Source text - Greek Λίγο πριν τους Ολυμπιακούς Αγώνες της Αθήνας προχώρησε, στην εισαγωγή αυτοτελούς ρύθμισης για την τρομοκρατία μέσω των άρθρων 40-42 του νόμου 3251/2004, την οποία παρενέλαβε ως άρθρο 187Α ΠΚ στις ρυθμίσεις για το οργανωμένο έγκλημα. Πέρα από μια κακώς νοούμενη επιβεβλημένη ανταπόκριση στις επιλογές της απόφασης πλαίσιο (Framework Decision 2002/475/JHA), ρυθμίστηκαν τελικά τα σχετικά με την τρομοκρατία, αλλά και έμειναν ανέπαφες οι ρυθμίσεις για το οργανωμένο έγκλημα οι οποίες ισχύουν παράλληλα προκαλώντας σύγχυση για το ποιες ρυθμίσεις είναι εφαρμοστέες τελικά
Το τρομοκρατικό αδίκημα κατά το άρθρο 187Α παρ. 1 ΠΚ μπορεί να τελείται τόσο από μια οργάνωση όσο και από ένα άτομο. Ωστόσο κρίνεται ότι η δυνατότητα μιας πράξης να βλάψει σοβαρά τη χώρα, πρέπει να συναρτάται με επιπλέον στοιχεία, από τα οποία προκύπτει η αυξημένη επικινδυνότητα της. Οι όροι αυτοί προκύπτουν από την ύπαρξη μιας δομής, μιας οργάνωσης που θα στηρίζει τη τέλεση των τρομοκρατικών πράξεων. Διαφορετικά παραβιάζεται τόσο η αρχή της αναλογικότητας, όσο και η αρχή της νομιμότητας.
Περαιτέρω, για την οριοθέτηση του τρομοκρατικού εγκλήματος, ο νομοθέτης επιλέγει να χρησιμοποιήσει εξαιρετικά αόριστες έννοιες. Το έγκλημα οριοθετείται με ένα μόνο αντικειμενικό στοιχείο, τη δυνατότητα να προκληθεί σοβαρή βλάβη στη χώρα ή ένα διεθνή οργανισμό και ένα υποκειμενικό στοιχείο, το σκοπό δηλαδή του δράστη να εκφοβίσει σοβαρά έναν πληθυσμό, να εξαναγκάσει μια δημόσια αρχή ή να καταστρέψει θεμελιώδεις δομές μιας χώρας ή ενός διεθνούς οργανισμού. Τα στοιχεία που διακρίνουν την τρομοκρατική πράξη δεν μπορούν να προσδιοριστούν επαρκώς, γιατί δεν είναι σαφές πότε μια μεμονωμένη πράξη μπορεί να θεωρηθεί ότι τελείται με τρόπο, σε έκταση ή υπό συνθήκες τέτοιες, ώστε να μπορεί να βλάψει σοβαρά μια χώρα ή ένα διεθνή οργανισμό.
Translation - English TERRORISM
Shortly before the Athens Olympics it proceeded to the introduction of independent regulation on terrorism by means of articles 40-42 of Law 3251/2004, which it included as Article 187Α of Penal Code in the arrangements for organised crime. Aside from a poorly understood imperative response to the choices of the Framework Decision (2002/475/JHA), arrangements were finally made concerning terrorism, while the arrangements concerning organised crime remained intact. This resulted in confusion as to which arrangements are eventually to be applied.
According to Article 187A (1) of Penal Code, the crime of terrorism can be committed by both a party and a single person. However, it is considered that the possibility of an act to seriously harm the country should be related to additional data, which can demonstrate its increased risk. These conditions arise from the existence of a structure, an organisation which will support the commission of terrorist acts. Otherwise, both the principle of proportionality and the principle of legality are violated.
Furthermore, in order for terrorism offense to be defined, the legislature chooses to use extremely vague concepts. Crime is only defined by single objective evidence – the possibility of severely damaging the country or an international organisation, and by single subjective evidence – i.e. the intention of the offender to seriously intimidate a population, to force a public authority or to destroy fundamental structures of a country or an international organisation. The evidence distinguishing an act of terrorism cannot be sufficiently determined, because it is not clear if a single act may be regarded as being committed in such a manner, to such an extent or under such circumstances, as to seriously damage a country or an international organisation.
