Source text - English 3.1. Payments for Contractor's services shall be made by the Customer once a month by a bank transfer to the Contractor's bank account within 30 (thirty) banking days after Certificates of Acceptance has been received with respect to the month in which the services were rendered.
The Contractor shall deliver an invoice and Certificates of Acceptance to the Customer within 10 (ten) calendar days after the end of the reporting month during which the services were rendered.
3.2 WHEREAS for the purposes of improving performance of Contractor's operators and maintaining confidentiality of the terms and conditions of each Contract the Contractor uses a single rate system for all clients and calculates the cost of each order according to Unified Tariffs;
3.3. WHEREAS the Customer's rates that are defined in this Contract in accordance with its provisions and individual requirements of the Customer with respect to the transportations stipulated herein differ from the Unified Tariffs stated in Appendix 1 of this Contract;
The total cost of the services is calculated as a multiple of the total cost of all orders calculated on the basis of Unified Tariffs and recalculation ratio which is defined as 15% for this Contract. Whereas the Contractor is a VAT payer, that cost shall be subject to VAT (20 %).
SUBJECT TO the aforementioned provisions of this clause 3.3, the total cost of the services to be paid by the Customer shall be calculated by the following formula:
Cs = Cr Х 1,15 + VAT (20%)
Where Cs is the cost of services, Cr is the cost stated in a transportation receipt according to Unified Tariffs, VAT is 20% value-added tax
Should the Customer fail to pay full cost of the services for any period, the Contractor shall have the right to terminate the services at its discretion until the full payment is received upon prior relevant notice to the Customer to be delivered by email 3 calendar days before to the services are terminated.
Translation - Russian 3.1 Оплата стоимости услуг, предоставленных Исполнителем, осуществляется Заказчиком один раз в месяц банковским переводом на банковский счет Исполнителя в течение 30 (тридцати) банковских дней после получения оригиналов Актов выполненных работ за месяц, в течение которого были предоставлены услуги.
Исполнитель предоставляет Заказчику счет-фактуру и Акты выполненных работ в течение 10 (десяти) календарных дней после окончания отчетного месяца, в котором были предоставлены услуги.
3.2 ПОСКОЛЬКУ с целью повышения эффективности работы операторов и сохранения конфиденциальности условий каждого Договора Исполнитель использует систему единых тарифов для всех клиентов и рассчитывает стоимость каждого заказа в соответствии с Едиными Тарифами;
3.3. ПОСКОЛЬКУ тарифы Заказчика, которые определяются в настоящем Договоре в соответствии с его условиями и индивидуальными требованиями Заказчика в отношении перевозок, определяемыми в настоящем Договоре, отличаются от Единых Тарифов, указанных в Приложении 1 к настоящему Договору;
Общая стоимость услуг рассчитывается как результат умножения общей стоимости всех перевозок, рассчитанных на основании единых тарифов, на коэффициент перерасчета, который устанавливается как равный 15% для данного Контракта. Поскольку Исполнитель является плательщиком НДС такая стоимость облагается НДС (20%).
ИСХОДЯ из вышеупомянутых условий настоящего пункта 3.3. общая стоимость услуг, которая оплачивается Заказчиком, рассчитывается на основе следующей формулы:
Су = Стк Х 1,15 + НДС (20%)
Где Су – стоимость услуг, Стк – стоимость, указанная в талоне-квитанции на перевозку согласно Единым Тарифам, НДС – налог на добавленную стоимость 20%.
Неосуществление оплаты полной стоимости услуг Заказчиком за какой-либо период предоставляет Исполнителю право по собственному усмотрению прекратить обслуживание до получения такой оплаты в полном объеме, предварительно уведомив об этом Заказчика по электронной почте за 3 календарных дня до момента прекращения оказания услуг.
