Source text - English Secure power supplies and associated wiring etc is the subject of the following section in this report because it became clear during the visit that this is an area of greatest concern for the whole project and any future similar ones.
Power supplies, earthing and lightning protection
The Consultant visited 13 of the total 22 sites in the K… network. Of these just over half appeared to be equipped with the 500VA UPS unit itemised in the TS. All but one of these units were loosely laid in the bottom of the equipment cabinet and, in most instances, the unit was connected to the mains supply by a lead and plug, sometimes via a multiway adapter. In no cases was the equipment wired into the mains power supplies by a properly installed, dedicated, fused spur outlet separate from the existing power outlets in the room in which the equipment was installed – the usual installation was a flying lead and plug which plugged into an available wall socket.
The Consultant did not see any of the specified standby power generators at any of the sites visited and no switching or changeover arrangements appear to have been made to actually allow a generator to be automatically connected to the equipment in the event of a mains power failure to support the UPSs, although the TS does not specify how the standby power equipment is to be deployed.
The Contractor noted that the standby power generators had actually been delivered to site.
The subcontractor team who appeared to be trying to complete various unfinished parts of the network and diagnose the radio link failures noted at the B… TV tower base station site were seen to be using one petrol generator which might be one of the deliverables.
In the light of the very poor power distribution system supplying the more remote border guard facilities, and the apparent generally insecure state of the mains power supplies to any of the remote SBGSU facilities, or indeed major facilities such as the TV station, it would seem essential to improve the reliability of the power system for most of these individual installations if full advantage is to be taken of the new wireless network and its ability to work 24/7.
The Consultant verified that, in all cases where it could be inspected, the subcontractor had installed a substantial cable from an earth point on the outdoor radio equipment to a suitable grounded earth connection. The Consultant was unable to confirm that lightning protection devices had been fitted to the indoor- and outdoor-mounted radio equipment. In the light of the major equipment failure at B… TV tower thought to be caused by a power surge and/or lightning it may be appropriate to consider reviewing the overall lightning protection of all installations in the network (see applicable documents ref. 5).
These devices, lightning and earthing arrangements in general, were not however specified in the TS.
These are therefore topics to be more thoroughly developed in any future TS for a similar network to be deployed elsewhere.
Documentation and training
It was noted that no documentation in the Ukrainian language has apparently been drafted or yet provided to the SBGSU. Training for SBGSU personnel has also to be carried out and the Consultant believes this is an important issue that should be addressed as soon as possible to make sure that further equipment failures due to power supply problems, surges etc may be quickly identified and faulty equipment diagnosed and replaced. It is also necessary to provide training as soon as possible in order that SBGSU personnel gain confidence in the network so that it will be adopted quickly and made an essential part of SBGSU operations in the field.

Електроживлення, заземлення та захист від блискавки
Консультант відвідав 13 з усіх 22 вузлів у мережі «K…». З них більше ніж половина як видається обладнані системами безперервного живлення на 500VA, перерахованих в технічному завданні. Чи не кожен з цих блоків вільно лежав на основі корпусу обладнання і в більшості випадків, блок був під’єднаний до живлення від мережі перемінного струму за допомогою свинцю та штепселя інколи через багатопозиційний перехідник. В жодному з випадків обладнання не було сполучено з мережевою розеткою електроживлення з допомогою виділеного вплавленого шпурового виходу, встановленого належним чином та відокремленого від існуючих штепсельних розеток, у кімнаті, де було встановлено обладнання, напівпровідниковий гнучкий вихід та штепсель вставлений у доступну стінну розетку є звичайною установкою.
Консультант не побачив ні жодного спеціалізованого автономного силового генератора на будь-якому з робочих майданчиків ні перемикаючого пристрою, які фактично дали б змогу генератору автоматично підключатися до обладнання в разі втрати мережевої напруги для підтримки систем неперервної напруги, хоча у технічному завданні точно не вказувалося, що автономне силове обладнання повинно бути розвернуто.
Підрядник зауважив, що автономні силові генератори фактично були доставлені до робочого майданчика.
Команда субпідрядника, яка здавалася намагається завершити різноманітні незакінчені частини мережі та виявити порушення в радіолінії зазначила що у площі базової станції телевізійної башти «B… TV» використовували один бензиновий генератор, який можливо є одним з доставлених.
У світлі дуже слабкої системи розподілення електричної потужності, яка надає дистанційні захисні пристрої та очевидний загальний незадовільний стан безпеки електроживлення мережі, яке подається до будь-якого з дистанційних пристроїв SBGSU, чи до більш значних пристроїв, таких як телевізійна станція, видається життєво необхідним покращити надійність силової системи для більшості цих індивідуальних установок при умові якщо будуть використовуватися переваги нової бездротової системи та її можливість працювати за схемою 24/7.
Консультант засвідчує, що у всіх випадках де це могло бути перевірено субпідрядник установив міцний кабель з точки заземлення на зовнішньому радіо обладнанні до відповідного заземленого з’єднання. Консультант не був у змозі підтвердити що пристрої для захисту від блискавки були приладнані до внутрішнього та зовнішнього радіообладнання. У світлі думки що відмова основного обладнання на телевізійній башті «B…» була викликана різким миттєвим підвищенням напруги та/чи блискавкою, можливо варто розглянути всю систему захисту від блискавок на всіх установках мережі (дивися відповідні документи посилання 5).
Проте ці пристрої, загальні установки для заземлення та захисту від блискавки не були точно визначені у технічному завданні.
Таким чином у майбутніх технічних завданнях слід більш детально розробити ці теми стосовно подібних мереж, які повинні бути розвернуті будь-де.

English to Russian: Law: Contracts
Source text - English The compensation should be paid within 5 (five) bank days from the point of billing by the Lessor.
3.5. Rental rate, specified in i. 3.1., is defined at the rate of 5.05 hrn. for 1 USA dollar, fixed by NBU as of 15.01.2007.
In case of rise in exchange rate of USA dollar with respect to hryvnia rental rate, defined in i.3.1 is subjected to indexing in accordance with ratio of rise in quotation of USA dollar to hryvnia, fixed by NBU at a point of billing. Indexing of rental rate should be made by the following formula:

Цн - indexed rental rate, matured according to issued bills
Кн - USA dollar rate, fixed by NBU at a point of billing
Кс - USA dollar rate, fixed by NBU as of 15.01.2007.
Цс - Amount of payments, defined in i. 3.1. of the Contract.
3.6. In case of imposition of real-estate taxes rental rate for one square metre a month would be increased by amount of tax, calculated for one square metre of the Premises per one calendar month, starting with first day of tax charge. This increase would be made automatically, without additional agreement with the Lessor. However, the Lessor should to send the Leasee the written message with calculation of the sum and extra charge, by which rental rate should be increased.
3.7. The Parties agreed that after every close of year of lease according to the Contract, the amount of monthly Rent for using by 1 (one) square metre of the Premises, defined in i. 3.1 of the Contract, is subjected to increase by 3% (three percent) in comparison with monthly Rent for use of 1 (one) square metre of the Premises, valid in last month of the year of lease.
In addition, aforesaid increase of Rental rate should be made automatically, without additional agreement of the Parties, starting from the first month of every next lease year according to the Contract.
The Lessor sends to the Leasee applicable reminding letter with calculation of increased Rental rate at the latest 10 calendar days before expiration of lease year.
Increase of Rental rate, defined in this item of the Contract, is made irrespective of Rental rate Indexing, which is connected with change of official exchange rate under item 3.5 of the Contract.
3.8. All expenses, connected with use of telephone numbers are covered by the Leasee on its own.
3.9. Rendering of telephone and other telecommunicational services are not regulated by this Contract. The Leasee concludes applicable services agreements independently. During term of lease the Leasee independently pays telephone license fee and all payment charged for local, long-distance, and international telephone talks as well as other communication service, supplied to the Leasee by telecommunicational enterprises.
3.10. The Leasee has a right to get to know bills of enterprises and third parties, under which the Lessor bills for reimbursement of expenses incurred for housing and public facilities, operational costs.
4. RIGHTS AND OBLIGATIONS OF THE LESSOR.
4.1. The Lessor has a right to:
4.1.1. enter into the Premises in order to check its target use and observation of preventive fire-fighting regulations, sanitary code and so on by the Lessor, as well as to demonstrate the Premises to potential buyers or leasees; however only during working hours and after previous notification of the Leasee (excluding emergency).
4.1.2. in case of the Contract termination before the appointed time as the result of breach of the terms and conditions of the Contract by the Leasee the Lessor has a right to seek redress of wrong from the Leasee owing to harm caused to the Lessor as the result of breach of the terms and conditions of the Contract before the appointed time as the supplement to all means of protection of infringed rights, which are provided by the Contract and existing legislation.
4.2. The Lessor is obliged:
4.2.1. to give to the Leasee an opportunity of the unimpeded use of the Premises under conditions of the Contract;
4.2.2. at the request of the Leasee to provide the Leasee with the copies of documents, confirmed the Lessor’s right of property for the Premises;
4.2.3. to eliminate effect of the accidents and damages of the Premises, if they have not been occurred through fault of the Leasee or persons, which are connected with the Leasee by the contractual relations;
4.2.4. to give to the Leasee an opportunity to use ground area according to i.1.8 of the Contract.

3.5. Размер арендной платы, отмеченной в п. 3.1., определенный при курсе 5,05 грн. за 1 доллар США, установленному НБУ состоянием на 15.01.2007 г.
В случае роста курса доллара США по отношению к гривне размер оплат, предусмотренных п. 3.1., подлежит индексации в соответствии с коэффициенту роста курса доллара США к гривне, установленного НБУ на момент выставления счета. Индексацию размера арендной платы следует осуществлять по следующей формуле:

3.6. В случае введения налога на недвижимость ставка арендной платы за один квадратный метр на месяц будет увеличена на сумму налога, рассчитанного на один квадратный метр Помещения за один календарный месяц, начиная с первого дня начисления налога. Такое увеличение будет осуществлено автоматически, без дополнительного согласования с Арендатором. Однако Арендодатель обязан послать Арендатору письменное сообщение с расчетом суммы, надбавки, на которую должна увеличиться арендная ставка.
3.7. Стороны согласились, что по окончании каждого года аренды по этому Договору, размер месячной Арендной оплаты за пользование 1 (одним) кв.м. Помещение установленный п. 3.1 Договора, подлежит увеличению на 3% (три процента) в сравнении с размером месячной Арендной оплаты за пользование 1 (одним) кв.м. Помещение, которая действовала в последнем месяце такого года аренды.
При этом, вышеприведенное увеличение Арендной платы будет осуществляться автоматически без дополнительного согласования Сторон, начиная с первого месяца каждого в следующем году аренды по Договору.
Не позже чем за 10 календарных дней до окончания каждый год аренды, Арендодатель направляет Арендатору соответствующий напоминание письма с расчетом увеличенного размера Арендной платы.
Отмеченое в этом пункте Договора увеличение Арендной платы, осуществляется независимо от Индексации Арендной платы, которая связана с изменением официального валютного курса на основании пункта 3.5 этого Договора.
3.8. Все расходы, связанные с пользованием номерами телефонов, платятся Арендатором самостоятельно.
3.9. Предоставление всех телефонных и других телекоммуникационных услуг не регулируется данным Договором. Арендатор самостоятельно заключает соглашения о предоставлении соответствующих услуг. В течение Срока аренды Арендатор самостоятельно оплачивает телефонную абонентскую плату и все платежи, начисленные за местные, междугородные и международные телефонные переговоры, а также за другие услуги связи, предоставленные Арендатору телекоммуникационными предприятиями.
3.10. Арендатор имеет право ознакомиться со счетами предприятий и третьих лиц, на основании которых в соответствии с условиями данного Договора Арендодатель выставляет ему счета на возмещение понесенных расходов на жилищно-коммунальные услуги и эксплуатационные расходы.
4. ПРАВА И ОБЯЗАННОСТИ АРЕНДОДАТЕЛЯ.
4.1. Арендодатель имеет право:
4.1.1. заходить в Помещение для проверки на предмет его целевого использования и соблюдения Арендатором правил пожарной безопасности, санитарных норм и тому подобное, а также для показа Помещения потенциальным покупателям или арендаторам; однако только в рабочее время и после предыдущего сообщения Арендатора (кроме аварийных случаев).
4.1.2. в случае досрочного прекращения Договора в следствие нарушения условий Договора Арендатором, в приложение ко всем средствам защиты нарушенных прав, которые предусмотрены Договором и действующим законодательством, Арендодатель имеет право требовать от Арендатора возмещения любого вреда, нанесенного Арендодателю в результате досрочного прекращения Договора.
4.2. Арендодатель обязан:
4.2.1. предоставить возможность беспрепятственного использования Арендатором Примищенья на условиях Договора;
4.2.2. предоставлять по требованию Арендатора копии документов которые подтверждают право собственности Арендодателя на Помещение;
4.2.3. ликвидировать следствия аварий и повреждения Помещения, если они возникли не по вине Арендатора или лиц, с которыми Арендатор имеет договорные отношения;
4.2.4. предоставить Арендатору возможность пользования земельным участком в соответствии с п. 1.8. Договора.
