Morelia, Michoacán.- No obstante la lucha de que homosexuales, lesbianas y transgéneros han dado en nuestro país por la defensa de sus derechos, México sigue siendo un país en que la diversidad sexual se observa como un tema altamente polémico.
Este 25 de junio se celebra el Día Mundial de la Diversidad Sexual, y no obstante las fechas conmemorativas y de reflexión con las que está cargado el calendario, la discriminación y el rechazo siguen siendo la constante hacia aquellos que han decidido asumir libremente su sexualidad.
Un estudio elaborado por el Instituto Nacional de la Mujer a propósito de la diversidad sexual en México, apunta que este tema es altamente controvertido dadas las implicaciones evidentes: el libre ejercicio de la sexualidad y la posibilidad de desarrollar lo humano desde una perspectiva corporal, política, sexogenital diferente de las expectativas establecidas socialmente.
"El horror de muchos padres y madres sigue siendo, aún, que sus hijos e hijas lleguen a ejercer su sexualidad tal y como lo deseen por sí mismos. Para muchos resultan insoportables las imágenes de hombres que besan y tocan a otros hombres, o que comparten con el género femenino maquillajes, vestuario, posturas, ademanes y deseos; o bien las dos mujeres que conviven y se bastan a sí mismas como pareja, o quizá la persona que desea compartir indistintamente con hombre o con mujer en pleno goce de su sexualidad y cumplimiento de su pulsión".
El documento apunta que el estigma social que cargan históricamente a cuestas las personas con preferencias sexuales diversas (transgénero, bisexual, homosexual) ha dejado de ser una mera postura victimizante y se ha ¡do convirtiendo en motivo de lucha, de orgullo, en afirmación de la necesidad de ser y estar en la sociedad.
No obstante, refiere que la aparición del VIH-sida se suma a la estigmatización y el maltrato que persigue a las personas con preferencias sexuales diversas. Por otra parte, la mayoría de reglamentos cívicos municipales y estatales se refiere vagamente a "ultrajes a la moral pública o a las buenas costumbres", "escándalo público", "atentados al pudor", "exhibiciones obscenas". Esto expone a lesbianas, homosexuales, bisexuales y personas transgénero a sufrir abusos por parte de autoridades. La ambigüedad deja a la autoridad la interpretación para la aplicación de las leyes discrecionalmente.
El articulo 47 de la Ley Federal del Trabajo se refiere a actos inmorales cometidos por el o la trabajadora dentro del centro de trabajo como causa de rescisión de contrato; esto es aprovechado para justificar el trato discriminatorio hacia lesbianas, homosexuales, bisexuales y transgénero, e incluso el despido de sus empleos.
Los denominados "crímenes de odio" quedan en la impunidad. La mayoría de las veces se les califica de "crímenes pasionales" o "típicos de homosexuales", como si con ello se diera por entendido que no amerita impartición de la justicia. Esta concepción según lo establecido en el estudio ha logrado permear la percepción general del problema; se ha convertido en un prejuicio, y una huella clara de la discriminación que viola derechos fundamentales. Despido laboral, exclusión de sistemas de salud y justicia, rechazo familiar, arrebato de la patria potestad de hijos e hijas, maltrato físico y psicológico, abuso sexual, menosprecio, caricaturización y burla son apenas algunos de los componentes de actos discriminatorios contra homosexuales, bisexuales y personas transgénero.
Gabriela Molina Aguilar, diputada presidenta de la Comisión de Grupos Vulnerables, Equidad y Género del Congreso, recordó que en diciembre pasado el Congreso aprobó la ley para prevenir y eliminar la discriminación, en donde se contempla la tolerancia y el respeto a las personas que tienen una preferencia sexual distinta a la heterosexual.
"Sin embargo el gran pendiente que tenemos es que se cree el Consejo para Prevenir y Eliminar la Discriminación y la Violencia porque será el organismo responsable de operar y hacer cumplir la norma".
La legisladora lamentó que por el día y hora en que se aprobó esta ley (la última sesión del Congreso en 2008) ya no se pudo garantizar un presupuesto etiquetado para el consejo, "sin embargo en este año vamos a trabajar para que el consejo tenga recurso y que la ley tenga el instrumento para su operación".
Para el 2001 el Instituto Federal Electoral y la Secretaría de Gobierno dieron a conocer los resultados de la Encuesta Nacional de Cultura Política y Prácticas Ciudadanas, en la que se reporta que el 66 por ciento de los mexicanos no compartiría techo con una persona homosexual.
Otros datos se pueden observar en la Encuesta Nacional de Juventud realizada por la SEP y el Instituto Mexicano de la Juventud, en donde se establece que el 71 por ciento de los jóvenes mexicanos no apoyaría los derechos homosexuales.
Por si fuera poco, en el 2004 el Instituto Nacional de Salud Pública reportaba que el 66 por ciento del personal de salud de hospitales públicos manifestó estar de acuerdo en aplicar la prueba obligatoria del VIH a todos los homosexuales como una medida de control de la epidemia.
Entre 1995 y el 2003 la estadística oficial señala mil ejecuciones de homosexuales en el país; en la actualidad el 70 por ciento de la comunidad gay considera que la homofobia en México va en aumento.
De acuerdo con la Primera Encuesta sobre Discriminación en México (Conapred), el 36 por ciento de las discriminaciones ocurre en el hogar, de esas víctimas, el 59 por ciento asegura haber recibido agresiones verbales, el trece por ciento fue echado de su casa, el seis por ciento recibió agresiones físicas.
El 70 por ciento de los homosexuales considera que la discriminación contra ellos ha aumentado.

Morelia, Michoacán- In spite of the fight that homosexuals, lesbians and transgender individuals have made for their rights in our country, Mexico is still a country where sexual diversity is seen as a very polarizing subject.
This June 25th is the celebration of Worldwide Sexual Diversity Day, but despite the days for tribute and reflection the calendar is packed with, discrimination and rejection are still the norm for those who have decided to openly accept their sexuality.
A study on sexual diversity in Mexico carried out by the National Institute for Women shows that this is a very controversial topic under the obvious implications: freely practicing one’s sexuality and developing as a person from a physical, political and sexual perspective different from the socially established expectations.
“Many parents’ greatest fear is still that their sons and daughters will some day exercise their sexuality openly like they’ve always wanted to. Many people can’t stand the idea of men kissing and touching other men, or sharing things with women like make up, a wardrobe, postures, gestures and desires; or the idea of two women living together and forming a couple by themselves, or the idea that someone chooses to fill their instinctual urges by fully enjoying the sexuality of both men and women.”
The document shows that the social stigma people with different sexualities (transgender, bisexual, homosexual) have had to bear has ceased to be reason for one to play the role of a victim and has become a reason to fight proudly for the need to exist and have a place in society.
Nevertheless, it mentions that the appearance of HIV and AIDS increases the stigmatization and mistreatment that haunts those with different sexual preferences. On the other hand, most municipal and state civil laws vaguely reference “insults to public morality or upstanding customs,” “public scandals,” “offenses against public decency,” and “obscene displays.” This puts lesbians, homosexuals, bisexuals and transgender individuals at risk of suffering abuse at the hands of authorities. This ambiguity leaves the individual authority at his or her own discretion to interpret how these laws should be applied.
Article 47 of the Federal Labor Law refers to immoral acts committed by a worker at the place of work as just grounds for termination. This Article is used to discriminate against lesbians, homosexuals, bisexuals and transgender individuals and may even be used to fire them.
“Hate crimes” are still committed with impunity. These are usually judged to be “crimes of passion” or “typical of homosexuals,” as if that meant that the situation does not warrant justice. According to the results of the study, this idea has seeped into the general public’s view of the problem; it has become a form of prejudice, clear evidence of discrimination and violation of people’s fundamental rights. Being fired, excluded from healthcare and the legal system, rejection by one’s family, loss of parental rights over sons and daughters, physical and psychological abuse, sexual abuse, scorn, stereotyping and ridicule are some forms of discrimination against homosexuals, bisexuals and transgender people.
Gabriela Molina Aguilar, deputy president of Congress’s Commission for Groups at Risk, Equality and Gender states that last December, Congress passed a law to prevent and eliminate discrimination, which included tolerance and respect for those who have non-heterosexual preferences.
“Nevertheless, the big issue we still have is that the Counsel for the Prevention and Elimination of Discrimination and Violence believes that it should be in charge of handling and enforcing this law.”
The legislator laments that because of when the law was passed (during Congress’s final session of 2008), a proper budget couldn’t be set for the group. “This year however, we are going to work hard so that the Counsel gets the resources it needs to be effective.”
For 2001, the Federal Electoral Institute and Government Secretary presented the results of the National Survey on Political Culture and Citizen Practices, which showed that sixty-six percent of Mexicans would not live with a homosexual person.
The National Youth Survey carried out by the SEP and the Mexican Youth Institute showed that seventy-one percent of young Mexicans would not support rights for homosexuals.
As if that weren’t enough, in 2004 the National Public Health Institute reported that sixty-six percent of public hospital staff were in favor of mandatory HIV testing for all homosexuals as a way to control the epidemic.
Between 1995 and 2003, official statistics show around one thousand executions of homosexuals in the country. Seventy percent of the gay community currently considers homophobia in Mexico to be on the rise.
The First Survey on Discrimination in Mexico (Conapred) indicates that thirty-six percent of the cases of discrimination occur at home. Out of these victims, fifty-nine percent of them reported verbal aggression, thirteen percent had been thrown out of their homes and six percent were victims of physical aggression.
Seventy percent of homosexuals consider the discrimination they face to be increasing.

El perfume encierra en su frasco un cóctel de fragancias y esencias naturales con propiedades que influyen en la personalidad. Como en México conviven mundos tan dispares como el de los transexuales de las calles o las familias que acuden a misa cada domingo, indica Ubaldo, perfumista de oficio a sus 34 años, licenciado en Arquitectura y un enamorado de su país y de sus hombres.
Este mexicano pertenece a la llamada generación X aquellos que conocieron de primera mano toda una serie de cambios tecnológicos, como los primeros compact disk o las primeras videoconsolas; y sociales, como la perdida del poder eclesiástico en la sociedad o el desarrollo educativo alrededor del mundo. 'El saber y el conocer era muy importante durante los años en los que curse la secundaria. Era una manera de aprender y crecer en los valores moralistas. La familia, el amor, el respeto, la solidaridad o el liderazgo dejando atrás el machismo extremista de los años 40 y 60", asevera Ubaldo.
De esta forma se comenzaba a abrir el camino a la igualdad entre hombres y mujeres que, por otra parte, aún no se ha conseguido en el vasto territorio del país latinoamericano. Pese a estos avances la homosexualidad se consideraba un absoluto tabú en la sociedad mexiquense. Cuando se velan dos hombres besándose en la callo, si se les vela, se les apaleaba y apalea hoy en día. Si en la televisión salla un personaje gay, no tardaba en oírse: 'Ya faltaba el puto'. "Y cada uno de estos referentes son los que hacen que pese a que siempre hayas sabido que eres homosexual tardes años y en años hasta exteriorizarlo. Por ello tuve mi primera experiencia sexual a la tardía edad de 25 años. No sé muy bien nada de aquel chico. Nos conocimos en un café. Simplemente él me abordó y surgió la chispa que nos llevó al lecho. Es ahí cuando tomé conciencia absoluta de cómo era mi situación y de cómo iba a vivir mi vida. Tal y como soy", afirma el perfumista.
Asi mismo, es curioso como si a los mexiquenses no se les permite mostrar su atracción por una persona do un mismo sexo, no pasa lo contrario con los gueritos -palabra con la que se conoce a los extranjeros en México. Porque como dice el dicho popular del país de Pancho Villa: 'Como te ven te tratan", es decir, 'si eres americano o europeo nadie se mete contigo o con tu chico al veros juntos, porque ellos son gays aceptados por su sociedad y aquí siempre ha habido y habrá malinchismo, una extraña preferencia de lo extranjero frente a lo nacional en todos los ámbitos sociales; sentencia Ubaldo.
Destino Europa
José Luís es un mexicano de 26 años afincado en la localidad de Toluca junto a su familia que proviene del norte del país. En este lugar dedica su vida a un ámbito tan liberal como es el periodismo dentro de la televisión Pública Mexiquense, manejando a diario la agenda de Felipe Calderón, Presidente de México, dentro de sus principales tareas. Quizás gracias a moverse entre círculos sociales más abiertos al México de la calle, del pueblo, ha podido hacer pública su orientación sexual tanto en su casa, como en su trabajo. 'He dicho siempre como era. No me ha importado lo que la gente pudiera decir. Pero entiendo que haya personas que no lo hagan cuando esto implica poder recibir palizas, no ser admitido en una escuela o incluso, en casos extremos, que lleguen a matarte", afirma el periodista.
Asi mismo, portales como: Manhunt literalmente traducido al Castellano como 'cazador de hombres', se han convertido en los ciber lugares de encuentro de todas estas personas en busca de sexo, porque muy pocos se plantean la posibilidad de una pareja por la dificultades sociales que ello supone.
De esta forma, el simple hecho de quedar para hablar o tomar un café por medio de este portal de contactos implica a primeras un pacto implícito para coger, verbo utilizado en México para describir la acción de tener sexo. Asi es la parte rural del país a contrapartida de la Zona Rosa en el la ciudad de México DF, muy semejante al barrio español do Chueca. Allí puedes besarte o agarrarte de la mano sin miedo a que to vaya a pasar nada. Quizás sea uno de los pocos lugares en el país donde puedes hacerlo", indica José Luís. Por ello el joven desea fijar su próxima residencia en España. 'Ahí está la libertad que persigo, el cambio de aires que necesito y el hogar de mis antepasados al que yo quiero regresar", sentencia el joven.
Sólo ser yo
David tiene 18 años y proviene de una mezcolanza de culturas. Su padre es judío, su madre católica y su hermano ateo. Por lo que en su casa siempre has existido un espacio y lugar para todo tipo de creenciencias, como para el diálogo. 'He tenido demasiada libertad en mi vida. En mi educación, en mi forma de pensar, en mi ocio. Es más, nunca me han dicho en qué Dios creer Y todo esto ha provocado que sea yo el que haya tomado las decisiones en mi vida, tanto con mis errores, como con mis aciertos", subraya el joven.
Con esta premisa David decidió quedar a la edad de 15 años con un chico cinco años mayor que él, que habla conocido en una página de contactos, para tener sexo. Esta seria la manera do descubrirse y de reafirmar lo que siempre creyó. Su homosexualidad. 'La experiencia no fue para nada satisfactoria. Me sentía mal. Me sentía culpable por haber hecho lo que hice. Porque eso era lo que habla visto a mi alrededor. Que la posibilidad de que dos hombres tengan relaciones sexuales es algo inconcebible. Por lo que opte por contárselo a mi madre. La que no me lo recrimino, sino me hizo sentirme mejor", revela el chaval.
Durante los siguientes tres años David prosiguió sus estudios al considerar que es su faceta académica su principal meta, por lo que a día de hoy cursa en una de las universidades mexicanas más prestigiosas una ingeniería industrial. "Porque estudiar, viajar, conocer gente, conocer ideas diferentes a las mías son lo que necesitaba para darme cuenta que no hay nada de malo en mi orientación sexual. Estoy muy bien tal y como soy. Ahora sólo espero el amor en la vida y poder compartido con mi familia y todos los míos", asegura un orgulloso muchacho.
Asi pues, con jóvenes como David se puede augurar que antes o después caerá el muro de la intolerancia que aún se cierne en el México del siglo XX!. Porque tal y como decía Miguel de Unamuno: "A veces, el silencio es la peor mentira".

This includes things like the first compact discs and the first VCRs, as well as social changes like the declining power of the Church in society and the progress of education throughout the world. “Knowing and understanding were very important during the years I was in high school. It was a way to learn and grow in one’s morals. Family, love, respect, solidarity and the leadership in leaving behind the extreme macho mentality of the ‘40s and ‘60s,” stresses Ubaldo.
“This is how a path began to open towards equality for men and women. Of course, this path has yet to be completed throughout the vast territory of this Latin-American country. Despite these advances, homosexuality is still considered an absolute taboo in Mexico City’s society. In the past, when you saw two men kissing in the street, if you saw them, they got beaten. The same thing happens today. If there was a gay character on TV, you would always hear, ‘Oh great, like we need a fag.’ And every reference like that meant that, even though you had always known you were homosexual, it would now take even longer for you to come out and be open about it. That’s why my first sexual experience didn’t even occur until I was 25. I don’t really know anything about that guy. We met in a cafe. He just came up to me and there was a spark and we ended up in bed. That’s when I really became aware of my situation and started thinking about how I was going to live my life. As me, and nobody else,” says the perfumist.

To Just Be Me
David is 18 and comes from a wide assortment of different cultures. His father is Jewish, his mother Catholic and his brother and Atheist. This meant that in their home, there was always a place for all types of beliefs and for dialogue as well. ”I’ve had too much freedom in my life. In how I was educated, in my way of thinking, in my job. What’s more, they never told me what God I believe in. All of this has led me to be the one who made the decisions in my life, both the right ones and the wrong ones,” stresses the young man.
Under this premise, at the age of 15 David decided to be with a guy five years his senior who he had met on a classified ads page for sex. This was how he would find himself and reaffirm what he had always known. He was homosexual. “The experience wasn’t satisfying at all. I felt bad. I felt guilty for having done what I’d done. Because that’s what I’d grown up with. The idea of two men having sexual relations was something inconceivable. That’s why I decided to tell my mom. She didn’t condemn me. She actually made me feel better,” he reveals.
Over the next three years, David continued his studies and saw education as his main objective. This led him to one of Mexico's most prestigious universities where he is currently studying industrial engineering. “It’s because studying, travelling, meeting people and being exposed to ideas different from my own were what I needed to realize that there is nothing bad about my sexual orientation.
