Discogenic pain is a major source of chronic low back pain. Patients suffering from discogenic pain are often young, otherwise healthy individuals who present with pain localized to the back. Although the cause of discogenic pain is controversial, most clinicians agree on a key characteristic of the pain that patients exhibit: the pain is typically worse in positions in which the spine is in flexion, such as sitting, bending forward, or leaning over at the sink (flexion exacerbated pain). Patients with discogenic pain therefore accommodate their syndrome by avoiding positions such as sitting, which cause their painful segment to go into flexion, and preferring positions such as standing, which maintain their painful segment in extension.
Most clinicians also agree on the biomechanical characteristics of disc degeneration: in the early stages of the degenerative cascade, in which the overall disc height is relatively preserved (less than 50% loss of height), the disc exhibits hypermobility. Decreased passive resistance to flexion seen at the diseased segment is thus associated with pain on flexion in presenting patients. Flexion and extension are known to change the mechanical loading pattern at a lumbar segment. When the segment is in extension (the standing position), the axial loads borne by the segment are shared by the disc and the facet joints (in a healthy spine, approximately 30% of the load is borne by the facet joints). In flexion, however, the segmental load is borne almost entirely by the disc. Furthermore, when the segment is in flexion, the nucleus shifts posteriorly, changing the loads on the posterior portion of the annulus (which is innervated), likely causing its fibers to be subject to tension and shear forces. Segmental flexion, then, both increases the loads borne by the disc and causes them to be borne in a more painful way.

Большинство врачей также приходят к общему мнению по биометрическим характеристикам дегенеративно-дистрофических изменений диска: на ранних стадиях дегенеративного каскада, когда общая высота диска относительно сохраняется (менее 50% потери высоты), диск демонстрирует гиперподвижность. Среди представленных пациентов снижение пассивного сопротивления сгибанию, которое наблюдается в пораженном сегменте, связано с болью от сгибания. Известно, что сгибание и распрямление изменяют механическую нагрузку на поясничный сегмент. Затем сегментарный сгиб увеличивает и нагрузку на диск и болевые ощущения от этой нагрузки.

XXX hereinafter referred to as Investor, acting as a natural person of the one part, and
YYY hereinafter referred to as Investee, acting as a natural person, of the other part,
collectively referred to as the "Parties", and individually as a "Party",
have entered into this Investing Agreement (hereafter referred to as “Agreement”) on the following:
1. Definitions
1.1. The Investor means a Party that provides investments to the Investee for the purposes stipulated herein.
1.2. The Investee means a Party receiving investment for the purposes stipulated herein.
1.3. The Investments means own, borrowed and/or raised funds, stock, other property, including property rights, other monetizable rights, invested by the Investor with the purposes to receive a profit.
2. Subject of the Agreement
2.1. In accordance with terms of the Agreement, the Parties shall jointly implement the investment project “Project A” (hereinafter referred to as Project), where the Investor performs Investee targeted financing by providing investments, and the Investee shall invest the given investments in the investment project specified in clause 2.2 of the Agreement, and implement the intended use of the said investments.
3. Agreement duration
3.1. This agreement shall take effect after being signed and remain in force until the Parties fulfill their obligations.
4. Procedure of settlements
4.1. Investments under the Agreement are defined in monetary terms, in the currency of Ukraine (UAH).
4.2. Investments are provided by the Investor in accordance with the terms of the Agreement within the time frames stipulated in the Payment Plan (Annex No. 1 to the Agreement), which shall form an integral part of the Agreement.
8. Responsibility of the Parties
8.1. The Parties are responsible for non- fulfillment or failure to fulfill properly their obligations under the Agreement in accordance with the Agreement and the law of Ukraine.
8.2. The penalty under the Agreement is paid only on grounds of the reasonable written request of the Parties.
8.3. Payment of a penalty shall not excuse the Parties from fulfilling the obligations stipulated herein.
9. Grounds and procedure for termination of the Agreement
9.1. The Agreement may be terminated by mutual consent of the Parties, as well as unilaterally at the written request of either Party on the grounds provided by the Agreement and the law.

В соответствии с условиями Договора Стороны обязуются совместными усилиями обеспечить реализацию инвестиционного проекта «Проект А» (далее по тексту — Проект), где Инвестор осуществляет целевое финансирование Получателя инвестиций путем предоставления инвестиций, а Получатель инвестиций обязуется обеспечить вложение предоставленных инвестиций в объект инвестиционной деятельности, указанный в п. 2.2 Договора, и осуществлять целевое использование представленных инвестиций.
3. Срок действия договора
3.1. Договор вступает в силу с момента подписания и действует до выполнения Сторонами свои обязательств.
4. Порядок расчетов
4.1. Инвестиции по Договору определяются в денежной форме, в валюте Украины (гривна).
4.2. Инвестиции предоставляются Инвестором в соответствии с условиями Договора в сроки, предусмотренные Графиком платежей (Приложение № 1 к Договору), являющимся неотъемлемой частью Договора.
8. Ответственность сторон
8.1. Стороны несут ответственность за неисполнение или ненадлежащее исполнение своих обязательств по Договору в соответствии с Договором и законодательством Украины.
8.2. Неустойка по Договору выплачивается только на основании обоснованного письменного требования Сторон.
8.3. Выплата неустойки не освобождает Стороны от выполнения обязанностей, предусмотренных Договором.
9. Основания и порядок расторжения договора
9.1. Договор может быть расторгнут по соглашению Сторон, а также в одностороннем порядке по письменному требованию одной из Сторон соглансо основаниям, предусмотренным Договором и законодательством.
