New arbitration law in Poland
Party autonomy is the overriding rule subject only to safeguards necessary for the public interest and specified in mandatory legal provisions, such as the independence of arbitrators and the principle of contradiction and equality of treatment. In this context, the deletion of the previous Article 1105 § 2 of the Civil Procedure Code can serve as an example of positive changes. That anachronistic provision stopped parties domiciled or having their registered office exclusively in Poland from effectively submitting their dispute to a foreign arbitration tribunal. Two key provisions expressly refer to a situation where the place of arbitration is outside of Poland. First, an action brought before a court in a matter which constitutes the subject of a valid arbitration agreement shall be rejected by the court if a party so requests not later than when submitting its first statement on the substance of dispute, unless the agreement is null and void, inoperative, or incapable of being performed as well as where the arbitration court decides that it is not competent. Second, submitting a dispute to arbitration does not exclude the possibility of a court applying an interim measure in respect of the subject matter of the dispute.
Awards are final, subject to being set aside on specific limited grounds. Recourse to a court against an arbitral award rendered in Poland may be made by a complaint based exclusively upon grounds set forth in the new provisions. The deadline for making a complaint is three months from the date a party received the award, and the court may suspend the set-aside proceedings.

Wysokościowce w Warszawie – konieczność, świadomy wybór czy przypadek?

Wstęp
Pałac Kultury i Nauki, kiedyś imienia Stalina, był pierwszym prawdziwym wieżowcem Warszawy. Budynek o wysokości 241metrów, zbudowany w 1955 r. zdominował Warszawę i jej Centrum, na zawsze być może, symbolizując rosyjską dominację. Dla wszystkich kolejnych prób planowania i ich szczątkowych realizacji Pałac był i jest punktem odniesienia.
Już w latach 60-tych powstały pierwsze próby obłaskawienia tego giganta w projektach tzw. ścian wschodnich i zachodnich Centrum Warszawy. Idea przesłaniania Pałacu od Zachodu utrwaliła się najbardziej i właściwie jest realizowana.
Od połowy lat 90-tych, obawa przed naruszeniem zasad architektury Pałacu ograniczyła w oczach planistów i polityków wysokość nowych wieżowców do 140 m (Elektrim, Marriott, WFC). Zmiany polityczne po 1989 r. oraz stopniowe zwiększanie udziału mniej skażonych historią urbanistów spowodowała rozluźnienie tych rygorów (Rondo 1, Daewoo - Warsaw Trade Tower – 190-200m).
Pozostała oczywiście kwestia samego Centrum, którego przyszłe zagospodarowanie jest okazją do całkowitego otoczenia i przesłonienia Pałacu „koroną” wieżowców.
Pierwszy miejscowy plan tego terenu z 2006 r. kształtował tradycyjne zasady tworzenia europejskiego Miasta, bez wieżowców. Kolejne plany natomiast oraz inne działania obecnych władz umożliwiają budowę nowych wieżowców, w zasadzie bez ograniczeń lokalizacyjnych czy wysokościowych.
„Światem rządzi chaos”
To wypowiedź jednego z najważniejszych warszawskich polityków. W trzech słowach oddaje ona przekonanie władz o bezsensowności planowania i świadomego kształtowania przestrzeni. Co więcej cnotą staje się wspieranie wszystkich inicjatyw deweloperskich, pozornie dla dobra rozwoju, a w rzeczywistości wyłącznie dla umożliwienia niektórym deweloperom osiągania zysków. W tej sytuacji dyskusja o konkretnych realizacjach bądź architekturze planowanych inwestycji staje się coraz bardziej powierzchowna. Należy więc zauważyć, że takie właśnie podejście warszawskich władz do kwestii planistycznych odzwierciedla znacznie szersze zjawisko. Wiara w istnienie wartości zostaje zastąpiona wiarą w wolny rynek. Dążenie do często bardzo krótkofalowych zysków, powodujących nawet straty w przyszłości, zastąpiło zdroworozsądkowe planowanie.
Taka ideologia zdejmuje z polityków odpowiedzialność za wspólną przestrzeń a społeczeństwo czyli wyborcy mogą jedynie konfrontować się z efektami, pełni zachwytu, zdumienia bądź grozy.
Przestrzeń publiczna
Jednym z efektów tej, niszczącej miasto, działalności jest zanik przestrzeni publicznej. Żaden z warszawskich placów nie jest godny nazywać się placem. Rozwój komunikacji samochodowej oraz brak zainteresowania władz przekształciły wszystkie place Warszawy w centra ruchu drogowego a nie życia publicznego.
Niewidzialna ręka rynku jest w sferze przestrzeni publicznej rzeczywiście niewidzialna. I nie jest to przypadek tylko konsekwencja aktualnej ideologii.
Wieżowce w Warszawie
Wieżowiec jako wyłączny eksponent dążeń dewelopera nie stanowi remedium na wszystkie bolączki.
Budowa wieżowca kosztuje co najmniej dwa razy więcej niż bardziej tradycyjnych budynków. Tylko tam gdzie czynsze najmu są wystarczająco wysokie będzie się opłacało budować wieżowce biurowe. Dotyczy to również apartamentowców. Tylko tam, gdzie wartość mieszkania przekracza dwukrotność średniej będzie się opłacało budować wieżowce. Te ograniczenia spowodują, że większość planowanych wież nie powstanie tak szybko. Wręcz odwrotnie. I paradoksalnie, twarde warunki rynkowe a nie świadomość obywatelska będą regulatorem rozwoju. W najlepszym razie.
W tak przez los dotkniętym mieście, zrujnowanym przez wojnę i przez komunistyczne quazi-planowanie, jest to sytuacja co najmniej przykra. Uniemożliwiającą wykorzystanie istniejących możliwości – patrz np. na niezabudowaną przestrzeń wokół Pałacu Kultury – dla stworzenia nowego, przyjaznego, modelowego wręcz Centrum Warszawy.
Prymitywny zachwyt praktyków, marzących o Manhattanie nad Wisłą oraz naturalne zachowanie żądnych zysków deweloperów mogą doprowadzić do zniszczenia fragmentów Śródmieścia poprzez zbyt ekstensywną zabudowę. Ten niestety słabo zrównoważony rozwój będzie również miał negatywny wpływ na resztę miasta, pozostającą często bez rozwiniętych centr dzielnicowych ale za to z zatłoczonym centrum

Sky-raisers in Warsaw – necessity, purposeful choice or an accident?



Introduction

The Palace of Culture and Science, formerly named after Stalin, was the first high-rise in Warsaw. The 241m high building, built in 1955 has dominated Warsaw and its city, maybe even for ever, symbolizing the Russian domination. It has became a landmark for all next attempts of planning and their partial realization.
Already in 60-ties first attempts of taming this giant were undertaken by designing development of so called the East and the West walls. The idea of concealing The Palace from the West has been mostly established and practically is being carried out until now.

Since mid 90-ties the planners' and politicians' concern about not violating the principals of The Palace architectural outlines has limited the hight of new skyscrapers to 140m (Elektrim, Marriott, WFC). Political changes after 1989 and gradually growing contribution of planners less influenced by the history resulted in loosening of these limitations. (Rondo 1, Daewoo - Warsaw Trade Tower – 190-200m).

There is still open a question of the very city Centre. Its future arrangement creates the occasion to thoroughly surround and conceal The Palace with “the crown” of towers.

First local arrangements plan for this area made in 2006 outlined traditional principles of the modern European City without sky-raisers. Whereas subsequent plans together with other activities of current authorities enable developing new towers, in principle, without any limitations concerning location or hight.

“The World is ruled by The Chaos”

These are the words of one of the most crucial Warsaw politicians. These few words depict the authorities conviction of senselessness of planning and purposeful space arrangement. What is more, supporting all developers' initiatives becomes the virtue, seemingly for the sake of development but in real, exclusively, of enabling some developers to yield a profit. In this situation the discussion about specific projects or the architectural design of planned investments becomes more and more superficial. It has to be noticed that such an approach of Warsaw authorities to urban planning mirrors considerably wider phenomenon. The faith in existing values is substituted for the faith in free market. Striving for often transient profits, which may even cause loss in future, was substituted for common sense planning.

Such ideology removes from politicians the responsibility for common space and society as voters may only confront the effects in overwhelming, amazement or horror.



Public space

One effect of this city devastating activity is disappearance of public space. None of Warsaw squares deserves to be called a square. The increase of traffic together with lack of the authorities interest changed all Warsaw squares into traffic centres instead of leaving them as public life places.

Laissez faire, non-interference doctrine, does not really interfere with the sphere of public space. And this is not the coincidence but the consequence of current ideology.

Sky-raisers (Tower blocks) in Warsaw

Sky-raiser as an exclusive exhibitor of developer's aspirations is not a panacea for all problems.

Sky-raisers development costs twice as much as more traditional buildings. Only if the rental is high enough, the commercial offices building will be cost-effective. The same refers to apartment blocks. Only where the apartment's value accedes by the double medium prise the high-rise building will be profitable. These limitations will cause most of the planned tower buildings not to be raised so quickly. Just the opposite. Moreover, paradoxically, tough market rules instead of citizens awareness will be, at the best, the development moderator.

In such a fate driven city, destroyed by the war and communist quasi-planning, the situation is very sad at the least. It precludes exploiting existing means – vide empty space surrounding The Palace of Culture – to create the new, friendly, simply model Warsaw Centre.

The primitive admiration of practitioners dreaming of the Manhattan at the Vistula river bank and the natural behaviour of developers greedy for profits are likely to devastate parts of the City Centre via too extensive development. This unfortunately weakly balanced growth will also negatively influence the rest of the Town, very often left without developed district's centres, however with overcrowded district's hearts.
