(1) Prezentul acord este încheiat în temeiul HG nr. 497/2004 privind stabilirea cadrului institutional pentru coordonarea, implementarea şi gestionarea instrumentelor structurale cu modificările şi completările ulterioare, al HG nr. 738/2003 privind organizarea si functionarea Ministerului Economiei si Comertului, cu modificările şi completările ulterioare, si ale HG..................., [actele normative care reglementează organizarea şi funcţionarea celor 2 părţi; se va menţiona tipul şi numărul actului, inclusiv dacă a suferit modificări], Regulamentului Consiliului nr. 1083/2006 care reglementează prevederile generale privind Fondul European pentru Dezvoltare Regională, Fondul Social European şi Fondul de Coeziune, Regulamentele de Implementare (de completat cu nr. acte) Cadrului Strategic Naţional de Referinţă şi Programului Operational Sectorial Creşterea Competitivităţii Economice aprobate în şedinţa de Guvern din data de [……………] si prin Decizia CE nr...........
(2) În contextul gestionării Programului Operaţional Sectorial Creşterea Competitivităţii Economice, denumit în continuare POS CCE, pentru eficienta implementare a acestuia şi în vederea creşterii capacităţii de absorbţie generală a Fondurilor, este necesară delegarea unor funcţii ale Autorităţii de Management către Organismul Intermediar. Autoritatea de Management va rămâne în continuare responsabilă pentru îndeplinirea corespunzătoare a functiilor delegate, precum şi a operaţiunilor finanţate prin instrumentele structurale.
(3) Pentru stabilirea funcţiilor care sunt delegate prin prezentul acord s-au avut în vedere, în special, tipurile de proiecte care urmează a fi implementate şi capacitatea administrativă şi expertiza în domeniu pe care o are Organismul Intermediar. În acest context, Autoritatea de Management, stabileşte şi tipul de control pe care îl va exercita în legătură cu îndeplinirea funcţiilor delegate.
Articolul 1 - Părţile acordului
(1) Ministerul Economiei şi Comerţului avand functia de Autoritate de Management pentru POS CCE, prin Direcţia Programe cu Organizatii Internationale, reprezentat prin Domnul Ioan Codrut Seres, Ministrul Economiei şi Comerţului. Autoritatea de Management pentru POST
(2) Institutia […………] avand functia de Organism Intermediar [……………..], prin [……………..], reprezentata prin [……………..] [conducătorul institutiei – nume, funcţie]. Organismul Intermediar [……………..] va fi denumit in continuare OI.
Articolul 2 – Definiţii şi interpretare
(1) Pentru interpretarea corectă a prezentului acord se vor lua în considerare termenii definiţi mai jos.
Program Operaţional - document înaintat de către Statul Membru şi adoptat de către Comisie, care conţine o strategie de dezvoltare cuprinzând o serie de priorităţi coerente care să fie implementate cu ajutorul unui Fond, sau în cazul obiectivului „Convergenţă”, cu ajutorul Fondului de Coeziune sau a FEDR .
Autoritate de Management – o autoritate publică naţională, regională sau locală sau un organism public sau privat desemnat de către Statul Membru să gestioneze programul operaţional.

(1) This agreement is concluded based on the GD no. 497/2004 regarding the setting up of the institutional framework for the coordination, implementation and management of structural instruments with its subsequent amendments and supplementations, GD no. 738/2003 regarding the organization and operation of Ministry of Economy and Trade with subsequent amendments and supplementations and GD ..................., [normatives setting forth the organization and operation of both parties; document type and number shall be specified, including its amendments], Council Regulation no. 1083/2006 laying down the general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund, Implementation Regulations (to be filled in with documents number) of the National Strategic Reference Framework and Sectoral Operational Programme Increase of Economic Competitiveness approved during the Government meeting dated [……………] and by CE Decision no. ...........
(2) Within the context related to the management of Sectoral Operational Programme Increase of Economic Competitiveness, hereinafter referred to as SOP IEC, for its proper implementation and for increasing the general Funds absorption capacity, it is necessary to delegate some functions of the Managing Authority to the Intermediate Body. The Managing Authority shall remain responsible for the proper performance of delegated functions, as well as operations financed by structural instruments.
(3) The types of projects to be implemented and the administrative capacity and field expertise of the Intermediate Body have been especially taken into consideration in order to establish the functions delegated hereby. Within this context, the Managing Authority also establishes the type of check to be exercised in connection to the performance of delegated functions.
Article 1 - Agreement Parties
(1) The Ministry of Economy and Trade as Managing Authority for SOP IEC, by the Directorate for Programmes with International Organizations, hereby represented by Mr. Ioan Codrut Seres, the Minister of Economy and Trade. The Managing Authority for SOP IEC shall be hereinafter referred to as MA.
(2) Institution […………] as Intermediate Body [……………..], by [……………..], hereby represented by [……………..] [Institution Manager – name, position]. The Intermediate Body [……………..] shall be hereinafter referred to as IB.
Article 2 – Definitions and Interpretation
(1) The terms defined below shall be considered for the proper interpretation hereof.
Operational Programme – document submitted by the Member State and adopted by the Commission, which contains a development strategy with a series of coherent priorities to be implemented using a Fund, or for “Convergence” objective, using the Cohesion Fund or ERDF.
Managing Authority – national, regional or local public authority or public or private body appointed by the Member State to manage the operational programme.
