If, from year to year during the term of this Agreement, there has been any substantial change in the economic or technical circumstances relating to the Agreement, not exhaustively including increases of costs of commodities, production, development, transport and/or storage, and such change might cause economic hardship which the Master Distributor could not reasonably have been expected to have taken into account at the time of the conclusion of this Agreement and which it could not reasonably have avoided, then the Master Distributor reserves the right to increase the prices of the Products and/or the Other Products set forth in Schedule A provided that such price increases are duly motivated by the Company and/or the Master Distributor. In such case, the Product Pricing as set forth in Schedule A will be amended. A written notification of intent to increase the Product Pricing, together with the amended Schedule A, must be delivered to the Distributor at a minimum of fifteen (15) days before the application of the increased prices.

В случае если на протяжении срока действия настоящего Соглашения произойдут какие-либо существенные изменения в экономической или технической ситуации, имеющей отношение к Соглашению, включая, среди прочего, повышение стоимости сырьевых товаров, производства, разработки, транспортировки и/или хранения, каковые изменения могут привести к возникновению экономических сложностей, которые Мастер-дистрибьютор не мог предвидеть на момент заключения настоящего Соглашения, и которых он не мог избежать, Мастер-дистрибьютор сохраняет за собой право повысить цены на Продукцию и/или Прочие продукты, указанные в Приложении A, при условии, что такое повышение цен будет должным образом обосновано Компанией и/или Мастер-дистрибьютором. Поручитель вправе отказать Кредитору в удовлетворении его требования, если это требование, либо приложенные к нему документы не соответствуют положениям настоящего договора, либо представлены Поручителю после прекращения поручительства. Поручитель обязан уведомить Кредитора об отказе удовлетворить его требование в течение двух рабочих дней после получения указанного требования. В случае неполучения Кредитором письменного отказа Поручителя в предусмотренный настоящим договором срок, считается, что Поручитель полностью и безоговорочно согласился с требованием Кредитора.
4.6. С момента получения письменного требования Кредитора о погашении просроченной задолженности или требования о досрочной уплате невыплаченной Должником общей суммы Генерального соглашения об аренде, Поручитель обязуется без предварительного письменного согласия Кредитора не отчуждать и не обременять имущество, принадлежащее Поручителю, не заключать сделок по получению Поручителем займов и кредитов, а также предоставлению новых поручительств до исполнения в полном объеме полученного требования Лизингодателя.
4.7. Если Поручителю до удовлетворения требования Кредитора стало известно, что обязательства Должника по Генеральному соглашению об аренде полностью или в соответствующей части уже исполнены, прекратились по иным основаниям либо недействительны, он обязуется немедленно сообщить об этом Кредитору и Должнику.
Translation - English 4.5. The Surety may deny the Lender's claim where such claim or the supporting documents attached thereto fail to comply with this Agreement or have been filed after the termination of the surety. The Surety shall notify the Lender of the denial of its claim within two working days of such claim. In case no written denial has been received by the Lender from the Surety within the period of time provided for herein, the Surety shall be deemed to have fully and irrevocably admitted the Lender's claim.
4.6. Starting from the time of receipt by the Surety of the Lender's written demand for repayment of the overdue debt or demand for early payment of the total amount of the General Lease Agreement not yet paid by the Borrower, the Surety shall not alienate or encumber the property owned by it or enter into any transactions to receive any credits or loans or provide any new surety without the Lender's prior written consent until the Lessor's claim is satisfied in full.
4.7. Should the Surety become aware, prior to the satisfaction of the Lender's claim, that the Borrower's obligations under the General Lease Agreement have been performed either in full or in the respective part, cancelled due to other reasons, or are void, it shall immediately notify the Lender and the Borrower to that effect.

постановляет:
1. Обратить внимание судов на то, что уголовная ответственность за преступления, предусмотренные статьей 296 Уголовного кодекса Республики Казахстан (далее - УК) наступает лишь в случае, если нарушение правил дорожного движения или эксплуатации транспортных средств повлекло за собой последствия в виде неосторожного причинения тяжкого вреда здоровью человека, либо смерть одного или более лиц.
При этом наступившие последствия должны находиться в непосредственной причинной связи с допущенными нарушениями правил дорожного движения или эксплуатации транспортных средств.
Иные нарушения правил дорожного движения или эксплуатации транспортных средств, не повлекшие указанные последствия, могут влечь дисциплинарную, гражданско-правовую или административную ответственность.
Translation - English In connection with the questions that arose in the judicial practice in the consideration of motor transport offence cases, and for the purpose of correct and uniform application of the law in the cases belonging to this category, the plenary session of the Supreme Court of the Republic of Kazakhstan
has resolved that:
1. It should be brought to the courts' notice that criminal responsibility for the offences under article 296 of the Criminal Code of the Republic of Kazakhstan (hereinafter - the Criminal Code) shall only be incurred when the violation of the road traffic or vehicle operation rules has entailed consequences in the form of serious bodily injuries or death of one or more persons caused through negligence.
With that, the consequences that ensued must be in direct causal connection with the committed violations of the road traffic and vehicle operation rules.
Other violations of the road traffic or vehicle operation rules that did not entail the aforesaid consequences may result in disciplinary, civil or administrative responsibility.

При цьому ефективним засобом слід розуміти такий, що призводить до потрібних результатів, наслідків та дає найбільший ефект. Європейський суд з прав людини у рішенні від 29.06.2006 року у справі «Пантелеєнко проти України», зазначив, що засіб юридичного захисту має бути ефективним, як на практиці так і за законом. У рішенні від 31.07.2003 року у справі «Дорани проти Ірландії» Європейський суд з прав людини зазначив, що поняття «ефективний засіб» передбачає запобігання порушенню або припиненню порушення, а так само встановлення механізму відновлення, поновлення порушеного права. В рішенні від 17.07.2008 року у справі «Каіч та інші проти Хорватії» зазначено, що для Конвенції було б неприйнятно, якби стаття 13 декларувала право на ефективний засіб захисту але без його практичного застосування. Таким чином, обов’язковим є практичне застосування ефективного механізму захисту. Протилежний підхід суперечитиме принципу верховенства права. Враховуючи викладене, держава повинна забезпечити особі реальний, ефективний засіб юридичного захисту та, як наслідок відновити порушене право особи.
Translation - English As stated above, Art. 13 of the Convention provides that the Contracting States must secure the availability of an effective remedy in their legal systems. At the same time, an effective remedy must be understood as a remedy that leads to the desired results, consequences, and has the greatest effect. In its Judgment of 29/06/2006 in Panteleyenko v Ukraine, the European Court of Human Rights states that the remedy must be "effective" in practice as well as in law. In its Judgment of 31/07/2003 in Doran v Ireland, the European Court of Human Rights states that remedies are considered "effective" if they prevent the alleged violation or its continuation, or provide adequate redress for any violation that has already occurred. The Judgment of 17/07/2008 in Kaić and Others v Croatia reads that it would be inconceivable that Article 13 provided the right to have a remedy, and for it to be effective, without protecting the implementation of remedies afforded. Thus, the implementation of remedies is indispensable. To hold the contrary would contradict the principle of the rule of law. Given the above, the state must provide a person with a real and effective remedy and, consequently, redress any violation of the person's rights.

Siemens PLM Software, a business unit of the Siemens Industry Automation Division and a leading global provider of product lifecycle management (PLM) software and services, today announced it has become a supplier of computer-aided design and engineering analysis (CAD/CAE) software to the Rocket City Space Pioneers (RCSP), a team of Huntsville businesses, academic institutions and non-profit organizations competing for the Google Lunar X PRIZE, a $30 million international competition to safely land a robot on the surface of the Moon, travel 500 meters over the lunar surface, and send images and data back to Earth. The RCSP team will use Solid Edge® software and Femap™ software with NX™ NASTRAN® software in the design and analysis process. Team leader of RCSP is Tim Pickens, who was also the lead propulsion engineer for the SpaceShipOne team which won the $10 million Ansari X PRIZE for private suborbital space flight in October 2004.
