré de nombreuses stratégies pour que le droit au développement soit effectivement réalisé au niveau national à travers la formulation des politiques de développement appropriées. Au niveau national, la Constitution camerounaise du 18 janvier 1996 en son préambule, consacre le droit au développement de tous sans discrimination. En termes de politiques publiques, l’on relève entre autres, le Document de Stratégie pour la Croissance et l’Emploi (DSCE), la vision de l’émergence à l’horizon 2035, le plan d’urgence pour le développement… Le Cameroun a également entrepris de nombreuses réformes aux plans normatif et institutionnel à travers l’adoption de nombreuses lois (foncière, minière, forestière, touristique, de la propriété intellectuelle, d’urbanisation, d’éducation, emploi et le travail, sur la santé, environnementale, la décentralisation, la justice, l’économie, la finance publique…). Au niveau international, la coopération permet au Cameroun de renforcer sa stratégie en matière de développement à travers l’adoption et la ratification de nombreux programmes de développement et traités y relatifs, notamment les OMD et aujourd’hui les ODD, l’Agenda 21, la Convention-Cadre des Nations Unies sur les Changements Climatiques (CCNUCC), la Déclaration Universelle des droits de l’homme, les Pactes internationaux relatifs aux droits civils et politiques, économiques, sociaux et culturels, la Charte Africaine des Droits de l’Homme et des Peuples. Les principaux obstacles au droit du développement au Cameroun sont liés à la multiplication des conflits dans la sous région Afrique Centrale, au terrorisme, à la corruption, au problème de la drogue, à la crise financière internationale, à la crise migratoire et à l’impact des changements climatiques dans les bassins du Lac Tchad et du Congo. Pour surmonter ces obstacles, il faudrait entre autres, renforcer et revitaliser les politiques anticorruptions ; favoriser une paix durable en réduisant les facteurs structurels et culturels propices au développement des conflits et du terrorisme en promouvant l’égalité des chances social, la tolérance religieuse ; favoriser l’accès à l’éducation afin de permettre aux populations de jouir effectivement de leur droit au développement et de tendre vers le bien-être. /-	Translation - English NOTE On the subject THE RIGHT TO DEVELOPMENT I- Definition and attributes of the right to development On 4 December 1986, the United Nations General Assembly adopted the United Nations Declaration on the Right to Development (Resolution 41/128). Under article 1 of the Declaration, the right to development is an inalienable human right by virtue of which every human person and all peoples are entitled to participate in, contribute to, and enjoy economic, social, cultural and political development in which all human rights and fundamental freedoms can be fully realized. The Right to Development is an inalienable right, a fundamental right which represents a means of advancing the promotion and protection of the full exercise of all human rights by each individual. It is based on a number of components:  A human-centred development;  a full realization of all human rights and fundamental freedoms;  an active, free and meaningful participation of everyone in development. II- Implementation of the right to development States are the main actors in the implementation of the Declaration on the Right to Development. This is justified not only because they are the main subjects of international law but also because they represent their people, have the legitimacy to enact laws and take appropriate development measures. Moreover, the Declaration expressly gives States primary responsibility for creating national and international conditions conducive to the realization of the right to development. In parallel, by insisting on their participation, it makes human beings and people not only subjects of this right but also key actors. To achieve the objectives of the right to development, the Declaration emphasizes the international cooperation and the duty of States to take, individually and/or jointly, measures to formulate international development policies with a view to facilitating the full realization of the right to development. It also requires States a sustained action for a rapid development of developing countries and an effective international assistance for these countries, as well as the removal of obstacles to the implementation of that right. The right to development should thus take into account the socio-political, economic and cultural realities of each country for a better achievement. III- Obstacles to the realization of the right to development The main obstacles to the realization of the right to development are: failure to respect the right to self-determination of peoples, international macroeconomic policies and the lack of coordination within the United Nations system. Generally, other obstacles include the following:  (Internal and international) armed conflicts and armament;  External debt and structural adjustment programmes;  Unequal exchange and unfair trade;  Economic policies fostering corporate takeovers in all fields;  Unequal distribution of wealth;  Capital flight and tax evasion;  Private control over natural wealth and unbridled waste;  Human rights violations;  Lack of international cooperation;  Lack of popular participation;  Governance issues at national and global levels. IV- The implementation of the right to development in Cameroon Cameroon, which is among the States that have ratified the United Nations Declaration on the Right to Development, has taken many measures and has developed strategies to achieve the full realization of the right to development at the national level through the formulation of appropriate development policies. At the national level, the Cameroonian Constitution of 18 January 1996, in its preamble, enshrines the right to development for all without discrimination. In terms of public policies, there have been, inter alia, the Growth and Employment Strategy Paper (GESP), the economic emergence by 2035, the contingency plan for development... Cameroon has also undertaken many normative and institutional reforms through the adoption of numerous (land, mining, forestry, tourism, intellectual property, urbanization, education, employment and labor, environmental health, decentralization, justice, economy, public finance, etc.) laws. At the international level, cooperation enables Cameroon to strengthen its development strategy, on the one hand through its accession to various legal instruments (the United Nations Framework Convention on Climate Change (UNFCCC), the Universal Declaration of Human rights, the International Covenants on Human Rights, the African Charter on Human and Peoples' Rights) and through the adoption of numerous development programmes (the MDGs, the SDGs, Agenda 21 etc.), on the other hand. The main obstacles to the right to development in Cameroon are related to the increase in conflicts in the sub-region of Central Africa, terrorism, corruption, drug problem, the international financial crisis, the migration crisis and the impact of climate change in the Congo and Lake Chad basins. To address these obstacles, the solution should include, inter alia, to strengthen and revitalize anti-corruption policies; promote lasting peace by reducing the structural and cultural factors conducive to the increase in conflicts and terrorism, by fostering equal opportunities, religious tolerance; promote the access to education to enable people to effectively enjoy their right to development and to achieve well-being./-

Source text - French VERS UNE OPTIMISATION DU CLASSEMENT DE RÉSISTANCE MÉCANIQUE DES ESSENCES DE BOIS DU BASSIN DU CONGO Charly Julien Nyobe1, René Oum Lissouck1, Jean Kisito Mvogo1, LM Ayina Ohandja1 1 Laboratoire de Mécanique Matériaux, ENSP, Université de Yaoundé I, Cameroun. RESUME L’objet de cette étude est d’affiner le système de classes de résistance mécanique par la prise en compte d’un nombre plus important d’essences de bois (97 essences) et de variables (masse volumique, module de rupture et module d’élasticité). Le test de normalité d’Agastino Pearson a permis de vérifier que ces variables sont toutes normalement distribuées. Suite à la consolidation des données, l’approche déterministe définie un partitionnement en 6 groupes de résistance mécaniques. Par la suite nous avons déterminé par classification floue les éléments les plus représentatifs de chacun groupe, constituant ainsi une base pour l’exécution ultérieure d’essais. Les valeurs caractéristiques des groupes sont évaluées par simulations de Monte Carlo. On obtient alors les classes CM 34, CM 53, CM 69, CM 84, CM 98 et CM 123. Mots clés : approche déterministe, classification floue, groupes de résistance mécaniques INTRODUCTION Les bois exotiques du bassin du Congo sont solides, résistants et esthétiques et font objet d’importants échanges commerciaux internationaux. Les impressionnantes qualités industrielles et les couleurs chatoyantes de ces bois, appréciés dans le monde entier tant pour des utilisations traditionnelles que novatrices, font office de dogme. On y dénombre plusieurs variétés d’espèces vivantes, parmi lesquelles 500 espèces d’arbres environ (FAO 2006). Cette richesse ligneuse est de plus en plus menacée par de nombreux facteurs au premier rang desquels figure la surexploitation d’un très petit nombre d’essences de bois. En effet, des espèces ligneuses à l’instar de l’ayous (triplochytonscleroxylon), du sapelli (entandrophragmacylindricum), du tali (erythrophleumivorense) et de l’azobé (lophiraalata) occupent plus de 80 % de l’exploitation forestière (ATIBT, 2003). Paradoxalement, des centaines d’espèces de bois d’œuvre exploitables sont disponibles en forêt et leur exploitation est très marginale. Comme conséquences, certaines espèces ligneuses du Bassin du Congo se raréfient et leur risque d’extinction à l’état naturel augmente. Le mukulungu (autranellacongolensis) et le wengé (millettialaurentii) par exemple sont des essences de bois en danger critique d’extinction (IUCN, 2011). Le sapelli et l’azobé par exemple sont des espèces vulnérables (UICN, 2011). Mvogo(2008) propose des solutions dont l’implémentation permettrait de limiter l’exploitation des essences dites nobles ou très demandées sur les marchés du bois. Elle est de type Eurocode 5 et porte sur le regroupement mécanique des essences de bois de la partie camerounaise du Bassin du Congo. Basée sur une approche vibratoire(donc non destructive) et d’un échantillonnage calibré au contexte économique des pays en développement, l’auteur propose une organisation de 19 essences tropicales de bois en quatre classes de résistance mécanique T38, T66, T93, et T136. Les chiffres 38, 66, 93, et 136 indiquent les contraintes caractéristiques de rupture en flexion. Ces classes sont respectivement pilotées par l’ayous, le sapelli, le tali et l’azobé. Cette approche est basée sur le principe de la substitution d’une essence surexploitée par une ou plusieurs essences aux propriétés mécaniques très voisines. Dans la classe T38 par exemple, on retrouve l’ayous, l’emien, le fromager. L’ayous qui est très exploité peut être substitué par le fromager sans risque d’altération de la résistance caractéristique en flexion, du module d’élasticité et de la densité. Cependant, la solution proposée par Mvogo(2008) est insuffisante car, il a établi un système de classes mécaniques à partir de 19 essences (soit moins de 5% de la population totale). Dans cet article, l’objectif général que nous visons est d’affiner le travail de Mvogo par la prise en compte d’un nombre beaucoup plus important d’essences pour l’élaboration des classes et l’utilisation de plus de variables pour le classement. MATERIELS ET METHODES Matériels Choix de la base de données De nombreuses bases de données renseignent sur les caractéristiques physiques et mécaniques des bois tropicaux, dont celles qui nous intéressent en particulier à savoir : module d’élasticité axial, masse volumique et contrainte de rupture en flexion. Nous pouvons en citer au moins quatre : ATIBT, ITTO (http://www.itto.int/fr/annual_review_output/), PROTA4U (http://www.prota4u.org) et Tropix 7.5 (http://tropix.cirad.fr/). En 1986, l’Association Technique Internationale des Bois Tropicaux (ATIBT) a publié un manuel intitulée « Atlas des bois tropicaux. Tome 1 – Afrique ». Dans ce manuel, l’ATIBT oriente ses travaux dans la réalisation d’une nomenclature internationale afin d’éviter toute confusion possible sur le marché international. En 2001, l’International Tropical Timber Organisation (ITTO) conçoit une base de données technologiques sur les bois tropicaux intitulé « Tropical Timbers Database ». Dans cette base de données, les propriétés technologiques des essences de bois sont représentées par leurs valeurs moyennes, et complétées par des informations portant sur le comportement des essences durant les opérations de transformation, de mise en œuvre, et leurs utilisations effectives et potentielles. PROTA4U est une base de données produite par PROTA (Plant Resources of Tropical Africa). Pour chaque essence sont présentées de façon condensée : la description, les utilisations, la transformation, les volumes produits et commercialisés et la conservation. Les caractéristiques physiques et mécaniques sont quantifiées et présentées sous forme d’intervalle indiquant les valeurs minimales et maximales. Les recherches les plus récentes sont celles du CIRAD (Centre de coopération Internationale en Recherche Agronomique pour le Développement). En 2004, le CIRAD a conçu un CD-ROM intitulé « Tropix 5.0 ». On y trouve pour chaque essence répertoriée sa description macroscopique et l’aspect du bois, les principales propriétés physiques et mécaniques, le comportement durant les opérations de transformation et de mise en œuvre, ainsi que les utilisations effectives et potentielles. Les valeurs numériques des propriétés mécaniques sont obtenues sur des éprouvettes de dimension 20mm x 20mm x 340mm. Cette base de données est régulièrement mise à jour, et sa dernière version, « Tropix 7.5 », date de mars 2015. Tropix 7.5 offre une bibliothèque de 245 essences tropicales et tempérées. Présentation des essences de bois La base de données Tropix 7.5 offre une bibliothèque de 245 essences de bois tropicales et tempérées, parmi lesquelles 97 sont rencontrées dans le bassin du Congo. Dans ce travail les données que nous utilisons pour ce classement ne sont pas le fruit de nos mesures mais proviennent de la base de données Tropix 7.5. La présente classification s’appuiera donc sur les 97 essences de bois rencontrées dans le bassin du Congo et figurant dans la base de données Tropix 7.5. Méthodes La méthodologie est basée sur les étapes suivantes : - Consolidation des données - Approche déterministe - Approche floue - Prise en compte de l’effet d’échelle Consolidation des données Le processus de consolidation des données est basé sur les étapes suivantes : - Test de normalité - Identification des outliers univariés - Identification des outliers multivariés - Analyse des corrélations Test de normalité Pour ce travail, nous utiliserons le test d’Agastino Pearson (Agastino et al, 1990), reconnu pour sa robustesse. Le test d’Agastino est encore connu sous le nom de test khi-deux. Ce test est basé sur les coefficients d’asymétrie et d’aplatissement . Le principe est de centrer et réduire les deux coefficients de manière à obtenir des valeurs et distribuées asymptotiquement selon une loi normale centrée réduite . La statistique du test est la combinaison : Elle suit asymptotiquement une loi du à 2 degrés de libertés. L’incompatibilité de la distribution évaluée avec la loi normale est d’autant plus marquée que la statistique prend une valeur élevée. Pour un risque , la région critique du test s’écrit : Le seuil critique est alors pour un risque (Rakotomalala, 2011) Identification des outliers univariés Les outliers univariés sont des valeurs observées pour une variable qui semblent anormales (extrêmement petites ou extrêmement grandes) au vue des autres données dont on dispose. Ils peuvent être identifiés à l’aide du test de Dixon (Barnett et Lewis, 1994). Dans ce travail notre choix s’est porté sur les tests de discordance relatifs à la présence des valeurs aberrantes supérieure et inférieure du test N9. Les statistiques respectives des tests s’écrivent : Les statistiques sont calculées et comparées à une valeur critique dépendant du nombre d’observations ou d’individus et du degré de confiance choisi. Le degré de confiance généralement recommandé est de 99%, ce qui correspond dans le cas de 89 individus à une valeur critique de 0.2699 (Verma and Quiroz-Ruiz, 2006). Identification des outliers multivariés La détection des outliers multivariés s’appuiera sur la méthode de Garrett (Garrett ,1989). Pour une série d’observations de dimension p on définit les distances de Mahanalobis comme suit : Où U et C désignent respectivement la moyenne arithmétique multivariée et la matrice de covariance. Pour des observations normalement distribuées, les distances de Mahanalobis suivent approximativement la loi du chi-deux avec p degrés de libertés . Les valeurs des quantiles de la loi de distribution du khi-deux se lisent sur la table de sa loi. Analyse des corrélations L’analyse des corrélations sert à déterminer s’il existe une relation entre les différentes variables étudiées ; et dans le cas où une telle liaison existe, elle permet de quantifier son intensité. Le coefficient de corrélation linéaire entre les variables et est une mesure de l’intensité de la liaison linéaire qui existe entre ces deux variables. Il est définit par : Généralement on admet que deux variables sont très fortement corrélées si , ce qui correspond à . Dans ce cas, on ne retient que l’une des deux variables. Approche déterministe La classification au sens déterministe consiste à répartir un ensemble de n individus en k groupes, chaque individu ne pouvant appartenir qu’à un et un seul groupe. De nombreuses méthodes statistiques permettent le regroupement d’individus semblables dans une population donnée parmi lesquelles la hiérarchisation. La hiérarchisation se fait par classification ascendante hiérarchique (CAH). La CAH repose sur la définition d’une mesure d’éloignement entre groupes. L’éloignement entre individus sera mesuré à l’aide des distances. Étant donné deux individus et , la Distance euclidienne est donnée par la formule (Morey et al., 1983) : Par la suite on obtient des partitions. S’agissant du critère d’agrégation, on utilise le Critère de Ward : Les groupes sont définis comme étant des groupes d’entités dans lesquelles la variance entre les membres est relativement petite (Blashfield et Aldenderfer, 1988). Les groupes sont progressivement formés en fonction du principe de minimisation de la variance (Morey et al., 1983). Elle permet la création de groupes d’effectifs relativement équilibrés (Blashfield et Aldenderfer, 1988) et est particulièrement utile lorsqu’on s’attend à des groupes bien distincts (Lorr, 1983) Approche floue L’évaluation des valeurs caractéristiques des différents groupes s’appuiera sur des simulations de Monte Carlo ( Flachaire 2003). Les valeurs caractéristiques des différents groupes nécessaires au classement des essences correspondent au fractile d’ordre 5% des variables masse volumique, module d’élasticité longitudinal et contrainte de rupture en flexion suivant l’équation suivante Ou représente les valeurs moyennes et les écart-types des variables Si nous désignons par la variable dont nous voulons déterminer la valeur caractéristique pour un groupe donné, alors pour chaque essence dans le groupe nous génèrerons de façon aléatoire une suite de valeurs que peut prendre la variable aléatoire sous l’hypothèse que celle-ci suit une loi normale. Afin d’affiner les résultats, il est nécessaire de prendre en compte un très grand nombre de simulations (Zadeh 1977) Prise en compte de l’effet d’échelle Les caractéristiques mécaniques des bois renseignées par la base de données Tropix 7.5 découlent d’échantillons de dimensions 20mm x 20mm x 340mm (Mvogo, 2008). Ces échantillons de petites dimensions sont supposés sans défaut. Cependant, le bois en dimension structurelle présente des singularités qui diminuent de façon non négligeable ses propriétés mécaniques (Délisée 1987). Afin de déterminer l’influence du changement de dimensions sur les caractéristiques mécaniques du bois nous allons nous aider de trois modèles d’effet d’échelle : le modèle américain tiré de la norme ASTM D1990, le modèle proposé par Lanvin et al. (2011) et le modèle de Nyobe (2015) résultant de ses essais sur l’Okan. RESULTATS Consolidation des données Test de normalité Le tableau ci-dessous résume les résultats obtenus à l’issu du test de normalité d’Agastino-Pearson. Identification des outliers univariés La détection des outliers univariés se fait à l’aide des statistiques et du test de Dixon. Ce test s’effectue avec l’hypothèse que la variable aléatoire utilisée suit une distribution normale, ce qui a été confirmé précédemment. Nous pouvons donc conclure que la base de données constituées de 89 essences de bois représentées par trois variables chacune ne contient aucun outlier univarié. Identification des outliers multivariés L’identification des outliers multivariés se fait conformément à la méthode de Garrett. Les points de la courbe des fréquences cumulées situées à droite du quantile sont les outliers multivariés. Il s’agit des deux essences dont les carrés des distances de Mahanalobis sont les plus élevés à savoir : l’Acajou Cailcedrat et le Congolati Analyse des corrélations Comme on peut le voir sur les graphes ci-dessous, aucun des coefficients de détermination entre les variables et MOR, et MOE ainsi que MOE et MOR n’est supérieur à 0.9 . Autrement dit, la condition du nécessaire pour affirmer la très forte colinéarité entre ces variables n’est pas respectée. Toutes les trois variables seront donc utilisées pour le classement de résistance mécanique des essences de bois du bassin du Congo. Figure 2: Corrélation -MOR Figure 3: Corrélation MOR-MOE Figure 4: Corrélation -MOE Approche déterministe Classification ascendante hiérarchique Après exclusion du Congolati et de l’Acajou Cailcedrat, et tenant compte de la distance euclidienne et le critère d’agrégation de Ward, nous obtenons le dendrogramme suivant : Figure 5: Dendrogramme de proximité de résistance mécanique des essences de bois du bassin du Congo Choix du nombre de groupes De nombreux indices permettent d’estimer le nombre optimal de groupes dans une population. .Il en est ressorti que la méthode de Calinski et Harabasz est celle qui présente les meilleurs résultats. L’approche proposée par Calinski et Harabasz consistait à trouver le nombre de groupes qui maximise l’indice . Cet indice est défini comme suit : Où représente le nombre de groupes, et sont respectivement l’inertie inter-groupe et l’inertie intra-groupe, l’effectif de la population. Nous évaluons pour chaque partition obtenue par coupure du dendrogramme la valeur de l’indice . Pour une meilleure appréciation des variations de cet indice avec le nombre de groupes nous représenterons ce graphe pour les vingt premières partitions (de la partition en 2 groupes à celle en 21 groupes). Figure 6: Variation de l'indice CH en fonction du nombre de groupes La courbe de variation de l’indice en fonction du nombre de groupes révèle que le partitionnement en 6 groupes est le meilleur. Dans la suite de cette étude, nous considérons donc que le regroupement des essences de bois du bassin du Congo se fera en 6 groupes de résistance mécanique. Les valeurs caractéristiques du MOE et de sont conservées tandis que pour le MOR trois modèles d’effet d’échelle sont utilisés : le modèle de Lanvin et al., celui de Nyobe et celui de la norme américaine ASTM D1990. Rappelons que le modèle de la norme ASTM D1990 découle d’essais sur des bois américains, tandis que celui de Lanvin (Lanvin et al.) est issu d’essais réalisés sur des bois tropicaux parmi lesquels quatre essences se retrouvent dans le bassin du Congo (Azobé, Tali, Mukulungu et Okan). Le modèle de Nyobe (Nyobe 2015) s’éloigne significativement des deux précédents modèles. Une explication plus probable est la quasi invariabilité d’une des dimensions des pièces de bois lors des essais ayant conduit à ce modèle. En effet, la formule proposée par Nyobe découle de tests réalisés sur des échantillons de dimensions 20mm x 20mm x 400mm et 22mm x 150mm x 2400mm. Lors du calcul du rapport des volumes, les valeurs 20mm et 22mm s’annulent pratiquement. On peut dès lors considérer que son modèle néglige la variation d’une des dimensions du bois. CONCLUSION Cette article avait pour but d’affiner le système de classes proposé par Mvogo en 2008 par la prise en compte d’un nombre plus important de variables pour le classement des essences et par la considération d’un nombre plus significatif d’essences de bois. La base de données Tropix 7.5 a été utilisée car non seulement elle est la plus récente, est régulièrement mise à jour, mais en plus et surtout elle renseigne sur un paramètre de dispersion (l’écart-type) indispensable pour la détermination des valeurs caractéristiques des différents groupes de résistance. Afin de déterminer le nombre optimal de groupes pour le classement des bois du bassin du Congo, nous nous sommes servis de la méthode de Calinski et Harabasz qui conduit à un partitionnement optimal en 6 groupes de résistance mécaniques. Les valeurs caractéristiques de chaque groupe sont obtenues par la méthode des simulations de Monte Carlo qui conduisent à des résultats similaires. La conformité des résultats obtenus avec ceux proposés par Mvogo fut établie. Enfin nous avons évaluer l’influence de l’effet d’échelle afin d’ajuster les valeurs caractéristiques des différentes classes. À cette fin, nous nous sommes servis de trois modèles rencontrés dans la littérature : le modèle américain tiré de la norme ASTM D1990, le modèle de Lanvin et al. et le modèle de Nyobe. Le modèle de Lanvin et al. Est présenté comme étant le plus convenable mais toute fois diminuent les valeurs caractéristiques réelles de chacun des groupes. ABSTRACT The purpose of this study is to refine the system of mechanical strength classes by taking into account a greater number of wood species (97 species) and variables (bulk density, modulus of rupture and modulus of elasticity). D'Agostino's chi-squared test verified that these variables are all normally distributed. Following the consolidation of the data, the deterministic approach defines a partitioning into 6 mechanical strength groups. We then determined through fuzzy classification the most representative elements of each group, thus constituting a basis for the subsequent running of tests. The characteristic values of the groups are assessed through Monte Carlo simulations. The classes CM 34, CM 53, CM 69, CM 84, CM 98 and CM 123 are then obtained. Key words: Deterministic approach, fuzzy classification, mechanical strength groups INTRODUCTION The exotic woods of the Congo Basin are solid, resistant and aesthetic, and are subject to significant international trade. The impressive industrial qualities and the shimmering colours of these woods, appreciated throughout the world for both traditional and innovative uses, serve as dogma. There are several varieties of living species, including about 500 species of trees (FAO 2006). This woody wealth is increasingly threatened by many factors, in the forefront of which is the overexploitation of a very small number of timber species. Indeed, woody species such as Ayous (triplochytonscleroxylon), sapelli (entandrophragmacylindricum), tali (erythrophleumivorense) and azobe (lophiraalata) account for more than 80% of logging (ATIBT, 2003). Paradoxically, hundreds of timberland species are available in the forest and their logging is very marginal. As a result, some woody species in the Congo Basin are becoming scarce and their risk of extinction in the natural state increases. Mukulungu (autranellacongolensis) and wengé (millettialaurentii), for example, are critically endangered wood species (IUCN, 2011). Sapelli and Azobé, for example, are vulnerable species (IUCN, 2011). Mvogo (2008) proposes solutions whose implementation would make it possible to limit the exploitation of so-called noble or very valuable species in the timber markets. It is of the Eurocode 5 type and concerns the timber species mechanical grouping from the Cameroonian part of the Congo Basin. Based on a vibratory (therefore non-destructive) approach and calibrated sampling to the economic context of developing countries, the author proposes an organization of 19 tropical timber species into four mechanical strength classes T38, T66, T93, and T136 .The Numbers 38, 66, 93, and 136 indicate the typical flexural strength These classes are controlled by ayous, sapelli, tali and azobé respectively. This approach is based on the principle of the substitution of a species overexploited by one or more species with very nearby mechanical properties. In class T38 for example, one finds the ayous, the emien, and the cheese maker. The highly exploited ayous can be substituted by the cheese maker without any risk of altering the typical flexural strength, the modulus of elasticity and the density. However, the solution proposed by Mvogo (2008) is insufficient because he created a mechanical class system based on 19 species (less than 5% of the overall population). In the hereby article our general objective is to refine the work of Mvogo by taking into account a much larger number of species for the elaboration of classes and the use of more variables for the clustering. MATERIALS AND METHODS Materials Choice of database Numerous databases provide information on the physical and mechanical characteristics of tropical timber, but particularly significant for us, namely: axial modulus of elasticity, bulk density and flexural strength. We can mention at least four of them: ATIBT, ITTO (http://www.itto.int/fr/annual_review_output/), PROTA4U (http://www.prota4u.org) and Tropix 7.5 (http://tropix.cirad.fr/). In 1986, The International Technical Tropical Timber Association (ATIBT) published a booklet entitled "Tropical Timber Atlas.Vol.1 - Africa”. In this booklet, the ATIBT focuses its work on the realization of an international nomenclature to avoid confusion in the world market. In 2001, the International Tropical Timber Organization (ITTO) developed a technological database on tropical timber, entitled “Tropical Timber Database”. In this database, the technological properties of timber species are represented by their mean values and supplemented by information on the behaviour of the species during processing, implementation and their actual and potential uses. PROTA4U is a database produced by PROTA (Plant Resources of Tropical Africa). The following are presented for each species in a condensed form: description, uses, processing, produced and marketed volumes and preservation. The physical and mechanical properties are quantified and presented as an interval indicating the minimum and maximum values. The most recent research is the CIRAD (Centre for International Cooperation in Agronomic Research for Development). In 2004, CIRAD designed a CD-ROM entitled "Tropix 5.0". For each listed species, there are macroscopic description and appearance of the wood, the main physical and mechanical properties, behaviour during processing and implementation, and actual and potential uses. The numerical values of the mechanical properties are obtained on specimens 20 mm × 20 mm × 340 mm in size. This database is regularly updated, and its latest version, "Tropix 7.5", dates to March 2015. Tropix 7.5 offers a library of 245 tropical and temperate species. Presentation of wood species The Tropix 7.5 database offers a library of 245 species of tropical and temperate wood, 97 of which are found in the Congo Basin. In this work the data we use for this clustering are not the result of our measures but come from the Tropix 7.5 database. This classification will therefore be based on the 97 timber species encountered in the Congo Basin and included in the Tropix 7.5 database. Methods The methodology is based on the following steps: Data Consolidation Deterministic approach Fuzzy approach Consideration of the scale effect Data Consolidation The data consolidation process is based on the following steps: Normality test Identification of univariate outliers Identification of multivariate outliers Analysis of correlations Normality test For this work, we will use the D’Agastino Pearson test (Agastino et al., 1990), known for its robustness. The D’Agastino test is still known as the chi-squared test. This test is based on the skewness g_1 and kurtosis g_2 coefficients. The principle is to centre and reduce both coefficients so as to obtain values z_1and z_2 asymptotically distributed according to a standard normal distribution N(0,1). The test statistic is the combination: K^2=z_1^2+z_2^2 (1) It follows asymptotically a standard of χ^2 with 2 degrees of freedom. The incompatibility of the distribution assessed with the normal standard is all the more marked given that the statistic K2 assumes a high value. For a risk a, the critical region of the test is: K^2>χ_(1-α)^2 (2) The critical threshold is then χ_0.95^2 (2)=5.99 for a risk α=5% (Rakotomalala, 2011) Identification of univariate outliers Univariate outliers are estimated values for a variable that appear abnormal (extremely small or extremely large) in view of other available data. They can be identified by using the Dixon test (Barnett and Lewis, 1994). In this work, we chose the N9u and N9i discordance tests N9_u et N9_l for the presence of the upper and lower aberrant values of the N9 test. The corresponding statistics of the tests N9_u et N9_(l )are: TN9_u=(x_n-x_(n-1))/(x_n-x_2 ) (3) TN9_l=(x_2-x_1)/(x_(n-1)-x_1 ) (4) The statistics TN9_u et TN9_l are calculated and compared with a critical value depending on the number of observations or individuals and the confidence level chosen. The confidence level generally recommended is 99%, which corresponds to 89 individuals at a critical value of 0.2699 (Verma and Quiroz-Ruiz, 2006). Identification of multivariate outliers The detection of multivariate outliers will be based on the Garrett method (Garrett, 1989). For normally distributed observations, the Mahanalobis distance approximately follows the chi-square distribution with p degrees of freedom (χ_p^2 ). The values of the quantile function of the chi-square distribution are read on the table of its law. Analysis of correlations The Correlation analysis is used to determine whether there is a relationship between the different variables studied; And in the case where such a link exists, it makes it possible to quantify its intensity. The linear correlation coefficient between the variables X and Y measures the strength and the direction of a linear relationship between the two variables. It is defined by: VIF=1/(1-r^2 ) (6) It is generally assumed that two variables are very strongly correlated if VIF>10 which equals to r^2>0.9. In this case, only one of the two variables is retained. Deterministic Approach The classification in the deterministic sense consists in dividing a set of n individuals into k groups, each individual being able to belong to only one group. Numerous statistical methods allow the grouping of similar individuals in a given population, including hierarchization. The hierarchization is done by the Hierarchical Ascendant Classification (HAC). The HAC is based on the definition of a distance measure between groups. Remoteness between individuals will be measured by using distances. Given two individuals, x_1 (x_(1,1),…,x_(1,p) )and x_2 (x_(2,1),…,x_(2,p)) the Euclidean distance is given by the formula (Morey et al., 1983): d(x_1,x_2 )=√(∑_(j=1)^p▒(x_(1,j)-x_(2,j) )^2 ) (7) Subsequently, partitions are obtained. The groups are gradually formed according to the principle of minimization of the variance (Morey et al., 1983). It allows the creation of relatively balanced workforce groups (Blashfield and Aldenderfer, 1988) and is particularly useful when distinct groups are expected (Lorr, 1983) Fuzzy approach The assessment of the characteristic values of the different groups will be based on Monte Carlo simulations (Flachaire 2003). The characteristic values of the different groups necessary for the classification of species are of the 5% fractile of the variables density, longitudinal modulus of elasticity and constraint of bending failure according to the following equation: x_(0.05)=-1.645 σ +μ (9) σ represents the medium values and μ the standard deviations of the variables Suppose X, the variable of which characteristic value we want to determine for a given group, then for each species in the group we randomly generate a sequence of values that the random variable X can assume under the assumption that it follows a normal standard. To refine the results, it is necessary to take into account a very large number of simulations (Zadeh 1977). Consideration of the scale effect The mechanical characteristics of the woods in the Tropix 7.5 database are derived from samples 20 mm x 20 mm x 340 mm size (Mvogo, 2008). These small samples are assumed to be flawless. However, wood in structural dimensions exhibits singularities which significantly reduce its mechanical properties (Délisée 1987). To determine the influence of the change in dimensions on the mechanical properties of wood, we will use three models of scale effect: the American model taken from ASTM D1990, the model proposed by Lanvin et al. (2011) and the model of Nyobe (2015) resulting from its tests on the Okan. RESULTS Data Consolidation Normality test The table below summarizes the results obtained from the D’Agastino-Pearson normality test. Identification of univariate outliers The detection of univariate outliers is done by using the statistics and of the Dixon test. This test is carried out on the assumption that the random variable used follows a normal distribution, which was confirmed previously. In other words, the minimum and maximum values taken by each of these variables are not aberrant. We can therefore conclude that the database consisting of 89 wood species represented by three variables, each does not contain any univariate outlier. Identification of multivariate outliers The identification of the multivariate outliers is done according to the Garrett method. The points of the cumulative frequency curve situated to the right of the quantile (χ_(3;0.975)^2 ) are multivariate outliers. These are the two species of which the squared Mahanalobis distance is the highest, namely the Mahogany Cailcedrat (MD_2=10.8987)and the Congolati (MD_23=9.7327) Analysis of correlations As can be seen from the graphs below, none of the coefficients of determination between the variables 0x1 and MOR, 0x1 and MOE as well as MOE and MOR is greater than 0.9(r_(ρ,MOR)^2=0.8994;r_(ρ,MOE)^2=0.8139;r_(MOE,MOR)^2=0.8800). In other words, the condition of the VIF>10 necessary to assert the multicollinearity between these variables is not respected. All the three variables will therefore be used for classifying the mechanical strength of timber species in the Congo Basin. It was found that the Calinski and Harabasz method is the one with the best results. The proposed approach by Calinski and Harabasz was to find the number of groups that maximizes the index CH. This index is defined as follows: CH(g)=(B(g)/(g-1))/(W(g)/(n-g)) (10) Suppose g is the number of groups, B(g)and W(g)are respectively the inter-group inertia and the intra-group inertia, nthe population size. For each part obtained by breaking down the dendrogram, we assess the value index CH. For a better assessment of the variations of this index with the number of groups, we will represent this graph for the first twenty partitions (from the partition into 2 groups to the one into 21 groups). Figure 6: CH index variation according to the number of groups The variation curve of the index CH according to the number of groups reveals that the partitioning into 6 groups is the best. In the rest of this study, we consider that the regrouping of the Congo basin wood species will be done in 6 groups of mechanical strength. Remember that the ASTM D1990 standard is derived from tests on American woods, while that of Lanvin (Lanvin et al.) is derived from tests on tropical woods, four of which are found in the Congo Basin (Azobe, Tali, Mukulungu and Okan). The Nyobe model (Nyobe 2015) is significantly different from the two previous models. A more likely explanation is the almost invariability of one of the dimensions of the wood pieces during the tests which led to this model. Indeed, the formula proposed by Nyobe arises from tests carried out on samples of 20mm x 20mm x 400mm and 22mm x 150mm x 2400mm size. When calculating the ratio of the volumes, the values 20mm and 22mm practically cancel. It can therefore be posited that its model neglects the variation of one dimension of wood. CONCLUSION The hereby article aimed to refine the class system proposed by Mvogo in 2008 by taking into account a greater number of variables for the classification of species and by considering a more significant number of wood species. The Tropix 7.5 database has been used because it is not only the most recent and regularly updated, but more importantly provides information on a dispersion parameter (the standard deviation) essential for the determination of characteristic values of the various strength groups. To determine the optimum number of groups for the Congo Basin timber classification, we used the method of Calinski and Harabasz which leads to optimal partitioning into 6 mechanical strength groups. The characteristic values of each group are obtained through the Monte Carlo simulation method which lead to similar results. The conformity of the results obtained with those proposed by Mvogo was established. Finally, we assessed the influence of the scale effect in order to adjust the characteristic values of the different classes. To that purpose, we used three models encountered in the literature: the American model taken from ASTM D1990, the model of Lanvin et al. And the Nyobe model.The model of Lanvin et al. is presented as being the most suitable but in any case diminishes the actual characteristic values of each of the groups. Source text - English APPENDIX II BILATERAL AIR SERVICE AGREEMENT BETWEEN THE GOVERNMENT OF THE STATE OF QATAR AND THE GOVERNMENT OF THE REPUBLIC OF CAMEROON FOR THE PURPOSE OF ESTABLISHING AIR SERVICES BETWEEN AND BEYOND THEIR RESPECTIVE TERRITORIES The Government of the State of Qatar and the Government of the Republic of Cameroon; (hereinafter referred to as “the Contracting Parties”); Being Contracting Parties to the Convention on International Civil Aviation opened for signature at Chicago on the Seventh day of December 1944; Desiring to conclude an Agreement, supplementary to the said Convention, for the purpose of establishing air services between and beyond their respective territories; Have agreed as follows: ARTICLE 1: DEFINITIONS For the purpose of this Agreement, unless the context otherwise requires and specifies: 1. the term “Convention” means the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944 and includes any annex adopted under article (90) of that Convention and any amendment of the annexes or the Convention under articles (90) and (94) thereof, so far as those annexes and amendments have become effective for or been ratified by both Contracting Parties. 2. the term “aeronautical authorities” means in the case of the Republic of Cameroon, the Cameroon Civil Aviation Authority(CCAA) or any body authorized to perform any such functions and in the case of the State of Qatar, the Civil Aviation Authority, or anybody authorized to perform any such functions. 3. the term “designated airline” means an airline which have been designated and authorized in accordance with article 4 of this Agreement. 4. the term “territory” in relation to a State has the meaning assigned to it in Article (2) of the convention. 5. the terms “air service”, “international air service”, “airline” and “stop for non-traffic purposes” have the meaning respectively assigned to them in article (96) of the Convention. 6. the term “Agreement” means this Agreement, its annex and any amendments thereto. 7. the term “aircraft” means civil aircraft. 8. the term “capacity” means: a. in relation to an aircraft, the payload of that aircraft available on a route or section of a route; b. in relation to an air service, the capacity of the aircraft used such service multiplied by the frequency operated by such aircraft over a given period on a route or section of a route. 9. the term “tariff” means the prices to be paid for the carriage of passengers, baggage and cargo and the conditions under which those prices apply, including prices and conditions for agency and other auxiliary service, but excluding prices and conditions for the carriage of mail. 10. the term “Route Schedule” means the Route Schedule annexed to this Agreement. The Route Schedule forms an integral part of this Agreement. 11. the term “specified route” means the route specified in the Route Schedule. 12. The term “user charges”means fees or rates levied for the use of airports, navigation facilities and other related services offered by one Contracting Party to the other. ARTICLE 2:APPLICABILITY OF CHICAGO CONVENTION The provisions of this Agreement shall be subject to the provisions of the Convention in so far as those provisions are applicable to international air services. ARTICLE 3: GRANT OF TRAFFIC RIGHTS 1. Each Contracting Party grants to the other Contracting Party the following rights in respect of its international air services : a) the right to fly across its territory without landing along the air route(s) prescribed by its aeronautical authorities; b) the rights to make stops in its territory for non-traffic purposes. 2. Each Contracting Party grants to the other Contracting Party the rights specified in this Agreement for the purpose of establishing scheduled international air services on the routes specified in the appropriate section of the Schedule/Schedules annexed to this Agreement. Such services and routes are hereafter called “the agreed services” and “the specified routes” respectively. 3. While operating an agreed service on a specified route the airline designated by each Contracting Party shall enjoy in addition to the rights specified in paragraph (1) of this Article, the right to make stops in the territory of the other Contracting Party at the points specified for that route in the Schedule to this Agreement for the purpose of taking on board and discharging passengers and cargo including mail in combination or separately. 4. Nothing in Paragraph (3) of this Article shall be deemed to confer on the airline of one Contracting Party the privilege of taking on board, in the territory of the other Contracting Party, passengers, cargo and mail carried for hire or reward and destined for another point in the territory of the other Contracting Party. ARTICLE 4: DESIGNATION OF AIRLINES 1. Each Contracting Party shall have the right to designate in writing to the other Contracting Party one or two airlines for the purpose of operating the agreed services on the specified routes. 2. On receipt of such designation, the other Contracting Party shall, subject to the provisions of paragraphs (3) and (4) of this Article, without delay grant to the airline (s) designated the appropriate operating authorization. 3. The aeronautical authorities of one Contracting Party may require an airline designated by the other Contracting Party to satisfy them that it is qualified to fulfill the conditions prescribed under the laws and regulations normally and reasonably applied to the operation of international air services by such authorities in accordance with the provisions of the Convention. 4. Each Contracting Party shall have the right to refuse to grant the operating authorization referred to in paragraph (2) of this Article, or to impose such conditions as it may deem necessary on the exercise by the designated airline of the rights specified in Article (3) of this Agreement, in any case where the said Contracting Party is not satisfied that substantial ownership and/or effective control of that airline is vested in the Contracting Party designating the airline or its nationals or both. 5. When an airline has been so designated and authorized, it may begin at any time to operate the agreed services, provided thattariffsestablishedin accordance with Article (13) of this Agreement are in force in respect of this service and the flight schedules have been approved by the aeronautical authorities. ARTICLE 5: REVOCATION OR SUSPENSION OF OPERATINGAUTHORIZATION 1. Each Contracting Party shall have the right to revoke an operating authorization or to suspend the exercise of the rights specified in Article (3) of this Agreement by an airline designated by the other Contracting Party, or to impose such conditions as it may deem necessary on the exercise of these rights where: a) it is not satisfied that substantial ownership and/or effective control of that airline are vested in the Contracting Party designating the airline or its nationals, b) that airline has failed to comply with the laws or regulations of the Contracting Party granting these rights, or c) the airline otherwise fails to operate in accordance with the conditions prescribed under this Agreement and fails to maintain and administer the safety standards. 2. Unless immediate revocation, suspension or imposition of the conditions mentioned in paragraph (1) of this Article is essential to prevent further infringements of laws or regulations, such rights shall be exercised only after consultation with the other Contracting Party. ARTICLE 6: CUSTOMS DUTIES AND TAXATION 1. Aircraft operated on the agreed services by a designated airline of one Contracting Party, as well as their regular equipment, spare parts, (including engines), fuels, oil (including hydraulic fluids, lubricants), aircraft stores (including food, beverages and tobacco) on board the aircraft shall be exempted onthe basis of reciprocity from the imposition of allcustoms duties, inspection fees and other similar fees and charges on arriving in the territory of the State ofthe other Contracting Party provided such equipment, spare parts supplies and stores remain on board the aircraft up to such time as they are re-exported. 2. There shall also be exemption onthe basis of reciprocity from the imposition of same duties, inspection fees and other similar charges on : a) regular equipment, spare parts (including engines), fuels, oil (including hydraulic fluids, lubricants) and aircraft stores (including food, beverages and tobacco) carried into the territory of the other Contracting Party and intended for use on aircraft operated on the agreed services by the designated airline (s), even when such equipment and items are to be used on part of the journey performed over the territory of the other Contracting Party; b) spare parts (including engines) introduced into the territory ofone Contracting Party for the maintenance or repair of aircraft engaged in operation on agreed services by a designated airline of the other Contracting Party; 3. The equipment and items referred to in paragraphs (1) and (2) of this Article may be unloaded in the territory of the other Contracting Party with the approval of the customs authorities of the other Contracting Party. Such equipment and items shall be kept under the supervision or control of the Customs authorities of the other Contracting Party up to such time as they are re-exported, or otherwise disposed of in accordance with the customs regulations of the other Contracting Party. 4. The exemption provided for in paragraphs (1) and (2) of this Article shall also be granted where a designated airline of one Contracting Party hascontracted with other airline (s), which similarly enjoy(s) such exemptions in the territory of the other Contracting Party, for the loan or transfer in the territory of the other Contracting Party of the equipment and items specified in paragraphs (1) and (2) of this Article. 5. Uniform items, office equipment printed ticket stock, air waybills and publicity materials introduced by the designated airline(s) of one Contracting Party into the territory of other Contracting Party shall be exempt on the basis of reciprocity from all customs duties, taxes, inspection fees and other similar fees and charges. 6. Passengers, baggage and cargo in direct transit across the territory of the State of one Contracting Party and not leaving the area of the airport reserved for such purpose shall, except inrespect of security measures against acts of violence and air piracy, be subject to no more than a simplified control. Baggage and cargo in direct transit shall be exempted from the imposition of customs duties and other similar taxes. 7. The revenues and profit realized by the designated airline (s) of each Contracting Party within the territory of the other Contracting Party in connection with operation of the agreed services shall be exempt from all taxes. ARTICLE 7 : USER CHARGES 1. User charges that may be imposed by the competent charging authorities or bodies of one Contracting Party on the designated airlines of the other Contracting Party shall be just, reasonable and not discriminatory. In any event, any such user charges shall be assessed on the designated airlines of the other Contracting Party on terms not less favourable than the most favourable terms available to any other designated airline at the time the charges are assessed. 2. Each Contracting Party shall encourage consultations between the competent charging authorities or bodies in its territory and the designated airlines using the services and facilities, and shall encourage the competent authorities or bodies and the designated airlines to exchange such information as may be necessary to permit an accurate review of the charges in accordance with the principles of paragraph (1) of this article. Each Contracting Party shall encourage the competent authorities or bodies to provide users with reasonable notice of any proposal for changes in user charges to enable users to express their view before changes are made. 3. Facilities and services for which charges are made shall be provided on an efficient and economic basis. ARTICLE 8: RECOGNITION OF CERTIFICATES AND LICENCES 1. Certificates of airworthiness, certificates of competency and licenses issued or rendered valid by one Contracting Party, and still in force, shall be recognized as valid by the other Contracting Party for the purpose of operating services provided for in this Agreement, provided that the requirements under which such certificates or licences were issued or rendered valid are equal to or above the minimum standards which are or may be established pursuant to the Convention. Each Contracting Party reserves the right, however, to refuse to recognize, for the purpose of flights above its own territory, certificates of competency and licencesgranted to its own nationals or rendered valid for them by the other Contracting Party or by any other State. 2. If the privileges or conditions of the licences or certificates referred to in paragraph (1) above, issued by the Aeronautical Authorities of one Contracting Party to any person or designated airline or in respect of an aircraft operating the agreed services on the specified routes would permit a difference from the standards established under the Convention, and which difference has been filed with the International Civil Aviation Organization, the Aeronautical Authorities of the other Contracting Party may request consultations in accordance with Article (17) of this Agreement with the Aeronautical Authorities of that Contracting Party with a view to satisfying themselves that the practice in question is acceptable to them. Failure to reach a satisfactory agreement will constitute grounds for the application of Article 5 of this Agreement. ARTICLE 9: APPLICATION OF NATIONAL LEGISLATION 1. The laws and regulations of a Contracting Party as to the admission to, stay in or departure from its territory of passengers, crew, baggage, cargo or mail of aircraft, such as regulations relating to entry, clearance, immigration, passports, customs, currency, health and quarantine shall be complied with by or on behalf of such passengers, crew, baggage, cargo or mail upon entrance into or departure from, or while within the territory of that Contracting Party. 2. The laws and regulations of a Contracting Party relating to the admission to, departure from or operation and navigation in its territory of aircraft engaged in international air navigation, shall be applicable to the aircraft of the designated airline(s) of the other Contracting Party, while entering, departing from or operating and navigating in the territory of the first Contracting Party. 3. Other relevant laws and regulations relating to aircraft and provisions in respect of civil aviation of one Contracting Party shall be applicable to the designated airline(s) of the other Contracting Party while operating the agreed services in the territory of the first Contracting Party. ARTICLE 10: PRINCIPLES GOVERNING OPERATION OF AGREED SERVICES 1. The total capacity to be provided on the agreedservices by the designated airlines of the Contracting Parties shall be agreedbetween the aeronautical authorities of the Contracting Parties before the commencement of the operations, and thereafter according to anticipated traffic requirements. 2. There shall be fair and equal opportunity for the designated airlines of each Contracting Party to operate the agreed services on the specified routes between their respective territories and beyond. 3. In operating the agreed services, the designated airlines of each Contracting Party shall take into account the interests of the designated airlines of the other Contracting Party so as not to affect unduly the services which the latter provide on the whole or part of the same routes. 4. Provision for the carriage of passengers and cargo including mail both taken on board and discharged at points on the specified routes in the territories of States other than that designating the airline shall be made in accordance with the general principles that capacity shall be related to: a) traffic requirements to and from the territory of the Contracting Party which has designated the airline; b) traffic requirements of the area through which the agreed service passes, after taking account of other transport services established by airlines of the States comprising the area; and c) the requirements through airline operation. ARTICLE 11: AVIATION SAFETY 1. Each Contracting Party may request consultations at any time concerning safety standards in any area relating to aircrew, aircraft or their operation adopted by the other Contracting Party. Such consultations shall take place within fifteen (15) days of that request. 2. If, following such consultations, a Contracting Party finds that the other Contracting Party does not effectively maintain and administer safety standards in any such area that are at least equal to the minimum standards established at that time pursuant to the Convention, the first Contracting Party shall notify the other Contracting Party of those findings and the steps considered necessary to conform with those minimum standards, and the other Contracting Party shall take appropriate corrective action. Failure by the other Contracting Party to take appropriate action within fifteen (15) days or such longer period as may be agreed, shall be grounds for the application of Article 5 (1.c) relating to suspension of exercise of traffic rights. 3. Notwithstanding the obligations mentioned in Article (33) of the Convention, itis agreed that any aircraft operated by the airline of one Contracting Party on services to or from the territory of the other Contracting Party may, while within the territory of the other Contracting Party, be made the subject of an examination by the authorized representatives of the other Contracting Party, on board and around the aircraft to check both the validity of the aircraft documents and those of its crew and the apparent condition of the aircraft and its equipment (in this Article called “ramp inspection”), provided this does not lead to unreasonable delay. 4. If any such ramp inspection or series of ramp inspections gives rise to: a. serious concerns that an aircraft or the operation of an aircraft does not comply with the minimum standards established at that time pursuant to the Convention; or b. serious concerns that there is a lack of effective maintenance and administration of safety standards established at that time pursuant to the Convention; the Contracting Party carrying out the inspection shall, for the purposes of Article (33) of the Convention, be free to conclude that the requirements under which the certificate or licenses in respect of that aircraft or in respect of the crew of that aircraft had been issued or rendered valid, or that the requirements under which that aircraft is operated, are not equal to or above the minimum standards established pursuant to the Convention. 5. In the event that access for the purpose ofundertaking a ramp inspection of an aircraft operated by the airline of one Contracting Party in accordance with paragraph (3) of this Article is denied by the representative of that airline, the other Contracting Party shall be free to inferthat serious concerns of the type referred to in paragraph (4) of this Article arise and draw the conclusions referred to in that paragraph. 6. Each Contracting Party reserves the right to suspend the exercise of traffic rights by an airline of the other Contracting Party immediately in the event the first Contracting Party concludes that, immediate action is essential to the safety of an airline operation. 7. Any action by one Contracting Party in accordance with paragraph (2) or (6)of this Article shall be discontinued once the basis for the taking of that action ceases to exist. ARTICLE 12: AVIATIONSECURITY 1. The assurance of safety for civil aircraft, their passengers and crew being a fundamental pre-condition for the operation of international air services, the Contracting Parties reaffirm that their obligations to each other to provide for the security of civil aviation against acts of unlawful interference form an integral part of this Agreement and in particular their obligations under the Chicago Convention, the Convention on offences and Certain Other Acts Committed on Board Aircraft, done at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, done at the Hague on 16 December 1970, and the Convention for the Suppression of Unlawful Acts Against the Safety of Civil Aviation, done at Montreal on 23 September 1971, the Protocol for the Suppression of Unlawful Acts of violence at Airports Serving International Civil Aviation, signed at Montreal on 24 February 1988 and any other multilateral agreement governing civil aviation security binding upon both Contracting Parties. 2. The Contracting Parties shall provide uponrequestall necessary assistance to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passengers and crew, airports and air navigation facilities, and any other threat to the security of civil airports and air navigation facilities, and any other threat to the security of civil aviation. 3. The Contracting Parties shall, in their mutual relations act in conformity with the Aviation Security Standards established by the International Civil Aviation Organization and designated as Annexes to the Convention; and shall require that operators of aircraft of their registry, operators who have their principal place of business or permanent residence in their territory, and the operators of airports in their territory, act in conformity with such aviation security provisions. In this paragraph,the reference to aviation Security Standards includes any difference notified by the Contracting Party concerned. 4. Each Contracting Party shall ensure that effective measures are taken within its territory to protect aircraft, to screen passengers and their carry-on items, and to carry out appropriate checks on crew, cargo (including hold baggage) and aircraft stores prior to and during boarding or loading and that those measures are adjusted to meet the threat level. Each Contracting Party agrees that its airlines may be required to observe the aviation security provisions referred to in paragraph (3) of this Articlerequired by the other Contracting Party, for entrance into, departure from, or while within the territory of that other Contracting Party. Each Contracting Party shall also act favourably upon any request from the other Contracting Party for reasonable special security measures to meet a particular threat. 5. When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful acts against the safety of such aircraft, their passengers and crew, airports or air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate as rapidly as possible, commensurate with minimum risk to life, such incident or threat. 6. Should a Contracting Party depart from the aviation security provisions of this Article, the aeronautical authorities of the other Contracting Party may request immediate consultations with aeronautical authorities of the former Contracting Party. Failure to reach a satisfactory agreement within thirty (30) days of the date of such request shall constitute grounds for withholding, revoking, limiting or imposing conditions on the operating authorization of airlines of the former Contracting Party. If required by an emergency, either Contracting Party may take interim action prior to the expiry of the thirty (30) days. ARTICLE 13: TARIFFS 1. Each Contracting Party shall allow tariffs for air services to be established by each designated airline based upon commercial considerations in the market place. Neither Contracting Party shall require its airlines to consult other airlines about the tariffs they charge or propose to charge for services covered by this Agreement. 2. Each Contracting Party may require notification or filing of any tariff to be charged by its own designated airline. Neither Contracting Party shall require notification or filing of any tariffs to be charged by the designated airline of the other Contracting Party. Tariffs may remain in effect unless subsequently disapproved under paragraphs 5 below. 3. Intervention by the Contracting Parties shall be limited to: a) the protection of consumers from tariffs that are excessive due to the abuse of market power; b) the prevention of tariffs whose application constitutes anti-competitive behaviour which has or is likely to have or is explicitly intended to have the effect of preventing, restricting or distorting competition or excluding a competitor from the route. 4. Each Contracting Party may unilaterally disallow any tariff filed or charged by its own designated airline. However, such intervention shall be made only if it appears to the aeronautical authority of that Contracting Party that a tariff charged or proposed to be charged meets either of the criteria set out in paragraph 3 above. 5.Neither Contracting Party shall take unilateral action to prevent the coming into effect or continuation of a tariff charged or proposed to be charged by the airline of the other Contracting Party. If one Contracting Party believes that any such tariff is inconsistent with the considerations set out in paragraph 3 above, it may request consultations and notify the other Contracting Party of the reasons for its dissatisfaction. These consultations shall be held not later than 14 days after receipt of the request. Without a mutual agreement the tariff shall take effect or continue in effect. ARTICLE 14: PROVISION OF STATISTICS AND TIME TABLES 1. The aeronautical authorities of a Contracting Party shall supply to the aeronautical authorities of the other Contracting Party at their request, such periodic or other Statements of statistics as may be reasonably required to determine the amount of traffic carried by their airlines on the agreed services and the origins and destinations of such traffic. 2. The designated airlines of a Contracting Party shall provide for approval to the aeronautical authorities of the other Contracting Party,at least thirty (30) days prior to the inauguration of the agreed services,flight schedules including information on the type of aircraft to be used. This requirement shall likewise apply to any change concerning the agreed services. ARTICLE 15: TRANSFER OF EARNINGS 1. Each Contracting Party shall grant to the designatedairline (s) of the other Contracting Party, the right of transfer of the excess of receipts over expenditure, earned in the territory of respective Contracting Party. Such remittances, however, shall be made without prior approval and in accordance with the foreign exchange regulations of the Contracting Party in the territory of which the revenue accrued. The conversion and remittance of suchrevenue shall be effected in convertible currencies at the effective rate of exchange prevailing on the date of remittance. 2. The designated airlines of each Contracting Partyshall be permitted to pay for local expenses, including purchases of fuel, in the territory of the other Contracting Party in local currency. At their discretion, the designated airlines of each Contracting Party may pay for such expenses in the territory of the other Contracting Party, in freely convertible currencies, according to local currency regulation. 3. The Contracting Parties have agreed to avoid the double taxation on revenues arising from the activities of their designated airlines. ARTICLE 16: COMMERCIAL ACTIVITIES 1. The designated airlines of one Contracting Party shall be permitted to bring and maintain in the territory of the other Contracting Party, employees and other personnel responsible for the administration, technical and operation of their air services activities in accordance with the entry, residence, and employment rules and regulations of the other Contracting Party. 2. The personnelmentioned in paragraph (1) of this Article may consist of the nationals of the States of the Contracting Parties, or of nationals of third countries at managerial level with the approval of the competent authorities of the Contracting Parties. 3. The designatedairline of the Contracting Party shall be granted the right of its own sale of transportation using their own transportation documents in the territory of the State of the other Contracting Party, in accordance with laws and regulations of that State. Such sale may be executed directly by the representatives of the designated airlines or through authorized agents which have an appropriate license to provide such service. 4. Ground services shall be available on an equal basis to all airlines; charges shall be based on the cost of services provided and such services shall be comparable to the kind and quality of services as if self-handling were possible. 5. In operation or holding out the agreed services, any designated airline of one Contracting Party may enter into cooperative marketing arrangement such as blocked space and code-sharing arrangements with the designated airlines of the other Contracting Party and/orairline or airlines of a third country, provided that(i) all airlines in such arrangements hold the appropriate authority and meet the requirements normally applied to such arrangements.(ii) the airline tickets and any other document regarding the conditions of the air transportation and/ or air waybills state clearly the buyer or user of such service, the airline that will actually operate each segment of the service, and the airline which will enter into a commercial contractual relation. ARTICLE 17: CONSULTATIONS 1. In a spirit of close co-operation, the aeronautical authorities of the Contracting Parties shall consult eachotherfromtime to time with a view to ensuring the implementation of and satisfactory compliance with the provisions of this agreement and the Annexed Schedule and shall consult when necessary to provide for modifications thereof. 2. Either Contracting Party may request consultation, which may be in writing and shall begin within a period of thirty (30) days of the date of receipt of the request, unless both Contracting Parties agree to an extension or reduction of this period. ARTICLE 18: SETTLEMENT OF DISPUTES 1. If any dispute arises betweenthe Contracting Parties relating to the interpretation or application of this Agreement, the aeronautical authorities of the two Contracting Parties shall in the first place try to settle it by negotiation. 2. Ifthe aeronautical authorities ofthe two Contracting Parties fail to reach a settlement of the dispute by negotiation, the dispute shall be settled through diplomatic channels. 3. If the Contracting Parties fail to reach a settlement by negotiation or diplomatic Channels, they may agree to refer the dispute for decision to some person or body; if they do not so agree, the dispute shall, at the request of either Contracting Party, be submitted for decision to a tribunal of three (3) arbitrators, one to be nominated by each Contracting Party and the third to be appointed by the two so nominated. Each of the Contracting Parties shall nominate an arbitrator within a period of sixty (60) days from the date of receipt by either Contracting Party, fromthe other, of a notice through diplomatic channels requesting arbitration of the dispute by such a tribunal, and the third arbitrator shall be appointed within a further period of sixty (60) days. If either of the Contracting Parties fails to nominate an arbitrator within the period specified, or if the third arbitrator is not appointed within the period specified, the President of the Council of the International Civil Aviation Organization may, at the request of either Contracting Party, appoint an arbitrator or arbitrators as the case requires. In such case, the third arbitrator shall be a national of a third State and shall act as President of the arbitral tribunal. 4. Costs incurred as a result of the Arbitration Panel shall be apportioned in equal amounts by the Contracting Parties. 5. The Contracting Parties shall comply with any decision given under paragraph (3) of this Article. ARTICLE 19: AMENDMENT 1. Ifeither ofthe Contracting Party desires to modify any provision of this Agreement including the annexed schedule, it should be after consultation in accordance with Article (17) of this Agreement. 2. If the amendment relates to the provisions of the Agreement other than those of the annexed Schedule, the amendment shall be approved by each Contracting Party in accordance with its constitutional procedures and shall come into effect on the date of the exchange of notes through the diplomatic channels. 3. Iftheamendment relates only to the provisions of the annexed Schedule, it shall be agreed upon between the aeronautical authorities of both Contracting Parties and would be effective from the date of the signature of the amendment. ARTICLE 20: MULTILATERAL CONVENTIONS This Agreement and its Annexes will be amended so as to conform to any multilateral Convention which may become binding upon the contracting Parties. ARTICLE 21: REGISTRATION WITH THE INTERNATIONALCIVIL AVIATION ORGANIZATION This Agreement and any subsequent amendments shall be registered with the International Civil Aviation Organization. ARTICLE 22: TERMINATION Either Contracting Party may at any time, give noticein writing, through diplomatic channels, to the other Contracting Party of its decision to terminate this Agreement; such notice shall be simultaneously communicated to the International Civil Aviation Organization. In such case, the Agreement shall terminate twelve (12) months after the date of receipt of the notice by the other Contracting Party, unless the notice to terminate is withdrawn by agreement before the expiry of this period. In the absence of acknowledgment of receipt by the other Contracting Party, notice shall be deemed to have been received fourteen (14) days after the receipt of the notice by the International Civil Aviation Organization. ARTICLE 23: ANNEXES Annexes to this Agreement shall be deemed to be part of the Agreement and all references to it shall include reference to the Annexes, except where otherwise expressly provided. ARTICLE 24: ENTRY INTO FORCE This Agreement shall be approved according to the constitutional requirements in the country of each Contracting Party and shall enterinto force onthe date ofthe last written notification throughdiplomatic channel,confirming that the Contracting Parties have fulfilled all their internal procedures for the entry into force of this Agreement. Beyond: Any points NOTES: The designated airlines of either Contracting Party may, on any or all its flights and at its option, operate flights in either or both directions and omit stop at any point or points, provided that services begin or end at a point in the territory of the Contracting Party designating the airline.	Translation - French Version du 11/03/16 ACCORD BILATERAL RELATIF AU TRANSPORT AERIEN ENTRE LE GOUVERNEMENT DE LA REPUBLIQUE DU CAMEROUN ET LE GOUVERNEMENT DE L’ETAT DU QATAR RELATIF AU TRANSPORT AERIEN ENTRE LEURS TERITOIRES RESPECTIFS ET AU DELÀ ARTICLE 1 Définitions ARTICLE 2 Octroi de droits ARTICLE 3 Désignation et autorisation d’exploitation ARTICLE 4 Révocation et suspension de l’autorisation ARTICLE 5 Applicabilité des lois et règlements ARTICLE 6 Sûreté de l’aviation ARTICLE 7 Sécurité de l’aviation ARTICLE 8 Droits de douane et autres charges ARTICLE 9 Principes régissant l’exploitation des services convenus et la capacité de régulation ARTICLE 10 Tarifs ARTICLE 11 Représentants des entreprises ARTICLE 12 Opportunités commerciales et transfert des fonds ARTICLE 13 Accords de coopération ARTICLE 14 Transport de fret intermodal ARTICLE 15 Redevances d’usage ou d’exploitation ARTICLE 16 Taxes sur le carburant ARTICLE 17 Statistiques ARTICLE 18 Consultations ARTICLE 19 Règlement de différends ARTICLE 20 Amendement de l’Accord ARTICLE 21 Convention multilatérale ARTICLE 22 Dénonciation ARTICLE 23 Enregistrement ARTICLE 24 Entrée en vigueur LE GOUVERNEMENT DE LA RÉPUBLIQUE DU CAMEROUN, d’une part, ET LE GOUVERNEMENT DE L’ÉTAT DU QATAR, d’autre part, (ci-après dénommés « les Parties contractantes »); Étant parties à la Convention Internationale relative à l’Aviation Civile signée à Chicago le 07 décembre 1944; Désireux de conclure un Accord complétant ladite Convention, relatif à l’établissement des services aériens entre leurs territoires respectifs et au-delà; Sont convenus de ce qui suit: ARTICLE 1 : DÉFINITIONS Aux fins du présent Accord, sauf indication contraire, les définitions suivantes sont acceptées: 1. « Convention »: la Convention relative à l’Aviation Civile Internationale ouverte à la signature à Chicago le 7 décembre 1944 et y compris toutes annexes adoptées en vertu de l’article 90 de ladite Convention, et tous amendements des annexes ou de la Convention adoptée en vertu des articles 90 et 94 de celle-ci, dans la mesure où ces annexes et amendements sont entrés en vigueur et ont été ratifiés par les deux Parties contractantes. 2. « Autorités aéronautiques »: en ce qui concerne la République du Cameroun, la « Cameroon Civil Aviation Athority » (CCAA) ou toute autre personne dûment mandatée pour remplir de telles fonctions, et s’agissant de l’État du Qatar, le Ministre du Transport et des Communications, ou toute personne dûment mandatée pour exercer de telles fonctions; 3. « Entreprise désignée »: compagnie aérienne désignée et mandatée conformément à l’article 4 du présent Accord; 4. « Territoire », en rapport avec un Etat, s’apparente à une définition qui lui est assignée à l’article 2 de la Convention; 5. « Transport aérien », « Transport aérien international », « Entreprise » et « Escale non commerciale » ont des définitions qui leur sont respectivement assignées à l’article 96 de la Convention; 6. « Accord » désigne le présent Accord, ses annexes et ses amendements; 7. « Aéronef »: aéronef civile 8. « Capacité »: a. en relation avec un aéronef, la cargaison dudit aéronef disponible sur une route ou section de route. b. en relation avec un service aérien, la capacité de l’aéronef utilisé pour de tels services multipliée par la fréquence d’exploitation de cet aéronef pendant une période donnée sur une route ou une section de route; 9. « Tarif »: prix à payer pour le transport des passagers, des bagages et du fret, ainsi que les conditions régissant l’application desdits prix et les conditions de l’agence ainsi que d’autres services auxiliaires, excepté la rémunération et les conditions du transport du courrier; 10. « Tableau de route »: programme de route annexé au présent Accord. Le tableau de route fait partie intégrante du présent Accord; 11. « Route spécifiée »: les routes spécifiées dans le tableau de route. 12. « Redevances d’usage »: frais ou taux perçus pour l’utilisation des aéroports, des facilités de navigation et autres services offerts par une Partie contractante à l’autre Partie contractante. ARTICLE 2 : APPLICABILITÉ DE LA CONVENTION DE CHICAGO Les dispositions du présent Accord sont sujettes aux dispositions de la Convention dans la mesure où ces dispositions sont applicables au transport aérien international. ARTICLE 3 : OCTROI DES DROITS 1. Chaque Partie contractante accorde à l’autre Partie contractante les droits suivants, en accord avec son tableau de route du transport aérien international : a) le droit de survoler son territoire sans y atterrir suivant le(s) tableau(x) de route prescrit(s) par ses autorités aéronautiques; b) le droit d’effectuer des escales non commerciales dans son territoire. 2. Chaque Partie contractante accorde à l’autre Partie contractante les droits précisés dans le présent Accord, à l’effet d’établir des services aériens internationaux sur les routes spécifiées dans les sections appropriées de la liste de liaison aérienne/des listes de liaison aérienne annexés au présent Accord. De tels services et routes sont ci-après respectivement dénommés « les services convenus » et « les routes spécifiées ». 3. Dans le cadre de l’exploitation des services convenus sur une route spécifiée, l’entreprise désignée par chaque Partie contractante jouit, en plus des droits spécifiés au paragraphe 1 du présent article, du droit d’effectuer des arrêts sur le territoire de l’autre Partie contractante à des points spécifiés pour cette route dans le programme du présent Accord dans le but d’embarquer ou de débarquer des passagers et le fret, y compris le courrier pris ensemble ou séparément. 4. Aucune disposition du paragraphe 3 du présent article ne confère à l’entreprise d’une Partie contractante le droit d’embarquer, sur le territoire de l’autre Partie contractante, les passagers, le fret et le courrier à destination d’un autre point dans le territoire de cette autre Partie contractante. ARTICLE 4 : DÉSIGNATION DES ENTREPRISES 1. Chaque Partie contractante aura le droit de désigner, en notifiant par écrit l’autre Partie contractante, une ou plusieurs entreprises pour l’exploitation des services convenus sur les routes spécifiées. 2. Dès réception d’une telle désignation, l’autre Partie contractante, conformément aux dispositions des paragraphes 3 et 4 du présent article, devra accorder sans délai à l’autre Partie contractante l’autorisation d’exploitation appropriée. 3. Les autorités aéronautiques d’une Partie contractante peuvent exiger de l’entreprise désignée par l’autre Partie contractante qu’elle soit réputée remplir les conditions prescrites dans les lois et règlements normalement et raisonnablement appliquées pour l’exploitation du transport aérien international par ces autorités conformément aux dispositions de la Convention. 4. Chaque Partie contractante se réserve le droit de refuser d’accorder l’autorisation d’exploitation mentionnée au paragraphe 2 du présent article, ou d’imposer des conditions qu’elle juge nécessaires à l’exercice par l’entreprise désignée des droits spécifiés à l’article 3 du présent Accord, au cas où ladite Partie contractante ne peut convaincre qu’elle est et demeure majoritairement la propriété ou est effectivement dirigée par un ressortissant de la Partie contractante désignant l’entreprise . 5. Lorsqu’une entreprise a été ainsi désignée et reçu l’autorisation, elle peut à tout moment commencer l’exploitation des services convenus, pourvu que les tarifs établis conformément à l’article 13 du présent Accord soient en vigueur conformément à ces services et que les programmes de vols aient été approuvés par les autorités aéronautiques. ARTICLE 5 : RÉVOCATION OU SUSPENSION DE L’AUTORISATION D’EXPLOITATION 1. Chaque Partie contractante se réserve le droit de révoquer une autorisation d’exploitation ou de suspendre l’exercice des droits prévus à l’article 3 du présent Accord par l’entreprise désignée par l’autre Partie contractante, ou d'imposer des conditions telle qu’elle jugera nécessaire à l’exercice de ces droits au cas où: a) elle n’est pas convaincue que l’entreprise est et demeure majoritairement la propriété ou est effectivement dirigée par la Partie contractante désignant l’entreprise ou ses ressortissants; b) cette entreprise n’a pas observé les lois et règlements de la Partie contractante accordant ces droits; ou c) l’entreprise n’exploite pas les services aériens conformément aux conditions prescrites dans le présent Accord et ne maintient ni n’applique les normes de sûreté. 2. Sauf si la révocation, la suspension ou l’imposition des conditions visées au paragraphe 1 du présent article sont nécessaires pour éviter d’autres infractions aux lois et règlements, de tels droits ne pourront être exercés qu’après consultation avec l’autre Partie contractante. ARTICLE 6 : DROITS DE DOUANE ET TAXES 1. Les aéronefs exploités pour les services convenus par les entreprises désignées d’une des Parties contractantes, de même que leurs équipements normaux, les pièces de rechange (incluant les moteurs), le carburant et le pétrole (y compris les fluides hydrauliques, les lubrifiants), les provisions de bord (y compris la nourriture, les boissons, et le tabac) à bord de l’aéronef seront, sur la base de la réciprocité, exonérés des droits de douane, des frais d’inspection et autres charges à l’arrivée sur le territoire de l’autre Partie contractante, pourvu que de tels équipements à savoir les pièces de rechange, les provisions et les réserves restent à bord de l’aéronef jusqu’à ce qu’ils soient réexportés. 2. Sont également exonérés, sur la base de la réciprocité, de l’imposition des mêmes droits, des frais d’inspection et autres charges similaires: a) les équipements réguliers, les pièces de rechange (y compris les moteurs), le carburant, le pétrole (incluant les fluides hydrauliques, les lubrifiants) et les provisions de bord ( y compris la nourriture, les boisson et le tabac) importés dans le territoire de l’autre Partie contractante et destiné à l’usage à bord de l’aéronef exploité pour les services convenus par les entreprises désignées, même lorsque de tels équipements seront utilisés sur une partie du voyage sur le territoire de l’autre Partie contractante; b) les pièces de rechange (y compris les moteurs) importés dans le territoire de l’une des Parties contractantes pour la maintenance ou la réparation des aéronefs servant à l’exploitation des services convenus par une entreprise désignée de l’autre Partie contractante; 3. Les équipements et les articles mentionnés au paragraphe 1 et 2 du présent article ne peuvent être débarqués dans le territoire de l’autre Partie contractante qu’avec l’autorisation des autorités douanières de l’autre Partie contractante. De tels équipements et articles seront gardés sous la surveillance ou le contrôle des autorités douanières de l’autre Partie contractante jusqu’à ce qu’ils soient réexportés, ou autrement, seront écoulés conformément à la réglementation douanière de l’autre Partie contractante. 4. Les exonérations prévues aux paragraphes 1 et 2 du présent article seront également accordées lorsqu’une entreprise désignée d’une Partie contractante a signé un contrat avec une autre entreprise qui jouit de telles exonérations dans le territoire de l’autre Partie contractante pour le prêt ou le transfert dans le territoire de l’autre Partie contractante des équipements et articles visés aux paragraphes 1 et 2 du présent article. 5. Les uniformes, les équipements de bureau, les réserves de billets, les lettres de transport aérien et le matériel de publicité importés par l’entreprise désignée d’une Partie contractante dans le territoire de l’autre Partie contractante, seront exonérés sur la base de la réciprocité de tous droits de douane, taxes, frais d’inspection et autres frais et charges similaires. 6. Les passagers, les bagages et le fret en transit direct sur le territoire d’une des Parties contractantes et présents dans l’espace aéroportuaire réservé à cet effet ne seront sujet qu’à un contrôle simplifié, excepté pour des raisons de respect des mesures de sécurité contre les actes de violence et la piraterie aérienne. Les bagages et le fret en transit direct seront exonéré des impositions des droits de douane et autres taxes similaires. 7. Les revenus et profits réalisés par les entreprises désignées de chacune des Parties contractantes dans le territoire de l’autre Partie contractante en rapport avec l’exploitation des services convenus seront exonérés de toutes taxes. ARTICLE 7 : REDEVANCES D’USAGE 1. Les redevances d’usage qui peuvent être imposées par les autorités ou les organismes compétents d’une Partie contractante aux entreprises désignées de l’autre Partie contractante seront justes, raisonnables et non discriminatoires. Dans tous les cas, ces redevances d’usage ne peuvent être imposées aux entreprises désignées de l’autre Partie contractante à des conditions moins favorables que les conditions les plus favorables accordées à toute autre entreprise désignée au moment de leur imposition. 2. Chaque Partie contractante encourage les consultations entre les autorités ou organismes compétents de son territoire et les entreprises désignées utilisant les services et installations, et encourage les autorités et organismes compétents et les entreprises désignées à échanger les informations qui pourraient être nécessaires, afin de permettre un examen précis des redevances conformément aux principes du paragraphe 1 du présent article. Chaque Partie contractante encourage les autorités et organismes compétents à informer les utilisateurs avec un préavis raisonnable de tout projet de modification des redevances d’usage afin de permettre aux utilisateurs d’exprimer leur avis avant la mise en œuvre de ces modifications. 3. Les installations et services qui font l’objet de ces redevances sont fournis sur une base efficace et économique. ARTICLE 8 : RECONNAISSANCE DES CERTIFICATS ET LICENCES 1. Les certificats de navigation, les certificats de compétence et les licences délivrées ou rendues valides par l’une des Parties contractantes et encore en vigueur seront reconnus valides par l’autre Partie contractante dans le cadre de l’exploitation des services convenus dans la mesure où les normes desdits certificats ou licences sont équivalentes ou supérieures aux normes minimales qui sont ou pourraient être établies par la Convention. Chaque Partie contractante se réserve le droit de refuser de reconnaitre, dans le cadre des survols de son territoire, la validité des certificats de compétence et des licences octroyées à ses ressortissants ou rendus valides par l’autre Partie contractante ou par un autre État. 2. Si les privilèges ou conditions des licences et certificats visés au paragraphe 1 ci-dessus, délivrés par les autorités aéronautiques de l’une des Parties contractantes à quelque personne ou entreprise désignée ou pour ce qui est des aéronefs utilisés dans l’exploitation des services convenus, autorise une différence avec les standards minimum établis dans la Convention, et laquelle différence a été fichiée avec l’Organisation de l’Aviation civile internationale , l’autre Partie peut demander une consultation conformément à l’article 17 du présent Accord avec les autorités aéronautiques de cette Partie contractante dans le but de s’assurer que la pratique en question leur convient. L’impossibilité de parvenir à un accord satisfaisant constitue un motif pour l’application de l’article 5 du présent Accord. ARTICLE 9 : APPLICABILITE DE LA LEGISLATION NATIONALE 1. Les lois et règlements d’une Partie contractante régissant l’entrée ou la sortie de son territoire des passagers, de l’équipage, des bagages, du fret ou des courriers de l’aéronef, notamment les règlements relatifs à l’entrée, au dédouanement, à l’immigration, aux passeports, à la douane, à la monnaie, à la santé et à la quarantaine s’appliqueront aux passagers, à l’équipage, aux bagages, au fret ou au courrier à l’entrée, au départ ou au séjour sur le territoire de cette Partie contractante. 2. Les lois et règlements d’une Partie contractante relatifs à l’entrée, au départ ou à l’exécution et à la navigation dans son territoire des aéronefs assurant la navigation aérienne internationale seront applicables aux aéronefs des entreprises désignées de l’autre Partie contractante à l’entrée, au départ ou exploitant et navigant dans le territoire de la première Partie contractante. 3. Les autres lois et règlements relatifs aux aéronefs et les dispositions sur l’aviation civile d’une des Parties contractantes seront applicables aux entreprises désignées de l’autre Partie contractante lors de l’exploitation des services convenus dans le territoire de la première Partie contractante. ARTICLE 10 : PRINCIPES RÉGISSANT L’EXPLOITATION DES SERVICES CONVENUS 1. La capacité totale à être fournie pour les services convenus par les entreprises désignées des Parties contractantes, sera convenue entre les autorités aéronautiques des Parties contractantes avant le début de l’exploitation, et par la suite selon les exigences de trafic. 2. Les entreprises désignées auront des possibilités justes et équitables pour exploiter les services convenus sur les routes spécifiées entre leurs territoires respectifs et au-delà. 3. Dans l’exploitation des services convenus, les entreprises désignées de chaque Partie prendront en compte les intérêts de l’entreprise de l’autre Partie contractante pour ne pas affecter les services que cette dernière offre sur tout ou partie de la même route. 4. Les provisions pour le transport des passagers et du fret, y compris le courrier embarqués et débarqués à des points sur les routes spécifiées sur les territoires des États autres que ceux désignant les entreprises feront l’objet d’un accord entre les deux Parties, étant donné que la capacité a trait aux: a) exigences de trafic en provenance ou à destination du territoire des Parties contractantes ayant désigné les entreprises; b) exigences de trafic de la zone par laquelle les services convenus traversent; après avoir pris en compte les autres services de transport établis par les entreprises des Etats compris dans la zone; et c) exigences d’exécution à travers les entreprises. ARTICLE 11: SÛRETÉ DE L’AVIATION 1. Chaque Partie contractante peut solliciter des consultations à tout moment au sujet des normes de sûreté, qui se rapportent aux installations aéronautiques, à l’équipage, à l’aéronef et à l’exploitation des aéronefs. De telles consultations auront lieu dans un délai de quinze (15) jours suivant une telle demande. 2. Si, suite à de telles consultations, une des Parties contractantes estime que l’autre Partie n’adopte ni n’assure effectivement le suivi des normes de sûreté qui soient au moins égales aux normes minimales en vigueur, conformément à la Convention, l’autre Partie contractante sera informée de cette situation et des démarches qui sont estimées nécessaires, afin de se conformer à ces normes minimales et prendra les mesures correctives qui s’imposent. Le refus par l’autre Partie contractante de prendre des mesures appropriées dans un délai de quinze (15) jours ou dans un délai plus long convenu, constitue un motif d’application de l’article 5 alinéa 1.c relatif à la suspension de l’exercice des droits de trafic. 3. Nonobstant les obligations visées à l’article 33 de la Convention, il a été convenu que tout aéronef exploité, ou tout aéronef n’appartenant pas à l’entreprise désignée de l’une des Parties contractantes et utilisé pour l’exploitation des services aériens au départ et à l’arrivée du territoire de l’autre Partie contractante, à travers des contrats de location d’un autre transporteur aérien appartenant à l'État de l’une des Parties contractantes ou d’un État, fera l’objet de fouilles par les représentants dûment mandatés de l’autre Partie contractante. Le but d’une telle inspection est de vérifier la validité des documents de l’aéronef, ceux de son équipage, et la conformité de l’état apparent de l’aéronef et de son équipement aux normes établies (dans cet Article, elle est dénommée « inspection au sol »), à condition que cela n’entraîne pas de retard déraisonnable pour l’exploitation de l’aéronef. 4. Si une telle inspection au sol ou une série d’inspections au sol donnent lieu à : a. des préoccupations majeures où un aéronef ou l’exploitation d’un aéronef n’est pas conforme aux normes minimales applicables à ce moment conformément à la Convention ; ou b. des préoccupations majeures où on a constaté un manque d'application et de gestion effectives des normes de sécurité établies en application de la Convention ; la Partie contractante qui effectue l’inspection, aux fins de l’article 33 de la Convention, est libre de conclure que soit les conditions auxquelles le certificat ou les licences pour tout aéronef ou tout équipage de cet aéronef avaient été délivrés ou rendues valides, soit les conditions auxquelles l’aéronef a été exploité ne sont pas égales ou excèdent les normes minimales établies conformément à la Convention. 5. Lorsque l’accès en vue d’une inspection au sol d’un aéronef exploité par la compagnie aérienne d’une Partie contractante, conformément au paragraphe 3 du présent article, est refusé par le représentant de cette compagnie, l’autre Partie contractante est libre de déduire que cette situation suscite de vives inquiétudes visées au paragraphe 4 du présent article et de tirer des conclusions prévues dans ce paragraphe. 6. Chaque Partie contractante se réserve le droit de suspendre immédiatement l’autorisation d’exploitation d’une entreprise de l’autre Partie Contractante lorsque la première Partie contractante conclut qu’il est indispensable d’agir immédiatement pour la sûreté de l’aviation d’une compagnie aérienne. 7. Toute mesure appliquée par une Partie contractante en conformité avec le paragraphe 2 ou 6 ci-dessus, sera rapportée dès que les faits motivant cette mesure auront cessé d’exister. ARTICLE 12: SÉCURITÉ DE L’AVIATION 1. La garantie de sécurité de l’aviation civile, celle de leurs passagers et de leur équipage, constituant une condition préalable à l’exploitation des services aériens internationaux, les Parties contractantes réaffirment que, leur obligation mutuelle de protéger l’aviation contre les actes d’intervention illicite, pour en assurer la sécurité, fait partie intégrante du présent Accord et, notamment conformément à la Convention de Chicago, à la Convention relative aux infractions et à certains autres actes survenant à bord des aéronefs, signée à Tokyo le 14 septembre 1963 ; à la Convention pour la répression de la capture illicite d’aéronefs signée à la Haye le 16 décembre 1970 ; et à la Convention pour la répression d’actes illicites dirigés contre la sécurité de l’Aviation civile, signée à Montréal le 23 Septembre 1971; au Protocole pour la répression d'actes illicites de violence dans les aéroports servant à l'aviation civile internationale signé le 24 février 1988, et à tout autre accord multilatéral relatif à la sécurité de l’aviation civile ratifié par les deux Parties contractantes. 2. 2. Les Parties contractantes fourniront, sur demande, toute assistance nécessaire à chacune dans le but de prévenir tout acte de capture illicite des aéronefs et autres actes contre la sécurité de ces aéronefs, des passagers et de l’équipage, des aéroports et des équipements de navigation aérienne, ainsi que toute autre menace contre la sécurité de l’aviation civile. 3. Les Parties contractantes agissent, dans leurs rapports mutuels, conformément aux normes de sécurité aérienne établies par l'Organisation de l'Aviation Civile Internationale et qui sont désignées comme annexes à la Convention; elles exigent des exploitants d'aéronefs immatriculés sur leur territoire, des exploitants d'aéronefs qui ont leur établissement principal ou leur résidence permanente sur leur territoire et des exploitants d'aéroports situés sur leur territoire, d’agir conformément à ces dispositions relatives à la sécurité de l'aviation. Dans le présent paragraphe, la référence aux normes de sécurité aérienne inclut toute différence notifiée par la Partie contractante concernée. 4. Chaque Partie contractante veille à ce que des mesures adéquates soient effectivement appliquées sur son territoire pour assurer la protection des aéronefs, pour inspecter les passagers, les équipages, leurs bagages de soute (y compris leurs bagages à main), ainsi que le fret et les provisions de bord, avant et pendant l’embarquement ou le chargement, et à ce que lesdites mesures soient adaptées en fonction des menaces. Chaque Partie contractante convient que les exploitants d'aéronefs peuvent être tenus d'observer les dispositions relatives à la sécurité aérienne visées au paragraphe 3 ci-dessus, requises par l'autre Partie contractante pour l'entrée et le séjour sur son territoire, ainsi que pour le départ de son territoire de l’autre Partie contractante. Chaque Partie contractante examine avec bienveillance toute demande émanant de l’autre Partie contractante en vue d’instituer des mesures spéciales de sécurité pour faire face à une menace particulière. 5. En cas de capture ou de menace de capture illicite d’aéronefs ou d’autres actes illicites dirigés contre la sécurité des passagers, des équipages, des aéronefs, des aéroports ou des installations et des services de navigation aérienne, les parties se prêtent mutuellement assistance en facilitant les communications et en prenant d’autres mesures appropriées destinées à mettre fin rapidement en toute sécurité à cet incident ou à cette menace d’incident. 6. Si une Partie contractante déroge aux dispositions du présent article, les autorités aéronautiques de l’autre Partie contractante pourront demander des consultations immédiates avec les autorités aéronautiques de l’ancienne Partie contractante. L'impossibilité de parvenir à un accord satisfaisant dans un délai de trente (30) jours à compter de la date de cette demande constitue un motif pour refuser, révoquer, limiter ou soumettre à des conditions l'autorisation d'exploitation et les agréments techniques de plusieurs transporteurs aériens de l’ancienne Partie contractante. Lorsque cela est justifié par un cas d'urgence, chacune des Parties contractantes peut prendre des mesures provisoires avant l'expiration de ces trente (30) jours. ARTICLE 13: Tarifs 1. Chaque Partie contractante offre des tarifs des services aériens fixés par chaque compagnie aérienne désignée, selon les considérations commerciales du marché. Aucune des Parties contractantes ne peut exiger de ses entreprises de transport aérien qu’elles consultent d’autres entreprises de transport aérien concernant leurs tarifs ou qu’elles proposent des services prévus dans le présent Accord. 2. Chaque Partie contractante peut exiger une notification ou un dépôt de tout tarif qui sera imposé par l’une de ses propres entreprises de transport aérien. Aucune des Parties contractantes n’exige de notification ou de dépôt des tarifs pratiqués par l’entreprise désignée de l’autre Partie contractante. Les tarifs restent en vigueur à moins qu’ils ne soient dénoncés ultérieurement en vertu du paragraphe 5 ci-après. 3. L’intervention des Parties contractantes doit se limiter à : a) la protection des consommateurs contre des tarifs excessifs résultant de l’exploitation abusive d’une position dominante ; b) la prévention de tarifs dont l’application constitue un comportement anticoncurrentiel qui a ou est susceptible d’avoir ou est clairement censé avoir pour effet d’empêcher, de restreindre ou de fausser la concurrence ou d’exclure un concurrent de l’itinéraire. 4. Chaque Partie contractante peut refuser unilatéralement tout tarif déposé ou imposé par l’une de ses propres entreprises de transport aérien. Cependant, l’autorité aéronautique de ladite Partie contractante n’a recours à une telle intervention que dans le cas où il lui apparaît qu’un tarif imposé ou proposé remplit l’un ou l’autre des critères énoncés au paragraphe 3 ci-dessus. 5. Aucune des Parties contractantes ne met en œuvre de mesures unilatérales visant à empêcher l’entrée en vigueur ou le maintien d’un tarif imposé ou proposé par l’entreprise de transport aérien de l’autre Partie contractante. Si l’une des Parties contractantes estime qu’un tarif est incompatible avec les considérations énoncées au paragraphe 3 ci-dessus, elle peut demander la tenue de consultations et informer l’autre Partie contractante des motifs de son mécontentement. Ces consultations doivent se tenir 14 jours au plus tard après la réception de la demande. En l’absence d’accord mutuel, le tarif entre ou reste en vigueur. ARTICLE 14: STATISTIQUES ET DONNÉES OPERATIONNELLES 1. Les autorités aéronautiques d’une Partie contractante fourniront aux autorités aéronautiques de l’autre Partie contractante sur demande, les informations et statistiques concernant le trafic entrant ou sortant effectué dans le cadre des services convenus par leurs entreprises désignées du territoire de l’autre Partie telles qu’elles ont été normalement préparées et soumises par les entreprises désignées auprès de leurs autorités aéronautiques. Ces informations comprendront des détails sur le volume, la distribution, l’origine et la destination du trafic. 2. Les entreprises désignées d’une Partie contractante fourniront, après approbation des Autorités Aéronautiques de l’autre Partie contractante aussi longtemps que possible, avant l’inauguration des services convenus, des horaires des vols, y compris toute information sur le type d’aéronef à utiliser. Cette exigence s’impose également à tout changement relatif aux services convenus. ARTICLE 15: TRANSFERT DES RECETTES 1. Chaque Partie contractante octroie à (aux) l’entreprise(s) désignée(s) de l’autre Partie contractante, des facilités en matière de transfert des recettes générées sur le territoire de la Partie contractante respective. Toutefois, ces transferts sont faits sans autorisation préalable et conformément à la règlementation sur les opérations de change en vigueur sur le territoire de la Partie contractante où ces revenus sont générés. Cette conversion et ce transfert de revenus s’effectuent en monnaies convertibles au taux de change qui prévaut à la date du transfert. 2. Les entreprises de transport aérien désignées de l'une des Parties contractantes sont autorisées à régler en monnaie locale les dépenses engagées sur le territoire de l'autre Partie contractante, notamment pour l'achat de carburant. Les entreprises de transport aérien désignées peuvent, à leur discrétion, régler ces dépenses dans une monnaie librement convertible, conformément à la réglementation nationale des changes. 3. Les Parties contractantes ont convenu d’éviter la double imposition des revenus découlant des activités de ces entreprises. ARTICLE 16: ACTIVITÉS COMMERCIALES 1. Les entreprises désignées de l’une des Parties contractantes sont autorisées, en ce qui concerne l'entrée, le séjour et le travail, à faire entrer et à employer sur le territoire de l’autre Partie contractante, le personnel administratif, commercial, technique, opérationnel, et tout autre agent spécialisé nécessaire pour assurer des services aériens. 2. Le personnel susvisé peut être constitué de ressortissants des États des Parties contractantes ou des ressortissants des États tiers sur approbation des autorités compétentes desdites Parties. 3. L’entreprise de transport aérien désignée de la Partie contractante a le droit de vendre, conformément aux lois et règlements dudit État, ses propres services aériens en utilisant ses propres titres de transport aérien sur le territoire de l’autre Partie contractante. Une telle vente peut être directement effectuée par les représentants des entreprises désignées ou à travers les agents qui possèdent une licence appropriée pour fournir un tel service. 4. Les services d’assistance au sol sont fournis à toutes les entreprises de transport aérien dans les conditions de parfaite égalité ; ils sont facturés sur la base de leur coût et sont comparables en nature et en qualité à l’auto-assistance que l’entreprise aurait pu assurer. 5. Pour exploiter ou offrir les services autorisés, toute entreprise de transport aérien d’une Partie contractante peut conclure des arrangements de commercialisation en coopération, notamment en matière de réservation de capacité et de partage de codes avec les entreprises de transport aérien désignées de l’autre Partie contractante et /ou de l’entreprise ou des entreprises d’un État tiers, à condition que : i. toutes les entreprises de transport aérien qui concluent ces arrangements détiennent les autorisations appropriées et répondent aux conditions normalement appliquées à ces arrangements ; ii. les billets d’avion des compagnies aériennes et tout autre document concernant les conditions de transport aérien et/ou les lettres de transport aérien indiquent clairement à l’acheteur ou à l’utilisateur d’une telle prestation, l’entreprise qui va en fait offrir chaque segment des services, et celle qui conclura des accords commerciaux. ARTICLE 17: CONSULTATIONS 1. Dans un esprit de franche coopération, les autorités aéronautiques des deux Parties contractantes devront tenir des consultations périodiques, à l’effet d’assurer la mise en œuvre et le respect satisfaisant des dispositions du présent Accord et de ses annexes. 2. L’une des Parties contractantes peut solliciter des consultations qui peuvent être faites par écrit et peuvent commencer dans un délai de trente (30) jours à partir de la date de notification, à moins que les deux Parties contractantes s’accordent sur une prorogation ou une réduction de ce délai. ARTICLE 18: RÈGLEMENT DES DIFFÉRENDS 1. En cas de différend entre les Parties contractantes relatif à l’interprétation ou à l’application du présent Accord et ses annexes, les autorités aéronautiques des deux Parties contractantes s’efforceront tout d’abord à le résoudre par voie de négociation directe. 2. Faute d’un règlement à l’amiable par voie de négociation par les autorités aéronautiques des deux Parties contractantes, le différend sera réglé par voie diplomatique. 3. Faute d’un règlement à l’amiable par voie de négociation ou diplomatique, elles peuvent convenir de demander un avis consultatif à un individu ou à un organisme ; en l'absence d'accord des Parties contractantes, le différend pourra être porté, à la demande de l'une des Parties contractantes, devant un tribunal arbitral constitué de trois (3) juges, dont deux seront nommés par chacune des Parties contractantes et un nommé surarbitre par les deux Parties contractantes. Chaque Partie contractante devra désigner un arbitre dans un délai de soixante (60) jours suivant la date de réception d’une correspondance écrite au sujet du différend soumis à l’arbitrage, et le surarbitre sera nommé dans un délai supplémentaire de soixante (60) jours suivant la date de la désignation des deux juges ainsi nommés. Si l’une des Parties contractantes ne nomme pas son arbitre dans les délais impartis, ou si le surarbitre n’a pas été nommé dans les délais prescrits, le Président du Conseil de l’Organisation de l’Aviation Civile Internationale peut être sollicité par l’une des Parties contractantes à l’effet de nommer un ou plusieurs arbitres, selon le cas. Dans ce cas, le surarbitre doit être un ressortissant d’un État tiers et exerce les fonctions de Président de tribunal. 4. Les coûts engagés à la suite du Groupe Spécial d’Arbitrage doivent être imputés à parts égales à chaque Partie contractante. 5. Les Parties contractantes se conforment à toute décision visée au paragraphe 3 du présent article. ARTICLE 19: AMENDEMENT 1. Lorsque l’une des Parties contractantes juge nécessaire de modifier une quelconque disposition du présent Accord y compris les annexes, elle pourrait solliciter des consultations avec l’autre Partie contractante conformément à l’Article 17 du présent Accord. 2. Si l’amendement se rapporte aux dispositions de l’Accord autres que celles de l’annexe, il sera approuvé par chaque Partie contractante conformément à ses procédures constitutionnelles et prendra effet à la date d’échange des notes diplomatiques. 3. Seuls les amendements qui se rapportent aux dispositions des annexes peuvent être convenus d’accord-parties entre les autorités aéronautiques des deux Parties contractantes et prendront effet dès leur approbation par les deux autorités aéronautiques. ARTICLE 20: CONVENTIONS MULTILATERALES Le présent Accord et ses annexes pourront être modifiés afin d’être conformes aux conventions ou accords multilatéraux qui peuvent s’imposer aux Parties contractantes. ARTICLE 21: ENREGISTREMENT AUPRES DE L’ORGANISATION DE L’AVIATION CIVILE INTERNATIONALE Le présent Accord et ses annexes seront enregistrés auprès de l’Organisation de l’Aviation Civile Internationale. ARTICLE 22: DENONCIATION Chaque Partie contractante pourra sans délai notifier à l’autre Partie contractante par écrit par voie diplomatique, sa décision de dénoncer le présent Accord. Cette notification sera simultanément communiquée à l’Organisation de l’Aviation Civile Internationale. Dans ce cas, le présent Accord prendra fin douze (12) mois après la date de réception de la notification par l’autre Partie contractante, sauf si ladite notification est retirée d’un commun accord entre les Parties avant l’expiration de ce délai. A défaut d’un accusé de réception de la part de l’autre Partie contractante, la notification sera réputée lui être parvenue quatorze (14) jours suivant la date de réception de la notification par l’Organisation de l’Aviation Civile Internationale. ARTICLE 23: ANNEXES Les annexes du présent Accord sont réputées faire partie intégrante dudit Accord et toutes les références de ces annexes, sauf disposition contraire du présent Accord. ARTICLE 24: ENTREE EN VIGUEUR Le présent Accord est approuvé conformément aux modalités constitutionnelles des pays de chaque Partie contractante et entre en vigueur à la date de réception, par voie diplomatique, de la dernière correspondance entre les Parties contractantes confirmant l’accomplissement des procédures internes préalables à son entrée en vigueur. Fait à ----------------------le--------------------en deux originaux, en français, arabe et anglais, tous les textes faisant également foi. Cependant, en cas de divergence d'interprétation du présent Accord, le texte anglais fait foi. POUR LE GOUVERNEMENT DE POUR LE GOUVERNEMENT DE L’ETAT DU QATAR LA REPUBLIQUE DU CAMEROUN ANNEXE: ROUTES SPECIFIÉES 1. Les routes spécifiées par les entreprises de transport aérien désignées de la République du Cameroun sont les suivantes : De: Points en République du Cameroun Via: Tous points A: Points à l'État du Qatar. Autres points: Tous points 2. Les routes spécifiées par les entreprises de transport aérien désignées de l'État du Qatar sont les suivantes : De: Points à l'État du Qatar. Via: Tous points A: Points en République du Cameroun. Autres points: Tous points NOTE: Les entreprises de transport aérien désignées de l’une des Parties contractantes peuvent, sur tout vol et à leur gré, exploiter des vols dans l'une ou l'autre direction ou dans les deux directions et omettre des escales en un ou en plusieurs points, à condition que les services commencent ou se terminent en un point sur le territoire de la Partie contractante désignant la compagnie aérienne.
