Translation - English The sun hung high above the earth. Its disc, copper-red from copious dust suspended in the air, loomed in the centre of a bleached, dull sky, casting underneath one’s soles a meagre shadow that was incessantly writhing and bristling, grey and fuzzy at times but then suddenly coming alive, acquiring sharp outlines and inky blackness and thus becoming particularly ugly. There was nothing resembling a road anywhere around, only uniform, lumpy and dried, greyish-yellow clay — cracked, dead, hard as stone and so bare that it was totally unclear how it managed to produce so much dust.
The wind, thank God, was blowing from the rear. Somewhere far behind it sucked up immeasurable amounts of a wretched, scorching powder and dragged it, with dogged persistence, along the sun-scorched outcrop squeezed in between the abyss and the Yellow Wall. Now and then the wind would coil the hot powder into a spinning outburst and throw it up to the sky, or twist it tightly in a flexible, almost playful, swan-neck tornado, or simply roll it along as a swirling cloud, but then, suddenly going wild, hurl the gritty flour in your back and hair with beastly animosity, whipping your sweaty nape, lashing your arms and ears and penetrating into your pockets and under your collar…
There was nothing there, and had been nothing for a long time, for ages, probably. Just the sun, the clay, and the wind. And only occasionally the prickly skeleton of a bush, torn out together with its root somewhere far behind, would sweep by, spinning and bouncing like a grimacing buffoon. Not a drop of water, not a sign of life. Nothing but dust, dust, dust — and dust again…
Occasionally clay would peter out underfoot, replaced by a continuous stretch of hashed up rock. Everything was hellishly hot. Once to the right, once to the left, gigantic rocks — greyish, as if powdered with flour — would emerge through the rushing clouds of dust. The wind and heat would mould them into most bizarre and unexpected shapes, and it was rather scaring to see them appearing and disappearing in this ghostly manner, as if they were playing some sort of hide and seek. From some point onwards, the gravel underneath would become coarser, and suddenly the stretch of scattered rock would end, once more replaced by clay dryly resounding under your feet.

Но куда чаще, отступая перед трудностями, сегодняшняя фантастика робко пятится назад – к сказкам. Отсюда, конечно, повальное увлечение Гарри Поттером и его компанией.
Я окончательно убедился в том, что фантастика проиграла сказке, когда провалились два последних фильма Спилберга – «Искусственный интеллект» и «Особое мнение». Дело не в том, что первый я считаю шедевром режиссера, а второй – его ошибкой. Важнее, что даже такой гений массового кино не смог по-настоящему заинтересовать зрителя картинами будущего, где разворачивается действие обеих картин. На фоне этих пусть относительных, но для Спилберга бесспорных неудач особенно ярким представляется грандиозный успех главных героев американского, да и мирового проката – «Гарри Поттера» и «Властелина колец».
Не означает ли это, что будущее перестало нас привлекать, потому что оно уже наступило и никто не знает, что с ним делать?
Раньше так не было. Раньше фантасты провоцировали науку, подгоняя ученых своей выдумкой. Так было во времена не только Жюля Верна и Уэллса, но даже Артура Кларка, дебютировавшего романом, где предсказывалась спутниковая связь. Теперь – все с точностью до наоборот: фантасты следят за учеными, надеясь поживиться сенсационными идеями с щедрого стола науки. Что уж такого нового могут придумать фантасты, когда в газетах пишут о том, как скрестить мышь с человеком, построить машину времени и осуществить мгновенную нуль-транспортировку?
Завтрашний день перестал быть миром чудес. Для этого у нас есть день сегодняшний, и он нам не слишком нравится. Мы уже привыкли бояться непреодолимой мощи разума, которая не способна только к одному – к самоограничению. Если науку не остановила даже инквизиция, то вряд ли и мы с ней справимся. Лишенные будущего и страшащиеся настоящего, мы ищем убежища в прошлом, зная, что уж его мы не в силах изменить – только придумать заново. Этим и занимается современная сказка. Она переносит нас в альтернативную вселенную, где все заведомо не так, как в жизни, но все-таки похоже. Как характерно, что в страну волшебников Гарри Поттера везет не ковер-самолет, а допотопный паровоз, пришедший не из такого уж далекого, но безопасного ХIХ века. Сегодня нет лучшего убежища, чем сказка – она переносит нас в ту нетленную вечность, что выбрала себе псевдонимом анахронизм – прошлое, которого не было.
Но фантастика – дело другое. Она должна не перелицовывать старое и не цитировать чужое, а сочинять свое. Только тогда она сможет выполнить роль, за которую мы ее – чаще авансом – так любим. Остранить, а значит – познать свою жизнь мы можем только тогда, когда сумеем взглянуть на нее со стороны. Вот эту другую сторону и должна нам дать настоящая – ненаучная – фантастика. Место для нее Лем искал на ничейной земле, которая разделяет и объединяет науку, философию и теологию. Здесь происходит действие его лучшего романа «Солярис».
Появление нового, голливудского, «Соляриса» – яркое свидетельство неувядающего обаяния романа. За четыре десятилетия своей жизни он стал самым бесспорным шедевром жанра, причем даже для тех, кто не признает фантастику как таковую. При желании Лема можно прочесть, игнорируя научно-фантастический антураж, и тогда он окажется в том же ряду, что и Кафка, Бруно Шульц, Беккет, Борхес, Павич или «Улитка на склоне» наших Стругацких. К этой традиции Лем и в самом деле ближе, чем к своему цеху. Членство в нем всегда тяготило писателя и мешало критикам (но не читателям!) оценить оригинальность и глубину его прозы. Translation - English The challenge is to get out of the rut of conventional thinking, to depict models of alien intellect and to open new horizons for imagination by bringing unprecedented concepts into the field of thought. But it is only too often that today's science fiction, retreating from challenges, timidly comes back to fairy tales. This, obviously, accounts for the current craze for Harry Potter and his company.
I was finally convinced that science fiction had lost ground to fairy tale when Spielberg's last two films, 'Artificial Intelligence' and 'Minority Report', failed. The point is not that I consider the first the director's masterpiece and the second his mistake. What is more important is that even this genius of mass film-making failed to really interest the viewer with pictures of the future, where the events unfold in both pictures. Against the background of these albeit relative but still undeniable – for Spielberg – failures, the tremendous success of 'Harry Potter' and 'The Lord of the Rings' as the undisputed leaders of American, as well as worldwide, film distribution appears particularly bright.
Does this mean that the future no longer attracts us because it has already come and no one knows what to do with it?
It used to be totally different. Science fiction writers used to motivate science, prodding scientists by the power of their invention. This is how it was not only in the days of Jules Verne and H. G. Wells but more recently as well, when Arthur C. Clarke made his debut with a novel where satellite communications were predicted. It's exactly the other way round in all respects today: science fiction writers watch scientists, hoping to pinch sensational ideas from technology's generous table. What really new can science fiction authors come up with when newspapers discuss crossing a mouse with a man, building a time machine and realizing instant space warp?
Tomorrow's world has ceased to be a world of wonders. For wonders we have today's world, and we don't like it very much. We have become used to fearing the irresistible power of mind, this power not being capable of just one thing: self-restraint. If science was not even halted by the Inquisition, we are unlikely to restrain it either. Deprived of the future and fearing the present, we seek refuge in the past, knowing that this is one thing we can only re-invent, but not change. And this is what modern fairy tale writing does. It takes us into an alternate universe where everything is predetermined to be different but still similar. It is very indicative that Harry Potter is brought to the magical world not by a magic carpet but by an antiquated locomotive that came from the not so distant, and yet safe, nineteenth century. There is no better shelter today than a fairy tale: it takes us into the imperishable eternity, the endlessness that chose anachronism as its pseudonym: the past that never existed.
But science fiction is a wholly different matter. It is expected to invent new concepts rather than renovate old ones and quote what has already been said. Only in that case will it be able to perform the function for which we love it, albeit often in advance. We can only estrange, and thus learn, our life if we manage to look at it from outside. And it is this outside that real, unscientific, science fiction should give us. To place such fiction, Lem searched the no-man's-land that separates and unites science, philosophy and theology. That is where the events unfold in his best novel 'Solaris'.
The release of the new, Hollywood, version of 'Solaris' is clear evidence of the unfading magnetism of the novel. Over the four decades of its life, the book has become an undisputed masterpiece of the genre, recognized even by those who do not accept science fiction as a genre at all. Lem's novels could even be read while ignoring the whole science fiction entourage, and then his works would be on the same scale as those by Kafka, Bruno Schulz, Beckett, Borges and Pavić, including 'The Snail on the Slope' by the Strugatsky brothers. Indeed, Lem is closer to this school than to the science fiction guild. The writer's membership in the latter always irked him and prevented his critics (but not readers!) from appreciating the originality and depth of his prose. This membership was probably the only obstacle on his way to the Nobel Prize, which he never received, though being more worthy of the award than a good third of Nobel laureates. But even without that official esteem that makes a writer an officially recognized master, Lem will be remembered in the literature of the twentieth century for the most rare quality of being the creator of a new world rather than a new style.
Source text - Russian 5. Порядок сдачи и приемки услуг
5.1. Сдача и приемка услуг оформляется путем подписания Сторонами Акта сдачи-приемки оказанных услуг.
5.2. Акт сдачи-приемки услуг представляется Спонсируемым в срок не позднее 10 (десяти) рабочих дней с даты окончания действия Договора одновременно с отчетом Спонсируемого с приложением подтверждающих материалов и документов согласно п. 3.2.9. настоящего Договора.
5.3. Спонсор подписывает Акт сдачи-приемки оказанных услуг и утверждает Отчет Спонсируемого в срок не позднее 10 (Десять) рабочих дней с даты получения Акта сдачи-приемки оказанных услуг либо в указанный срок направляет мотивированный отказ от подписания указанного Акта и утверждения Отчета. В случае получения мотивированного отказа Спонсируемый обязуется за свой счет устранить в согласованный Сторонами срок претензии Спонсора, после чего Стороны в порядке, указанном в настоящем пункте Договора, подписывают повторно предоставленный Акт сдачи-приемки оказанных услуг по настоящему Договору.
6. Ответственность сторон
6.1. За неисполнение или ненадлежащее исполнение обязательств Спонсируемый и Спонсор несут ответственность в соответствии с настоящим Договором и действующим законодательством РФ.
6.2. В случае неисполнения Спонсируемым своих обязательств по настоящему Договору в полном объеме, в том числе не предоставления Акта сдачи-приемки оказанных услуг и Отчета о размещении и распространении рекламных материалов Спонсора вместе с документами и материалами, подтверждающими надлежащее исполнение обязательств согласно п.п. 3.2.9. настоящего Договора (кроме случаев, предусмотренных в разделе 4 Договора), Спонсируемым возвращаются все денежные средства, перечисленные Спонсором в соответствии с разделом 2 настоящего Договора.
6.3. Спонсируемый несет ответственность за неточности, ошибки, искажения, допущенные по вине Спонсируемого, в тексте опубликованных информационных материалов Спонсора. В этом случае Спонсор вправе потребовать от Спонсируемого уплаты штрафа в размере 5% от суммы спонсорского взноса, указанной в п. 2.1. настоящего Договора, и/или устранения недостатков в кратчайшие сроки за свой счет.
6.4. Спонсируемый не несет ответственность, предусмотренную пп. 6.2., 6.3, настоящего Договора, в случае если неисполнение в полном объеме либо частичное неисполнение своих обязательств возникло в связи с непредставлением (частичным предоставлением) информационных материалов Спонсором.
6.5. Спонсор самостоятельно несет полную ответственность за несоответствие содержания информационных материалов, передаваемых Спонсируемому, действующему законодательству РФ. В случае поступления каких-либо претензий в адрес Спонсируемого в отношении размещаемых в соответствии с настоящим Договором информационных материалов Спонсора, Спонсор обязуется урегулировать вышеуказанные претензии своими силами и за свой счет при наличии вины Спонсора.
6.6. Спонсор самостоятельно несет ответственность за нарушение принадлежащих третьей стороне прав (включая, но не ограничиваясь авторскими правами), вызванное размещением предоставленных им информационных материалов. Все расчеты с авторами и обладателями смежных прав в отношении произведений и исполнений, вошедших в информационные материалы Спонсора, производятся Спонсором самостоятельно. В случае предъявления к Спонсируемому претензий в отношении нарушения прав третьих лиц, вызванного размещением информационных материалов Спонсора, Спонсор обязуется оградить Спонсируемого от любых претензий третьих лиц, связанных с нарушением авторских, смежных прав или иных законных прав на результаты интеллектуальной деятельности, используемые в информационных материалах Спонсора и при наличии документального подтверждения понесенных расходов Спонсируемым в связи с предъявлением указанных претензий возместить понесенные Спонсируемым расходы только при наличии доказанной вины Спонсора.
6.7. Спонсор несет полную ответственность за несоответствие действительности информации, используемой в информационных материалах Спонсора.
7. Прочие условия
7.1. Договор вступает в силу с даты подписания его Сторонами, распространяет свое действие на правоотношения Сторон, возникшие с __________ 201___ г., и действует до полного исполнения Сторонами своих обязательств по настоящему Договору.
7.2. Об изменении своих реквизитов Стороны должны уведомить друг друга в письменной форме в течение 2 (Два) рабочих дней с момента изменения.
7.3. Споры по настоящему Договору разрешаются путем переговоров, а при недостижении согласия в Арбитражном суде г. Москвы в соответствии с действующим законодательством Российской Федерации и регулируются как материальным, так и процессуальным правом, действующим на территории РФ.
7.4. Настоящий Договор составлен на русском языке в двух подлинных экземплярах, имеющих равную юридическую силу. Один экземпляр - для Спонсора, один – для Спонсируемого.
7.5. Все изменения, дополнения и приложения к настоящему Договору производятся только по письменному соглашению Сторон и являются неотъемлемой частью настоящего Договора.
7.6. Во всем, что прямо не предусмотрено настоящим Договором, Стороны руководствуются действующим законодательством Российской Федерации.
7.7. Заключая настоящий Договор, каждая Сторона заявляет другой Стороне следующее и заверяет ее в следующем:
- Сторона является юридическим лицом, должным образом созданным в соответствии с законодательством Российской Федерации, и ее деятельность осуществляется в соответствии с учредительными документами и действующим законодательством Российской Федерации;
- Сторона имеет все необходимые корпоративные одобрения и соответствующие полномочия на заключение настоящего Договора и выполнение взятых на себя обязательств по настоящему Договору;
- лица, подписывающие от лица Стороны настоящий Договор и все документы, относящиеся к нему, надлежащим образом назначены на должность и уполномочены на подписание настоящего Договора и всех документов с ним связанных;
- заключение настоящего Договора не нарушает и не нарушит никаких положений учредительных документов Стороны или действующего законодательства Российской Федерации.
Translation - English 5. Procedure for the Delivery and Acceptance of Services
5.1. The delivery and acceptance of the services shall be documented by the Parties by means of signing a Services Acceptance Certificate.
5.2. The Service Acceptance Certificate shall be provided by the Sponsored Organization within 10 (ten) working days after the expiry of the Agreement, together with a Report produced by the Sponsored Organization and supporting materials and documents attached thereto, in accordance with paragraph 3.2.9 of this Agreement.
5.3. The Sponsor shall either sign the Service Acceptance Certificate and approve the Sponsored Organization's Report within 10 (ten) working days after the receipt of the Services Acceptance Certificate, or send, within the same period, a reasoned refusal to sign the Services Acceptance Certificate and approve the Sponsored Organization's Report. Having received a reasoned refusal, the Sponsored Organization shall eliminate, at its own expense and within a period agreed by the Parties, the faults that have been indicated by the Sponsor, after which the Parties shall sign the resubmitted Services Acceptance Certificate following the procedure set forth in this clause.
6. Responsibilities of the Parties
6.1. If failing to fulfil properly their obligations under this Agreement, the Sponsored Organization and the Sponsor shall be held liable in accordance with this Agreement and the applicable laws of the Russian Federation.
6.2. If the Sponsored Organization fails to fulfil its obligations under this Agreement in their entirety, including failure to provide the Services Acceptance Certificate and the Report on Placing and Distributing the Sponsor's advertising materials together with documents and materials supporting the proper fulfilment of the obligations set forth in subparagraph 3.2.9 of this Agreement (except as described in section 4 of this Agreement), the Sponsored Organization shall refund all the money the Sponsor has provided it with in accordance with Section 2 of this Agreement.
6.3. The Sponsored Organization shall be held liable for any inaccuracies, errors, or misrepresentations that have been made through the fault of the Sponsored Organization in the text of the published information materials. In this case, the Sponsor may request the Sponsored Organization to pay a fine of 5% of the sponsorship fee specified in paragraph 2.1 of this Agreement and/or rectify the faults within the shortest possible time at the Sponsored Organization's own expense.
6.4. The Sponsored Organization shall not be held liable under paragraphs 6.2 and 6.3 of this Agreement if it fails to fulfil its obligations either partially or in their entirety as a result of the Sponsor's failure to provide the information materials in full (or partially).
6.5. The Sponsor shall take full responsibility for any inconsistency in the content of the information materials handed over to the Sponsored Organization under this Agreement with respect to the current laws of the Russian Federation. If the Sponsored Organization receives any objections against any of the Sponsor's information materials published under this Agreement, the Sponsor, if found to have been at fault, shall address such objections on its own and at its own expense.
6.6. The Sponsor shall be solely responsible for any violation of third parties' rights (including, but not limited to, copyright) that may result from publishing the Sponsor's information materials. All payments due to the authors and holders of any related rights to works or performances that are included in the Sponsor's information materials shall be made by the Sponsor independently. If the Sponsored Organization receives complaints about violation of third parties' rights caused by the publication of the Sponsor's information materials, the Sponsor shall protect the Sponsored Organization from any third party complaints relating to infringement of copyright, related rights, or other legitimate rights to intellectual property used in the Sponsor's information materials, and, if found and proven to have been at fault, and if the Sponsored Organization provides documentary evidence of the expenses incurred in connection with such complaints, the Sponsor shall reimburse the Sponsored Organization for the expenses.
6.7. The Sponsor shall be fully responsible for any inconsistency of the information used in the Sponsor's information materials with real facts.
7. Other Terms and Conditions
7.1. This Agreement shall enter into force once signed by the Parties, apply to the legal relationship between the Parties arising as of __________ 201___, and be valid until the Parties fulfil their obligations hereunder in full.
7.2. If changing any of its particulars, a Party shall notify the other Party thereof in writing within 2 (two) working days of the change.
7.3. The Parties shall seek to settle any disputes arising from this Agreement by means of negotiation, or, if failing to reach an agreement by doing so, shall resort to the adjudication of the Moscow Arbitration Court in accordance with the current laws of the Russian Federation, whereupon such disputes shall be settled under both substantive and procedural laws applicable in the territory of the Russian Federation.
7.4. This Agreement is produced in Russian in two original copies that have equal legal force. One copy shall be kept by the Sponsor, and one by the Sponsored Organization.
7.5. Any amendments, additions or supplements to this Agreement shall be made only by the Parties' written agreement and shall constitute an integral part of this Agreement.
7.6. In anything that is not expressly provided for in this Agreement, the Parties shall be governed by the applicable laws of the Russian Federation.
7.7. When entering into this Agreement, each Party states and assures the other Party of the following:
- the Party is a legal entity duly constituted under the laws of the Russian Federation, and its activities are carried out in accordance with the Party's constituent documents and the applicable laws of the Russian Federation;
- the Party has all the necessary in-house approvals and appropriate authority to enter into this Agreement and fulfil its obligations hereunder;
- the persons who sign this Agreement and all the documents relating thereto on behalf of the Parties have been duly appointed to this position and authorized to sign this Agreement and all the documents related to it;
- the signing of this Agreement does not and will not violate or infringe any of the Party's constituent documents or any of the current laws of the Russian Federation.

В сезоне 2013/ 2014 пермская труппа вернула на сцену после перерыва длиною в год «Концерт» на музыку Шопена и «Времена года» на музыку Верди.
Впервые они были исполнены в Перми в 2007 году, чем вызвали неподдельный интерес со стороны балетоманов всей страны.
Ведь на тот момент пермяки были единственными в России исполнителями хореографии выдающегося американца.
«Времена года» — блистательный пример неоклассической хореографии.
История постановки началась с того, что Джером Роббинс сочинил хореографическую миниатюру «Весна» на музыку Верди для солистов New York City Ballet Киры Николс и Питера Мартинса.
Постановка имела большой успех, и балетмейстер решил представить аналогичным образом все сезоны года.
В результате получился спектакль-дивертисмент, восходящий к традициям старинного придворного балета.
От исполнителей этот балет требует не только виртуозного мастерства, но и хорошего чувства юмора.
В свойственной ему манере Роббинс разбавляет лирику шутками: например, в «Зиме» «снежинки» сначала зябнут от холода, потирая замерзшие голые плечики, а потом, «разгорячившись», закручиваются в вихре танца.

Пьесам Шопена особенно часто дают причудливые названия, такие, как этюд «Бабочка», вальс «Минутка», прелюдия «Капли дождя» и т.д.».
Сюжет спектакля порхает между вставными новеллами.
Ироничный тон «Концерту» задает пианист, который, садясь за инструмент, сдувает с него вековую пыль.
С первых нот в его фантазиях рождаются необыкновенные сценки, навеянные музыкой: экзальтированная балерина в шляпе, замирающая в обнимку с роялем; танцовщицы, путающиеся в движениях и сталкивающиеся в прыжках; супружеская чета, в которой муж разрабатывает варианты по устранению надоевшей супруги и замены ее на тонконогую возлюбленную, которая, в свою очередь, представляет себя бабочкой...
Когда, повинуясь разыгравшемуся воображению, пианист бросает клавиши и хватается за сачок, зал разрывается аплодисментами.

Choreographed in 1979, the ballet had its première in Perm in 2007, and was restaged in 2013.
An Oscar-winning American choreographer who produced the dances for the famous musical film "West Side Story", Jerome Robbins has worked both with the aesthetics of New York City Ballet's academic environment as well as on the liberal stages of Broadway.
A younger contemporary of George Balanchine, and his deputy at New York City Ballet, Robbins created more than 50 scintillating, compact, and concentrated ballets.
Today those ballets have become the embodiment of the American style in choreography, and their creator has become the personification of the American spirit – cheerful, inexhaustible, bold, and ironic.
A combination of humour and top-notch choreography also marks out the two ballets presented as part of a performance titled "An Evening of Choreography by Jerome Robbins".
After a year-long break, for the 2013/2014 season the Perm company brought back to the stage a performance of "The Concert" to music by Chopin and "The Four Seasons" to music by Verdi.
First performed in Perm in 2007, these ballets sparked a great deal of interest from ballet fans throughout the country at that time.
Indeed, Perm was then the only Russian city where choreography by the prominent American artist had been staged.
"The Four Seasons" is a brilliant example of neo-classical choreography.
The story of this theatrical work began when Jerome Robbins wrote "Spring", a choreographic miniature to music by Verdi, to be performed by New York City Ballet soloists Kyra Nichols and Peter Martins.
The production enjoyed great success, and the choreographer decided to present all the seasons of the year in a similar fashion.
This resulted in the creation of a divertissement dating back to the old traditions of court ballet.
The piece requires the performers to have a good sense of humour in addition to technical virtuosity.
In his typical manner, Robbins dilutes lyricism with jokes: Thus, in "Winter", for example, the 'snowflakes' first feel cold from the frost, rubbing their frozen bare shoulders, and then, having 'warmed up', spin around in a whirl of dance.

"The Concert" is a rare example of a comedy in ballet; it is often called a caricature ballet. "One of the pleasures of attending a concert", Robbins commented on his conception of the piece, "is the freedom to lose oneself in listening to the music.
Quite often, unconsciously, mental pictures and images form, and the patterns and paths of these reveries are influenced by the music itself, or its program notes, or by the personal dreams, problems and fantasies of the listener.
Chopin’s music in particular has been subject to fanciful "program" names such as the Butterfly Etude, the Minute Waltz, the Raindrop Prelude, etc."
The production’s plot flits between the novels that comprise it.
The ironic tone is initially imparted to "The Concert" by the pianist who blows age-old dust off the grand piano before sitting down to play.
From the very first sounds, the fantasies he plays seem to generate little eccentric scenes as if inspired by the music: an ecstatic ballerina wearing a wide-brimmed hat, stopping motionless with her arms wrapped around the piano; dancing girls, confused in their movements and colliding with each other in their leaps; a married couple in which the husband is contriving plots in order to do away with his annoying wife and replace her with a thin-legged lover, who, in turn, sees herself as a butterfly...
When the pianist, following his own overheated imagination, suddenly abandons the piano and grabs a butterfly net, the audience bursts into applause.

Вступив в партнерские отношения с компанией Ploom из Сан-Франциско, JTI разрабатывает новый подход к курению.
История компании Ploom, долю в которой JTI приобрела в декабре прошлого года, началась в 2004 году, когда Джеймс Монсиз и Адам Боуэн, два выпускника Стэнфордского университета, задались вопросом: "Что было бы, если бы курение изобрели в наши дни?" Ответ для людей, живущих в Кремниевой долине, где у каждого второго - свой стартап, был очевидным: надо создать технологию, которая позволила бы потреблять табачную продукцию, при этом создавая положительный образ курильщика. Друзья решили, что прежде всего нужно избавиться от дыма, и заменили его технологией генерации пара, которая существовала давно, но для курения не применялась.
В результате были сконструированы и разработаны принципиально новые устройства для потребления табачной продукции. Эти устройства очень быстро завоевали популярность в модной тусовке Сан-Франциско, а сейчас готовы произвести настоящую революцию в курении, которая изменит отношение миллионов потребителей по всему миру к самому процессу курения.
Пар, а не дым
В основе парогенерации лежит процесс нагрева растительной смеси до температуры 160-180 градусов по Цельсию, которая в этот момент начинает выделять еле заметный пар для вдыхания. Смесь не горит, поэтому дым не выделяется.
Воспользоваться системой Ploom очень просто: индивидуальный картридж, содержащий одну порцию табака, оставляется в небольшое продолговатое устройство, и включается кнопка пуска. Эта технология имеет два отличительных преимущества в сравнении с другими нетрадиционными курительными устройствами. В картридже Ploom используется настоящий листовой табак, а не никотиновые ароматизированные вещества, как в подавляющем большинстве электронных сигарет. Само устройство ничем не напоминает те тяжелые стационарные испарители, которые были распространены повсеместно до недавнего времени. Изделие с тонким снимающимся мундштуком выполнено из стильного черного пластика.
В отличие от электронных сигарет, форма устройства не была задумана как копия сложившегося зя последние 150 лет образа сигареты. Все дело в том, что устройство - это не сигарета, а абсолютно новый подход к ритуалу получения удовольствия от табака, не доставляющий беспокойства окружающим.
Инновационной стала не только технология. Всего 30 секунд достаточно, чтобы смесь разогрелась до температуры, при которой потребитель может начать "плюмить", а одной зарядки картриджа достаточно, чтобы "плюмить" в течение 10-15 минут. Слово "курение" очень быстро вышло из обращения курильщиков Сан-Франциско, которые теперь предпочитают "плюмить". На волне публикаций в ведущих изданиях слово "плюмить" стало трендовым среди 25-35-летних молодых людей, проживающих в Кремниевой долине.
Инвестиции в будущее
Учредители компании "Монсиз и Боуэн" всегда верили в потенциал Ploom, но найти инвесторов, готовых вложить деньги в развитие и маркетинг, было сложно. Как развивается сотрудничество после восьми месяцев работы над проектом? "На первый взгляд кажется, что для компании наших размеров сложно наладить эффективное сотрудничество с предприятием, состоящим всего из 10 сотрудников, говорит Фриц. - Наши временные масштабы, приоритеты, отношение к риску и т.п. явно различаются. Но на самом деле все это не имеет значения. У нас с самого начала установились великолепные отношения. Мы доверяем друг другу и вместе учимся, что очень полезно".
Международный запуск
После подписания договора кросс-функциональная рабочая группа JTI приступила к подготовке запуска продукции Ploom на международный рынок. В устройствах, которые в настоящее время продаются в США, в качестве топлива используется бутан, но для глобального рынка, по словам Али Ягиза, будет разработана электронная версия. В качестве источника питания будет использоваться небольшая батарейка, которая приводится в действие нажатием кнопки на внешней стороне устройства. Подзарядка осуществляется через USB-порт

Стратегию действий будет разрабатывать небольшая рабочая группа из центральной штаб-квартиры потребительского и торгового маркетинга. "Почти как бренд-группа", - объясняет Али. А в каждой из стран, где планируется выйти на рынок, создается небольшая рабочая группа отдела потребительского и торгового маркетинга. "С таким уникальным продуктом, как Ploom, наши возможности проведения исследований потребительского рынка весьма ограничены, но очень важно быстро получать обратную связь. По ходу реализации проекта мы будем прислушиваться к различным мнениям, учиться и совершенствоваться в нашей работе", - говорит Али Ягиз.
Ни Али, ни Фриц не захотели делать какие-то предположения относительно потенциала международного рынка. Нынешний подход - начинать с малого и готовиться к быстрому развитию.
Они также намекнули, что готовится к выпуску новое поколение продукции. В США уже выпущено устройство под названием Pax, сходное с Ploom. Это небольшое карманное приспособление из алюминия, которое в прессе окрестили "вожделенным устройством" с "культовой привлекательностью iPod". На данном этапе цель понятна. Having formed a partnership with Ploom of San Francisco, JTI are developing a new approach to smoking.
The history of Ploom, a company shares in which JTI acquired last December, started in 2004 when James Monsiz and Adam Bowen, two graduates of Stanford University, asked themselves "What would happen if smoking was invented today?" The correct answer to this question was for them, as it would be for anyone living in Silicon Valley whose every other resident has a startup business of their own, quite obvious: A technology that would enable smokers to use tobacco products and develop a positive image at the same time would need to be created. The two friends decided that first of all this required getting rid of the smoke, and thus replaced it with the help of a steam generation technology that had existed for quite some time but had never been used in smoking.
This resulted in the design and development of entirely new devices for consuming tobacco products. The devices quickly became popular in San Francisco's fashionable coterie, and are now capable of making a whole revolution in smoking by changing the attitude of millions of tobacco consumers around the world to the process of smoking.
It's steam, not smoke
The steam generation technology is based on heating a vegetable mixture to a temperature of 160 to 180 degrees Celsius, whereupon the mixture begins to emit a barely visible vapour which will be inhaled. The mixture does not burn, so there is no smoke produced.
The Ploom system is very simple to use: an individual cartridge that contains a serving of tobacco is put in a small oblong device and the start button is pressed. This technology has two distinct advantages over the other non-traditional smoking devices. The Ploom cartridge contains real leaf tobacco rather than flavoured nicotine substances used in the vast majority of electronic cigarettes. The device itself bears no resemblance to those heavy stationary vaporizers that have been used widely until recently. The product is fitted with a thin removable mouthpiece and is made of stylish black plastic.
In contrast to electronic cigarettes, the device is not shaped like a replica of the cigarette as it is known today as a result of 150 years' evolution. This is because the device, being nothing like a cigarette, offers a completely new approach to the ritual of deriving pleasure from tobacco, without disturbing people around you.
It is not only the technology that is innovative. It takes only 30 seconds for the mixture to get heated to a temperature at which the user can start "pluming", and a single cartridge, once filled, will have 10 to 15 minutes' "pluming" capacity. The word "smoking" went out of use very quickly among San Francisco smokers who now prefer to "plume". As a result of a series of publications in popular magazines, the word "plume" has become trendy among 25-35-year-olds living in the Silicon Valley.
Investing in the future
The founders of Monsiz & Bowen have always believed in Ploom's potential but still it was difficult to find investors willing to put money into the development and marketing of the product. However in the spring of 2011 they held talks with JTI, and after a number of study tours made to San Francisco and Europe both sides expressed interest in cooperation. In December, the companies announced that a strategic agreement had been signed whereby JTI acquired a 25 percent stake in Ploom, Inc. and committed itself to the commercial use of the product outside the U.S.
INSIDE International Magazine asked Senior Vice President for Business Development and Corporate Communications Fritz Vranken who led the negotiations with Ploom and Vice President for Innovation and Consumer and Trade Marketing Ali Yagiz who has been managing the project on behalf of JTI to speak about this partnership and about the prospects of developing tobacco products of the new generation.
"We realized immediately that Ploom possessed an exclusive technology that would fit perfectly into our plans," Fritz says. "Ploom is a small innovative business that uses original technology and cutting edge design to create products demanded in the market. With JTI's financial and operational resources, our global coverage and popular brands added, huge business development opportunities emerged."
He rejects totally the assumption that products that use steam generation pose a threat to traditional tobacco products, including JTI's products: "It is necessary to keep pace with life. Kodak was slow with the development of digital photography, as there was a risk of cannibalizing, i.e. forcing the company's own film products out of the market. Other companies made this step, and Kodak had to leave the scene. As soon as any technology comes in to compete with traditional tobacco products, we will participate in its development."
How is the cooperation going after eight months' work on the project? "At first glance it might seem difficult for a company of our size to establish effective cooperation with a company that consists of only 10 employees," Fritz says. "Our time scales, priorities, attitude to risk, etc. are clearly different. But in fact all this does not matter. We had a great relationship right from the beginning. We trust each other and learn together, which is very practical."
International launch
Once the agreement was signed, JTI set up a cross-functional working group which started preparing the Ploom products for entering the international market. The devices which are currently sold in the U.S. use butane as the fuel, but for the global market, according to Ali Yagiz, an electronic version will be developed. A small battery rechargeable via a USB-port and activated by pressing a button on the outside of the device will be used for power supply.
"By and large, we use the same technology that was developed by Ploom, but we have somewhat improved the design and packaging of the product and cartridges," Ali says. "We also took full advantage of our expertise in blending tobacco and additionally created some new flavour suggestions. Five tobacco blend options are currently available on the market, but this list may be expanded in the future. With a view to supplying the production to international markets, new tobacco processing equipment and a fast cartridge production line have been installed at our manufacturing facility in Trier (Germany)."
All efforts of our team are concentrated now on putting the products on the market in early 2013. "First, we will focus our attention on the developed markets," Ali continues. "The first objective is to inform consumers and to conduct tests among early users of Ploom devices in key cities. The age category is the same as in the U.S. where the device is now popular. The exact sequence of expansion has not been determined yet, but, according to Ali, the Ploom device will be selling on at least six markets by the end of next year.
Start small, get ready for more
There are currently different flavour options available on the market, including Dragon, Gold and Cooler. Outside the United States, cartridges will be sold under the Ploom trade name along with cartridges sold under JTI's global flagship brand. Each of these brands has its advantages: there is quality and easily recognisable appearance boasted by one of the two and innovation claimed by the other. Together the two create a great potential. The packing of the cartridges will look very different from the traditional packs of cigarettes, which will serve to promote the brand as a premium product as it was conceived by Ploom.
Each market has a certain capacity to offer and demonstrate Ploom products. Fritz believes that legislative regulation of any new product category is a complex process: "Such issues as excise taxes, display and presentation of products and information of consumers must be discussed with the regulatory authorities of each particular market."
The action strategy will be developed by a small working group based at the central Consumer and Trade Marketing Headquarters. "It is almost like a brand group," Ali explains. And in each of the countries where the market is to be entered, a small working group is established as part of the Consumer and Trade Marketing Department. "With such a unique product as Ploom, our ability to investigate the consumer market is very limited, but it is important to get feedback quickly. We will listen to different opinions, learn and improve our work during the implementation of the project," Ali Yagiz says.
Neither Ali nor Fritz were prepared to make any assumptions about the capacity of the international market. The current approach is to start small and get ready for rapid development.
They also hinted that a new generation of the products was being prepared for release. A device called Pax, similar to Ploom, has been released in the United States. It is a small handheld device made of aluminium, dubbed "the coveted device" by the press and possessing "the iPod's cult appeal". At this stage, the goal is clear. "We have allocated significant resources so as to provide Ploom with the best opportunity to gain long-lasting popularity," Fritz says with a smile.

Особенности нормативно-правовых характеристик данной категории предопределяются как ее собственными (конституционно-правовыми) свойствами, вытекающими в конечном счете из природы Конституции как акта особого рода, так и особенностями деятельности Конституционного Суда как квазиправотворческого органа, нормативно-доктринальной спецификой его решений.
Специфика нормативной энергии конституционных ценностей такова, что они имеют предметом (сферой) своего влияния и одновременно формой политико-правового бытия прежде всего нормативные величины наиболее высокого, абстрактного уровня - общие принципы права, конституционные принципы, декларации, конституционные презумпции, статусно-категориальные характеристики субъектов конституционного права и конституционных явлений и т.п. С помощью конституционных ценностей происходит своего рода приращение и актуализация нормативного содержания соответствующих норм, институтов, принципов, а также установление их сбалансированного взаимодействия. Это особенно важно, если иметь в виду, что Конституционный Суд нередко сталкивается с ситуациями, когда возникают противоречия между представлениями о различных конституционных принципах, да и конституционные принципы могут быть внутренне противоречивы . Достаточно отметить такие, нередко вступающие друг с другом в конфликт, конституционные принципы, как, например: принципы правового государства и социального государства; принципы свободы и ответственности; принцип единства государственной власти и принцип федерализма и т.д.
Нормативно-правообразующее значение конституционных ценностей проявляется и в том, что с их помощью Конституционный Суд выявляет и оценивает правовые модели организации тех или иных сфер общественных отношений, преодолевает пробелы и дефекты в правовом регулировании и одновременно определяет тенденции развития конституционных отношений, обосновывает конституционную стратегию совершенствования законодательства по направлениям, попавшим в сферу конституционного нормоконтроля.
Весьма характерным в этом отношении является Постановление Конституционного Суда от 5 февраля 2007 г. № 2-П , предметом рассмотрения по которому стал институт надзорного производства в гражданском процессе в том виде, в каком он был урегулирован на тот момент ГПК РФ. Установив наличие нарушения оспариваемыми законоположениями конституционных принципов правосудия и ценностей судебной защиты прав граждан, Конституционный Суд указал, что признание соответствующих положений противоречащими Конституции и утратившими силу создавало бы такой пробел в правовом регулировании, который в данном случае не может быть устранен непосредственным применением Конституции и требует внесения системных изменений в действующее законодательство о судоустройстве и о гражданском судопроизводстве. Поэтому, опираясь на вытекающие из преамбулы и статей 1 (ч. 1), 2, 15 (ч. I и 4), 17, 18, 19, 46 и 11В Конституции ценности правовой справедливости и основанный на них принцип справедливости судебных актов, Конституционный Суд принял решение - в целях защиты основ конституционного строя Российской Федерации, прав и свобод человека и гражданина, поддержания баланса конституционно защищаемых ценностей, и с учетом объективно сложившихся реалий воздержаться в указанном деле от признания оспариваемых законоположений не соответствующими Конституции в той части, к какой ими предопределяется множественность надзорных инстанций, возможность неоднократного пересмотра судебных постановлений, принятых в порядке надзора, неопределенность сроков надзорного обжалования и производства. При этом в названном Постановлении была сформулирована развернутая программа реформирования института надзорного производства в целях приведения его в соответствие с Конституцией и европейскими стандартами правосудия.
Отражаемые в Конституции социальные ценности представляют собой качественные характеристики государственно-правовых явлений высшего порядка, связанные с осознанием обществом - через призму общедемократического опыта и национально-исторической практики - идей человеческого достоинства, добра и справедливости, фундаментальных целей и норм развитая, наиболее целесообразных форм общественного и государственного устройства. Посредством конституционного закрепления они трансформируются в конституционные идеи-принципы и обретают формально-юридическую нормативность, а в результате их восприятия отдельными индивидами, социальными группами, обществом в целом становятся элементом их конституционного правосознания, демократической культуры.
Конституционализируясь, соответствующие социальные ценности упорядочиваются, встраиваются в определенную иерархическую систему многоуровневых связей и корреляций, основанную на объективно существующем в государственно-организованном обществе социальном порядке в его социокультурном контексте, поскольку правовой социальный порядок, будучи системой связей прав и обязанностей, свободы и ответственности, выступает одновременно и действительным масштабом социальных ценностей.
Следовательно, конституционные ценности находятся в тесной (имплицитной и эксплицитной) связи с нормативной энергией Основного Закона. С одной стороны, они выступают социально-правовым генератором этой энергии, обеспечивая перевод фактически (консенсуально) признаваемых обществом в качестве общезначимых и общеполезных правил жизнедеятельности в нормативное содержание общеобязательных конституционных положений. Тем самым сложившиеся в общественной практике конституционные ценности посредством адекватной конституционализации (возведения в ранг норм Основного Закона) не только упрочивают легитимность Конституции, но и обретают формально-юридическую нормативность и обязывают всех субъектов права, включая государство в целом.
С другой стороны, с момента конституционной формализации определенной системы социально-правовых ценностей фактические аксиологические конституционные отношения оказываются под воздействием принудительной силы норм Основного Закона и уже не могут развиваться иначе как посредством коррелирующего взаимодействия с формально закрепленными правилами и нормами. Стало быть, соответствие фактических социально-правовых ценностей формальным удваивает их нормативный потенциал, а противоречие - не только снижает доверие к Конституции и затрудняет реализацию ее положений, но и снижает эффективность всего правового регулирования, поскольку оно проистекает из норм Основного Закона. Гармонизация же фактических и формальных социально-правовых ценностей в нормативном содержании положений действующей Конституции - пожалуй, генеральная задача Конституционного Суда в рамках возложенных на него функций и полномочий.
Нормативные начала конституционных ценностей, обобщенно говоря, проистекают из их объективной социальной значимости для народа, волей которого они утверждаются в качестве первичного и безусловного основания как для правовой системы государства в целом, так и для каждой ее юридической нормы. В свою очередь, социальная значимость конституционных ценностей состоит в том, что выраженные в них социальные начала (цели, интересы, отношения, институты и т.п.) обеспечивают наиболее оптимальное (эффективное, прогрессивное) развитие общества на основе согласования интересов не только внутри государства, но и на международной арене.
Соответственно конституционные ценности обусловлены внутренней и внешней социальной средой, а потому при их анализе следует учитывать в том числе складывающиеся закономерности международных отношений и тенденции общепланетарного развития, которые воздействуют и на становление (формирование) конституционных ценностей, и на порядок их реализации. В то же время необходимо принимать во внимание, что сам по себе международный социально-правовой порядок, будучи производным от взаимодействия между суверенными волями равноправных народов мира, выступает своего рода результирующей от соотношения и сбалансирования фактических национальных конституционных ценностей государств мирового сообщества.
Одной из фундаментальных закономерностей и тенденций современного этапа развития человечества следует признать глобализацию, процессы которой, следовательно, оказывают прямое влияние на систему конституционных ценностей и их иерархические характеристики.
Translation - English Constitutional values are not a merely theoretical, doctrinal and epistemological category but also a category of effective law. This category displays certain regulatory characteristics whose special qualities are pre-determined both by its inherent (constitutional) properties stemming ultimately from the nature of the Constitution as an act of a special kind and by the operation of the Constitutional Court as a quasi-legislative authority, i.e. by the special regulatory and doctrinal qualities of decisions made by the Constitutional Court.
Having special regulatory energy, constitutional values influence primarily regulative dimensions (while themselves being a form of political and juridical existence of such dimensions) of the highest, abstract level, such as general principles of law, constitutional principles, declarations, constitutional assumptions, status and category properties of subjects of constitutional law and constitutional phenomena, etc. Constitutional values enable a certain kind of augmentation and synchronisation of the normative content of rules, institutions and principles, and their balanced interaction. This is particularly important if bearing in mind that the Constitutional Court is often faced with situations involving contradictions between differing notions of constitutional principles, while the constitutional principles themselves may be inherently contradictory . As concrete examples, such often conflicting constitutional principles as constitutional state vs social state, freedom vs responsibility, unity of state power vs federalism, etc. can be pointed out.
The regulatory and legislative importance of constitutional values is manifested in that they enable the Constitutional Court to identify and assess legal mechanisms for managing various areas of public relations, bridge gaps and eliminate flaws in legal regulation, as well as to determine trends in the development of constitutional relationships and justify constitutional strategies to improve legislation in areas that come within the purview of constitutional regulation.
Illustrative of this is Constitutional Court's Decision No. 2-P of February 5, 2007 whose subject matter was the institute of review proceedings in civil process in the form in which it was laid out in the RF Code of Civil Procedure at the time. Having established that the challenged statutory provisions violated the constitutional principles of supremacy of justice and values of judicial protection of citizens' rights, the Constitutional Court stated that recognising the relevant provisions unconstitutional and invalid would create a regulatory gap which could not be eliminated by direct application of the Constitution and required systemic amendment of effective legislation pertaining to the judicial system and civil proceedings.
Therefore, in view of the juridical equity values implied by the Preamble and Articles 1 (part 1), 2, 15 (parts 1 and 4), 17, 18, 19, 46 and 11C of the RF Constitution and based on the ensuing principle of equity of judicial decisions, the Constitutional Court, in order to protect the essentials of the Constitutional System of the Russian Federation and the rights and liberties of man and the citizen, as well as to maintain balance between constitutionally protected values and while taking into consideration objectively existing realities, decided to refrain from recognising on that case that the challenged statutory provisions were in conflict with the Constitution insofar as they provided for multiple reviewing authorities and repeated revisions of judicial decisions made in review proceedings and set no definite timeframes for submitting review appeals and for conducting review proceedings. Furthermore, the said Decision formulated a comprehensive programme to reform the institute of review proceedings in order to bring it into conformity with the Constitution and the European standards of justice.
The social values which are set in the Constitution represent qualitative characteristics of legal phenomena of a higher order, whose purpose is to raise society's awareness - in the light of general democratic experience and national and historical practices - of the ideas of human dignity, kindness and justice, of the fundamental development goals and standards and of the most appropriate forms of social and governmental arrangement. Once adopted constitutionally, they transform into constitutional conceptual principles and acquire formal legality, and when accepted by individuals, social groups, and society in general they become part of their constitutional conscience and democratic culture.
Having been endowed with a constitutional status, such social values become properly arranged and embedded in a certain hierarchy of multi-level relations and correlations, which is based on a social order that objectively exists in a governmentally managed society in the social and cultural context of this order, as a legally formalised social order, being a system of links between rights and obligations and liberties and responsibilities acts at the same time as a valid benchmark for the social values.
Consequently, constitutional values are in close (both implicit and explicit) communication with the regulatory energy of the Fundamental Law. On the one hand, they act as a social and legal generator of this energy, and thus convert rules of life that are actually (consensually) recognised by society as universally valid and generally useful into the normative content of mandatory constitutional provisions. In this way, once provided with adequate constitutional formalisation (i.e. promoted to the rank of norm of the Basic Law), constitutional values that have established themselves in public practice not merely reinforce the legitimacy of the Constitution, but also take on a formal legal validity and become obligatory for all subjects of law, including the state as a whole.
On the other hand, as soon as a certain system of social and legal values is constitutionally formalised, the actual axiological constitutional relations are affected by the coercive power of the norms of the Fundamental Law and cannot develop except through correlative interaction with formalised rules and regulations. Consequently, conformity of actual social and legal values with formal ones doubles their regulatory capacity, while conflict not only weakens confidence in the Constitution and complicates the implementation of its provisions, but also reduces the effectiveness of legal regulation per se as the latter relies on the provisions of the Basic Law. Therefore, harmonisation of actual and formal social and legal values within the normative content of the provisions of the Constitution appears to be the general task of the Constitutional Court within the scope of functions and powers it has been vested with.
Generally speaking, the regulatory origins of constitutional values stem from their objective social importance for the people by whose will they are approved as a primary and unconditional basis for the national legal system as a whole and for each of its legal norms individually. The social importance of constitutional values in turn is seen in that their social origins (goals, interests, relationships, institutions, etc.) provide for most optimal (efficient, progressive) development of society on the basis of coordination of interests both nationally and on the international scene.
Accordingly, constitutional values are conditional on both the internal and external social environment, and therefore they should be analysed in consideration of, inter alia, both the patterns forming in international relations and the global development trends that affect the establishment (formation) of constitutional values and the process of their implementation. That said, it should be kept in mind that the international social and legal order by itself, being derived from the interaction between sovereign wills of equal peoples of the world, acts as a composite of correspondence and balance of the actual national constitutional values of states making up the world community.
Globalisation needs to be recognised as one of the fundamental principles and trends in human development today. Its processes, therefore, directly affect the system of constitutional values and their hierarchical characteristics.
