TERMS & CONDITIONS OF BUSINESS

These Terms & Conditions of business are between HBTC FZ LLC (thereinafter called the ‘Company’) and ………. (hereinafter called the ‘Client’ and are deemed to be accepted by the Client by virtue of the request or acceptance of CVs , an interview or the engagement (which term includes employment or use, whether under a contract of services, or under an agency, license, franchise for partnership agreement) of an applicant introduced by the company.

The Client shall notify the Company of the engagement of an applicant immediately upon such an engagement and shall pay the fee (calculated in accordance with clause 6). Such fee shall be due from the Client if an applicant introduced by the company is engaged by the Client within twelve months of any introduction whatever the circumstances of the subsequent engagement.

Introductions by the Company to the Client are strictly confidential. If within twelve months of the Company’s initial or subsequent introduction the Client or one of its employees introduces an applicant to any third party who subsequently engages the applicant the Client will pay the fee (calculated in accordance with clause 6).

All costs incurred when a client interviews a candidate such as flights, hotel bills, etc shall be borne by the client.

The fee payable by the Client upon engagement of an applicant introduced by the Company is calculated in accordance with the scale set out in clause 6. Remuneration is deemed to the applicant’s annual gross package (Salary, Housing, Car and any other cash/allowances or cash equivalent remuneration. If not provided as a cash equivalent a car is deemed to be valued at Dhs 2,500/- per month.

Fees: 10 % of the successful applicant’s gross annual package.

If the Client engages the Candidate on a temporary or project basis, which then develops into permanent employment, temporary fees will apply up to the change of status whereupon a placement fee is then applicable.

The Company is not held responsible for establishing the eligibility for employment or visa status of a candidate. The Company shall not be held liable if the Client does not adhere to all relevant Labour Laws (e.g. sponsorship, visas, work permits, etc).

All communication with the candidate shall be routed through the Company.

Условия и Положения Трудового Договора


1. Условия и Положения Трудового Договора между HBTC FZ LLC (здесь и далее именуемое Предприятие) и .......................................(здесь и далее именуемый Клиент).
Данный Трудовой Договор предпологает, (на основании заявки и принятия Клиентом резюме) интервью или трудовые обязательства (которые включают в себя трудовые отношения по контракту или использование по лицензии, франшизе на основании данного Трудового Договора) для заявителя предоставленного Предприятием.

2. Клиент обязан немедленно известить о заключении трудового контракта с заявителем и оплатить гонорар Предприятию (вычисленный согласно пункту №6). Данный гонорар подлежит оплате, даже в случае подписания заявителем трудового контракта с Клиентом, в течении 12 (двенадцати) месяцев со дня представления заявителя Предприятием.

3. Представление заявителя Предриятием Клиенту, является строго конфиденциальным.
В случае если, в течении 12 (двенадцати) месяцев со дня представления заявителя, Клиент или его служащий предоставит информацию о заявителе другим предприятиям или заинтересованным лицам, последний обязан оплатить гонорар (вычисленный согласно пункту №6).

4. Все оплаты связанные с интервью кандидата, как то авиабилеты, транспорт, проживание в гостинице итд. должны быть оплачены Клиентом.

5. В случае заключения трудового контракта между Клиентом и кандидатом предоставленным Предприятием, гонорар оплачивается в соответствии со шкалой выплат описаной в пункте №6.
Оплата кандидата предполагает годовой комплекс выплат, включающий Заработную Плату, Проживание, Автомобиль или ссуда для приобретения такового, а так же другие денежные начисления. В случае если Клиент не имеет возможности предоставить заявителю положенного по трудовому контракту Автомобиля или денежной ссуды, предпологается ежемесячная выплата в размере 2, 500 /- Дирхам.

6. Гонорар: 15% (десять) процентов от полной суммы годовых начислений.

7. В случае подписания Клиентом временного контракта с Кандидатом, который в последствии переходит в постоянное сотрудничество, временные выплаты гонорара оплачиваются Клиентом Предприятию до заключения постоянного трудового контракта.
После заключении постоянного контракта Клиент оплачивает гонорар Предприятию в соответствии со шкалой выплат описанной в пункте №6.

8. Предприятие не несёт ответственности за приём на постоянную работу или обеспечение кандидата рабочей визой.
Предприятие не полежит ответственности, если Клиент не придерживается всех норм и правил Трудового Законодательства.

9. Все переговоры с кандидатом должны происходить через и только в присутствии Предприятия.

10. Пользуясь услугами Преприятия HBTC FZ LLC вы соглашаетесь с вышеуказанными Условиями и Положениями.

Bio
I moved to Dubai in 1993 and been freelancing as a Translator and Interpreter ever since. Dubai start to grow as a Business hub and Tourist destination from 1992 and never slow down, therefore I always had a plenty of translation work. 
I've been communicating both in written and oral English on a daily basis for over three decades. I am equally comfortable with business and legal English as I am with colloquial English. 
Dubai is a host of many exhibitions and  other business seminars and I had an opportunity to work with several multinational companies, who were exhibiting at such exhibitions as ADIPEC, WETEX, AGRAME, BIG5, GITEX etc. (as a Translator and Interpreter) on many occasions.
