Ending Child Marriage in Bangladesh: Issues, Challenges and Ways Forward
Despite several attempts made by both the state and non-state actors to end child marriage in Bangladesh, it is still persisting and has become a matter of concern. In this context, this issue brief seeks to outline the nature of the problem that still persists, the probable causes for the problem, the challenges that lie ahead, and some practical solutions to the problem.
SUMMARY
Bangladesh ranks first in South Asia and fourth globally with the highest rate of child marriage in the world with some progress in the reduction of marriage below 15 years of age.
Bangladesh has made remarkable progress in the last 20 years in improving the lives of women and girls. Maternal mortality rates are falling, the fertility rate is declining and gender parity in school enrolment is advancing. However, despite the efforts made by both the government and NGOs to end child marriage, the rate is still very high at 59%.
Almost one in four girls get married before the age of 15 and nearly 59 per cent get married before the age of 18. And, there was no further improvement over the past few years in respect of ending child marriages before 18.
The main reasons for child marriage include:
Poverty, illiteracy and a lack of awareness;
A lack of job opportunities, especially for the educated ones;
Threats to physical safety. Parents fear for the safety of their daughters and they believe that married girls are less likely to be physically or mentally abused;
Fear of losing family dignity. Young people involving in love affairs and getting married without parents’ consent at an early age are seen as an embarrassment (this is becoming more likely with access to cell phones and connected it to the Internet), and parents believe that entering girls into marriage earlier could help prevent this;
A higher demand for young girls for marriage, especially among bideshi patro (grooms who work abroad and who are considered by parents as better options);
Fear of increase in dowry demand and even not getting married at all. Younger brides are expected to be given a lower dowry, so parents are compelled by the need to enter their girls into marriage earlier. Also, they worry about their daughters not being able to get married at all if it doesn’t happen early;
Traditional beliefs in Bangladesh are that it is advantageous to marry daughters off sooner. These beliefs are particularly deeply held by poorer and uneducated parents;
Ineffective or lack of enforcement of laws, rules and regulations.
• Major way-outs may include:
Restore law and social order in all communities. Involve local governments, local elites and influential civil society members in such an endeavour. End violence of any kind against girls ruthlessly;
Provide more educational opportunities for girls and create more job opportunities for qualified and educated women;
Continue public awareness campaigns and activities for parents, girls and boys, and among prospective grooms;
Strict enforcement of laws, rules and regulations.
Introduction
All children have the right to childhood wherein they can play and take rest. They ought to be protected from harm, abuse and exploitation. Yet, childhood of millions of children in Bangladesh is cut short by child marriage. Bangladesh ranks first in South Asia and fourth globally in terms of rate of child marriage, despite some progress has been made in ending child marriage under 15 years of age (UNFPA, 2019).
For women and girls in Bangladesh, their lives have improved in general in the last 20 years. Maternal mortality rates are falling, the fertility rate is declining and gender parity in school enrolment is advancing. Despite these changes, child marriage remained a challenge. Almost one in four girls get married before the age of 15 and nearly 59 percent do so before the age of 18 (NIPORT and ICF, 2019). And, no further improvement has been observed over the past few years in respect of marriages before 18. Therefore, stopping child marriage is a priority for both the government as well as the development partners in Bangladesh. It is widely recognised that ending or delaying child marriage preserve children’s childhood, secure their rights to education and lives, reduce their exposure to violence and exploitation, and contribute to breaking inter-generational cycle of poverty.
Given the above situation, this issue brief discusses the current situation of child marriage in Bangladesh. It focuses on the problems caused by child marriage, the trend of child marriage over time, the probable causes and consequences of child marriage, existing policies and visible actions taken by stakeholders to end child marriage, challenges to addressing this problem, and possible and practical solutions to the problem.
Methodological Note
This policy brief is based on data collected from both primary and secondary sources. The secondary data were collected from various sources, including the Bangladesh Bureau of Statistics (BBS), UNFPA, UNICEF, the office of the Platforms for Dialogue (P4D) programme of the British Council in Bangladesh and other relevant sources. The primary data were collected using a qualitative survey carried out in 14 districts where the Social Action Projects (SAP) of the first phase of the P4D programme took place. The survey was conducted during November-December 2019 through undertaking the Focus Group Discussions (FGDs), Key-Informants’ Interviews (KIIs) and Case Studies (CSs). A total of 60 FGDs, 60 KIIs and 30 case studies were conducted for the entire study.
Problems Related to Ending Child Marriage in Bangladesh
Child marriage has significant negative impacts – not only for girls, but also for the society as a whole. Marriage effectively ends schooling and prevents girls from achieving their full potentials, and it increases the risk of early pregnancy that could lead to maternal mortality. Therefore, delaying child marriage is closely associated with female schooling, adult literacy and pregnancies. Child marriage, if delayed by one year, increases girls’ schooling by 0.32 years, increases literacy rates by 5-10 percent and reduces the total number of pregnancies a woman experiences by 0.27 (Field, 2004). Additionally, child marriage is associated with high maternal mortality and increased total fertility. Demographic and Health Survey data from around the world suggest that marriage, rather than unwedded motherhood, is a driver of early childbearing (Haberland et al., 2005). Around 90 per cent of first births to mothers under the age of 18 take place within the context of child marriage (ibid.).
Moreover, the death of girls aged 15–19 years are also noticeably related to pregnancy and delivery complications. Girls who expect children before the age of 15 are five times more likely to die of pregnancy-related causes compared to older mothers (Murphy and Carr, 2007). Recent studies highlight the fact that girls who marry early are also at an increased risk of gender-based violence (USAID 2009). Therefore, keeping girls in school will help delay marriage, and it will ultimately help reduce early pregnancy and lower overall fertility, maternal mortality and the risk of gender-based violence.
Changes in child marriage over time
The legal age of marriage for girls in Bangladesh is 18 years, however, a large proportion of marriages take place before the girls reach the legal age. The 2017-18 BDHS found that 59% of women aged 20–24 were married before the age of 18 (Figure 2). Between 2014 and 2017-18, the proportion of women aged 20-24 years who were first married before the age of 15 years has declined by 3 percent points, from 22.4 percent in 2014 to 19.3 percent in 2017-18. However, the proportion of women of the same age group who were married before age 18 remained almost stagnant, from 58.6% in 2014 to 58.9% in 2017-18. This implies that, from 2014 onward, there has been no further improvement in respect of marriage before 18.
Probable Causes
The persistence of child marriage depends on multiple factors. From the review of literature, it is found that child marriage is mediated through respondents’ social characteristics (e.g., education, values, social norms, sense of security, cultural beliefs such as ensuring girl’s virginity), economic factors (poverty, economic opportunities, employment), cultural characteristics (gender and cultural norms, religion) and other factors, such as physical insecurity, demand for marriages and dowry, and parents’ anxieties, for instance, those around chastity (Islam et al., 2016).
The primary data collected from key informant interviews and case studies also confirm that child marriage is associated with multiple factors including: poverty; illiteracy and lack of awareness among parents; unemployment especially for the educated ones; threat to physical safety including the fear of being physically or mentally abused as well as protecting family dignity; parents’ fear of their children being engaged in love affairs and even getting married themselves at an early age; high demand for young girls for arranged marriage especially those with bideshi patro (better groom working abroad); fear of increase in dowry demand as the girls get older; fear of not being able to marry off girls and young women before they become ‘too old’; traditional beliefs that getting married earlier is better, especially among the poor and uneducated parents; and lack of effective enforcement of laws, rules and regulations.
Poverty is one of the most frequently cited factors behind child marriage in Bangladesh (Ferdousi, 2013). Parents having low income and a large number of family members usually find it difficult to afford the expenses for all of their children. Therefore, where poverty is acute, young girls may be regarded as a burden.
Child marriage before the age of 18 is also inversely correlated with children’s education levels (Figure 3). Secondary and further education has a profound impact on eliminating child marriage before the age of 18. Having incomplete or less than primary-level education makes negligible difference for those married before the age of 18 (BDHS, 2018). ICDDR,B and Plan International (2013) found that education has a strong negative association with child marriage. For example, 86% of women with no education were married before 18, compared with 26% of the women who had completed secondary or higher education. In connection with this, USAID (2012) argued that ‘one of the best ways to enable children to avoid early marriage is to keep them in school ……. children are less likely to marry early if they are kept in school, emphasizing quality primary schooling, which facilitates the transition to higher levels of schooling.’ In short, providing girls secondary education can significantly reduce the likelihood of them entering into child marriage.
Child marriage is also associated with economic and social status of parents; one indicator commonly used is households’ wealth. The BDHS 2018 study found that, the higher the household wealth is, the lower the prevalence of child marriage is. This is because parents with financial instability tend to prioritise marriage over financing education for their daughters. Young women and girls from the poorest 20 percent of Bangladeshi households were almost twice as likely to be married before the age of 18. See Figure 4 for a comparison.
Another factor that contributes to the problem of child marriage is the community cultural norms in Bangladesh. It is considered to be favourable to marry off girls as soon as they reach puberty. In relation to that are the economics of dowry and the misbelief that child marriage can provide girls a sense of sexual safety. Dowry practices trigger child marriage because later marriage entails higher dowries (White, 2017). A research study shows that dowry payments increased by 40% of the baseline cost with each additional year if the marriage is postponed (Field, 2004.). Concerns about sexual safety are often cited as an additional reason to marry off a daughter because of perceived and real threats; child marriage is used as a pre-emptive strategy for safeguarding young women’s chastity (PLAN International and Coram International 2015). The fear of sexual harassment, also known as eve teasing, therefore influenced parents’ decision to marry their daughter off at an early age. In many cases, it is found that perpetrators marry young women and girls whom they abused, and this is usually done against the will of the affected young women and girls (see Box 1).
The survey conducted for this study finds that the emerging reasons of child marriage that come out from the primary survey was parents’ fear of daughters being engaged in love affairs, and even getting married themselves at early age. This freer way of finding a partner has been enabled by the prevalent use of mobile phones that are also connected to the Internet. Furthermore, there is a high demand for young brides, especially among prospective grooms who live overseas (also known as bideshi patro). Parents thought that grooms who work abroad, especially those in the Middle East and Southeast Asian countries (who usually prefer young girls as bride), would be good husbands for their daughters, as they believe that these men could provide financial security.
Consequences to the people and the community
Child marriage has significant negative impacts not only on girls but also on a range of development outcomes. Child marriage damages the lives of girls and their families. Girls after getting married are usually rid of opportunities to receive education. Without education, many married girls suffer from restricted personal, psychological and cognitive development, and this takes away the opportunities for them to social interactions and good employment (Afroza, 1999). Without proper education and hence high-level skills, these girls can hardly find a job in the labour market. Worse still, new brides are expected to work in their husbands’ households and are subject to the same hazards as child domestic workers.
In addition, early pregnancy, which is closely related to early marriage, could cause serious health problems and even death. Abandonment of wives and domestic violence from spouses and in-laws are also related to early marriage.
Girls entering into marriage at a young age usually experience intense pressure to prove their fertility within the first year of their marriage. Compared to adult mothers, adolescent mothers are more likely to suffer from pregnancy-related complications with considerable health risks. Teen-aged mothers are twice as likely as older mothers to die during childbirth. For babies born to mothers younger than 14, it is 50% more likely for them to die than being born to a mother over 20 years of age. Girls married at young ages are also more likely to experience multiple pregnancies and recurrent miscarriage, and suffer from malnutrition, termination of pregnancy, and delivery-related complications.
Domestic violence is more prevalent in cases of early marriage. Adolescent girls suffer from inferiority complex and lack confidence in dealing with other people. Marriages involving a very young wife and a much older husband tend to be less cohesive, more likely to be riddled with marital strife and dissatisfaction, and more likely to end in divorce, abandonment or polygamy. Young brides with a much older husband have a higher risk of becoming widows early in life than older brides. Early marriage leads to low female labour force participation and impedes economic growth and development.
Challenges that Lie Ahead to Address Child Marriage
There is no provision in the Law in regard to disciplinary actions if the authority chooses not to make complaints against incidences of child marriage. According to the Law, child marriage is a punishable offence, but it is not invalid. Since child marriage is still valid under the statutory laws of Bangladesh, a marriage becomes legitimate when the under-aged reaches the legal age of marriage. Moreover, the law also legitimises marriages at the age of 16 under special circumstances and with consensus from parents of both spouses.
The implementation of the anti-child marriage Law is often hampered due to a lack of birth certificates of bride and groom, which are required to offer evidence for the legal age of those involved. Due to the unfair practices of some respective authorities, counterfeit birth certificate can be obtained in order to make child marriage legal. Physical verification by the courts is generally impossible owing to a lack of technology and social conservatism. As some respondents pointed out, it was also common for parents to take brides to a relative’s village to administer the marriage when it was blocked in the first place.
Possible and Practical Solutions to Overcome the Problem
Ending child marriage requires multifaceted and mutually reinforcing strategies and actions. Some of the important measures that need to be taken are as follows:
Restore law and order in every community. Local government, local elites and influential civil society members, involving young change makers, need to be involved in such an endeavour. Violence against girls of any kind must be ended.
Ensure that schools are girl-friendly. Help girls complete at least higher secondary education.
Provide educational opportunities for girls further. Help them develop their social and technical skills. Create more employment opportunities for qualified and educated women.
Continue public awareness campaigns and activities for parents, teachers, local elites, girls and boys, and among prospective grooms;
Enforce relevant laws, rules and regulations strictly;
Develop a strategy to strengthen collaboration and coordination among stakeholders, such as government organisations including law enforcing agencies, civil society organisations, UN agencies and community-based organisations; and
Substantiate the collaboration between government and non-government organisation to devise strategies about how social security can be provided to reduce child marriage.

বাল্য বিবাহের সর্বোচ্চ হারে বাংলাদেশ দক্ষিণ এশিয়ায় প্রথম এবং বিশ্বব্যাপী চতুর্থ অবস্থানে রয়েছে। তবে, ১৫ বছরের কম বয়সী কিশোরীদের বিবাহ হ্রাসের ক্ষেত্রে দেশ কিছুটা অগ্রগতি সাধন করেছে।
নারী ও কিশোরীর জীবনযাত্রার উন্নয়নে গত ২০ বছরে বাংলাদেশ উল্লেখযোগ্য অগ্রগতি দেখিয়েছে। মাতৃমৃত্যুর হার হ্রাস পাচ্ছে, সন্তান জন্মদানের হার কমছে এবং স্কুলে অন্তর্ভূক্তি বা ভর্তির ক্ষেত্রে লিঙ্গ সমতা দেখা যাচ্ছে। তবে, বাল্য বিবাহ বন্ধের জন্য সরকার এবং এনজিও উভয় পক্ষের প্রচেষ্টা সত্ত্বেও এ হার এখনও ৫৯ শতাংশেরও বেশি।
প্রতি চারজন কিশোরীর প্রায় একজনের ১৫ বছরের কম বয়সে বিয়ে হচ্ছে এবং ১৮ বছর বয়সের আগেই বিবাহ বন্ধনে আবদ্ধ হচ্ছে ৫৯ শতাংশেরও বেশি নারী। ১৮ বছরের কম বয়সে বাল্য বিবাহ বন্ধ হওয়ার ক্ষেত্রে গত কয়েক বছরে আর কোনও উন্নতি হয়নি।
বাল্য বিবাহের মূল কারণগুলির মধ্যে রয়েছে:
১। দারিদ্র্য, নিরক্ষরতা এবং সচেতনতার অভাব;
২। চাকুরীর সুযোগের অভাব, বিশেষ করে শিক্ষিতদের ক্ষেত্রে;
৩। শারীরিক নিরাপত্তার অভাব। বাবা-মায়েরা তাদের কন্যা সন্তানের সুরক্ষা নিয়ে চিন্তিত থাকেন এবং তাদের মতে বিবাহিত মেয়েদের শারীরিক বা মানসিক নির্যাতনের শিকার হওয়ার সম্ভাবনা কম থাকে;
৪। পারিবারিক মর্যাদা হারানোর ভয়। ছেলে-মেয়েদের অল্প বয়সে প্রেমের সম্পর্কে জড়িত হওয়া এবং বাবা-মায়ের অনুমতি ছাড়াই বিয়ে করা একটি বিব্রতকর বিষয় হিসাবে বিবেচনা করা হয় (মুঠোফোন ও ইন্টারনেটের সহজলভ্যতার কারণের এর সম্ভাবনা বেড়ে গিয়েছে), এবং অভিভাবকরা বিশ্বাস করেন মেয়ে সন্তানদের আগে বিয়ে দিতে পারলে এ ব্যাপারটি প্রতিরোধে করা সম্ভব;
৫। অল্প বয়সী মেয়েদের বিয়ের ক্ষেত্রে ব্যাপক চাহিদা, বিশেষত বিদেশী পাত্রদের কাছে (বিদেশী পাত্র বলতে যারা দেশের বাহিরে কাজ করেন; মেয়ের বাবা-মায়েরা প্রবাসী/বিদেশী পাত্রকে ভাল পাত্র হিসেবে বিবেচনা করেন);
৬। যৌতুকের চাহিদা বৃদ্ধি এবং একেবারেই বিয়ে না হওয়ার ভয়। অল্প বয়সী কনেদের কম যৌতুকে বিয়ে দেয়া যায়, তাই পিতামাতারা তাদের মেয়েদের আগেই বিয়ে দিতে বাধ্য হন। এছাড়াও, আগে বিয়ে দিতে না পারলে আদৌ বিয়ে দিতে পারবেন কিনা সেটি তাদের উদ্বেগ কাজ করে;
৭। মেয়েদের দ্রুত বিয়ে দেয়া সুবিধাজনক বলে একটি তথাকথিত ধারণা আছে বিশেষ করে দরিদ্র এবং অশিক্ষিত পিতামাতার মধ্যে;
৮। আইন, বিধি ও নিয়মকানুনের নিষ্ক্রিয়তা বা প্রয়োগের অভাব।
মুখ্য সমাধানসমূহঃ
সকল জনসাধারণের মধ্যে আইন ও সামাজিক শৃঙ্খলা আনায়নের ব্যবস্থা করা এবং এ জাতীয় প্রচেষ্টায় স্থানীয় সরকার, স্থানীয় অভিজাত এবং প্রভাবশালী সুশীল সমাজের সদস্যদের অন্তর্ভূক্ত করা। নারীর প্রতি যে কোন ধরণের সহিংসতা বন্ধ করা;
মেয়েদের আরও বেশি শিক্ষার সুযোগ প্রদান করা এবং যোগ্য ও শিক্ষিত নারীদের জন্য আরও বেশি কাজের সুযোগ সৃষ্টি করা;
পিতা-মাতা, কিশোর-কিশোরী এবং সম্ভাব্য পাত্রদের মধ্যে জনসচেতনতামূলক প্রচার ও কার্যক্রম চালিয়ে যাওয়া;
আইন, বিধি ও নিয়মকানুনের কঠোর প্রয়োগ।
ভূমিকা
সকল শিশুরই রয়েছে শৈশবের অধিকার, যখন তারা খেলাধুলা আর আরামা-আয়েশ করে কাটাবে। তাদেরকে যে কোন ধরণের ক্ষতি, নির্যাতন এবং শোষণ থেকে সুরক্ষা দিতে হবে। তবুও, বাল্য বিবাহের কারণে বাংলাদেশের কয়েক মিলিয়ন শিশুর শৈশব সংক্ষিপ্ত হয়ে যায়। বাল্য বিবাহের হারে বাংলাদেশ দক্ষিণ এশিয়ায় প্রথম এবং বিশ্বব্যাপী চতুর্থ অবস্থানে রয়েছে, যদিও ১৫ বছরের কম বয়সে বিবাহ হ্রাসের ক্ষেত্রে দেশ কিছুটা অগ্রগতি সাধন করেছে (UNFPA, ২০১৯)।
নারী ও কিশোরী জীবনযাত্রার উন্নয়নে গত ২০ বছরে বাংলাদেশ উল্লেখযোগ্য অগ্রগতি সাধন করেছে। মাতৃমৃত্যুর হার হ্রাস পাচ্ছে, সন্তান জন্মদানের হার কমছে এবং স্কুলে অন্তর্ভূক্তি বা ভর্তির ক্ষেত্রে লিঙ্গ সমতা দেখা যাচ্ছে। প্রতি ৪ জন কিশোরীর প্রায় ১ জনের ১৫ বছরের কম বয়সে বিয়ে হচ্ছে এবং ১৮ বছর বয়সের আগেই বিবাহ বন্ধনে আবদ্ধ হচ্ছে ৫৯ শতাংশেরও বেশি নারী (NIPORT and ICF, ২০১৯)। ১৮ বছরের কম বয়সে বাল্য বিবাহ বন্ধ হওয়ার ক্ষেত্রে গত কয়েক বছরে আর কোনও উন্নতি লক্ষ্য করা যায় নি। সুতরাং, সরকার ও বাংলাদেশের উন্নয়ন সহযোগী উভয়েরই অগ্রাধিকার হল বাল্য বিবাহ বন্ধ করা। এটি সর্বজন স্বীকৃত যে বাল্য বিবাহের অবসান বা বিলম্বের ফলে শিশুদের শৈশব সংরক্ষিত হয়, তাদের পড়াশোনা ও জীবনযাপনের অধিকার সুরক্ষিত হয়, তারা কম সহিংসতা ও শোষণের শিকার হয় এবং এ্টি দারিদ্র্যের আন্ত-প্রজন্ম চক্র (inter-generational cycle) থেকে বের হতে অবদান থাকে।
উপরোক্ত পরিস্থিতি বিবেচনা করে এই নীতি সংক্ষেপ বা সমস্যা বিবরণীটিতে বাংলাদেশের বাল্য বিবাহের বর্তমান পরিস্থিতি সম্পর্কে সংক্ষিপ্ত আলোচনা করা হয়েছে। এখানে বাল্য বিবাহের ফলে সৃষ্ট সমস্যাগুলি, সময়ের সাথে বাল্য বিবাহের প্রবণতা, বাল্য বিবাহের সম্ভাব্য কারণ ও পরিণতি, বাল্য বিবাহের অবসানের জন্য সংশ্লিষ্ট কর্তৃপক্ষের নেয়া বিদ্যমান নীতিমালা ও দৃশ্যমান পদক্ষেপ, সমস্যাটি সমাধানের প্রতিবন্ধকতা এবং সম্ভাব্য ও বাস্তবিক সমাধান নিয়ে আলোকপাত করা হয়েছে।
গবেষণা পদ্ধতি (Methodological Note)
এই Policy Brief (নীতি সংক্ষেপ)-টি primary ও secondary উভয় উৎসের তথ্য উপাত্তের ভিত্তিতে রচিত। Secondary উপাত্ত নেয়া হয়েছে বাংলাদেশ পরিসংখ্যান ব্যুরো (বিবিএস), ইউএনএফপিএ, ইউনিসেফ, ব্রিটিশ কাউন্সিল বাংলাদেশ পরিচালিত প্ল্যাটফর্ম ফর ডায়ালগ (Platforms for Dialogue-P4D) কর্মসূচীর কার্যালয় এবং অন্যান্য সংশ্লিষ্ট উত্স থেকে। Primary Data সংগ্রহ করা হয়েছে ১৪ টি জেলায় পরিচালিত qualitative survey এর মাধ্যমে যেখানে P4D কর্মসূচীর প্রথম ধাপ Social Action Projects (SAP) সম্পন্ন হয়েছে। Focus Group Discussions (FGDs), Key-Informants’ Interviews (KIIs) এবং Case Studies (CSs) এর মাধ্যমে ২০১৯ সালের নভেম্বর-ডিসেম্বরে এই জরিপটি করা হয়েছিল। এই গবেষনার জন্য মোট ৬০টি FGDs, ৬০টি KIIs এবং ৩০টি case studies করা হয়েছে।
বাংলাদেশে বাল্য বিবাহ বন্ধে সমস্যা
কেবল নারীদের উপর নয়, বাল্য বিবাহের নেতিবাচক প্রভাব রয়েছে পুরো সমাজের উপর। বিয়ে কার্যকরভাবে মেয়েদের স্কুলশিক্ষার অবসান ঘটায় এবং তাদের নিজেদের সম্ভাবনাকে আবিষ্কারে বাধা প্রদান করে। এটি অপরিনত বয়সে গর্ভাবস্থার ঝুঁকি বাড়িয়ে তোলে যা মাতৃমৃত্যুর কারণ। সুতরাং, বাল্য বিবাহ বিলম্বে হওয়া মেয়েদের স্কুলে যাওয়া, বেশী বয়স পর্যন্ত পড়াশোনা এবং গর্ভাবস্থার সাথে ঘনিষ্ঠভাবে জড়িত। বাল্য বিবাহ এক বছর বিলম্ব হওয়া মানে মেয়েদের স্কুলে পড়াশোনা ০.৩২ বছর বেড়ে যাওয়া, স্বাক্ষরতার হার ৫-১০ শতাংশ বৃদ্ধি পাওয়া এবং একজন মহিলার গর্ভধারণের মোট সংখ্যা ০.২৭_____ হ্রাস করে (ফিল্ড, ২০০৪)। এছাড়াও, বাল্য বিবাহ উচ্চ মাতৃমৃত্যু এবং সন্তান জন্মদানের মোট বর্ধিত হারের সাথে যুক্ত। বিশ্বজুড়ে ডেমোগ্রাফিক এবং স্বাস্থ্য জরিপের তথ্য নির্দেশ করে যে, অবিবাহিত মাতৃত্বের তুলনায় বিয়ে হচ্ছে দ্রুত সন্তান ধারণের মূল চালক (Haberland et al., ২০০৫)। ১৮ বছরের কম বয়সী নারী যারা প্রথমবার মা হন তাদের প্রায় ৯০ শতাংশই বাল্য বিবাহের কারণে হয়ে থাকে (ibid.)
তদুপরি, ১৫-১৯ বছর বয়সী মেয়েদের মৃত্যুর কারণ লক্ষণীয়ভাবে গর্ভাবস্থা এবং প্রসবের জটিলতা। যেসব মেয়েরা ১৫ বছর বয়সের আগে বাচ্চা নিতে চায় তাদের গর্ভাবস্থা সম্পর্কিত জটিলতার কারণে মৃত্যুর ঝুঁকি বয়স্ক মায়েদের তুলনায় পাঁচগুণ বেশি (Murphy and Carr, 2007)। সম্প্রতি দেখা গেছে, যেসব মেয়েরা অল্প বয়সে বিয়ে করে তারা লিঙ্গ-ভিত্তিক-সহিংসতার (gender-based violence) অধিক ঝুঁকিতে থাকে (USAID ২০০৯)। সুতরাং, মেয়েদের স্কুলে পড়াশোনা তাদের বিবাহ বিলম্বিত করতে সহায়তা করবে ও অপরিণত গর্ভাবস্থার হ্রাসে সহায়তা করবে এবং সন্তান জন্মদানের সামগ্রিক হার, মাতৃমৃত্যু ও লিঙ্গ-ভিত্তিক সহিংসতার (gender-based violence) ঝুঁকি হ্রাস করতে সহায়তা করবে।
সময়ের ব্যবধানে বাল্যবিবাহের পরিবর্তন
বাংলাদেশে মেয়েদের বিয়ের আইনী বয়স ১৮ বছর, তবে মেয়েদের একটি বড় অংশের এই বয়সে পৌঁছানোর আগেই বিয়ে হয়। ২০১৭-১৮-তে BDHS এর গবেষনায় দেখা গেছে যে ২০-২৪ বছর বয়সী ৫৯ শতাংশ নারী ১৮ বছরের পূর্বেই বিয়ে করেছিলেন (চিত্র ২)। ২০১৪ এবং ২০১৭-১৮ সালের মধ্যে, ১৫-২৫ বছর বয়সের নারী যারা ১৫ বছর বয়সের আগে প্রথম বিয়ে করেছিল তাদের অনুপাত ৩ শতাংশ পয়েন্ট হ্রাস পেয়েছে, অর্থাৎ ২০১৪ সালে ২২.৪ শতাংশ থেকে ২০১৭-১৮-এ ১৯.৩ শতাংশ হয়েছে। তবে, একই বয়সী নারী যারা ১৮ বছরের আগে বিয়ে করেছিলেন তাদের অনুপাত প্রায় স্থির অবস্থায় রয়েছে, অর্থাৎ ২০১৪ সালে ৫৮.৬ শতাংশ থেকে ২০১৭-১৮-এ ৫৮.৯ হয়েছে। এখানে থেকে স্পষ্ট যে, ২০১৪ সালের পর থেকে ১৮ বছরের পূর্বে বিবাহের ক্ষেত্রে আর কোন ধরণের উন্নতি সাধিত হয়নি।
সম্ভাব্য কারণসমূহ
সমাজে বাল্য বিবাহের উপস্থিতি অনেকগুলো বিষয়ের উপর নির্ভর করে। পূর্বের গবেষণাগুলো থেকে দেখা যায়, বাল্য বিবাহ নির্দিষ্ট সমাজের সামাজিক বৈশিষ্ট্য (যেমন- শিক্ষা, মূল্যবোধ, সামাজিক রীতিনীতি, নিরাপত্তা বোধ, মেয়ের সতীত্ব রক্ষা করার মতো সাংস্কৃতিক বিশ্বাস), অর্থনৈতিক কারণ (দারিদ্র্য, অর্থনৈতিক সুবিধা ও কর্মসংস্থান), সাংস্কৃতিক বৈশিষ্ট্য (লিঙ্গ ও সাংস্কৃতিক রীতিনীতি, ধর্ম, ইত্যাদি) এবং অন্যান্য বিষয় যেমন- শারীরিক নিরাপত্তাহীনতা, বিবাহ ও যৌতুকের চাহিদা এবং মেয়ে সন্তানের সতীত্বে নিয়ে বাবা-মায়ের উদ্বেগ ইত্যাদি দ্বারা নির্ধারিত হয় (Islam et al., ২০১৬)।
প্রধান তথ্যদাতা সাক্ষাত্কার (key informant interviews) এবং কেস স্টাডি থেকে সংগৃহীত প্রাথমিক তথ্য-উপাত্তগুলো থেকে নিশ্চিত হওয়া যায় যে, বাল্য বিবাহ অনেকগুলো বিষয়ের উপর নির্ভর করে যেমনঃ দারিদ্র্য; নিরক্ষরতা এবং পিতামাতার মধ্যে সচেতনতার অভাব; বেকারত্ব বিশেষ করে শিক্ষিতদের মধ্যে; শারীরিক সুরক্ষায় ভয় অর্থাৎ শারীরিক বা মানসিক নির্যাতনের পাশাপাশি পারিবারিক মর্যাদা রক্ষার ভয়; ছেলে-মেয়েদের প্রেমের সম্পর্কে জড়িয়ে পড়া ও অল্প বয়সেই নিজে নিজে বিয়ে করে ফেলা নিয়ে পিতামাতার উদ্বেগ; কম বয়সী মেয়েদের বিয়ের ক্ষেত্রে উচ্চ চাহিদা বিশেষত বিদেশি পাত্রের সাথে (দেশের বাইরে প্রবাসী হিসেবে কাজ করা ভাল পাত্র বা স্বামী); মেয়ের বয়স বাড়ার সাথে সাথে যৌতুকের চাহিদা বৃদ্ধির ভয়; কিশোরী এবং যুবতী মেয়েদের বয়স বেশী হওয়ার আগে বিয়ে না দিতে পারার ভয়; আগে বিয়ে দেয়া ভাল এধরণের প্রচলিত বিশ্বাস, বিশেষত দরিদ্র এবং অশিক্ষিত বাবা-মায়েদের মধ্যে; এবং আইন, বিধি ও নিয়মকানুনের কার্যকর প্রয়োগের অভাব।
বাংলাদেশে বাল্য বিবাহের পিছনে দারিদ্র্য অন্যতম ও সর্বাধিক উল্লেখিত কারণ (Ferdousi, ২০১৩)। যেসব বাবা-মায়ের আয় কম ও পরিবারের সদস্য সংখ্যা বেশী তাদের জন্য সব সন্তানের ব্যয় বহন করা কঠিন হয়ে যায়। সুতরাং, যেখানে দারিদ্র্য তীব্র হয় এবং কম বয়সী মেয়েদের সাধারণত বোঝা হিসাবে ধরা হয়।
১৮ বছর বয়সের আগে বাল্য বিবাহ শিশুদের শিক্ষার স্তরের সাথে বিপরীতভাবে সম্পৃক্ত (চিত্র ৩)। ১৮ বছর বয়সের পূর্বে বাল্য বিবাহ দূরীকরণে মাধ্যমিক এবং তৎপরবর্তী শিক্ষার গভীর প্রভাব রয়েছে। ১৮ বছর বয়সের আগে বিবাহিতদের জন্য প্রাথমিক স্তরের (পঞ্চম শ্রেণি) চেয়ে কম বা অসম্পূর্ণ পড়াশোনা এই দুটোই সমান অর্থাৎ এটি তাদের ঐ বয়সে বিয়ে হওয়া না হওয়ার ক্ষেত্রে কোন ভূমিকা রাখেনা (BDHS, 2018)। আইসিডিডিআর, বি এবং প্ল্যান ইন্টারন্যাশনাল (২০১৩)এর গবেষনাতেও একই রকম বিপরীত সম্পর্কই পাওয়া যায়। উদাহরণস্বরূপ, মাধ্যমিক বা উচ্চশিক্ষায় শিক্ষিত ২৬ শতাংশ নারীর বিপরীতে ৮৬ শতাংশ নারীদের ১৮ বছরের কম বয়সে বিয়ে হয়। একইসাথে USAID (২০১২) বলেছে, ‘শিশুর বাল্য বিবাহ এড়াতে সবচেয়ে ভাল উপায় হল তাকে স্কুলে রাখা …… স্কুলে পড়াশোনা করা বাচ্চাদের দ্রুত বিয়ে হওয়ার সম্ভাবনা খুব কম থাকে। একইসাথে তারা মানসম্পন্ন প্রাথমিক শিক্ষার উপর জোর দিয়েছেন যা মেয়েদেরকে পরবর্তী স্তরে (মাধ্যমিক) পড়াশোনার সুযোগ করে দেয়। এক কথায়, মেয়েদের মাধ্যমিক শিক্ষা প্রদান করা গেলে বাল্যবিবাহের সম্ভাবনা উল্লেখযোগ্যভাবে হ্রাস পেতে পারে।
বাল্য বিবাহও পিতামাতার অর্থনৈতিক এবং সামাজিক মর্যাদার সাথে জড়িত; এক্ষেত্রে একটি প্রচলিত সূচক হল পারিবারিক সম্পদ (households’ wealth)। BDHS এর ২০১৮ সালের সমীক্ষায় দেখা গেছে যে, পরিবারের সম্পদ যত বেশি, বাল্যবিবাহের পরিমাণ তত কম। এর কারণ হলো আর্থিকভাবে অস্বচ্ছল পিতামাতারা তাদের কন্যা সন্তানের শিক্ষায় খরচ করার চেয়ে বিবাহকে অগ্রাধিকার দেন। বাংলাদেশের দরিদ্রতম ২০ শতাংশ পরিবারের কিশোরী ও নারীদের ১৮ বছর বয়সের আগেই বিয়ে হওয়ার দ্বিগুণ সম্ভাবনা রয়েছে। এই তুলনাটি বুঝতে চিত্র ৪ দেখুন।
বাল্যবিবাহের সমস্যার আরেকটি কারণ হল বাংলাদেশের মানুষের সাংস্কৃতিক রীতিনীতি। বয়ঃসন্ধিতে পৌছানোর সাথে সাথে মেয়েদের বিয়ে দেয়ার সবচেয়ে ভাল সময় হিসেবে মনে করা হয়। এর সাথে রয়েছে যৌতুকের অর্থনীতি এবং বাল্য বিবাহ মেয়েদেরকে যৌন সুরক্ষা দিতে পারে এরকম অনুভূতি বা ভুল বিশ্বাস। যৌতুক প্রথা বাল্য বিবাহকে উসকে দেয় কারণ দেরিতে বিয়ে হওয়া মানে যৌতুকের অর্থ বেড়ে যাওয়া। (White, ২০১৭)। একটি গবেষণা সমীক্ষায় দেখা গেছে, কোন কারণে বিয়ে স্থগিত হলে প্রতি অতিরিক্ত বছরের সাথে যৌতুকের প্রদানের মূল ব্যয়ের ৪০ শতাংশ বেড়ে যায় (Field, ২০০৪)। যৌন সুরক্ষা নিয়ে উদ্বেগ কন্যা সন্তানের বিয়ের ক্ষেত্রে আরেকটি অতিরিক্ত কারণ হিসেবে প্রায়ই উল্লেখ করা হয়; বাল্য বিবাহ কম বয়সী মেয়েদের সতীত্ব রক্ষার জন্য পূর্ব কৌশল হিসাবে মনে করা হয় (PLAN International and Coram International ২০১৫)। যৌন হয়রানি বা ইভ টিজিং এর ভয় বাবা-মায়েদের তাদের কন্যা সন্তানের দ্রুত বিয়ে দেয়ার ক্ষেত্রে প্রভাবিত করে। অনেক ক্ষেত্রে দেখা গেছে, অপরাধীরা যে কিশোরী ও নারীদের যৌন হয়রানির জন্য দায়ী তাদেরকেই বিয়ে করে এবং সেটি ঐ কিশোরী ও নারীদের ইচ্ছার বিরুদ্ধে (বক্স ১ দেখুন)।
এই গবেষণার জন্য পরিচালিত সমীক্ষার প্রাথমিক জরিপে দেখা গেছে যে, বাল্য বিবাহের একটি স্পষ্ট কারণ কন্যা সন্তানের প্রেমের সম্পর্কে জড়িয়ে যাওয়া ও নিজে নিজে বিয়ে করে ফেলা নিয়ে অভিভাবকের ভয়। জীবনসঙ্গী খুঁজে নেয়ার এই মুক্ত উপায়টি সম্ভব হয়েছে ইন্টারনেট সংযুক্ত মুঠোফোনের প্রচলিত ব্যবহারের কারণে। তাছাড়া, কম বয়সী তরুণীদের বিয়ের ক্ষেত্রে উচ্চ চাহিদা রয়েছে, বিশেষত ঐসব সম্ভাব্য বরদের কাছে যারা বিদেশে থাকেন (বিদেশি পাত্র হিসেবে পরিচিত)। পিতামাতার ধারণা বিদেশে কর্মরত পাত্র, বিশেষ করে যারা মধ্যপ্রাচ্য এবং দক্ষিণ-পূর্ব এশিয়ার দেশগুলিতে থাকেন (যারা সাধারণত কম বয়সী তরুণীদের কনে হিসাবে পছন্দ করেন) তারা তাদের কন্যার জন্য ভাল স্বামী কারণ তাদের বিশ্বাস এসব পাত্ররা তাদের মেয়েদের আর্থিক সুরক্ষা দিতে পারবে।
সমাজ ও মানুষের উপর প্রভাব
বাল্য বিবাহের কেবলমাত্র মেয়েদেরই উপরই নয়, দেশের উন্নয়নের উপরেও এর নেতিবাচক প্রভাব রয়েছে। বাল্য বিবাহ নারী এবং তাদের পরিবারের ক্ষতি সাধন করে। বিয়ের পরে মেয়েরা সাধারণত শিক্ষার সুযোগ পায় না, যা তাদের ব্যক্তিগত, মানসিক এবং বুদ্ধিভিত্তিক বিকাশকে সীমাবদ্ধ করে দেয়, তাদের সামাজিক যোগাযোগ এবং তারা ভাল চাকুরী পাওয়ার সুযোগকে বাধাগ্রস্থ করে (Afroza, ১৯৯৯)। যথাযথ শিক্ষা ও উচ্চমানের দক্ষতাহীন এসব নারীরা শ্রমবাজারে অকেজো হয়ে পড়ে। সবচেয়ে খারাপ বিষয় হলো, নব বিবাহিত নারীদের মনেই করা হয় তারা তাদের স্বামীর বাড়িতে কাজ করবে এবং সেটি অনেকটা শিশু গৃহকর্মীদের মতো।
এছাড়াও, বাল্য বিবাহের সাথে ঘনিষ্ঠভাবে জড়িত অকালে গর্ভধারণ যা নারীর গুরুতর স্বাস্থ্য সমস্যা এবং এমনকি মৃত্যুর কারণ হতে পারে। স্ত্রীর পরিত্যক্ত হওয়া এবং শ্বশুরবাড়ি কর্তৃক পারিবারিক সহিংসতাও বাল্য বিবাহের সাথে সম্পর্কিত।
কম বয়সে বিবাহিত মেয়েরা সাধারণত তাদের বিয়ের প্রথম বছরের মধ্যেই সন্তান ধারণ ক্ষমতা প্রমাণ করার তীব্র চাপে থাকে। প্রাপ্তবয়স্ক মায়েদের তুলনায় কৈশোর বয়সী মায়েরা যথেষ্ট স্বাস্থ্য ঝুঁকি ও গর্ভাবস্থা-সংক্রান্ত জটিলতায় ভোগে। প্রাপ্তবয়স্ক মায়েদের তুলনায় কৈশোর বয়সী মায়েদের প্রসবকালে মৃত্যুর সম্ভাবনা দ্বিগুণ থাকে। ২০ বছরে বেশী বয়সে সন্তান জন্ম দেয়ার চেয়ে ১৪ বছরের নিচে সন্তান জন্ম দেয়া মায়ের মৃত্যুর সম্ভাবনা ৫০ শতাংশ বেশী। অল্প বয়সে বিবাহিত মেয়েদের একাধিকবার গর্ভধারণ এবং বারবার গর্ভপাত হওয়ার সম্ভাবনা বেশি থাকে এবং তারা অপুষ্টি, গর্ভাধারণ ক্ষমতার সমাপ্তি এবং প্রসব-সম্পর্কিত জটিলতায় ভোগে।
বাল্য বিবাহে পারিবারিক সহিংসতা বেশি দেখা যায়। কিশোরী মেয়েরা কারো সাথে কথা বলতে অথবা কোন বিষয়ে আলোচনা করতে হীনমন্যতা ও আত্মবিশ্বাসের অভাবে ভোগে। কম বয়সী স্ত্রী বা নারীদের এবং বয়স্ক স্বামীর সাথে বিবাহবন্ধনে মিলিত হওয়ার প্রবণতা কম থাকে এবং এসব বিয়ের পরিণতি হলো বৈবাহিক কলহ ও অসন্তুষ্টি এবং বেশীরভাগ ক্ষেত্রে বিবাহবিচ্ছেদ, ছেড়ে চলে যাওয়া বা বহুবিবাহ। বয়স্ক স্বামীর সাথে বিয়ে হওয়া কিশোরী মেয়েদের বয়সী মহিলাদের চেয়ে আগে বিধবা হওয়ার বেশি ঝুঁকি থাকে। বাল্য বিবাহের কারণে নারীদের শ্রমবাজারে যুক্ত হওয়ার সম্ভাবনা কমে যায় যা অর্থনৈতিক প্রবৃদ্ধি ও বিকাশে বাধা প্রদান করে।
বাল্য বিবাহ রোধে ভবিষ্যৎ প্রতিবন্ধকতা
সংশ্লিষ্ট প্রশাসন বাল্যবিবাহের প্রাদুর্ভাবের বিরুদ্ধে যদি কোন অভিযোগ না করে তবে এর বিরুদ্ধে পদক্ষেপ নেয়ার আইনী কোন বিধান নেই। আইনানুযায়ী বাল্য বিবাহ একটি শাস্তিযোগ্য অপরাধ, তবে এটি অবৈধ নয়। যেহেতু বাংলাদেশের বিবাহ আইনে বাল্য বিবাহ এখনও বৈধ, তাই কম বয়সে বিয়ের পর নারী বা পুরুষ বিবাহের আইনী বয়সে পৌঁছালে বিবাহ বৈধ হয়ে যায়। এছাড়াও, আইনেই উভয় পক্ষের পিতামাতার সম্মতিতে বিশেষ পরিস্থিতিতে ১৬ বছর বয়সেও বিয়ে বৈধ।
পাত্র-পাত্রীর জন্ম সনদের অভাবের কারণে প্রায়শই বাল্য বিবাহ বিরোধী আইন কার্যকর বাধাগ্রস্ত হয়। জন্ম সনদ পাত্র-পাত্রীর আইনী বয়সে পৌছানোর প্রমাণ দেয়ার জন্য প্রয়োজন হয়। সংশ্লিষ্ট কিছু শাসকগোষ্ঠীর অন্যায় কাজের সুবাধে বাল্য বিবাহ বৈধ করার জন্য জাল জন্ম সনদ সংগ্রহ করা যায়। প্রযুক্তির সীমাবদ্ধতা ও সামাজিক রক্ষণশীলতার কারণে আদালত কর্তৃক সরজমিনে সনদের সত্যতা যাচাই করা অসম্ভব হয়ে পড়ে। কিছু সাক্ষাতকারী যেমন উল্লেখ করেছেন, কোথাও বাল্য বিবাহ দেয়া বন্ধ থাকলে বাবা-মায়েরা তাদের কম বয়সী মেয়েদের বিয়ে দেয়ার জন্য অন্য গ্রামে তাদের আত্মীয়ের বাড়িতে নিয়ে যান এবং এটি খুব সাধারণ ঘটনা।
সমস্যা উত্তরণের সম্ভাব্য এবং বাস্তবিক সমাধান
বাল্য বিবাহের বন্ধের জন্য প্রয়োজন বহুমুখী এবং পারস্পরিকভাবে পুনরায় বলবৎ করা যায় এরকম কৌশল ও ব্যবস্থা। কয়েকটি গুরুত্বপূর্ণ ও প্রয়োজনীয় ব্যবস্থা নিম্নরূপ:
প্রত্যেক সমাজে আইন-শৃঙ্খলা ব্যবস্থা পুনরুদ্ধার করা। পরিবর্তনের মানসিকতা সম্পন্ন তরুণ, স্থানীয় সরকার, স্থানীয় অভিজাত ও প্রভাবশালী সুশীল সমাজের সদস্যদের এ জাতীয় উদ্যোগে যুক্ত করা। নারীর বিরুদ্ধে যে কোন ধরণের সহিংসতা রোধ করা;
স্কুলগুলিকে নারী-বান্ধব করা। মেয়েদেরকে কমপক্ষে উচ্চ মাধ্যমিক শিক্ষা সম্পন্ন করতে সহায়তা প্রদান করা;
নারীর শিক্ষার সুযোগ বাড়ানো। সামাজিক এবং প্রযুক্তিগত দক্ষতা বিকাশে তাদের সহায়তা করা। যোগ্য এবং শিক্ষিত নারীদের কর্মসংস্থানের আরো সুযোগ তৈরি করা;
পিতা-মাতা, শিক্ষক, স্থানীয় অভিজাত শ্রেণি, ছেলে-মেয়ে এবং সম্ভাব্য পাত্রদের মধ্যে জনসচেতনতামূলক প্রচার ও কার্যক্রম চালিয়ে যাওয়া;
আইন, বিধি ও নিময়কানুনের কঠোর প্রয়োগ ঘটানো;
বিভিন্ন স্টেকহোল্ডার যেমন- আইন-শৃঙ্খলা রক্ষা বাহিনী, সুশীল সমাজ সংস্থা, জাতিসংঘের বিভিন্ন সংস্থা এবং সমাজভিত্তিক সংস্থাসমূহের মধ্যে সহযোগিতা ও সমন্বয় জোরদার করার জন্য একটি কৌশল তৈরি কয়ার; এবং
বাল্য বিবাহ হ্রাসে কীভাবে সামাজিক সুরক্ষা সরবরাহ করা যেতে পারে সে সম্পর্কে কৌশল নির্ধারণ করতে সরকারি ও বেসরকারি সংস্থার মধ্য সহযোগিতা বাস্তবায়ন করা।

As a graduate of the University of
Chittagong, I have my Master's in English Language and Literature. I have more than five years of experience
in documents/papers translation (English to Bengali and vice versa) for the
government organizations and NGO/INGOs, MNCs, and other international
organizations.
