Як активісти борються із варварською вирубкою лісів просто під Львовом.
Від активістів Варіантам стало відомо, що у Винниківському лісництві, зокрема на території, що розташована просто навпроти Львівської Швейцарії, масово вирубують буки.
Саме Винниківське лісництво входить до восьми лісництв держпідприємства «Львівського лісового господарства». Адміністративно воно підпорядковується Пустомитівському району, а також частково Львову.
Втім землі, на яких рубають дерева, належать Винничківській сільській раді, а самі насадження, відповідно, – лісгоспу.
Аби добратися на місця вирубки, не потрібно довго їхати та шукати їх, адже лісники вибрали вигідне місце.
Їдучи по кільцевій дорозі у напрямку Винник, з обох боків милують око густі, пишні пасма лісів. Звичайний львів’янин навряд чи здогадався би, що коїться у них усередині.
Зупиняємось біля Львівської Швейцарії. Взуваємо ґумаки, беремо камери і йдемо у ліс, що прямо навпроти відпочинкового комплексу.
Просто при вході у ліс бачимо знак «Прохід і проїзд заборонені. Валка лісу». Піднімаємось трохи вгору і вже натрапляємо на сліди рубок: пеньки, розкидані довкола деревна тирса та купи гілляччя.
Ідемо далі вглиб лісу і бачимо, як посеред масиву хаотично або окремими групами виглядають пеньки.
Звісно, є різні види рубок: санітарні, вибіркові, прочищення, проріджування тощо. Втім, прогулявшись протягом перших півгодини, складається враження, що на невеликих територіях хотіли повністю позрубувати дерева, але не встигли.
Натомість на маленькому клаптику землі залишили кілька дерев, довкола яких розкинулись кущі та геть молоді деревця.
Таких «напівлисих» ділянок на території Винниківського лісництва хоч греблю гати. Ба більше, всі вони засмічені, оскільки лісники навіть не прибрали відходи своєї діяльності.
Блукаючи поміж дерев, ми натрапили на галявину, яка не могла не вразити своєю пустотою.
Добрий десяток пеньків та купи з гілками, що розляглись просто одна за одною, – перше, що впадає в око.
Підходимо ближче до останніх. І як виявилось, під цими купами лісники ховають пеньки, щоб їхню остаточну кількість було важко порахувати.
Особливо вражає те, що навіть зрубавши дерева, їхні частини та вже нарізані дрова просто залишили посеред лісу.
«Найприкріше те, що всі ці варварські рубки вважаються законними, – розповідає кандидат сільськогосподарських наук, член-кореспондент Лісівничої академії наук України Віталій Майборода. – Справа в тому, що лісники домовилися з лісовпорядженням, яке написало, що на цій території є рідколісся. Поясню: букове рідколісся утворюється переважно високо в горах у верхній частині ареалу бука. На цих ділянках бук є низькорослий, поганої форми та низької повноти. Таке насадження має лише ґрунтозахисне значення».
Як пояснив Віталій Майборода, згідно з документами, повнота насадження, тобто густота лісу становить 0,2, що відповідає нормам рідколісся.
Такі показники є результатом роботи таксаторів «Львівліспроекту» – спеціально навчених людей, що встановлюють цю густоту насаджень.
Сам Віталій Майборода переконаний: повнота насадження на згаданій території Винниківського лісництва становить мінімум 0,6, що аж ніяк не підпадає під рідколісся.
«Якщо ідеальна густота насадження – одиниця (100%), то тут – як максимум на 40% нижчий показник, тобто 0,6. Насадження з таким показником у жодному випадку не можна не те, що відносити до рідколісся, а навіть кваліфікувати як низькоповнотне і призначати у вирубку. Тим більше, це – лісопаркова зона, де підхід до букових та інших деревостанів зовсім інший, ніж в експлуатаційних лісах. Виняток становить той випадок, коли буки були б заражені трутовиком, чи пройшлась би буря і повалила дерева», – каже Віталій Майборода.
Натомість буки на територіях, які ми досліджували, науковець вважає абсолютно здоровими.
Хворе дерево видно неозброєним оком: першим очевидним признаком є те, що з нього назовні вилазить плодове тіло трутовика.
На нездорові дерева Віталій Майборода все-таки натрапляв, втім, за його словами, їхня кількість є мізерною.
«Таксатори, які дорахувались до таких цифр, працюють у державній фірмі. Ми навіть запрошували їх обійти територію лісу разом із нами. Але вони навідріз відмовились. А знаєте, чому? Та тому, що їхні дані насправді не відповідають дійсності. Лісники просто домовляються з таксаторами, а в результаті всі вони дуже пристойно заробляють на лісі», – каже голова Західноукраїнського правозахисного руху «За правду, за людей» Ярослав Семенюк.
Як стверджує Ярослав Семенюк, масово почали рубали дерева у Винниківському лісництві ще взимку цього року.
«Рубати мають іще до кінця року. І варто наголосити, що це, за твердженням лісівників, законні рубки прямо під Львовом! А що відбувається вглибині Винниківського лісництва? Ще й хитро придумали: вирізають дерева всередині лісу, щоб люди, які їдуть по трасі, нічого не бачили. Бо й справді з боку траси видно гарні, пишні ліси. А зайдеш вглиб – жахнешся», – ділиться Ярослав Семенюк.
Станом на 1 червня Львівський лісгосп видав шість дозвільних документів, які дають право проводити рубку дерев на землях Винниківського лісництва, що підпорядковуються Винничківській сільраді.
Загальна площа рубок протягом 2016 року становить 27,3 га.
На 21,5 га проводитимуть різного виду рубки, зокрема вибіркову санітарну, лісовідводну санітарну та прочищення деревостану.
Втім у документах не вказано конкретної рубки на рідколіссі, площею у 5,8 га. Відтак виникає підозра, що з території можуть вирубати геть усі дерева.
Схема дерев’яного бізнесу
Перед вирубкою працівники лісгоспу визначають, які ж саме дерева слід зрізати.
Відтак існує три категорії, відповідно до яких відносять дерева, що підлягають рубці.
Для цього на стовбури дерев лісники наносять спеціальні позначки, які звичайному пересічному, звісно, не зрозуміти.
Якщо на дереві є одна вертикальна риска – це ділове дерево, тобто те, яке майже у повному обсязі піде на виробництво паркету та меблів.
Якщо ж на дереві є дві риски – воно є напівділовим. Відповідно, частину дерева використають на виробництво меблів та паркету, а іншу – на дрова.
Висота ділової частини стовбура повинна сягати від 2,5 до 4 метрів, і тільки решта повинно піти на дрова.
Три риски на дереві означають, що воно повністю дров’яне. Причому довжина ділової частини такого дерева має бути меншою, ніж 2,5 метри.
«Тут у лісі є сотні дерев, які позначені під дрова, хоча насправді довжина їхньої ділової частини складає мінімум 5-6 метрів. Відтак по факту вони є на 100% діловими, тобто тими, з яких виготовлятимуть дороговартісні меблі та паркет», – заявляє обурено Віталій Майборода.
Тож схема досить проста: у лісгоспі вирішують, який тип дерева потрібно зрубати, а потім розставляють на стовбурах невідповідні позначки, аби підзаробити.
Відтак здорові дерева, які абсолютно підходять під виробництво недешевих меблів, відводять у рубку як дрова.
У кращому випадку стовідсотковий діловий бук відведуть як напівділове дерево. Тобто лише половину стовбура продадуть на виготовлення паркету й меблів, а решту ділової деревини в документах вкажуть як дрова, які продадуть втридорога за ціною ділового лісу.
«Яку саме позначку на дерево нанести, вирішує лише працівник лісництва. Звичайно, він може виправдовуватись, що на тих деревах, які вказані як дрова, були якісь нарости чи інші відхилення. В такому випадку нехай би собі росли і далі, адже неправильна форма чи нарости на стовбурі не свідчать про те, що дерево хворе. А як ми переконались, тут здорові та великі дерева списують під дрова, щоби нажитись на різниці між вартістю дров та ділового лісу», – стверджує Віталій Майборода.
Як зауважує науковець, за час, поки він із колегами досліджував дерева, на жодному з буків не було однієї позначки, яка й означає, що дерево справді іде на виробництво меблів чи паркету.
Більше того, коли дерево зрубають, довести, що лісник неправильно визначив його призначення, буде вже неможливо.
Відповідно до лісорубного квитка, виданого 13 січня 2016 року, з території Винниківського лісництва (квартал 61 виділ 10), яку визнали рідколіссям, буде виділено 383 кубометри деревини.
Серед них ділової вказано лише 26 метрів кубічних, все решта – дрова.
«Сьогодні один кубометр кругляка бука хорошої якості коштує близько 4000 гривень, а кубометр дров – всього лише 400 гривень. Тож по паперах лісники заготовляють дрова, а з лісосіки вивозять ділову деревину. І це все вважатиметься законним», – пояснює Віталій Майборода.
Також він додає, що лісники полюють не лише за буками, а й за дубами.
Вартість кубометру кругляка дуба на ринку сьогодні становить мінімум 8000 гривень, а дров – 400 гривень.
А в середньому з великого шестиметрового дуба можна отримати 2-3 кубометри деревини.
«Ми неодноразово натрапляли на здорові дуби такого розміру, а на них було три позначки. Неважко уявити, скільки лісникам залишиться деревини з них. А зароблять вони чимало на тих «дровах», які спишуть по 400 гривень», – констатує Віталій Майборода.
Зрізаючи дерева, лісники не тільки не прибирають за собою купи відходів, а й нищать ті дерева, які ще не встигли вирубати.
Так ми натрапляли на буки, частина стовбурів яких була з обдертою корою через недбальство лісгосппрацівників. Відтак дерево стає вразливе до шкідників і може швидко загинути.
Механізми впливу на лісових злодіїв
Загальні обсяги вирубувань визначає «Ліспроект», але лише працівники лісгоспу можуть вирішувати, які саме дерева зрізати. До цього процесу неможливо залучити сторонніх до установи фахівців.
Лісові господарства сьогодні стали потужною машиною, працівники якої злагоджено заробляють гроші.
«На думку Львівського лісгоспу я не є експертом, оскільки не працюю в їхній сфері. Хоча хороших фахівців на Львівщині поза лісгоспами є вдосталь. А самотужки боротися із вирубкою лісів дуже нелегко», – веде далі Віталій Майборода.
Проконтролювати стан вирубок у Винниківському лісництві й на Львівщині зокрема може лісова інспекція. Втім як тільки Арсеній Яценюк посів крісло прем’єра, їй відразу заборонили їздити з плановими перевірками щопівроку.
Сьогодні така перевірка можлива, але лише за наявності скарги в екологічну інспекцію Львівської області.
Вона, в свою чергу, подає запит у Київ, і лише після погодження лісова інспекція приїжджає на місце.
«Ми таку скаргу вже надіслали, тепер треба чекати десять днів. Хоча я впевнений, що перевірка, якщо вона й відбудеться, то мінімум за днів двадцять, не раніше. А за цей час можна знищити увесь масив лісу», – каже Віталій Майборода.
За його словами, зазвичай перевірка відведених під рубку насаджень завершується таблицею ділення.
«Яку установу до неї не залучали б, чи той ж "Львівлісозахист", який буцімто незалежний, чи будь-які працівники інших лісгоспів, все одно всі вони підпорядковуються Агентству лісових ресурсів України. І всі вони – один клан, ніхто не піде проти свого», – із сумом підсумовує Віталій Майборода.
Та незважаючи на це Віталій Майборода сподівається, що інспекція все-таки об’єктивно проведе перевірку, а лісники не встигнуть замести сліди злочину до її приїзду.
Згідно із законодавством, органи місцевого самоврядування, на землях яких проводять вирубку лісів, можуть її заборонити.
Тож Винничківська сільська рада має право зупинити рубку лісів на землях, які безпосередньо знаходяться у її власності.
У коментарі Варіантам голова Винничківської сільради Любомир Лещишин підтвердив, що територія лісництва, на якій проводять рубку, справді належить владі села. Відтак він також виступив за те, аби припинити лісове варварство.
«Я обома руками за те, щоби зупинити вирізання лісу на наших землях. Буквально на днях дізнався про цю проблему і точно не залишусь осторонь. Зроблю від себе все можливе, але спочатку мушу проконсультуватись із юристами, як це правильно зробити», – заявив Любомир Лещишин.

How Activists Fight Against Barbaric Deforestation near Lviv
We’ve become aware from activists of the fact that beech trees are massively chopped down in Vynnyky Forestry (Винниківське лісництво). In particular this concerns the territory near Lvivska Shveytsariya (Lviv Switzerland / Львівська Швейцарія) recreation complex.
Vynnyky Forestry itself is a subsidiary of Lviv Forestry State Enterprise (Державне підприємство “Львівське лісове господарство”). One part of forestry is situated in Pustomyty district (Пустомитівський район) near Lviv, while the other part relates directly to Lviv.
However, the land on which deforestation is taking place, is municipal property of Vynnychky village local authorities (Винничківська сільська рада). And planting itself is owned by forestry.
One doesn’t have to drive for a long time and look for deforestation area carefully, because woodmen have chosen beneficial spot for their activity.
When you drive the ring-road towards Vynnyky (Винники), you have a chance to observe the glory of local thick forest from both sides of the road. Average citizen of Lviv will never guess what is going on behind the trees.
We stop near Lvivska Shveytsariya, put on rubber boots, take cameras and head straight to the forest, which is opposite to resort.
Right at the entrance to the forest we see a sign which says: “No trespassing. Felling operations”. We are climbing a little bit further and see deforestation evidence: stumps, sawdust and several piles of tree branches.

We keep moving deep into the forest and we again see chaotic set of stumps.
There are certainly different types of forest fell, which include sanitary felling, selective felling, forest isolating, forest decimation etc. However, after half an hour of walking through the forest, it seems that someone wanted to entirely cut the forest here, but didn’t have enough time to do it.
Several big trees were left untouched on this small piece of land. They are surrounded by bushes and small young trees.
There is plenty of such “half-bald” sites in the territory of Vynnyky Forestry. To make matters worse, all of them are littered, because woodmen did not even bother to pick up waste left by them.
Wandering around the trees, we came across a glade which greatly impressed us with its emptiness.
Lots of stumps and piles of tree branches is the first thing which strikes the eye here.
We are approaching closer to distant piles. As it turned out, woodmen hide stumps under them to make precise counting of their exact number more complicated. The most impressive thing is that even after cutting down the trees woodmen just left their parts and sliced firewood right here, in the middle of the forest.

Vitalii Maiboroda (Віталій Майборода), PhD in agriculture, corresponding member of Forestry Academy of Science of Ukraine (FASU / Лісівнича академія наук України) tells that devil of the situation is that everything we’ve just seen, all this barbaric deforestation is considered to be legal. The fact is that woodmen have made an agreement with forest inventory body, which acknowledged this zone as having sparse growth of trees. Vitalii Maiboroda explains that beech sparse growth usually takes place deep in the mountains in upper distribution area of this kind of tree. Beech in such areas is scrubby, bad-shaped and has low density. This type of planting is important only in terms of soil protection.
According to formal documentation, stand density here is only 0.2, which conforms with standards of trees sparse growth.
Such indicators are the result of forest cruisers’ job. Forest cruisers are specially trained people, who establish planting density in a certain territory. Vitalii Maiboroda himself is convinced that density of planting in abovementioned territory of Vynnyky Forestry is 0.6 at minimum. This means that this zone can’t be actually recognized as the territory of trees sparse growth.
Vitalii Maiboroda says: “If ideal planting density is 1 (100%), than here we have this indicator equal to 0.6 at minimum. Planting with such indicator can’t be related to sparse under any circumstances. It can’t be even qualified as low-density planting area and can’t be allowed to cut down. More importantly, this is a woodland park, which needs special approach to beeches and other trees stands. The only exception possible could be the situation when beeches would be infected with tinder fungus or sheared as a result of storm. Scientist is sure that beeches in the territories we’ve been to are absolutely healthy.
Diseased tree is always easily recognizable. The first obvious symptom of diseased tree is when we see that fruiting body of tunger fungus is growing out from such tree. Vitalii Maiboroda came across diseased trees during our journey. However, he assured us that their number was next to none.
Diseased tree sheared by storm
Yaroslav Semeniuk (Ярослав Семенюк) from “Za Pravdu, Za Liudei” human rights group (правозахисний рух «За правду, за людей») says: “Forest cruisers, who approved indicators we are talking about now, are working in state-owned company. We even invited them to walk around the forest territory with us. They flatly refused our invitation. Guess why! The reason is simple: in fact their indicators deny the truth. Woodmen and forest cruisers just reach an agreement, and as a result all of them make huge profit on the forest.”
Yaroslav Semeniuk claims that massive deforestation in Vynnyky Forestry has been going on since the beginning of 2016.
Yaroslav Semeniuk speaks emotionally because of the deforestation problem: “They are planning to keep on cutting down trees till the end of the year. It is noteworthy that according to woodmen this deforestation is absolutely legal, right near Lviv! They’ve organized everything really craftily. What happens inside Vynnyky Forestry? The trees are being cut down inside the forest, not near the motorway. This allows to remain unseen, because when people are driving nearby, they don’t see any suspicious activity - only good-looking forest. They would be terrified, if they went deeper in the forest..

As of June 1 Lviv forestry enterprise (Львівський лісгосп) had issued six permits, which grant the right to carry out deforestation in the lands of Vynnyky Forestry, which subordinate to Vynnychky local authorities (Винничківська сільрада).
Total amount of forest felling throughout 2016 is 27.3 hectares. Various types of fellings like sanitary felling, reforestation and forest isolating will be conducted in the territory of 21.5 hectares.

However, deforestation in the sparse growth zone (5.8 hectares) is not mentioned in the documents. This brings up a suspicion that all the trees may be chopped down here.
Wooden Business Scheme
Before deforestation itself forestry employees define exact trees to be chopped down.
There are three categories, according to which trees will be chopped down.
Woodmen place special labels to distinguish different types of trees. Average person will surely not understand what they mean.
Labeled trees
If a tree has one vertical dash than it is considered to be merchantable tree that will be fully used for parquet and furniture production.
When a tree is labeled with two dashes it is a semi-merchantable tree. Thus, one part of this tree will be used for furniture production, while the other part will be turned into firewood.
Height of merchantable part of a tree should be from 2.5 to 4 meters. And only the rest part will be used for firewood.
Three dashes mean that a tree will be fully used to produce firewood. Length of such tree merchantable part should be less than 2.5 meters. Vitalii Maiboroda speaks indignantly: “There are hundreds of trees here in the forest marked for firewood production, although length of their merchantable part is 5-6 meters at minimum. Thus in fact they are 100% merchantable and ready to be used for expensive parquet and furniture production.”

So the scheme is pretty simple. Forestry decides, which trees will be chopped down and then forestry workers place inappropriate labels on the trees to earn extra money.
Consequently, trees which perfectly fit for producing expensive furniture, are accounted as those used for firewood production.
At best 100% merchantable beech will be semi-merchantable on paper. This means that formally only half of tree trunk will be used for parquet and furniture production. The other half of merchantable wood will be formally marked as firewood in documents and in fact it will be sold at higher prices of merchantable wood.
Vitalii Maiboroda claims that only forestry employees decide how many dashes will be placed on a tree. This forestry worker can certainly justify himself that trees marked as firewood had some buildups or other defects. But he is cheating because wrong shape of a certain tree part or buildups on trunk are not indications of a diseased tree. As we can see, healthy big trees here are accounted as firewood in order to cash in on difference between the cost of firewood and merchantable trees.
Scientist notices that for the whole time of his investigation not a single beech had one dash label, which meant that tree would be used for furniture production.
What is more important, when the tree has already been chopped down, it becomes impossible to prove that woodman improperly categorized this tree.
According to deforestation permit issued on January 13, 2016, 383 cubic meters of wood will be produced in the territory of Vynnyky Forestry (block 61, unit 10), which was acknowledged as having sparse growth of trees.
Among this wood only 26 cubic meters are formally merchantable, the rest volume is firewood. Vitalii Maiboroda explains that today one cubic meter of high-quality round log costs about 4,000 UAH ($150), while one cubic meter of firewood costs only 400 UAH ($15). Thus woodmen formally collect firewood, while in reality they bring out merchantable wood from felling area. And this process as a whole is considered to be legal.
He adds that woodmen chase not only beeches, but also oaks. The cost of one cubic meter of oak round log is 8,000 UAH ($300) at minimum and the cost of firewood is 400 UAH ($15).
It is typical to get an average of 2-3 cubic meters of wood from a single 6-meter oak.
Vitalii Maiboroda states: “There were numerous cases when we came across healthy oaks of such big size. And they were marked with three dashes! It is not difficult to calculate how much wood can be received from them. And woodmen will earn much money on that “firewood”, which will be accounted at the cost of 400 UAH.”
Having chopped down trees, woodmen not only leave all the waste after them but also make harm to those trees, which remain.
In this way we encountered beeches, which had parts of trunk with stripped bark due to negligence of forestry workers. Therefore, these trees become vulnerable to forest pests and may die very quickly.
Mechanisms of Preventing Forestry Crimes
Total amount of deforestation is defined by State Enterprise “Ukrderzhlisproekt” (державне підприємство “Укрдержліспроект”). However, only forestry employees decide which trees are to be chopped down. It is impossible to engage independent experts to this procedure.
Forestries have become a powerful machine, which has a stable system of earning extra criminal money.
Vitalii Maiboroda goes on: “Representatives of Lviv forestry think that I am not an expert because I am not employed in their field, though there is a plenty of experts out of forestries in Lviv Oblast. And it is very difficult to fight against illegal deforestation on your own.”
Besides independent activists the status of deforestation in Vynnyky Forestry and in Lviv region in general can be controlled by State Forestry Inspection (Державна лісова інспекція). However, as soon as Arseniy Yatsenyuk became the Prime Minister of Ukraine (Прем’єр-міністр України), Forestry Inspection was immediately forbidden to make a regular forestries audit every six months.
Today such audit is possible only in case of complaint received by ecology inspection in Lviv Oblast.
Ecology inspection in turns submits inquiry to Kyiv and only after Kyiv’s agreement Forestry Inspection gets right to visit deforestation site.
Vitalii Maiboroda says: “We have already sent such complaint. And now we have to wait for 10 days. Though I am sure that audit (if it ever happens) will be carried out only in 20 days at minimum, not earlier. And before they manage to come to the site it is possible to destroy all the trees here.”
According to Vitalii Maiboroda, such audit usually has no sufficient results.
Vitalii Maiboroda concludes: “Whatever organization is involved in audit, all of them are subordinate to the State Forest Resources Agency of Ukraine (Агентство лісових ресурсів України). And all of them in fact represent the same forestry mafia. Nobody will turn against partners in this criminal wood business.”
Nevertheless, Vitalii Maiboroda hopes that audit will be more or less impersonal and woodmen won’t have enough time to cover up traces of their criminal activity.

According to applicable law, local authorities may forbid deforestation in their lands.
Thus Vynnychky local authorities have a right to stop deforestation on the lands directly owned by them.
In his commentary to us, the head of Vynnychky Village Council (Винничківська сільрада) Liubomyr Leshchyshyn (Любомир Лещишин) confirmed that the territory of forestry, on which forests devastation takes place, is the property of village authorities. Therefore, he also speaks in favor of stopping forest vandalism.
Liubomyr Leshchyshyn claimed: “I support stopping deforestation in our land. I’ve heard of this problem the other day and I will certainly not ignore it. I will do my best, but first I should get lawyers’ opinion on how to do it properly.”

У понеділок 12 серпня у сесійній залі Львівської обласної ради відбулося громадське обговорення проблеми незаконних вирубок лісу у регіоні. Таким чином голова Обласної адміністрації Олег Синютка виконав свою обіцянку перевірити стан вирішення питання, яку він дав громадським активістам 100 днів тому.
Обговорення мало формат розширеної наради, на яку прийшли чиновники, правоохоронці та представники громадськості. Олег Синютка, намагаючись продемонструвати готовність боротися із незаконними вирубками, вимагав від підлеглих чиновників і правоохоронців звітів про чіткі результати роботи за минулих три місяці. Саме 100 днів тому на спільній із громадськими активістами нараді очільник області пообіцяв активізувати роботу різних служб для зменшення обсягів незаконних вирубок деревини.
Понеділкова нарада стала, радше, не круглим столом, а саме звітом посадовців про роботу у цій сфері. Почергово до трибуни підходили голова управління лісового господарства Львівської ОДА Анатолій Дейнека, голова «Галсільлісу» Петро Пешко, начальник Національної поліції у Львівській області Дмитро Загарія та Прокурор Львівської області Юрій Квятківський, а також інші посадовці. Вони представили інформацію про свою роботу за 100 звітних днів, хоча ця інформація навряд чи комплексно проілюструвала дійсні масштаби проблеми.
Анатолій Дейнека розповів, що за звітні 100 днів до його управління надійшла інформація про 433 самовільних вирубки. При чому, він запевнив, що у 424 випадках такі факти виявляли самі лісничі, хоча раніше саме цих людей найчастіше звинувачували у покриванні таких дій. Трьох лісничих було усунено від виконання обов’язків, – повідомив посадовець. Також він анонсував запуск електронного обліку деревини, що доступна для вирубки та вирубується.
Петро Пешко розповів про масштабні перевірки на підприємствах «Галсільлісу»: 18 доган було оголошено керівникам підприємств, 45 – лісничим. Найбільш проблемним із них виявилося ДП «Львівський військовий лісокомбінат», Магерівський лісгосп – там виявлено одразу 26 порушень, одне – на 199 кубометрів. Він додав, що найбільш проблемними у плані порушень є саме військові лісгоспи.
Дмитро Загарія говорив уже про більш конкретні показники у боротьбі з незаконними вирубками. Так, за його звітом, до поліції надійшло 364 повідомлення про порушення на місцях вирубок, було відкрито 326 кримінальних проваджень. Хоча із доповіді не було зрозуміло, про який саме період часу йдеться. Очільник обласної поліції нарікав, що завершення справ гальмує у судах – їх розглядають подекуди до півроку. Також він запропонував провести обговорення жорсткості покарань за причетність до незаконних вирубок.
«Найближчого часу керівництву області, правоохоронцям та громадськості треба сідати за стіл, та розглядати питання покарань. Інколи людина наносить збитків на 60 тисяч гривень, але несе лише адміністративну відповідальність», – пояснив Загарія.
Зрештою, на думку керівника обласної поліції, першочерговим питанням для найближчого обговорення має стати проблема неконтрольованості експорту деревини із Львівщини за кордон.
Зрештою, дані про роботу Львівської обласної прокуратури за цим напрямком представив і Юрій Квятківський. Він розповів, що за підзвітний період цього року його відомство зафіксувало у два рази більше повідомлень про незаконні вирубки, ніж за аналогічний час минулого: 394 звернення, 41 із них – від громадян, 10 – від підприємців. Прокуратура порушила 8 справ за цими зверненнями, 3 із них було передано до суду, до відповідальності було притягнуто 13 осіб. Актуальними залишаються ще 13 проваджень.
ІА «Дивись.Info» попросила прокоментувати результати цього обговорення громадського активіста із ГО «Українська галицька асамблея» Антона Петрівського, який знається на проблемах вирубок і був присутній на зустрічі.

– «Попереднього разу, коли була нарада в Олега Михайловича, прийняли певні рішення, була резюлюція із його боку, звернення до керівників певних відомств, до керівника Управління лісового господарства, до керівника «Галсільлісу». Пройшли три місяці, за які назбиралося теж багато порушень. Тобто, керівники всіх відомств говорять, що були порушення, що люди понесли покарання, що виписувалися штрафи, але ліс надалі продовжували рубати.
Якщо після останньої наради ситуація так само повториться, ми зможемо говорити, що такі зустрічі є імітацією боротьби із незаконними вирубками. Ми бачимо таку картину: усі говорять, що знайдено правопорушення, усі говорять, що є покарані люди та відкриті кримінальні провадження, але вирубки надалі продовжуються. Для чого тоді робити таку неефективну роботу?
Рано говорити про результати цієї наради. Насправді лісова мафія сильно тримається за свої прибутки на лісі. Побороти її можна лише комплексними заходами, спільними зусиллями усіх служб і активістів. Але якщо б влада мала бажання, такі речі вона припинила б. Насправді вона може набагато більше.
Це буде добре, якщо Олег Михайлович звертатиметься до правоохоронців і суддів. Прокурор Квятківський і керівник поліції Загарія говорили, що чимало справ зависли у судах, що вони не працюють так, як повинні працювати. І Синютка пообіцяв, що це питання обговорюватиметься.
Олег Михайлович наголошував на тому, що в нього була зустріч із генпрокурором Юрієм Луценком і що між ними є співпраця та можливість отримання допомоги. Якщо є такий важіль впливу, то Синютка мав би ефективніше використовувати їх. Чому їх не використовують?»
Владі важливо було продемонструвати громадськості, що її вимоги, висловлені три місяці тому, виконуються. І цифри, що їх озвучили посадовці, дійсно вражають. Але вони не дають вповні оцінити масштаби проблеми. По-перше, показники за підзвітний період варто було б комплексно порівняти із показниками за попередній час і з реальними обсягами вирубленої деревини. По-друге, реальні результати про роботу правоохоронців та органів влади можна буде говорити за двох обставин: доведення кримінальних проваджень до кінцевих вироків судів (виправдальних чи обвинувальних) та реальному скороченні кількості незаконно вирубуваної деревини.
Водночас, варто визнати, що влада області та правоохоронці зробили важливий крок вперед: вперше громадськості представлено зведену інформацію про порушення у лісовій галузі та представлено звіт про порушені справи. Це обговорення – поки незначне для повного вирішення проблеми. Але воно є імпульсом для подальшої роботи: Олег Синютка анонсував зустріч із представниками прокуратури, поліції та судів, на якій пообіцяв обговорити причини гальмування розгляду проваджень щодо вирубок. Також він попередив, що 27 вересня у Львівській обласній раді відбудеться обговорення розвитку лісової галузі краю на наступний рік, а у жовтні буде представлено документ із відповідною стратегією.
Відтак громадськості залишається контролювати перебіг цих процесів, аби імпульс переродився на дійсне реформування. Аби звільнені лісничі не поверталися до роботи на посади в інших господарствах. Аби не приховувалися обсяги реальних вирубок. Аби понеділковий «круглий стіл» не став звичайною декларацією.

Translation - English Struggle Against Illegal Deforestation in Lviv Oblast. Are There Any Real Results?
On Monday, August 12, a public discussion regarding the problem of illegal deforestation took place in the main hall of Lviv Regional Council (Львівська обласна рада). This is how the Head of Lviv regional administration (Львівська обласна державна адміністрація) Oleh Syniutka (Олег Синютка) fulfilled his promise to check the progress with solving the problem, a promise he had given to civil activists 100 days before.
Discussion was held in a format of conference, which was attended by regional officials, policemen and representatives of the general public. Trying to show his readiness to fight against illegal deforestation, Oleh Syniutka demanded reports on the results of activity over the previous three months from officials and policemen. It was exactly 100 days previously, at a conference with civil activists, when he promised to stir up the work of different services to reduce amount of illegal deforestation.
Monday’s meeting was a kind of officials’ reporting on the results in this field rather than a round table. Head of Lviv regional forestry administration (Управління лісового господарства Львівської ОДА) Anatolii Deineka (Анатолій Дейнека), head of “Halsillis” utility enterprise (компанія “Галсільліс”) Petro Peshko (Петро Пешко), head of National Police office in Lviv Oblast (Управління Національної поліції України в Львівській області) Dmytro Zahariia (Дмитро Загарія), Prosecutor of Lviv Oblast (Прокурор Львівської області) Yurii Kviatkivskyi (Юрій Квятківський) and other officials had the floor in turn. They presented the results of their work for the previous 100 days, though this information would be unlikely to illustrate the real scope of the problem.
Anatolii Deineka said that his department had received information about 433 unauthorized fellings over the 100 days. He emphasized the fact that forest officers revealed such facts in 424 cases, though these people were usually accused of hiding such activity before. Three forest officers were relieved from office. He also announced the launch of an electronic accounting system for wood, which would include information about the wood available for felling and about the wood currently being felled.
Petro Peshko described the results of massive internal audit of the affiliate companies of “Halsillis”: 18 rebukes were given to heads of these companies, 45 rebukes were delivered to foresters. It turned out that the most problematic subsidiaries of “Halsillis” were “Lviv military forestry” state-owned enterprise (ДП «Львівський військовий лісокомбінат») and Mahery forestry (Магерівський лісгосп). There were 26 violations by these two companies alone, the biggest one was related to 199 cubic meters of wood. He added that the most problematic forestries in respect to various violations were those related to the military.
Dmytro Zahariia talked about more specific examples of the struggle against illegal felling. According to his reports, police received 364 messages about violations that were revealed during deforestation. As a result, 326 criminal cases were opened. However, it was not clear which period of time was covered in the report. Head of Regional police reproached local courts because they often slowed down resolution of criminal cases. There were situations when courts took up to six months to deal with some cases. He also suggested discussing strengthening penalties for involvement in illegal logging.
Zahariia explained: “Regional authorities, policemen and the general public should negotiate and go into the matter of penalties. It is not normal, when a person causes damage equivalent to 60,000 UAH ($4,000) and is only administratively responsible for it.”
The Head of Regional police suggested that the matter of unregulated wood exported abroad from the Lviv region should become a high-priority problem for discussion in the nearest future.
Lastly, Yurii Kviatkivskyi presented information about the results of Lviv Oblast Prosecutor’s Office’s work in this field. He said that throughout reporting timeframe his office recorded twice as many messages regarding illegal deforestation compared to similar previous timeframe. There were 394 messages, 41 of which came from citizens, 10 came from entrepreneurs. Prosecutor’s service opened 8 criminal cases based on these messages. Three of them were passed to the court, 13 persons were brought to account. 13 cases are still being investigated.
“Dyvys.Info” information agency asked Anton Petrivskyi (Антон Петрівський), a civil activist from public association “Ukrains’ka Halyts’ka Asambleya” (громадське об’єднання «Українська галицька асамблея») to comment on the results of the meeting. Anton is an expert in field of felling problems and was present at the meeting.

“We passed several decisions during the previous meeting at Oleh Syniutka’s office. There was resolve from his side as well as an appeal to the heads of various departments, the Forestry administration and the “Halsillis” company. Three months have passed since that meeting, over which a lot of new violations have emerged. In other words, heads of all departments state that there were violations, that people were punished and fined for this. Nevertheless, illegal deforestation keeps on happening.
If nothing changes after the recent meeting, we will be able to conclude that such meetings are only pretending to fight against illegal logging. We see the whole picture this way: everyone says that violations were found, everyone states that there are people punished and that criminal cases were opened, but fellings are going on. What’s all this inefficient work for?
It is too early to estimate the results of this meeting. In fact the forest mafia seriously fights for their wood profits. It can be defeated only with complex methods and joint efforts of all services and activists. If authorities wanted to solve this problem, they would actually do it. Their capabilities are far beyond what we’re used to seeing.
It would be good if Oleh Syniutka addresses policemen and judges. Prosecutor Kviatkivskyi and the Police head Zahariia said that lots of cases are stuck in courts, that courts do not the way they should do. And Syniutka assured us that this matter will be discussed. He stressed the fact that he had met with Yurii Lutsenko (Prosecutor General of Ukraine) and they had agreed upon collaboration and ability to get the necessary help on this matter. If there is such powerful method of influencing criminals, than Syniutka should have used it more effectively. Why doesn’t he use it in a most effective way?”
It was important for authorities to demonstrate to the public that the demands expressed by them three months ago were fulfilled. And the numbers announced by officials are really impressive. But these numbers don’t allow one to estimate real scope of the issue. Firstly, current period indicators should have been compared to the similar indicators of previous periods and with real volumes of cut trees. Secondly, real results of police and authorities can be assessed only when the following conditions will be met: finishing criminal cases up to court sentences (whether they are absolutory or condemnatory) and real reduction of wood amount, which was illegally cut.
At the same time it is important to note that regional authorities and police services have made an important step forward. For the first time they’ve presented summary data regarding violations in forestry field and showed criminal cases to general public. Such discussion is still not enough for the solution of this complex problem. However, it is an intention for further work. Oleh Syniutka announced meeting with representative of Prosecutor Office, police and courts, on which he promised to discuss the reason of slow progress in criminal cases related to illegal deforestation. He also noticed that on September 27, the Lviv Regional Council (Львівська обласна рада) would discuss its forestry development plans for the next year. And the document with the corresponding development strategy would be presented in October.
Therefore, the only thing the general public can do now is control this process in order to transform the intention mentioned above into real changes for better. This means that fired woodmen won’t be able to be hired in other forestries, the real amount of felling won’t be hidden and Monday’s round table won’t remain just a trivial declaration.
