I obtained the required information to fulfil my duties as statutory auditor and conducted my examinations in accordance with the generally accepted auditing principles in Colombia, which includes the recommended procedures for the technique of account auditing. Such standards require planning and executing my examinations to obtain a reasonable certainty that the financial statements are free of material errors. An audit of financial statements includes, amongst other procedures, the examination, on a selective basis, of the evidence that supports the numbers and disclosures in the financial statements. Further, it includes an evaluation of the utilised accounting principles, significant accounting estimates made by the management of the Company, and of the presentation of the financial statements as a whole. I consider that my examinations provide me a reasonable basis to establish the opinion that I express in the fourth paragraph. |

3). Bahwa PENGGUGAT sangat perlu untuk menguraikan latar belakang sengketa yang telah diputus oleh Purusan Arbitrase Internasional (Bukti P-1), seperti telah PENGGUGAT uraikan didalam Repliknya. Hal ini perlu dikemukakan sebagai bahan pertimbangan Majelis Hakim untuk memutus perkara a quo, dan mengapa sampai PENGGUGAT mengajukan pembatalan atas Putusan Arbitrase Internasional a quo.
3.1. Bahwa sengketa arbitrase yang telah diputus oleh Putusan Arbitrase (Bukti P-1) berasal dari dua kontrak yang berbeda dan terpisah, yaitu masing-masing-masing:
a. Joint Operating Contract (JOC), Bukti P-2 yang dibuat dan diadakan pada tahun 1994 antara TERGUGAT dengan PENGGUGAT.
b. Energy Sales Contract (ESC), Bukti P-3 yang dibuat dan diadakan pada tahun 1994 antara TERGUGAT, PENGGUGAT dan TURUT TERGUGAT.
3.2 Bahwa baik didalam JOC (Bukti P-2) maupun didalam ESC (Bukti P-2), keduanya memuat ketentuan, bahwa para pihak, TERGUGAT dan TERGUGAT telah memilih hukum Indonesian yang berlaku terhadap kedua kontrak tersebut (lihat Pasal 20 JOC dan Pasal 12.1. ESC).
3.3 Bahwa didalam P-2 dan P-3 tersebut, juga terdapat ketentuan mengenai force majeure (Pasal 15 JOC, dan Pasal 9 ESC). | Translation - English

That the PLAINTIFF had a strong need for outlining the background of the dispute which was decided by the International Arbitral Award (Exhibit P-1), as was outlined by the PLAINTIFF in its Reply. This matter should be indicated as consideration material for the Panel of Judges to decide the mentioned case, and the PLAINTIFF has filed for a annulment of the mentioned International Arbitral Award.
3.1. That the arbitration dispute that was decided by the Arbitral Award (Exhibit P-1) originated from two distinct and separate contracts, that are respectively:
a. The Joint Operating Contract (JOC), Exhibit P-2 that was drafted and effective on the year 1994 between the DEFENDANT and the PLAINTIFF.
b. The Energy Sales Contract (ESC), Exhibit P-3 that was drafted and effective on the year 1994 between the DEFENDANT, CLAIMANT and CO-DEFENDANT.
3.2. That it is correct that within the JOC (Exhibit P-2) as well as the ESC (Exhibit P-3), both contain the provision, that the parties, the DEFENDANT and the CO-DEFENDANT have elected Indonesian law to apply to the two mentioned contracts (see Clause 20 JOC and Clause 12.1 ESC).
3.3. That in the mentioned P-2 and P-3, there is also provision regarding force majeure (Clause 15 JOC, and Clause 9 ESC). |

Selaras dengan keputusan Kerajaan, Lembaga menasihatkan supaya perbelanjaan dikurangkan 5% bagi tujuan penjimatan dengan menguarangkan skop kerja projek-projek berkenaan mana-mana difikirkan berpatutan.
Pihak Puan adalah disyorkan merundingkan semula harga tawaran diatas kepada penender yang berjaya dengan tujuan mengurangkan harga tawaran demi menjimatkan perbelanjaan Kerajaan yang mana mengambilkira penurunan harga barang-barang dan sebagainya. Jika ada penurunan harga dipersetujui oleh penender yang berjaya, Pengerusi Lembaga Tawaran Kecil hendaklah dimaklumkan dan salinannya kepada Jurukira Agung dan Juruaudit Agung.

We respectfully refer to your letter (ref: XXX) dated 8 August 2015 in regard to the above-mentioned offer.
In line with the Government’s decision, the Board advises that expenses should be reduced by 5% for the purpose of cost savings via reducing the scope of work for the projects where it is deemed reasonable.
It is recommended that you enter into further negotiations with the successful Tenderer with the objective of revising downward the above Offer Price to save costs for the Government by taking into account decreased prices of goods and other relevant factors. In the event that the successful Tenderer agrees to reduce their Offer Price, the Chairman of the Small Tenders Board should be informed and copies should be forwarded to the Accountant General and the Auditor General.
The Board therefore advises that you undertake negotiations for reduction of the Offer Price as soon as possible.
