1. Nach § 31 Abs. 1 SGB II verletzen erwerbsfähige Empfänger von Arbeitslosengeld II, die keinen wichtigen Grund für ihr Verhalten darlegen und nachweisen, ihre Pflichten, wenn sie sich trotz Rechtsfolgenbelehrung nicht an die Eingliederungsvereinbarung halten, wenn sie sich weigern, eine zumutbare Arbeit, Ausbildung, Arbeitsgelegenheit oder ein gefördertes Arbeitsverhältnis aufzunehmen, fortzuführen oder deren Anbahnung durch ihr Verhalten verhindern oder wenn sie eine zumutbare Maßnahme zur Eingliederung in Arbeit nicht antreten, abbrechen oder Anlass für den Abbruch gegeben haben. Rechtsfolge dieser Pflichtverletzungen ist nach § 31a SGB II die Minderung des Arbeitslosengeldes II in einer ersten Stufe um 30 % des für die erwerbsfähige leistungsberechtigte Person maßgebenden Regelbedarfs. Bei der zweiten Pflichtverletzung mindert sich der Regelbedarf um 60 %. Bei jeder weiteren wiederholten Pflichtverletzung entfällt das Arbeitslosengeld II vollständig. Die Dauer der Minderung beträgt nach § 31b SGB II drei Monate.
2. Das zuständige Jobcenter verhängte gegen den Kläger des Ausgangsverfahrens zunächst eine Sanktion der Minderung des maßgeblichen Regelbedarfes in Höhe von 30 %, nachdem dieser als ausgebildeter Lagerist gegenüber einem ihm durch das Jobcenter vermittelten Arbeitgeber geäußert hatte, kein Interesse an der angebotenen Tätigkeit im Lager zu haben, sondern sich für den Verkaufsbereich bewerben zu wollen. Nachdem der Kläger einen Aktivierungs- und Vermittlungsgutschein für eine praktische Erprobung im Verkaufsbereich nicht eingelöst hatte, minderte das Jobcenter den Regelbedarf um 60 %. Nach erfolglosem Widerspruch erhob er Klage vor dem Sozialgericht. Dieses setzte das Verfahren aus und legte im Wege der konkreten Normenkontrolle dem Bundesverfassungsgericht die Frage vor, ob die Regelungen in § 31a in Verbindung mit § 31 und § 31b SGB II mit dem Grundgesetz vereinbar seien.

According to Sec. 31a German Social Code Book II, the legal consequence of this breach of obligation is a reduction of unemployment allowance II, initially by 30% of the standard allowance (Regelbedarf) for eligible persons who are fit to work. After a second breach of obligation, the standard allowance is reduced by 60%. Unemployment allowance II is wholly discontinued upon each additional repeated breach of obligation. Under Sec. 31b German Social Code Book II, the reduction lasts for three months.
2. The responsible job centre initially imposed a sanction of reduction of the standard allowance by 30% on the Claimant in the main proceedings after he, a trained warehouse clerk, informed an employer with whom the job centre had connected him that he had no interest in the offered job in a warehouse, but wanted to apply for a sales job instead. After the Claimant failed to redeem an activation and placement voucher for a practical trial of a sales job, the job centre reduced the standard allowance by 60%. After unsuccessfully objecting, the Claimant filed suit before the Social Court. The Court suspended the proceedings and referred the question of whether the regulations of Sec. 31a, taken together with Sec. 31 and Sec. 31b German Social Code Book II, are compatible with the Basic Law to the Federal Constitutional Court for a concrete test of constitutionality.

Die Vorgänge der Emission der sichtbaren und der ihnen benach-barten ultraroten und ultravioletten Strahlen zerfallen in zwei wesentlich verschiedene Klassen, erstens diejenige, bei welcher die ausgesandte Strahlung lediglich von der Temperatur abhängt, die sogenannte „reine Temperaturstrahlung“, zweitens diejenige, bei welcher die Temperaturkeine wesentliche oder doch nicht die einzig wesentliche Rolle spielt; letztere, die man als „Luminiszenz“ bezeichnet, spielt bei unseren jetzigen Betrachtungen einstweilen keine Rolle.
Das Gebiet der Temperaturstrahlung ist ein sehr großes; es umfaßt z. B. alle Vorgänge, von denen man in den künstlichen Leuchtquellen als Lichtquelle Gebrauch macht; die Licht- und Wärmestrahlung, die von der Sonne zur Erde durch den Weltenraum gelangt und die Quelle aller Bewegung und alles Lebens auf der Erde ist, stellt uns den zubesprechenden Vorgang wohl im größten und schönsten Maßstabe dar.
Wenn wir einen Körper erwärmen, z. B. mit Hilfe einer Flamme, so wird seine Temperatur stetig immer höher. Wir denken uns den Vorgang so, daß die Moleküle des Körpers in immer heftigere Bewegung geraten. Äußerlich verrät sich dies bei festen und flüssigen Körpern durch die räumliche Ausdehnung; dem Gefühl verrät sich die Wirkung durch das Auftreten eines mit unseren Gefühlsnerven wahrnehmbaren Agens, das wir als Wärme bezeichnen. Bei Gasen zeigt sich ebenfalls eine noch relativ stärkere Volumvergrößerung oder bei konstant gehaltenem Volumen ein wachsender Druck; das Maß für die Heftigkeit der hypothetischen Bewegung der einzelnen Moleküle oder ihre lebendige Kraft ist die Temperatur. Ich erinnere hier an die Erörterung der Grundgedanken der kinetischen Theorie der Gase.
Wenn ein Körper über eine bestimmte Temperatur erhitzt wird, so beginnt er meist eine dem Auge sichtbare Strahlung auszusenden, und zwar glüht er bei etwa 525◦ rot, bei 1000◦ gelb, bei 1200◦ weiß. Er sendet dann außer den Wärmestrahlen auch Lichtstrahlen aus. Man nennt diesen Vorgang „Emission“. Umgekehrt erwärmt sich ein Körper, wenn Licht- oder Wärmestrahlen auf ihn auftreffen. Hierbei zeigen sich sehr charakteristische Unterschiede; erfahrungsgemäß weiß jeder, daß dunkle Körper bei gleicher Bestrahlung ungleich mehr davon aufnehmen, weiße dagegen viel mehr zurückwerfen; ersteren Vorgang nennt man Absorption, letzteren Reflexion. Bei sehr tiefen Temperaturen kann gleichwohl die Erwärmung durch die Strahlung sehr hohe Werte annehmen; ich erinnere an Bergtouren im Winter.
Translation - English We begin with a short overview of the historical development of the theory of radiation. The processes of emission of visible and its neighbouring infrared and ultraviolet radiation fall into two fundamentally different classes: first, those in which the emitted radiation depends only on the temperature, called “pure thermal radiation,” and second, those in which temperature does not play a significant role or does not play the only significant role. The latter, called “luminescence,” will play no role in our considerations for the time being.
Thermal radiation has a very broad scope; for example, it encompasses all processes used as a light source in artificial lighting. The light and heat radiated by the Sun to the Earth through space, the source of all motion and all life on Earth, is likely the grandest and most beautiful example of the process we wish to discuss.
When we heat up a body, e.g. with the aid of a flame, its temperature constantly increases. We conceive of this process as the motion of the molecules in the body becoming more and more violent. In solid and fluid bodies, this is made apparent externally through spatial extension; our sense of touch detects the effect through the occurrence of a phenomenon perceptible to our nerves, which we call heat. In gases, we likewise observe an even greater expansion of volume or, if volume is held constant, a growing pressure. The measure of the violence of the hypothetical motion of the individual molecules or their kinetic energy is the temperature. Recollect here the explanation of the basic ideas of the kinetic theory of gases.
If a body is heated above a certain temperature, it begins to send out radiation, usually visible to the eye; at about 525º it glows red, at 1000º yellow, at 1200º white. Along with this heat radiation, it also sends out light radiation. This process is called “emission.” Conversely, a body heats up when light or heat radiation is incident upon it. Very characteristic differences appear during this process: from experience, everyone knows that dark bodies take in disproportionately more and white ones throw back far more of the same radiation. The first process is called absorption, the second reflection. At very low temperatures, the warming brought about by radiation can reach very high levels: think of mountain hikes in winter.

I grew up in the United States speaking German at home and English at school. The child of a translator, I picked up the family trade with my first job writing English abstracts of German-language articles for the ProQuest Company. Not long after, I began freelancing for translation agencies.
After graduating with a Bachelor's degree from the University of California, Berkeley, I moved to Berlin for several years before finally settling in Edinburgh. I professionalized my translation business, passing the CIoL's DipTrans exam in 2015 and obtaining a 2-year diploma in paralegal studies from the National Association of Licensed Paralegals in 2016 to support my goal of specializing in legal translation. In 2016 I was a panel member of Translating Europe: Young People in Translation at the Glasgow Language Show.
For me, learning is a way of life and translation is the perfect complement. In 2012, I completed a Master's degree in archaeology at the University of Edinburgh. In 2015, I returned to university for an integrated Master's in mathematical physics, to be completed in 2020. Next up? A PhD in astrophysics or renewable energy studies.
I've put theory into practice with original research projectsand publications about the mysterious designs found on Iron Age Italian belts, the economic feasibility of a space station in geostationary orbit, software for the automatic detection of satellites streaking across the night sky, and novel image processing algorithms based on partial differential equations. Everything I learn opens up new pathways in the translation industry for me.
Today I work for agency and direct clients in legal and technical translation. I remain dedicated to continuing professional development and am a regular attendee of professional translation events. In my free time, I rock climb.
