Source text - English (RJN Ex. 16 (yellow emphasis added)). Thus, at the point-of-sale plaintiff would have been informed that, although the 2012 Hyundai Elantra has an EPA estimate of 40 mpg highway,
• the "Expected range for most drivers [is] 33 to 47 MPG" and
• that "Your actual mileage will vary depending on how you drive and
maintain your vehicle".
(Id. (emphasis in original)).
Plaintiff's Amendments Reference Press Releases and An Online Video, But She Does Not and Cannot Allege She Relied On The Materials. Plaintiff's new complaint references two supposedly misleading press releases, (FAC ¶ 16), but both postdate plaintiff's purchase by more than two months and even postdate plaintiff's original complaint. (Compare FAC ¶ 5 (alleging plaintiff bought her vehicle on Oct. 17, 2011) with FAC Ex. 4, p.1 (press release dated Jan. 9, 2012) and Ex. 5, p.1 (press release dated Jan. 9, 2012)). Plaintiff also refers to a video that purportedly states the Elantra "will deliver 40 mpg on the highway" but has "no mention of 'EPA estimate'" or "that the actual mileage will vary." (FAC ¶ 16.) But this allegation is refuted by the video itself. Starting at the 12-second mark the video displays a mileage window sticker with the 40 mpg/highway figure that includes "EPA Fuel Economy Estimates" at the top and the statement "Your actual mileage will vary depending on how you drive and maintain your vehicle."
Plaintiff Newly Alleges Hyundai "may have inflated EPA numbers and
may not have followed the appropriate protocols set forth by the EPA." Although the original complaint stated that plaintiff "does not challenge the EPA figures for the subject vehicles or the manner in which those figures were calculated" (Compl. ¶ 21), plaintiff now suggests even the EPA figures may be incorrect (FAC ¶ 28). As factual support, plaintiff relies on comments from online forums, some news articles, and a press release from Consumer Watchdog. Notably, not one of these sources purports to have tested an Elantra under the EPA protocols, nor provides any other factual basis to allege the mileage figures were not generated in accordance with EPA-approved testing conditions.
Based on these spare allegations, plaintiff asserts six causes of action under California law: (1) violation of Business & Professions Code § 17200 et seq. (prohibiting "unfair," "unlawful" and "fraudulent" business acts and practices); (2) violation of Business & Professions Code § 17500 et seq.; (3) violation of Consumer Legal Remedies Act; (4) fraud; (5) negligent misrepresentation; and (6) deceit under Civil Code § 1710. Each claim is premised on the same factual and legal theories concerning purported "real world" fuel efficiency discrepancies.

원고 수정안은 몇몇 보도자료와 한 온라인 동영상을 참조하고 있다. 그러나 원고는 그 자료들에 의존하여 혐의를 제기하지도 않으며, 할 수도 없다. 원고의 새로운 고소장은 오해의 소지가 있어 보이는 두 보도자료를 참조하고 있는데, (FAC¶16), 두 보도자료 모두 원고가 차량을 구매한 날짜보다 2달 이상 뒤에, 심지어 최초 고소장보다 이후에 작성되었던 것이다. 원고는 현대측에서 “EPA 수치를 부풀렸을 수 있고, EPA가 제정한 규약을 지키지 않았을 수도 있다” 라고 새롭게 주장하고 있다. 비록 최초 고소장에서 원고는 “해당 차량의 EPA 수치나 그 수치가 측정된 방식에 대해서는 검문하지 않겠다.”(Compl.¶21)고 했지만, 원고는 현재 그 EPA수치마저 부정확하다고 이의를 제기하고 있다(FAC¶28). 원고는 사실적 뒷받침 자료로 온라인 포럼 댓글들과 몇몇 뉴스기사들, 그리고 Consumer Watchdog의 보도자료에 의존하고 있다. 그러나 그 자료들 중 EPA규정 하에 엘란트라를 테스트해보았다고 주장하는 자료는 아무것도 없을 뿐더러, 연비 수치가 EPA측에서 허용한 실험 조건에 부합하지 않는 수치라는 사실적 기반 역시 제공하고 있지 않다.
