23. Allgemeine Regelungen fuer das patentamtliche und gerichtliche Verfahren
1. Verfahren vor dem Deutschen Patent- und Markenamt
a) Rechtsstellung des Amts und seiner Mitglieder
1. Schon zu der Zeit, als zum DPA noch Beschwerde und Nichtigkeitssenate gehoerten, gelangte das Bundesverwaltungsgericht in einem Grundsatzurteil zu der Auffassung, daB es sich dabei um eine Verwaltungsbehoerde handelt. Es folgerte daraus, daB die Moeglichkeit, Entscheidungen des Amts vor dessen eigenen Beschwerdesenaten anzufechten, der Rechtsweggarantie des Art. 19 Abs. 4 GG nicht genuegte und mangels anderweitiger gerichtlicher Nachpruefbarkeit der Weg zu den Verwaltungsgerichten offenstand. Nachdem daraufhin unter Ausgliederung der Beschwerde und Nichtigkeitssenate aus der Amt das BPatG errichtet geworden ist, kann als allgemein anerkannt gelten, daB das DPMA nach seiner Stellung im staatlichen Behoerdenaufbau und seiner inneren Organisation eine Verwaltungsbehoerde darstellt. Seine Entscheidungstaetigkeit kann daher verfassungsrechtlich gesehen keine richterliche sein; denjenigen, die sie ausueben, ist nicht die richterliche Unabhaengigkeit zugesichert.
Das Bundesverfassungsgericht hat dies durch einen BeschluB vom 25. Februar 2003 bestaetigt: "Die Taetigkeit der Beschwerdefuehrer als technische Mitglieder des Deutschen Patent- und Markenamtes gehoert nicht zur Rechtsprechung."
Durch Gesetz vom 23. November 2007 wurde in 26. Abs. 1 Satz ausdruecklich bestimmt: "Das Deutsche Patent- und Markenamt ist eine selbstaendige Bundesoberbehoerde im Geschaeftsbereich des Bundesministeriums der Justiz."
2. Unter diesen Umstaenden kann nur ueber die Frage diskutiert werden, ob de lege ferenda die Entscheidung ueber Erteilung oder Versagung, Aufrechterhaltung oder Widerrut von Patenten nicht nur richterlicher Kontrolle zu unterwerfen, sondern von vornherein unabhaengigen Richtern zu uebertragen ist. In diesem Zussamenhang wird auf Besonderheiten hingewiesen, die die Taetigkeit des DPMA im Vergleich zu derjenigen vieler anderer Verwaltungsbehoerden aufweist: es verfolgt bei der Entscheidung ueber die Gewaehrung von Patentschutz keine eigene verwaltungsmaeBige Zielsetzung und hat keine an einer solchen Zielsetzung ausgerichteten ZweckmaeBigskeitserwaegungen anzustellen; es genieBt keinen ERmessensspielraum, sondern muB und darf ein Patent immer und nur dann erteilen, wenn die im Gesetz festgelegten Voraussetzungen erfuellt sind.-Verwaltungsentscheidungen, die in solcher Weise gebunden sind, finden sich jedoch auch in anderen Bereichen.

a.) Legal Status of the Office and its Members
1. Even in a time, when the DPA still handled appeals and revocations, the Federal Administrative Court came to the conclusion, that they were also a matter for the administrative authorities. From that, it followed that there was a possibility that the decisions of the office, even when contested in its own court of appeals, did not fulfill the guarantee of legal (due) process, as seen in (Sentence 19, 4 CG), and thus were left to provide their judicial verifiability through administrative courts. Thereafter with the divestment of the appeals and revocation authority upon which the office is formed, it can be generally recognized, that the DPMA, based on its position as an administrative body and its inner organization, becomes an administrative authority. Therefore, constitutionally speaking, its decision making powers cannot be judicial; likewise, that which it practices cannot be granted judicial immunity.
The Federal Constitutional Court declared this is a ruling on February 25, 2003: “The activities of the appellate as a technical member of the German Patent and Trademark Office do not pertain to jurisprudence.”
In a law from November 23, 2007 (Paragraph 26, Sentence 1), it was expressly stated that “The German Patent and Trademark Office is an independent higher federal authority in conjunction with the Federal Ministry of Justice.
In these circumstances, it can only be speculated, as to whether the “de lege ferenda” of the decision on acceptance or refusal, extension or revocation of patents not only should be subject to judicial control but also should be taken over by it. In this context, the characteristics of DPMA and the way they compare to the many other administrative authorities should be cited; it pursues no administrative objectives in its decision on the granting of patent protection and shows no signs of intentional consideration to instill such objectives; it enjoys no exemption from discretion, rather it must grant a patent when and only when the legally defined prerequisites have been fulfilled-administrative decisions joined in such a way, though, are found in many other domains.

Hello, my name is Ryan LLoyd. I am a native English speaker from the United States. Presently I have a full-time job as an ESL teacher. However, I am still very interested in the field of translation.
The foreign language I am most comfortable with, especially in terms of writing, is German. My major was German, so that is the language in which I'm most grammatically sound. While I am not interacting in German on a frequent basis now, I am still comfortable doing so. The main reason is that I still often read German novels.
Korean is my second best foreign language. I have studied it for almost 9 years now, both while living in Korea and in the U.S., and I use it on a daily basis. I
would be considered fluent in Korean. My vocabulary is excellent, but Korean grammar still poses some difficulties for me, especially in terms of production. As my wife is Korean and also fluent in English, though, any project I might undertake with Korean would be as a pair.
In recent years, I have also been engaged in serious study of Spanish and am confident about translating relatively high-level material, such as what you would find in newspapers or magazines, into English or Korean (English-Korean with my wife's help).
Admittedly, I am an amateur translator with no formal training in translating and only some working experiences (eight or nine small to medium Korean projects and two large projects with German), but I am a bonafide linguist and am extremely conscientious about my work.
I am very flexible on the type of material to translate. I am a creative writer well versed in a wide variety of subjects, especially literature and natural sciences.
I typically work for 0.045 USD/word and have always been on time.
