Source text - English 3.0 Description of the Device and Intended Application
3.1 Materials
XXXX’s textured YYYY mammary implant range is wholly manufactured from implant grade silicone materials. XXXX’s textured YYYY mammary implant range is comprised of a round, textured high performance silicone elastomer shell, providing a high tear resistance with low permeability due to the incorporation of a barrier layer within the shell. The shell is filled with a soft, high cohesive gel and is sealed posteriorly with a disc-shaped closure patch. XXXX’s textured YYYY mammary implant range does not incorporate medicinal substances, tissues or blood products nor are they used in the manufacturing process.
3.2 Device Components and Accessories
XXXX’s textured YYYY mammary implant range is comprised of three main components:
a) Silicone shell: Round silicone elastomer shell with a textured surface.
b) Silicone gel: The silicone elastomer shell is filled with a soft, high cohesive silicone gel fill material.
c) Closure patch: The silicone elastomer shell is sealed with a disc-shaped closure patch bearing the product identification details.
XXXX’s textured YYYY mammary implant range are not supplied with any accessories, nor are they intended to be used in conjunction with any other medical device. A technical description of XXXX’s mammary implant family is provided in section 3.6 below.
3.3 The Intended Application of the Device
XXXX’s textured YYYY mammary implant range are single use, sterile breast implant products designed for surgical implantation to replace tissue lost by trauma, surgical intervention or to augment tissue for therapeutic or cosmetic purposes. XXXX’s textured YYYY mammary implant range are intended for permanent implantation, however, they are not considered to be lifetime devices due to a number of factors, including differences in patient physiology and variation in surgical procedures. As a result, revision surgeries may be necessary.

Source text - English B. OTC Derivative Transactions
1. The Bank shall execute "over the counter derivative" transactions under the terms and conditions of the XXX Master Agreement OTC Derivatives entered into between the Client and the Bank. The Client herewith acknowledges that the Bank is entering into each transaction subject to being able at all times to enter into and maintain a back-to-back transaction with one or more affiliates of the Bank (each a "Related Transaction"). This means that while the Client will not be a contracting party of such Related Transaction to be entered by the Bank and the affiliates of the Bank, the Bank may terminate the derivative transaction with the Client upon occurrence of a default, event of default or termination event (howsoever described) in respect of a Related Transaction. The Client will under such circumstances be obliged to make a payment in an amount equal to any loss incurred by the Bank and bear all market and credit risk of the Bank in connection with such Related Transactions.

2. The Client confirms by signing these Conditions to have read and understood the terms and conditions of the Goldman Sachs Master Agreement OTC Derivatives. The Client understands that these Conditions coupled with the Credit and Pledge Agreement and the XXX Master Agreement for OTC Derivatives provide the Bank with security rights over the Margin Collateral as further defined and outlined under Section C below. The Client further acknowledges that the XXX Master Agreement for OTC Derivatives requires a high level of comprehension of the English language, including financial and legal terms, and that the Client has such skills and is capable of fully comprehending all of the matters set out in this document in addition to all documentation relating to the Account (whether provided in its/his/her first language or English). The Client confirms to have read carefully and fully understood all such documents and that the providing of the XXX Master Agreement for OTC Derivatives in English language is in the interest of efficiency and is expressly agreed by the Client. The Client has taken independent legal advice where necessary
Without limiting the generality of the foregoing, the Client in particular acknowledges and agrees that:
2.1. the Bank may terminate all OTC derivative transactions following and Event of Default and Related Transaction Event as defined in the XXX Master Agreement for OTC Derivatives;
2.2. the Bank has incurred or will incur (in its reasonable determination) any increased cost in relation to one or more OTC derivative transaction(s) and the Client shall bear all costs and losses due to such a termination;
3. The Client confirms by signing these Conditions that it/he/she has received the respective information and understands the inherent risks of dealing in derivative transactions (see also Clause C.4 hereinafter).

1. La Banque devra conclure les opérations sur produits dérivés de gré à gré conformément aux termes et conditions du Contrat cadre de XXX relatif aux produits dérivés de gré à gré conclu entre le Client et la Banque. Le Client reconnaît par les présentes que la Banque conclut chaque transaction sous réserve de pouvoir à n'importe quel moment conclure et conserver une opération réciproque avec un ou plusieurs affiliés de la Banque (chacune étant une « Transaction connexe »). Le Client comprend que les présentes Conditions, associées au Contrat de Crédit et Nantissement et au Contrat cadre de XXX relatif aux produits dérivés de gré à gré offrent à la Banque des droits de sécurité sur la Garantie de marge tel que défini et décrit dans la section C ci-après. Le Client reconnaît par ailleurs que le Contrat cadre de XXX relatif aux produits dérivés de gré à gré nécessite un degré élevé de compréhension de la langue anglaise, y compris des termes financiers et juridiques, et que le Client possède ces compétences et est capable de comprendre la totalité des questions présentées dans ce document en plus de toute la documentation relative au Compte (qu'elle soit fournie dans sa langue maternelle ou en anglais).
