Source text - Korean 나. 이 사건 정정청구가 적법한 것인지 여부
(1) 정정청구의 내용
이 사건 정정청구는, 이 사건 제 5항 발명의 구성 중 ‘라이오셀 섬유의 염색성을 증가시키는 방법에서’를 ‘라이오셀 섬유에 대한 직접 염료와 반응성 염료중의 하나에 대한 염색성을 증가시키는 방법에서’로 정정하는 것이다(이하 ‘정정사항’이라 한다).
(2) 정정청구의 적법여부에 관한 판단
이 사건 정정은, 정정 전에 염료에 대한 한정없어 모든 종류의 염료를 발명의 대상으로 한 것에서, 정정으로 염료의 종류를 ‘직접 염료 또는 반응성 염료’로 한정함으로써 발명의 대상을 축소한 것이고, 위와 같은 정정으로 새로운 기능이나 효과를 추가한 것도 아니므로, 위 정정은 특허 청구범위를 감축하는 경우에 해당한다.
한편, 구 특허법( 2006.3.3 법률 제 7871호로 개정되기 전의 것, 이하 같다) 제 77조 제 3항에 의하여 준용되는 같은 법 제 136조 제 4항은, 특허청구범위의 감축에 의한 정정은 정정후의 특허청구 범위에 기재된 사항이 특허 출원시 특허를 받을 수 있는 것이어야 한다고 규정하고 있으므로, 아래에서는 정정후의 제 5항 발명(이하 ‘이 사건 정정발명’이라 한다.)이 특허출원을 한 때에 특허를 받을 수 있는 것인지에 관하여 살펴본다.
Translation - English B. Whether this Application for Correction is Proper for the Instant Case
(1) Details of the Correction Application
This application pertains to a correction request related to the changes to be made to the instant case number 5 invention’s composition from ”Method to Increase Lyocell Fiber’s Dye Capacity” to “Method to Increase Lyocell Fiber’s Dye Capacity Using Either the Direct Dye Material or the Reactive Dye Material” (hereinafter referred to as correction item).
(2) Judgment re: Whether the Application for Correction is Proper
This application for correction falls into the category where the correction reduces the scope of the patent claim by not introducing new features or effects, and by changing the dye capacity of the dye material from a general and all types of dye material to either “a direct dye material or a reactive dye material” and thereby reducing the applicability of the initial invention claim.
However, unrevised Patent law (which was in effect prior to March 3, 2006 revision by Statute 7871 as follows) Section 136, Subsection 4, which is effectuated by an enabling statute Section 77, Sub-section 3, provides that in the event the application for correction reduces the scope of the applicability of the patent, the specified correction recorded on the new patent should have been patentable at the time the initial patent was approved, and therefore, a review is necessary to determine whether the corrected number 5 invention (hereinafter referred to as “Instant Case Corrected Invention”) would have been patentable at the time the initial patent claim was submitted.
