Source text - Spanish 2.1. Plazo.
La entrega habrá de realizarse en el plazo indicado. En caso de incumplimiento nos reservamos el derecho de anular el pedido o contrato. Renunciando el proveedor a reclamación alguna por los trabajos realizados.
En caso de incumplimiento del plazo de entrega especificado en la hoja de contrato, se aplicara una sanción del 2 % sobre el precio de venta pactado por semana de atraso. Una vez transcurrido 1 mes de atraso desde la fecha de entrega acordada en el presente contrato, XXX se reserva el derecho de dar por anulado el presente contrato y el proveedor renuncia a reclamación o indemnización alguna por los trabajos realizados.
XXX se reserva el derecho de repercutir al proveedor todos o parte de los daños y perjuicios que pueda generar su incumplimiento en la entrega, asi como de transferirle aquellos costes que le pueda repercutir su cliente.
2.2. Planing.
El proveedor suministrará una vez a la semana un informe del estado de construcción según el PER previamente acordado y que pasa a formar parte del presente contrato.
El moldista podrá utilizar cualquier otro formato de planing con la condición de que posea las mismas indicaciones que el del anexo.
XXX se reserva el derecho de efectuar cuantas visitas de control considere necesarias para garantizar el cumplimiento del PER. Con la firma del presente contrato, el proveedor autoriza el libre acceso a sus intalaciones a que cualquier persona de XXX , para la verificación del estado de los trabajos en curso.
2.3 Proceso de contrucción y responsabilidades.
De las diferentes fases que conforman la construcción de un molde, el moldista/matricero asume la completa y total realización en sus instalaciones o de las empresas asociadas, del proyecto de construcción y despiece completo del utillaje.
Al mismo tiempo, asume la responsabilidad del control de utilización de los aceros acordados asi como de los tratamientos térmico, superficiales o mecanizados que se realicen a los mismos.
El hecho de subcontratar la realización de ciertas fases del proyecto, no exime al moldista/matricero de la total responsabilidad sobre la correcta construcción del utillaje en calidad y plazo, siendo a su cargo las correcciones que puedan ser necesarias realizar en el supuesto que cualquier subcontratado no realice su función correctamente.

The molding specialist may use any other planning format with the condition so long as it has the same indications as the annex.
XXX reserves the right to make as many control visits as it deems necessary in order to guarantee the fulfillment of the PER. With the signing of the present contract the Supplier authorizes free access to his facilities to any employee of XXX in order to check on the progress of the work being done.
2.3. The construction process and responsibilities
Of the different phases that make up the construction of the model, the molding specialist assumes the complete and utter execution of the construction project and the complete disassembling of the equipment in his facilities or in those of partner companies.
At the same time he assumes responsibility for the control of the use of the agreed steel as well as of the treatments be them thermal, superficial or mechanized that may have been applied. The fact of subcontracting the completion of certain phases of the project does not exempt the molding specialist from the complete responsibility for the correct building of the equipment in quality and period, being it in his charge to make the necessary corrections in the case that any subcontractor does not fulfill his job correctly.
