Powstaje automatycznie w chwili zawarcia małżeństwa chyba, że małżonkowie przed wstąpieniem w związek małżeński wyłączyli ją zawierając małżeńską umowę majątkową albo jej istnienie jest niedopuszczalne z mocy prawa.
