Source text - English Criminal Justice Diversion Program
Diversion provides mainly first time offenders
with the opportunity to avoid a criminal record by undertaking conditions that benefit the offender, victim and the community as a whole.
When the offender has satisfactorily
completed the Diversion conditions, the
Magistrate will discharge the charges against
the offender at a completion hearing.
The offender is not required to attend
the completion hearing unless requested
to do so by the Magistrate. The onus is on the offender to file proof, prior to the completion hearing, that all conditions are complete.
Going to Court
Upon the first listing of your case, you are able to make application for an adjournment. You must arrange this with the Court Coordinator prior to the date of hearing.
IF YOU DO NOT GO TO COURT
If you have been charged on summons, you should attend Court on the date your case is listed. If you do not attend and have not contacted the Court to make arrangements for an adjournment, your case may be heard and determined in your absence.
WHAT HAPPENS IN THE COURTROOM?
When your name is called, go into the Courtroom. You will be guided where to stand by the Bench Clerk. You should call the Magistrate either “Your Honour” or “Sir” or “Madam”. You will be asked if you plead guilty or not guilty.
Civil Procedures
The civil jurisdiction includes claims for debts or damage to property, damages for breach of contract or for personal injury, and some neighbourhood disputes.
TAKING COURT ACTION
Civil action begins by the Plaintiff issuing a “Complaint” (Form 4A) against the Defendant. The “Complaint” must contain the full name and details of the parties, their addresses, and details about the claim and the orders or relief sought. A fee is payable to the Court to issue the document.
WHAT IS MEDIATION?
Mediation is a voluntary and confidential process that assists parties to resolve disputes quickly, in a fair and informal environment.
