Source text - English ARTICLE 1. DEFINITIONS
As used in this Agreement, each of the following terms shall have the meaning hereinafter stipulated:
1.1 “Products” shall mean hoses/pipes and multi-flow condenser for automotive air conditioning systems and parts thereof to be manufactured and/or assembled by Licensee under this Agreement.
1.2 “A/C Systems” shall mean automotive air-conditioning systems designed by Licensor or Licensee which consists of Products and other related parts.
1.3 “Technical Information” shall mean proprietary information and technical information, including, but not limited to technical know-how, unpatentable knowledge, invention and any other information publicly unavailable, relating to Products and A/C Systems and the manufacture and/or assembly thereof, the development, design, manufacture and/or assembly of A/C Systems, which are and may be commercially used, owned and/or controlled by Licensor during the terms of this Agreement.
1.4 “Territory” shall mean territory of the Russian Federation (and such other territory or territories that the parties may agree to add to the area of this Agreement).
1.5 “Production” shall mean the manufacture and/or assembly of Products and/or A/C Systems. “Produce” shall be construed accordingly.
1.6 “Development and/or Design” shall mean the development and/or design of automotive air-conditioning systems. “Develop and/or Design” shall be construed accordingly.
1.7 “Trademarks” shall mean the trademark “XXX” or other mark(s) owned and/or controlled by the Licensor for sales of Products and A/C Systems in the Territory.
Translation - Russian СТАТЬЯ 1. ОПРЕДЕЛЕНИЯ
Для целей настоящего Соглашения приведенные ниже термины имеют следующие значения
1.1 Продукты – шланги/трубки и многопоточные конденсаторы для автомобильных систем кондиционирования, а также их детали, изготавливаемые и собираемые Лицензиатом в соответствии с настоящим Соглашением.
1.2 Системы кондиционирования воздуха – автомобильные системы кондиционирования воздуха, сконструированные Лицензиаром или Лицензиатом, состоящие из Продуктов и прочих сопутствующих деталей.
1.3 Техническая информация – служебная и техническая информация, которая включает в себя, но не ограничивается, техническими ноу-хау, непатентоспособными знаниями, изобретениями и любой другой информацией, которая не является общедоступной, относящейся к Продуктам и Системам кондиционирования воздуха, а также к их производству и/или сборке, разработке, конструированию, производству и/или сборке Систем кондиционирования воздуха, которые используются и могут использоваться с коммерческой целью, в собственности и/или под контролем Лицензиара в течение срока действия настоящего Соглашения.
1.4 Территория – территория Российской Федерации (а также другая территория или территории, которые Стороны по согласованию могут добавить к территории настоящего Соглашения).
1.5 Производство – производство и/или сборка Продуктов и/или Систем кондиционирования. Производить имеет соответствующее толкование.
1.6 Разработка и/или Конструкция автомобильных систем кондиционирования воздуха. Разрабатывать и/или Конструировать имеют соответствующее толкование.
1.7 Товарный знак – товарный знак“ХХХ” или иной знак (знаки), находящиеся в собственности и/или под контролем Лицензиара для продажи Продуктов и Систем кондиционирования на Территории.
