I agree with MacroJanus. I would probably prefer "taking into consideration mutual obligations" as sounding more official and contract-like.

Tak marginalnie, "obligations" to takie wynikające z zewnątrz np. z ustaw, zapisów... natomiast "undertakings" to zobowiązania własne wobec drugiej strony, czy czuć różnicę?

I teraz trzeba wczuć się w literę całego dokumentu, które pojęcie lepsze.
Potem jeszcze to podrzucę:
"Considering the mutual...."
"Given the mutual ....."
"In view of ...."
