In vista del nuovo regolamento Europeo sui dispositivi medici, ecco un articolo il più semplice possibile per mettere in guardia i soccorritori dai rischi penali e civili che si corrono quando non si sta alla manutenzione e alla revisione dei dispositivi presenti sulle proprie ambulanze.
“Manutenzione”, “revisione generale”, “tempo di vita”, “interventi di mantenimento”. Sono tante le parole che stanno facendo capolino con insistente frequenza nella gestione di un’ambulanza. Non solo nella gestione del mezzo, ma anche per molti prodotti utilizzati a bordo. Dall’assistenza clinica alla movimentazione del paziente, esistono delle regole da rispettare per non “perdere” la conformità alla marcatura CE. Cosa significa?
La marcatura CE è una garanzia del fabbricante che dice al cliente finale: “Questo prodotto rispetta i requisiti essenziali richiesti dalla direttiva europea 93/42/CE, dalla progettazione all’immissione in commercio e l’uso in determinate situazioni”.
Nel mondo dei prodotti medicali, questa marcatura è accompagnata – quando previsto – da raccomandazioni e da prescrizioni emesse da autorità competenti, come i Ministeri, e/o da enti di certificazione, che servono a spiegare come mantenere in perfette condizioni il prodotto durante tutto il tempo di vita previsto dal Fabbricante, affinché funzioni senza arrecare danno a sé stessi o al paziente trasportato.
Alcuni dei dispositivi che abbiamo a bordo dell’ambulanza fanno parte dei “dispositivi medici”. Si tratta di strumenti usati in medicina per finalità differenti. La definizione della direttiva è questa:
«dispositivo medico»: qualunque strumento, apparecchio, impianto, software, sostanza o altro prodotto, utilizzato da solo o in combinazione, compreso il software destinato dal fabbricante ad essere impiegato specificamente con finalità diagnostiche e/o terapeutiche e necessario al corretto funzionamento del dispositivo, destinato dal fabbricante ad essere impiegato sull’uomo a fini di: — diagnosi, prevenzione, controllo, terapia o attenuazione di una malattia; — diagnosi, controllo, terapia, attenuazione o compensazione di una ferita o di un handicap; — studio, sostituzione o modifica dell'anatomia o di un processo fisiologico; — intervento sul concepimento, la cui azione principale voluta nel o sul corpo umano non sia conseguita con mezzi farmacologici né immunologici né mediante metabolismo, ma la cui funzione possa essere assistita da questi mezzi;
Ma come fa il servizio di ambulanza (associazione, privato o pubblico che sia) a garantire al paziente che sta usando strumenti “a norma di legge”?
E’ molto semplice: quando si acquista un prodotto medicale (ventilatore, defibrillatore, barella, aspiratore eccetera) questo viene fornito con un manuale d’uso e manutenzione. Quest'ultimo riporta le informazioni e le tempistiche per effettuare in modalità corretta manutenzione, revisione generale, revisione straordinaria ed eventuale tempo di vita massimo del dispositivo (un periodo che il nuovo Regolamento Europeo in materia rende obbligatorio, e ve lo spieghiamo più avanti).
ATTENZIONE: il manuale d’uso – a dispetto del nome – non contiene quasi mai informazioni sanitarie per guidare l’utente su come fare correttamente un soccorso. Quel tipo di linee guida sono gestite dai sanitari, secondo criteri internazionali: ed essendo l’Italia un paese che ha delegato alle Regioni la competenza in ambito sanitario, potrebbe capitare che le indicazioni di impiego di un prodotto siano difformi da una Regione all’altra. Ciò che non può mai cambiare è invece l’obbligo a mantenere in perfetta efficienza il dispositivo medico. Altrimenti il dispositivo perderebbe la marcatura CE, il sigillo che garantisce il dispositivo come sicuro e prodotto secondo le norme di sicurezza del nostro continente.
Cosa garantisce la marcatura CE?
La marcatura CE garantisce l’utente, perché significa che il fabbricante ha rispettato tutte le regole sulla sicurezza e ha consegnato un prodotto certificato. Ma il legislatore sa che l’usura, eventuali utilizzi inappropriati e il passare del tempo peggiorano le condizioni dei prodotti. Quindi – in pratica – la garanzia della funzionalità è anche un carico per l’utilizzatore. Se un cliente non rispetta i termini di revisione indicati nel manuale d’uso infatti decade la marcatura CE, ovvero il dispositivo non risponderebbe più ai famosi “requisiti di sicurezza”.
Manutenzione e garanzia: quali regole valgono in Italia sui dispositivi medicali?
Il grande “cappello normativo” europeo che regola produzione e manutenzione di questi dispositivi è la Direttiva europea 93/42/CEE sui dispositivi medici. In Italia la norma è attuata tramite il decreto legislativo 46/1997. Secondo questa legge è il produttore che deve dire al soggetto che usa il dispositivo medico cosa bisogna fare per l’installazione, la manutenzione e le precauzioni d’uso. Per quando riguarda i soccorritori, le informazioni del fabbricante sono vincolanti. Significa che per garantire la propria e l’altrui sicurezza nel corso delle operazioni, per tutta la vita del dispositivo medico, bisogna rispettare divieti e suggerimenti scritti nero su bianco. Quando non ci sono specifiche raccomandazioni o si hanno dei dubbi, subentra il testo unico per la sicurezza, ovvero il Dlgs 81/08 che fornisce restrizioni di carattere generale.
Il servizio di manutenzione ufficiale è una certezza!
Come detto, per mantenere la conformità (non la garanzia, è un concetto diverso) i produttori più seri e attenti richiedono che il dispositivo sia sottoposto ad un piano di manutenzione.
NON FIDATEVI DI PRODUTTORI CHE NON HANNO UNA FILIERA DELLA MANUTENZIONE!
E’ il fabbricante infatti che garantisce totalmente l’utente finale sulla conformità, effettuando in esclusiva o con service autorizzati le attività di manutenzione o revisione, con propri dipendenti o con centri autorizzati.
Il cliente deve SEMPRE rivolgersi al venditore per conoscere quali operazioni mettere in atto la manutenzione. Purtroppo è ancora presente chi effettua “verifiche funzionali” o “refresh” dei dispositivi sanitari che non sono autorizzate e non sono equiparabili alle revisioni prescritte sui manuali d’uso: in questi casi i dispositivi medici perderebbero la marcatura CE e quindi non potrebbero in alcun modo essere usati in ambulanza.
Se non pensi alla manutenzione dei tuoi prodotti, il responsabile... diventi tu!
E’ dovere dell’utilizzatore permettere al produttore di effettuare periodiche manutenzioni, sostituzioni di parti usurate e verifiche. Quando questa attività non avviene, il dispositivo medico perde i suoi requisiti essenziali “per cause non attribuibili al fabbricante”.
Queste situazioni espongono a gravi rischi pazienti ed operatori, sia dal punto di vista della salute che dal punto di vista della legge. Se il dispositivo procura un danno ad un paziente o ad un operatore per un uso improprio o una manutenzione mancata, ne risponde davanti al giudice l’utilizzatore, ovvero (secondo la 81/08) il datore di lavoro.
Ma non è finita qui, perché l’Unione Europea ha già approvato il nuovo regolamento 2017/745 Con questo nuovo testo verranno superati, a partire dal 26 maggio 2020, tutte le direttive del Consiglio e tutti i regolamenti precedenti. Si tratta di un regolamento estremamente importante e mirato ad aumentare la sicurezza e il controllo dei dispositivi.
Aspiratori, Barelle, Collari Cervicali, Defibrillatori, Monitor ECG, Sedie portantine e molti altri prodotti in ambulanza con marcatura CE, dovranno rispettare le nuove leggi e subire controlli più stringenti, rispettando vincoli di sicurezza periodicamente controllati in base a specifiche obbligatorie.
I dispositivi dovranno avere un tempo di vita chiaro e preciso, stabilito dal produttore.
Queste regole dovrebbero davvero sbaragliare il campo da produttori e distributori di prodotti non adeguati agli standard europei e – quindi – potenzialmente pericolosi.

There are many important rules that need to be respected in order to use these devices securely, hence with no risks for the patient and for the professionals that operate them. What could happen to those who do not pay enough attention to rules, regulations and do not carry out regular checks and maintenance? Let’s take a look in more detail these complex world made of rules that are always founded on a fundamental principle: SAFETY!
What does the CE marking on a medical device stand for?
What is meant by product warranty?
What is regular maintenance and why does it need to be carried out?
“Maintenance”, “general review”, “lifespan”, “maintenance interventions”. There are many words that are starting to be introduced more frequently within the realm of ambulance management. This is true not only for the management of the vehicle, but also for the many devices that are used on board. From clinical assistance to patient’s movement, there are rules to be followed in order not to “lose” the CE marking compliance. What does it involve?
CE marking is a manufacturer’s warranty which guarantees to the end client that “This product is compliant with all the essential requirements that are laid out in the European Directive 93/42/CE from the design phase up until the introduction to the market and the use of the device in certain situations.
In the medical device world, this marking is accompanied – when required – by recommendations and provisions issued by competent authorities, such as Ministries and/or certification institutions. These sets of recommendations are used to explain how to maintain your device in perfect conditions during its entire lifespan and in order for it to work without causing harm to us, or the patient who is being transported.
Some of the devices that are on board of an ambulance are part of the so-called “medical devices”. These are tools that are used in medicine for different purposes. The definition given by the directive is the following:
'Medical device' means any instrument, apparatus, appliance, material or other article, whether used alone or in combination, including the software necessary for its proper application intended by the manufacturer to be used for human beings for the purpose of:
- diagnosis, prevention, monitoring, treatment or alleviation of disease,
- diagnosis, monitoring, treatment, alleviation of or compensation for an injury or handicap,
- investigation, replacement or modification of the anatomy or of a physiological process,
- control of conception,
and which does not achieve its principal intended action in or on the human body by pharmacological, immunological or metabolic means, but which may be assisted in its function by such means;
How does the ambulance service provider (association, private or public entity) guarantee to the patient that they are using devices in compliance with the law?
It is actually quite simple: when you purchase a medical device (ventilator, defibrillator, stretcher, aspirator etc.) this is always sold in conjunction with a user’s manual and additional maintenance information. This second document has all the information and timings to carry out a proper maintenance, general maintenance or extraordinary maintenance and also contains the maximum lifespan of the device (this information is now required by the new European Regulation on the subject)
WARNING: The user’s manual – despite its name – usually never contains any health related information to guide the user in administering first aid. Health professionals, following international criteria, manage this kind of information. Considering that the Italian State has delegated to its Regions the authority to regulate in this field, it is possible that the directions of use may be different from Region to Region. What remains the same is the obligation to keep the device in perfect condition and order. Should this not happen, the device may lose CE marking, which represents the safety of the product as laid out in EU Rules and Regulations.
What does the CE marking guarantee?
The CE marking is a guarantee that applies to the users of a medical device. It symbolizes that the manufacturer has followed all safety rules and has produced a certified device. The legislator is aware of the fact that the normal wear and tear, any inappropriate use of the device and its progressive ageing will deteriorate the conditions of the product. Hence, the warranty of functionality it’s also a burden for the user. If a user does not respect the terms of maintenance that are laid out in the user’s manual, the CE marking will be lost and the device will therefore not have the required safety compliance to be used in case of necessity.
Maintenance and warranty: what are the current rules in Italy regarding medical devices?
The main European relevant set of rules that regulates the production and maintenance of these devices is the European Directive 93/42/CEE on medical devices. This Directive has been implemented through the Legislative Decree 46/1997. The decree states that it is the responsibility of the manufacturer to supply to the user information on how to install and maintain the device and also any precautions that need to be taken during its use. The users are bound to follow the information that is being supplied to them. This means that during the entire lifespan of the device and in order to safeguard the safety and security of the patients and the users, the regulations provided must always be followed. In case no specific information are found, or in case any doubt should arise, the answer can be found in the general regulation for security (Legislative Decree 81/08) that gives broader rules on the subject.
Official maintenance service saves lives!
As mentioned before, in order to maintain the conformity (not warranty, which is a different concept) the more attentive and safety oriented manufacturers require that the device is the subject of a maintenance plan.
BEWARE OF ALL THOSE MANUFACTURERS THAT CAN’T PROVE TO BE PROACTIVE IN THE MAINTENANCE SECTOR
It is totally the responsibility of the manufacturer to guarantee the conformity of the device, by carrying out the required maintenance or review activities, through its employees working in authorized retailers.
The user must ALWAYS go back to the manufacturer to acquire information on how to maintain the device correctly. Unfortunately, it is not uncommon for unauthorized personnel to carry out “functional checks” or “refresh” of the health devices. These actions are not authorized and do not compare to the ones that would be carried out by an authorized technician. In this case the device may lose the CE marking and could not be used on an ambulance,
If you are not attentive to the maintenance of your devices…. It becomes your problem!
It is responsibility of the user to allow the manufacturer to carry out regular maintenance, substitution of ageing parts and other checks. When this is not the case, the device loses its essential requisites “by cause that cannot be attributed to the manufacturer”.
These conditions put at very high risk the patient and the user, both from a safety and regulation perspective. If the device causes any arm to either the patient of the user due to improper use or a missed scheduled service, the user’s employer will be responsible in a court of law as prescribed in the Legislative Decree 81/08.
You thought this was enough…. But it isn’t! The Eu has already approved the new Regulation 2017/745
This text is going to substitute starting from the 26th of May 2020 all the Counsel’s Directives and all the precedent Regulations. This is a very important Regulation and has its main objective to improve the safety and control of the devices.
Devices such as aspirators, stretchers, cervical collars, defibrillators, ECG monitors, medical transport chairs and many others will need to comply with the new Regulation, which lays out more stringent requirements.
Devices must now have a defined lifespan that is decided by the manufacturer.
The new rules should be able to push out of the market those manufacturers and distributors that are not compliant with the new European standards and therefore potentially dangerous.

The Betfair Exchange - Betting Exchanges

The Bookies or The Bookmakers

Back Bet

Lay Bet
This is simply a term for placing a bet that an outcome will NOT happen. We do this on the betting exchange. Betfair is the exchange we will be using as they are the most popular and easiest to use. Betfair allows us to place a bet that covers the opposite outcome of the back bet. Eg. Man Utd Vs Chelsea On the exchange, I lay a bet that Manchester United will NOT WIN. This means that Chelsea winning and importantly the Draw is also covered.
Qualifier Bet
Usually, with a welcome bonus bet from the bookies, you are required to bet through your deposit before you can withdraw. This is called the qualifier bet as it is used to qualify us for the free bonus bet. (By using the back and lay technique in the tutorial we don't lose this as you will see later when going through the 8 steps)
Turnover Requirements
Some bookmakers want you to reach a certain amount of bets on your account before they allow you to withdraw your profit. Sometimes this is 2x the amount. Example. If the 5.00 back bet wins in the bookie we would win $40, to make sure we are not risking anything. We need to lay the bet at 5.00 on the exchange with a lay stake of $10.00. So in this example, we would need to put $40 into Betfair exchange to neutralize the bet. So below is the result no matter what happens.
Usually, to get our free bet we lose a few cents or dollars depending on how much we are placing. Don't worry we make this back with a nice profit, this is why its called no-risk matched betting :-) Once this bet finishes our money will be either in the exchange (Betfair) or the online bookies (Betstars).

Betfair Italia is the main exchange I would recommend for matched betting Italy, they are the most popular by far and always have the most liquidity. This is where we place our opposing lay bet to cancel out the back bet with Betstars.

Step 3 - Use Decimal Odds Only
This is essential to make things easier when using the matched betting calculator later. Most sites use decimal as default. If the odds are displayed in a fraction there is usually an option in the settings that lets you change this.

La Back Bet
La back o backing bet è la scommessa che fai sull'esito della partita. Piazziamo questa scommessa online con il bookmaker che ci dà un bonus. Per esempio in una partita tra Manchester United e Chelsea faccio una Back Bet che il Manchester United vincerà con Betstars.
La Lay Bet
Questa è una scommessa che ti permette di dire che un risultato NON accadrà. Facciamo questa scommessa sulla piattaforma di scambio di scommesse. Betfair è la piattaforma che utilizzeremo- Betfair ti permette di fare una scommessa che copre il risultato opposto della back bet. Per esempio Nella stessa partita tra il Manchester United e Chelsea sulla piattaforma, faccio una scommessa che il Manchester United non vincerà. Questo significa che il Chelsea vince. È anche importante che il risultato di pareggio sia coperto.
La scommessa di qualificazione
