Ενόψει της ολοκλήρωσης της Φάσης Παραμετροποίησης (‘’Detailed Configuration Analysis Phase’’) αλλά και σε απάντηση του σχετικού με Αριθμ. Πρωτ.:(deleted) εγγράφου σας, σας ενημερώνουμε για τα κάτωθι:
Το ‘’SRS’’ (deleted) το οποίο αποτελεί τμήμα του Παραρτήματος Α της υπ’ αριθμ. (deleted) Σύμβασης ως αυτή τροποποιήθηκε με την υπ’αριθμ. 5 τροποποίηση, περιλαμβάνει και καταγράφει κατ’ αποκλειστικό τρόπο το σύνολο των απαιτήσεων και προδιαγραφών για την υλοποίηση, δοκιμή και αποδοχή του νέου CDSS και των διεπαφών αυτού και επομένως οποιαδήποτε απαίτηση δεν περιλαμβάνεται και δεν καταγράφεται στο SRS δεν αποτελεί συμβατικό περιεχόμενο και αντίστοιχα υποχρέωση του Προμηθευτή.
Σύμφωνα με το SRS, η διαδικασία υλοποίησης του CDSS αναλύεται σε επτά επιμέρους (7) Φάσεις, εκ των οποίων οι δύο πρώτες (‘’Requirements Analysis Update Phase’’ και ‘’System Requirement Specification (SRS) Phase’’) έχουν ήδη ολοκληρωθεί κατά την υπογραφή της τροποποίησης (deleted) της Σύμβασης, όπως ρητά προκύπτει από το κείμενο του SRS, ενώ σήμερα βρισκόμαστε ενόψει της ολοκλήρωσης της τρίτης φάσης, ήτοι της Φάσης της Παραμετροποίησης.
Σκοπός και περιεχόμενο της παρούσας φάσης, είναι σύμφωνα με το SRS, η διακρίβωση των απαιτούμενων παραμετροποιήσεων για κάθε εφαρμογή και διεπαφή (που εξαρτάται από κάποιο BFI από πλευράς Αγοραστή) προκειμένου να καταστεί δυνατή η υλοποίηση από τον Προμηθευτή των καθοριζόμενων στο SRS απαιτήσεων , η διακρίβωση αναγκών εκπαίδευσης κλπ.
Προκειμένου δε να υποστηριχθεί το ως άνω έργο του Προμηθευτή και να καταστεί δυνατή η συγκέντρωση από πλευράς του των στοιχείων/ πληροφοριών που του είναι απαραίτητες για την διακρίβωση των απαιτούμενων παραμετροποιήσεων, το SRS προβλέπει την διεξαγωγή συναντήσεων με τους τελικούς χρήστες, τα αποτελέσματα των οποίων θα πρέπει να καταγράφονται σε πρακτικά υπογραφόμενα από αμφότερα τα Μέρη.
Στο παραπάνω πλαίσιο και σύμφωνα με τις προβλέψεις του SRS, πραγματοποιήσαμε συναντήσεις με τους τελικούς χρήστες, κατά την διάρκεια των συναντήσεων αυτών συγκεντρώσαμε τις απαιτούμενες πληροφορίες για την διαμόρφωση του παραδοτέου εγγράφου που απορρέει από την παρούσα φάση και που από κοινού πρέπει να συμφωνηθεί με τον Αγοραστή. Πλην όμως σε ορισμένες περιπτώσεις τα στοιχεία που μας δόθηκαν από πλευράς τελικών χρηστών και αντίστοιχα κατεγράφησαν στα πρακτικά των συναντήσεων δεν εντάσσονται στο παραπάνω πλαίσιο ούτε εξυπηρετούν την διαδικασία της παραμετροποίησης αλλά αποτελούν νέες απαιτήσεις βρισκόμενες εκτός των συμβατικών πλαισίων και επομένως και εκτός των συμβατικών υποχρεώσεων του Προμηθευτή.
Στο επισυναπτόμενο έγγραφο της παρούσας επιστολής παραθέτουμε τα στοιχεία που τέθηκαν κατά την διάρκεια της φάσης λεπτομερούς παραμετροποίησης (για τις εφαρμογές και τις διεπαφές για τις οποίες έχουν ολοκληρωθεί οι συναντήσεις της φάσης λεπτομερούς παραμετροποίησης), από πλευράς τελικών χρηστών πλην όμως δεν εξυπηρετούν τις ανάγκες της εν λόγω φάσης ούτε εντάσσονται στις συμφωνηθείσες απαιτήσεις του SRS αλλά αποτελούν νέες απαιτήσεις τιθέμενες επιπλέον των συμβατικών προβλεπομένων προδιαγραφών για την υλοποίηση του CDSS. Σημειώνουμε ότι στα πλαίσια της αποδεδειγμένης μέχρι σήμερα προσπάθειάς μας να ικανοποιήσουμε στο μέγιστο δυνατό βαθμό εύλογες απαιτήσεις του Αγοραστή ακόμη και εάν βρίσκονται έξω και πέραν των συμβατικών μας υποχρεώσεων αποδεχόμαστε την υλοποίηση ορισμένων εξ αυτών, όπως σημειώνουμε στον επισυναπτόμενο πίνακα.
Στο παραδοτέο έγγραφο της Λεπτομερούς Ανάλυσης Παραμετροποίησης που θα σας δοθεί μέχρι 9/11/2007 δεν θα περιλαμβάνονται οι αναφερόμενες στο επισυναπτόμενο στην παρούσα επιστολή έγγραφο, εξωσυμβατικές απαιτήσεις, καθώς επίσης και τυχόν νέες εξωσυμβατικές απαιτήσεις που ενδεχομένως προκύψουν κατά τις συναντήσεις που έχουν προγραμματιστεί για τις εφαρμογές (E-Protocol , Case Management), πλην όμως είμαστε διατεθειμένοι να προβούμε στην περαιτέρω ανάλυσή τους, ώστε να σας τεθούν από την πλευρά μας οι τυχόν τεχνικοί περιορισμοί που ενδεχομένως δεν επιτρέπουν την υλοποίησή τους, ή στην περίπτωση που αυτοί δεν υφίστανται, το κόστος και το χρονοδιάγραμμα για την υλοποίησή τους. Είναι ευνόητο ότι η εν λόγω προσπάθεια θα πρέπει να γίνει παράλληλα και ανεξάρτητα από τις ενέργειές μας για την ολοκλήρωση της Φάσης Παραμετροποίησης ώστε να μην τεθεί σε διακινδύνευση η πρόοδος υλοποίησης και η έγκαιρη ολοκλήρωση του CDSS ως αυτό προδιαγράφεται στο SRS.
Στην περίπτωση που διατηρείτε οποιαδήποτε αντίρρηση για κάποια από τις εξαιρούμενες περιπτώσεις, παρακαλούμε να μας ενημερώσετε σχετικά και να μας υποδείξετε το σημείο του SRS στο οποίο αυτές εντάσσονται.

Translation - English Dear Sirs,
In view of the Detailed Configuration Analysis Phase completion, but also in response to your relevant document (deleted), please be informed on the following:
The SRS (Attachment deleted) which is part of Annex Α of Contract (deleted), as modified through Modification 5, includes and records exclusively all requirements and specifications for the implementation, test and acceptance of the new CDSS and its interfaces, and therefore, any requirement not included or recorded in the SRS is not part of the contract nor is it an obligation of the Supplier.
Per the SRS, the CDSS implementation procedure is analyzed in seven (7) individual Phases, the first two of which (“Requirements Analysis Update Phase” and “System Requirement Specification (SRS) Phase”) have already been completed at Contract Modification (deleted), as it is stipulated in the SRS text; today, we are about to complete the third phase, namely, the Configuration Phase.
The aim and the context of the present phase, per the SRS, is to verify the required configurations for each application and interface (depending on a certain BFI) in order to render possible the implementation of the SRS requirements by the Supplier, and also to verify the training needs, etc.
In order to support the above task of the Supplier and to render possible the collection of data/ information that are necessary for the verification of the required configurations, the SRS provides for the meetings conduct with the end users, the results of which should be recorded in meeting minutes signed by both Parties.
In the aforementioned framework and in accordance with the SRS provisions, we held meetings with the end users, during which we collected the required information for the formation of the deliverable document resulting from the present phase, which should be commonly agreed upon with the Buyer. However, in certain cases, the data provided to us by the end users and respectively recorded to the meeting minutes are not included in the above framework nor do they facilitate the configuration procedure, but are new requirements out of the contractual scope and therefore, are not contractual obligations of the Supplier.
In the herein attached document we present the data provided on behalf of the end users during the detailed configuration analysis phase (concerning applications and interfaces for which meetings for the detailed configuration analysis phase have been concluded), which however do not accommodate the needs of the said phase nor are they integrated in the SRS requirements that have been agreed upon but constitute new requirements that are out of the scope of the contractually stipulated specifications for CDSS implementation. It should be noted that in the context of our proven efforts up to date to satisfy the reasonable requirements of the Buyer to the maximum, even if they reach beyond the scope of our contractual obligations, we accept the implementation of some of these requirements, as noted in the attached table.
The deliverable document of the Detailed Configuration Analysis that will be provided to you by 09/11/2007 will not include the requirements that are out of the scope of the contract which are mentioned in the herein attached document, neither any new requirements out of the scope of the contract that may arise from meetings scheduled for applications (E-Protocol, Case Management), but we are willing to analyze them further, in order to refer to any technical restrictions that may not allow for their implementation, or, if there are not any, state the cost and schedule for their implementation. As you may understand, the said attempt has to be underway at the same time with and independently from our actions for the completion of the Configuration Phase in order not to jeopardize the implementation progress and the timely completion of CDSS as provided for in SRS.
If you have any objections with regard to any of the cases excluded, please inform us accordingly and advise about the SRS part under which they fall.
